Modern international law in the last few decades has experienced very rapid development, this is characterized by the emerge of the State in a modern sense, as well as a legal system that regulates relations between countries and international legal entities with each other. Relations between countries are no longer limited by absolute sovereignty, for example in the case of war crimes, the international community could sue countries or even individuals to be responsible for these actions based on universal principles. Recently, State practices is shifting from the hard law legal system to soft law which can be an alternative solution in breaking the deadlock when international political compromises are difficult to realize. Various international law development shows that there is a need for the international community to form a legal system that is acceptable to all parties, especially the State as a subject of international law par excellence. Therefore, the Belli ac Pacis Journal presents the multifarious developments in contemporary international law as a study of current State practices. The Belli ac Pacis Journal encompasses Public International Law, International Law of the Sea, International Humanitarian Law, International Environmental Law, International Criminal Law, International Organizational Law, International Dispute Settlement Law, Diplomatic Law, Air and Space Law, International Trade Organization Law, ASEAN Law, and International Economic Law.

Abstract

This study was conducted to determine the legality of the Russian intervention on the territory of Crimea in Ukraine. Researcher answer the problem with normative side by basing on the norms and principles of intervention. Materials used in this research include international agreements, doctrine, customary international law, as well as some cases of intervention. Legal materials collected through library research and analyzed through content analysis and text interpretation. The results showed that the legality of intervention discussion is based on five criteria namely: collective intervention by the UN charter, intervene to protect the interests and rights of citizens in other countries, intervention as self-defense, state intervention protectorate, and intervene if a country committed serious violations. So the Russian intervention on the territory of Crimea not obtain legality because it does not meet the five criteria for intervention is allowed in international law.

Abstract

The main issue in this research is about injustice situation occur in South Korea regarding to the Conscientious Objection to Military Service. In the past 6 decades, sincere young men in South Korea have been convicted because of their refusal to the Miltary Service for reason of conscientious and their religion belief. Up until now, over 19.000 have been sentenced to imprisonment, which Jehovah’s Witnesses in majority. In 2007, the Korean Government announced that it would introduced an alternative service system for conscientious objectors. However in the following year, it canceled the plan because majority of people did not supported. This Korean Government stand on this issue draws international attention. In 2007, 2010, 2011, and in 2012 in more than 500 individuals cases, the United Nations Human Rights Committee concluded that South Korea violated article 18 of International Covenant on Civil and Political Rights (ICCPR) which guarantees freedon of conscience. In 2014, the committee adopted it’s 5th view against South Korea. The Committee accepted the authors claim that Souht Korea also violated Article 9 of the Covenant which prohibits arbitrary detention. On December 12th 2012, The Universal Periodic Review by United Nations Human Rights Council aims to assess the Human Rights situation in all it’s United Nations member states.The delegates of 8 state parties strongly urged South Korea to introduced an alternative service. But Korean Government has not taken any measures to improve human rights despite international warning.According to the current situation, Korean Government has to take the neccesary steps for recognizing Conscientious Objection by introducing the alternative service system.

Abstract

Penelitian hukum ini bertujuan untuk memahami dan menganalisis mengenai penegakan hukum terhadap kasus IUU Fishing yang dilakukan terhadap kapal KM BD 95599 TS di Laut Natuna sesuai dengan hukum internasional dan hukum nasional. Jenis penelitian hukum ini adalah penelitian normatif yang bersifat preskriptif guna menemukan dan merumuskan argumentasi hukum, melalui analisa pokok permasalahan dalam kaitannya dengan penegakan hukum pada ZEEI yang dilakukan Indonesia terhadap kapal asing yang melakukan IUU Fishing. Penelitian hukum ini menelaah bahan kepustakaan dengan mengumpulkan serta mempelajari bahan hukum primer dan sekunder. Hasil dari penelitian hukum ini menunjukan bahwa Kapal KM BD 95599 TS yang ditangkap oleh Kapal Pengawas Perikanan ORCA 02 dibawah kendali Kementerian Kelautan dan Perikanan terbukti telah melakukan tindak pidana IUU Fishing di wilayah ZEEI. Proses penegakan terhadap Kapal KM BD 95599 TS beserta nahkoda dan awak kapal KM BD 95599 TS sudah sesuai dengan ketentuan yang ada dalam hukum internasional dan hukum nasional, penegakan hukum hanya terbatas pada pemberian sanksi pidana denda tanpa adanya pidana penjara.

Abstract

This study examines the extend to the applicability of diplomatic immunity rights for senior officials against gross human rights violations they have committed. Toa achieve such aim, the author analysed the different types of immunity granted by international law to state officials, the reasons for the conferment of this immunity, and whether they apply in cases in which it is alleged that an official has committed an international crime. By using a statutory and case approach, the author examines several cases heard before international courts to compare the implementation of immunity rights. The author argues that both immunity ratione materiae and immunity ratione personae cannot be applied to cases that constitute gross violations of human rights. Moreover, instead did not agree with the argument which have been put forward by scholars and ICJ in support of the contrary.

