Modern international law in the last few decades has experienced very rapid development, this is characterized by the emerge of the State in a modern sense, as well as a legal system that regulates relations between countries and international legal entities with each other. Relations between countries are no longer limited by absolute sovereignty, for example in the case of war crimes, the international community could sue countries or even individuals to be responsible for these actions based on universal principles. Recently, State practices is shifting from the hard law legal system to soft law which can be an alternative solution in breaking the deadlock when international political compromises are difficult to realize. Various international law development shows that there is a need for the international community to form a legal system that is acceptable to all parties, especially the State as a subject of international law par excellence. Therefore, the Belli ac Pacis Journal presents the multifarious developments in contemporary international law as a study of current State practices. The Belli ac Pacis Journal encompasses Public International Law, International Law of the Sea, International Humanitarian Law, International Environmental Law, International Criminal Law, International Organizational Law, International Dispute Settlement Law, Diplomatic Law, Air and Space Law, International Trade Organization Law, ASEAN Law, and International Economic Law.

Abstract

This research aims to analyze the sanctions that can be applied to the United States for violations of international law arising as a result of the unilateral proclamation announced by President Donald Trump on December 6, 2017 as its foreign policy that recognizes Jerusalem as the capital of Israel and moves its embassy from Tel Aviv to Jerusalem. This type of research is prescriptive normative in order to identify sanctions to the United States that has violated international law.The result of this research showed that violations of international law on the United States unilateral proclamation regarding the status of the City of Jerusalem may be subject to various sanctions by the UN Security Council including economic sanctions, diplomatic sanctions, sports sanctions, individual sanctions, and sanctions to suspend privileges as a member of the United Nations. Of the various sanctions that can be applied by the UN Security Council, there are obstacles that can be found, namely the veto rights of permanent members of the Security Council. Therefore it is recommended to countries that have economic stability and geopolitical conditions more or less the same as the United States such as China in order to impose political sanctions in the form of unilateral economic and diplomatic sanctions.

Abstract

Hak untuk menikah merupakan salah satu hak asasi manusia yang diakui dalam UDHR dan ICCPR. Namun ketentuan dalam UDHR dan ICCPR mengenai hak menikah menimbulkan perbedaan pendapat. Perdebatan tersebut terjadi karena timbul pertanyaan: “Apakah UDHR dan ICCPR juga mencakup pernikahan bagi pasangan homoseksual?”. Berdasarkan UDHR dan ICCPR, keluarga sebagai suatu kesatuan yang dibentuk melalui perkawinan merupakan suatu kesatuan yang kodrati dan mendasar dalam masyarakat. Oleh karena itu, konsep pernikahan sangat bergantung pada masyarakat suatu negara. Artikel ini mengkaji negara-negara anggota ASEAN dalam memberikan perlindungan hak menikah bagi individu homoseksual. Dengan fokus pada Brunei Darussalam, Indonesia dan Thailand yang memiliki kekhasan dalam menyikapi kaum homoseksual. Jenis penelitian dalam penulisan artikel ini adalah penelitian normatif dengan menggali konsep-konsep dalam bahan hukum primer yang mengatur hak perkawinan di setiap negara. Penelitian dilakukan dengan menganalisis bahan hukum primer serta menggunakan silogisme dan interpretasi hukum. Pasal ini menunjukkan bahwa hukum perkawinan di ketiga negara tersebut menyetujui perkawinan antara laki-laki dan perempuan dan tidak memberikan penafsiran lain. Oleh karena itu, individu yang homoseksual secara hukum tidak dapat memiliki pasangan sah yang berjenis kelamin sama dengan dirinya, seperti halnya hubungan suami istri. Namun, sikap masing-masing negara memiliki sejumlah perbedaan dalam menyikapi serikat sesama jenis. Brunei Darussalam dengan tegas menolak hubungan homoseksual, sedangkan Indonesia saat ini hanya mengkriminalisasi hubungan homoseksual antara orang dewasa dan anak di bawah umur sebagai tindakan cabul. Sedangkan di Thailand, pernikahan homoseksual bisa dilakukan sesuai adat atau agama.

Abstract

The conflict between India and Pakistan starts with the territorial conflict of a region called Kashmir. The tension of the conflict arises along with the use of force, makes the territorial conflict become an armed conflict. This study explains the conflict between India and Pakistan over Kashmir territory on 1947 and 1965. The objectives of this study are to determine whether the use of force on territorial conflict can be legitimate and to determine the applications of international humanitarian law on the territorial conflict. This study uses case approach and conseptual approach. This study also uses deductive methods, by using the analysis of the legitimate use of force by a state based on just war theory in common as major premise, and the use of force by India and Paksitan on territorial conflict as minor premise.

Abstract

This study examines the granting of asylum to Ahmed Chataev by Austria from the standpoint of international refugees. This research is a normative legal research viewed from prescriptive and uses several approaches, namely a legal approach, a conceptual approach, and a case approach. The research uses primary and secondary law material. The data was collected by library research and analyzed by deductive method with syllogism.  The results of this study indicates  that Ahmed Chataev acquired the asylum from Austria and the status as a refugee he owned legitimately, as in article 1 letter A paragraph (2) of the Convention of Geneva 1951. The application for extradition from Russia was rejected by Ukraine and Bulgaria due to the status of Ahmed Chataev as refugees as well as concerns for the safety of his life.

