Abstract

Indonesia, as an archipelagic country, has a vast coastal area rich in natural resources. However, in practice, coastal areas that should be protected are often misused for business interests, such as the construction of shrimp farms, hotels, and resorts that do not comply with regulations. This study aims to determine how the government supervises activities in coastal areas and the legal consequences for businesses that violate these regulations. The method used is normative juridical research with a legislative approach and case studies. Based on the discussion, five cases of coastal zone violations were found in various regions such as Jember, Labuan Bajo, East Sumatra, Berau, and Takalar. These violations caused damage to the coastal environment, loss of livelihoods for the community, and disruption of the marine ecosystem. The results of the study show that government supervision is still weak, and most businesses have not been subject to strict sanctions even though the regulations are clearly stipulated in Law Number 1 of 2014 and Government Regulation Number 13 of 2017. Strict law enforcement and increased public awareness are needed so that the function of the coastal zone as a protected area can be maintained and encourage a balance between economic development and environmental sustainability.

Abstract

The evolution of non-cash payment, specifically debit cards with contactless features, offers a quick transaction speed through a mechanism that doesn’t require a Personal Identification Number (PIN) for certain nominals. However, this convenience is directly proportional to the risk of misuse or unauthorized transactions if the card is stolen, considering that the system does not actively verify the cardholder's identity. This study aims to analyze the forms of legal protection for customers as well as the mechanisms for dispute resolution and recovery of losses for unauthorized transactions on stolen contactless debit cards. The research method used is normative legal research based on literature studies with a statutory approach and a conceptual approach. The primary legal materials used include the Indonesian Civil Code, the Law on the Development and Strengthening of the Financial Sector, and the Financial Services Authority Regulation (POJK) Number 22 of 2023 (POJK PKM SJK). The results show that legal protection for customers includes preventive protection through the bank's obligation for information transparency and regulatory that is required, as well as repressive protection through a loss compensation claim mechanism. Banks as payment system providers have the primary responsibility to ensure the security of the products offered. If an unauthorized transaction occurs due to the characteristics of the contactless product design, the bank cannot fully release its responsibility. However, customers also have an obligation to safeguard the card and immediately report its loss, where customer negligence can be a limiting factor for loss compensation based on the principle of proportionality. Dispute resolution mechanisms are carried out in stages through internal bank complaints, non-litigation settlement through the Alternative Dispute Resolution Institution for the Financial Services Sector (LAPS SJK), and litigation as a last resort (ultimum remedium). The enactment of POJK PKM SJK emphasizes that financial services sector dispute resolution is now focused on LAPS SJK, replacing the role of the Consumer Dispute Resolution Agency (BPSK) in this realm

Abstract

The amendment of the land acquisition legal regime through Law Number 6 of 2023 concerning Job Creation has brought fundamental implications to the concept of "Public Interest." This study aims to analyze the shift in the meaning of public interest, which was originally restricted to basic service infrastructure, to now include the development of strategic economic zones. The research method used is normative legal research with a statute approach and a conceptual approach. Legal materials were analyzed qualitatively to examine the expansion of land acquisition objects in Article 10 of Law No. 2 of 2012 jo. Job Creation Law. The results show that the redefinition of public interest has radically expanded to include exclusive commercial areas, such as Industrial Zones, Special Economic Zones (SEZ), and Tourism. This expansion marks a paradigm shift from a public service orientation (state-oriented) to a market orientation (market-oriented). This has resulted in a distortion of the state's power of eminent domain, where state instruments are utilized to facilitate asset accumulation for business entities (State-Owned Enterprises/Private). The juridical implication is the reduction of protection for land rights holders due to the elimination of voluntary agreement mechanisms (Business to Business) in commercial projects, as well as the increasing potential for agrarian conflicts due to the neglect of the social function of land. Abstract

The rapid development of Artificial Intelligence (AI) technology has significantly influenced various aspects of social life, particularly in the digital media environment. One prominent application of AI is facial editing technology, including deepfake, face swap, and image manipulation, which enables the creation of highly realistic visual content. However, the misuse of such technology poses serious risks, especially in relation to defamation. The dissemination of AI-manipulated visual content through digital platforms may harm an individual’s reputation and dignity on a massive scale. This phenomenon raises legal issues concerning the adequacy of defamation regulations in Indonesia’s digital legal framework. This research aims to analyze the legal regulation of defamation in Indonesia and to examine forms of AI misuse in facial editing that may result in defamation. The research employs a normative juridical method, focusing on statutory and conceptual approaches. The findings indicate that existing legal provisions under the Indonesian Criminal Code and the Law on Electronic Information and Transactions are generally applicable to AI-based defamation through legal interpretation. Nevertheless, the absence of specific regulations governing AI creates legal loopholes, particularly in law enforcement and evidentiary processes. Therefore, adaptive legal reform and strengthened law enforcement mechanisms are necessary to ensure legal certainty and effective protection in the digital era.

Abstract

This study aims to examine the legal provisions governing food provision within “the Free Nutritious Meal Program (MBG)” and to analyze the forms of government legal responsibility in the event of mass “food poisoning incidents during its implementation. The MBG program is a government policy supported by Presidential Regulation Number 83 of 2024 concerning the National Nutrition Agency,” which emphasizes the government's role in planning, implementing, supervising, and ensuring the quality and safety of nutritious food provided to program beneficiaries, particularly school-age children who are considered a vulnerable group. “This research employs a normative legal research method supported by statutory and conceptual approaches. Legal materials, both primary and secondary, were analyzed using descriptive qualitative techniques to systematically explain and understand the research issues. The results of the study indicate that although the legal framework concerning government supervision and responsibility has been normatively established, its practical implementation has not been fully effective due to” weak supervisory control, unclear division of authority among institutions, and suboptimal accountability mechanisms. Government negligence in supervision may give rise to administrative and civil legal liability, and under certain circumstances may also lead to criminal liability if it is proven to have caused mass food poisoning. This study highlights the importance of strengthening the supervision system, improving inter-agency coordination, and implementing transparent accountability mechanisms to ensure that the MBG Program can be carried out effectively, safely, and fairly, while providing optimal legal protection for the public, especially children as program beneficiaries. The findings of this study are expected to serve as a basis for policy evaluation and recommendations to improve food safety supervision and legal protection for society.
