Abstract

This study examines the legal implications of fixed-term employment contracts (PKWT) made without written agreements through a progressive law approach. The primary concern addressed is the legal vacuum and uncertainty caused by the absence of sanctions for unwritten PKWT, as stipulated in the amendments to Article 57 of Law Number 6 of 2023 concerning Job Creation. This study aims to analyze the legal implications of unwritten PKWT and seek progressive law-based solutions that prioritize workers justice. This research employs a normative juridical approach, utilizing a legislative approach and analysis of progressive law doctrine. The findings indicate that unwritten PKWT lead to legal uncertainty for workers, particularly in pursuing their rights and resolving industrial relations disputes. This is due to the lack of consequences for non-compliance with Article 57, resulting in a legal vacuum. From a progressive law perspective, an alternative solution emerges by prioritizing substantive justice over legal formalities, providing better protection for workers. This approach also highlights the need to strengthen regulations to ensure PKWT implementation aligns with the principles of justice.

Abstract

The Regional Public Service Agency (BLUD) was established by the Government in an effort to fulfill community services, and it is authorized financial management flexibility to support service delivery.  BLUD that is commonly found by the community is the Public Health Centre (Puskesmas), which is a first-level health facility that aims to provide optimal health services. The implementation of optimal health services is supported by policies that authorize BLUD to manage finances independently and then account for the authority by preparing financial reports. The implementation of BLUD necessitates the establishment of robust internal control mechanisms. These mechanisms are designed to ensure that BLUD operates in accordance with its objectives, while also mitigating potential health and financial risks. Research conducted at BLUD Puskesmas Pabedilan revealed that the internal control mechanisms at BLUD Puskesmas Pabedilan have endeavored to implement the five components of control in the performance of services and the preparation of financial statements. However, the study identified deficiencies in the supervision of medications and medical devices, the simultaneous holding of positions by internal auditors and financial managers, and the absence of an ideal internal control configurations

Abstract

Occupational Safety and Health (OSH) is a vital component in creating a safe, healthy, and productive work environment while protecting workers from the risks of accidents and work- related illnesses. This article provides an in-depth review of the basic concepts of OSH, the underlying regulations, workplace risk factors, and effective implementation strategies. In Indonesia, OSH implementation is governed by Law No. 13 of 2003 on Manpower and Law No. 1 of 1970 on Occupational Safety. Despite the availability of regulations, OSH implementation still faces various challenges, particularly in the informal sector and small and medium enterprises. This article identifies various risk factors that can affect the safety and health of workers, including physical, chemical, biological, ergonomic, and psychosocial risks. Strategies such as strong policy formulation, continuous training, routine audits, and active worker participation can help minimize these risks. The use of modern technology, such as automated detection devices and safety sensors, also supports more effective risk management. The findings of this study reveal that optimal OSH implementation not only reduces workplace accidents and work-related illnesses but also provides significant benefits for companies. These benefits include increased productivity, operational efficiency, worker motivation, and the organization's reputation as an entity that cares about employee welfare. Therefore, OSH is not merely a legal obligation but also a strategic investment that supports business sustainability and long-term worker welfare

Abstract

This research is motivated by increasing merger and acquisition (M&A) activity at the global and national levels, where corporate communication has become a critical factor in determining the success of the integration process. Although the value of global M&A transactions will reach US$ 3.8 trillion by 2022, around 70% of M&A transactions fail to achieve their strategic objectives, with poor communication being one of the main factors of such failure. This research aims to analyze the strategy and impact of corporate communication in the M&A context, with a special focus on effective communication practices at the global level and their adaptation in the Indonesian context using a systematic literature study research method. The research results show that companies that implement a structured communication strategy from the early stages of M&A have a 40% higher integration success rate. In Indonesia, communication approaches that combine global standards with local values, such as deliberation and a family approach, have proven to be more effective in facilitating the integration process. Research also reveals that companies that integrate digital platforms in their M&A communications strategy achieve 45% higher levels of employee engagement, while social media monitoring is becoming increasingly critical with 70% of reputation issues during M&A stemming from discussions on social media. This research provides theoretical contributions to the development of adaptive M&A communication models as well as practical implications for communications professionals and executives involved in the M&A process