Abstract

The right to self-determination is one of the principles of international law that can be applied as a norm in various international agreements, notably on human rights law which state that all state or nation has the right to form political system and regulations by themselves which are free to develop economic, social and cultural rights using their own resources, but unfortunately the right to self-determination do not yet have the practical arrangements so that their use is often debated. The purpose of this research is to analyze the self-determination of the people of Crimea is in accordance with the rules of international law, the second to determine the legitimacy of the ballot by the citizens of Crimea which supports separation of Ukraine to join Russia, the third to know how the recognition of other countries on the outcome of the referendum of citizens Crimea. This case study discusses the principles of law and comparative law. Source of data used are primary and secondary data sources were obtained from literature. The conclusion from this study is self-determination are the principle embodied in international law, where such rights have been formulated in the UN Charter. The referendum conducted in Crimea produces option to secede from Ukraine and join Russia. The second, the implementation of the Crimean referendum is not in accordance with the principles of international law. Third, recognition in international law is a complex issue because it involves issues of law and politics, in the case of recognition of the Crimea it is reviewed by the declarative theory.

Abstract

This journal aims to know the application of the principles of good neighborliness in the transboundary haze pollution in the ASEAN region. Principles of good neighborliness determines that a country is not allowed to perform an action, such that within the territory of the country, causing environmental problems in other countries. This research is a normative legal research or doctrinal, and prescriptive. This research uses statute approach and conceptual approach. The legal material which are used are primary and secondary legal materials. The collection of legal materials technique that  used in this research islibrary research. The analysis technique used is the deductive pattern. Based on the results of this research and discussion produced the conclusion that transboundary haze pollution (transboundary haze pollution) in the ASEAN region has violated the principles of good neighborliness in international environmental law. The application of the principles of good neighborliness based on some the regulations of international law.

Abstract

This study aims to describe maritime terrorism as a new threat to maritime security in ASEAN. This research is a normative legal research by using content analysis to source data. ASEAN as one of the international organizations that oversees Southeast Asian countries has a mechanism of cooperation among members that can be used as an alternative form of countermeasures against terrorism in Southeast Asia, namely, the ASEAN Counter-terrorism and ASEAN Regional Forum. In this study the authors will identify the mechanism of cooperation at the ASEAN level as a form of cooperation in maritime terrorism.

Abstract

This research aims at two things. First, describes and analyzes the legal standing of Private Military and Security Company (PMSC) in International Humanitarian Law. Second, analyzes the responsibility mechanism for Private Military and Security Company (PMSC) personnel. This research is normative legal research viewed from applied prescriptive. The legal material used by this research include primary and secondary legal material. The legal material was collected by library research and analyzed by deductive methods. The results show that PMSC cannot be equated with mercenaries as regulated in Article 47 Additional Protocol I Geneva Convention 1977. According to Montreux Document, the legal standing of PMSC will depend on the signed contract. Montreux Document provisions explain that PMSCs status can be civilians, members accompanying armed forces, and illegal combatants. The coercive services responsibility conducted by PMSC personnel will also depend on the agreement made by the parties. PMSC personnel will be individually responsible when the conduct is not representing the contracting subject.

Abstract

This research examines the absence of international halal standards in the interest of the differences in the standards of halal institutions which raises the urgency of halal standard harmonization by Standardization and Metrology for Islamic Countries (SMIIC) as an effort to decrease the international trade dispute. The type of research used in this study is normative with prescriptive analytic to identify the urgency of harmonizing international halal standards and proposing SMIIC as the center of harmonization of international halal standards institutions in terms of conformity with SMIIC international legal organizations and international trade. The result of this research showed the urgency of harmonizing halal product standardization is as a legal certainty of international halal standards, to prevent the overlapping of halal standard, increase consumer confidence, increase food supply integration, reduce time and production costs, and provide conducive of trade situation. SMIIC was proposed as a center for international halal standard harmonization institutions due to several considerations, including related to the urgency of harmonizing international halal standards, SMIIC’s position as an OIC affiliated institution that guarantees authority in issuing international halal standard harmonization, and for the compatibility of SMIIC’s policies with the WTO’s policies precisely of TBT Agreement.

Abstract

This study aims to determine the legal significance of the establishment of Indonesian Sea and Coast Guard, analyze threats in Indonesian waters, overlapping law enforcement and maritime security in Indonesia and conventions issued by the International Maritime Organization relating to marine safety. This research is a normative  legal research that is prescriptive. Types and sources of materials used in this research is the primary legal materials and secondary legal materials. The data collection techniques by means of literature. While the analysis uses legal interpretation. Based on the conclusions generated discussion needs to establish Indonesian Sea and Coast Guard to conduct maritime security and implement IMO conventions concerning maritime safety and the safety of shipping.The establishment of Indonesian Sea and Coast Guard can be effective tools for implementation of IMO convention relating to marine safety.