Abstract

The imprisonment of minors in adult prison cells is an act that violates the human rights of the child, because children have different vulnerabilities and circumstances than adults. The Australian Government's action to imprison Indonesian migrant smugglers who are partly children in adult prisons is a violation of a human rights values. The method used in this study is a normative prescriptive method that aims to analyze how protection is carried out by the Government of Indonesia through its representatives abroad protecting the citizens of Indonesia. The conclusion of this study showed that the imprisonment of children violates various international conventions namely, the Convention on the Rights of the Child and ICCPR. Protection of Indonesian citizens abroad is regulated in The Minister of Foreign Affairs regulation of the Republic of Indonesia No. 5 of 2018. Protection is carried out within the corridors of international law and not ignoring the applicable laws in Australia.

Abstract

Currently, Indonesia has not yet included the blue carbon component in its Nationally Determined Contribution (NDC). Therefore, this research aims to determine whether the current policy framework of the Indonesian government is oriented towards incorporating blue carbon to achieve the NDC. This study is a doctrinal, descriptive research. The sources of legal materials used are primary and secondary legal materials, collected through literature review as the data collection technique. Meanwhile, the legal material analysis technique employed is the syllogism method with deductive reasoning, based on all international and national legal regulations. The results of this research show that current policies regarding blue carbon in Indonesia are still limited to general regulations under the Indonesian Maritime Policy. The absence of specific regulations on blue carbon in Indonesia means that the existing policies are not yet oriented towards reducing greenhouse gas (GHG) emissions. In order to achieve Indonesia's NDC and reduce GHG emissions by 26% independently and 41% with international assistance, while there is a significant potential for blue carbon in Indonesia to contribute to the GHG reduction target, the lack of specific policies regulating blue carbon has resulted in its underutilization.

Abstract

This legal research aims to examine the implementation of the principle of good faith in the decision of the Permanent Court of Arbitration between the Philippines and China in the South China Sea Case as a disputed country. The verdict of the South China Sea dispute was issued in order to resolve the dispute between the two countries to achieve peace and certainty in the disputed South China Sea region, thus eliminating shared unrest. The type of research used in this study is normative in order to provide data related to the state of the south china sea that has been a problem for a long time, mainly due to territorial claims based on china's use of historical rights. According to this research it is known that China refusing to comply with the decision of the Permanent Court of Arbitration, they also continue to carry out some activities in an effort to maintain its existence and power in the South China Sea region. Hence, China is considered not to implement the principle of good faith.

Abstract

Pencari suaka dan pengungsi dalam masa menunggu status dan resettlement di Indonesia terjebak dalam jangka waktu yang tidak ditentukan. Hak bekerja untuk pengungsi di jamin dalam Pasal 17 Konvensi Pengungsi 1951. Namun Indonesia tidak  meratifikasi konvensi tersebut sehingga pemenuhan hak bekerja diabaikan dan mereka dilarang terlibat dalam kegiatan yang berpenghasilan baik berbisnis ataupun bekerja. Peraturan tersebut tercantum dalam Peraturan Dirjen imigrasi Nomor IMI-1489.UM.08.05 tahun 2010 tentang penanganan imigran ilegal.  Keadaan ini tidak hanya melanggar hak asasi manusia, tetapi juga tidak sejalan dengan norma-norma internasional yang telah diratifikasi oleh Indonesia. Tujuan penelitian ini adalah untuk menemukan suatu solusi agar pemenuhan hak bekerja bagi pengungsi dan pencari suaka dapat terpenuhi. Penelitian ini merupakan penelitian yuridis-normatif dengan metode pendekatan undang-undangan dan pendekatan konseptual. Gagasan hasil dari penelitian ini adalah dengan menyusun kebijakan baru mengenai akses bekerja untuk pengungsi dengan memberikan  akses bekerja sementara bagi pencari suaka dan pengungsi yang transit di Indonesia.

Abstract

This study examines the impact of PT Pertamina Niaga's alleged fuel mixing case on Indonesia's commitment to the Paris Agreement. The research analyzes how mixing higher octane fuels (RON 92) with lower octane fuels affects carbon emissions and contributes to environmental degradation. Through case study methodology comparing Indonesia's policies with successful implementations in Canada and the Philippines, the research reveals significant challenges in Indonesia's emission reduction efforts. The findings demonstrate that Indonesia faces obstacles in meeting its Nationally Determined Contribution targets due to heavy reliance on fossil fuels, inadequate investment in renewable energy infrastructure, and weak regulatory enforcement. The study highlights the ineffectiveness of the Paris Agreement's enforcement mechanisms and proposes solutions including expanding green finance policies, transitioning to clean energy, strengthening compliance mechanisms, and implementing carbon pricing strategies similar to the Carbon Border Adjustment Mechanism. This research contributes to understanding the intersection between corporate practices, environmental regulations, and international climate commitments in developing nations.

Abstract

This article aims to assess the legal protection of pangolins from illegal trade in Indonesia in accordance with CITES, by analyzing the causes of CITES’ ineffectiveness in protecting pangolins, and how Indonesia could give pangolins a better protection from illegal trade. This article applies the method of prescriptive normative, with statute and conceptual approaches. This article focuses on finding the most fitting resolution for problems arising from the illegal trade of pangolins. The legal data provided in this article contains both primary and secondary data. The primary data being international treaties which under the present case is CITES, customary and general principles of international law. Secondary data includes textbooks, guidelines, and any sources that might show relevance along the research process.  This paper is also library-based, including the use of digital library. Data collection begins with the research approach and the gathered information will be analyzed. The results of this research show that there are multiple causes that could lead to CITES ineffectiveness in giving legal protection towards pangolins from illegal trade in Indonesia, along with a few changes needed to accommodate the main purposes of the treaty.