Abstract

Disputes or problems that arise in human life often require resolution to maintain peace and social harmony. One of the ways of resolving disputes that is still applied in the people of Belu Regency is through Hakohik customary law, which is a tradition of fighting or struggle between two opposing parties. This customary law is used to resolve disputes, both criminal ones, such as insults or slander, as well as non-criminal disputes, such as land disputes or infidelity. In dispute resolution using Hakohik, both parties involved traditional elders to decide the case customarily, by involving certain rituals and procedures that have a deterrent effect. This process aims to restore the honor and dignity of those who feel aggrieved, as well as to maintain solidarity and peace in indigenous communities. Although this method has existed for hundreds of years, Hakohik is still accepted and used as a dispute resolution system that is considered effective by the Tetun people in Belu Regency. Through this research, it is hoped that it can provide a deeper understanding of the role and mechanism of Hakohik customary law in the indigenous people of Belu Regency, as well as its relevance in dispute resolution in the modern era

Abstract

Disaster prevention and management in the Ngada Regency area requires a comprehensive and coordinated approach to reduce the risks and impacts caused. Ngada Regency, located in East Nusa Tenggara Province, has its vulnerability to natural disasters such as floods, landslides, and forest fires. Prevention efforts involve increasing public awareness through disaster mitigation education and training, as well as building disaster-resilient infrastructure. In addition, coordination between local governments, disaster management agencies, and communities is essential to create an effective early warning system and clear evacuation procedures. Disaster management in Ngada Regency requires preparedness, adequate resource organization, and rapid response in emergency situations. This study aims to identify effective disaster prevention and management strategies and assess the role of the community and the government in disaster management in this region. The results of the study are expected to provide recommendations for policy makers to strengthen regional capacity and resilience to natural disasters.

Abstract

Water is one of the renewable natural resources, whose availability and quality are limited and declining, although according to the law of material conservation the amount of water in the world does not change. Water has many functions, such as in the metabolic process water is used by organisms in chemical reactions, it is also a medium for nutrient transport. The purpose of water management is of course accompanied by problems that arise with water. The use of water management in general also has a great impact as a source of clean water suitable for consumption. Proper water management is beneficial in preventing landslides, floods, and land footprints.

Abstract

Correctional Institutions (Lapas) are institutions that have an important role in the development of prisoners, with the main goal of rehabilitating and reintegrating prisoners into society. This article discusses the first stage of the coaching process for male inmates in the Kupang Class IIA Correctional Institution, which focuses on the application of personality development and independence in an effort to reduce the level of recidivism. Coaching at this stage is carried out through a series of programs, including religious awareness education, skills training, discipline coaching, and social activities that support the integration of inmates with the community. This study uses interview and direct observation methods to collect data on the implementation of coaching programs in Kupang Prison. The results of the study show that the coaching stage, which starts from the Maximum Security stage, aims to shape the character of prisoners, increase legal awareness, and prepare them to return to society with positive skills and attitudes. The coaching process at Kupang Class IIA Prison is expected to create better and independent individuals, as well as reduce recidivism rates in the future

Abstract

This study aims to analyze the effectiveness of the final-stage rehabilitation program for female inmates at the Class IIB Women's Correctional Facility (Lapas Wanita Kelas IIB) in Kupang in the context of social reintegration. The final-stage rehabilitation plays a crucial role in preparing inmates to adapt and contribute positively to society after release. This research employs an empirical approach, utilizing primary data through interviews and secondary data from related sources. The findings indicate that the rehabilitation program includes psychological counseling, vocational training, spiritual strengthening, and family support. However, its implementation faces various challenges, such as limited resources, inadequate post-release support, and persistent social stigma. The evaluation of inmate progress during the final stage highlights the importance of monitoring and ongoing assistance to prevent recidivism. Therefore, this study recommends strengthening reintegration programs based on the specific needs of female inmates, increasing resource allocation, and conducting public awareness campaigns to promote social acceptance of former inmates. The success of these programs is expected to help female inmates return to society better prepared and more productive.

Abstract

In the criminal justice system, the Correctional Institution is the last institution of the criminal justice system. Correctional facility is a place to carry out coaching for inmates and Correctional Students. Considering that the physical and psychological aspects of female inmates are different from those of male inmates, so the coaching of female inmates must be placed in a Female's Correctional Institution. This study aims to find out the process of implementing training for female inmates and obstacles for Correctional Institution in implementing coaching for female inmates and their efforts to overcome these obstacles.
