Abstract

The times and business complexity have encouraged the important role of corporations in various aspects of life. On the other hand, corporations also have the potential to violate the law, including corruption. Corruption is a complex issue that has a major impact on the environment, economy and community welfare. In some cases, corruption offenses are committed by corporations, so questions arise about corporate criminal liability and law enforcement. Corporate criminal liability is a relatively new concept in Indonesia. This concept allows corporations to be convicted for criminal offenses committed by the management, directors, or employees of the corporation. Based on this relatively new concept, the regulation of corporate criminal liability and law enforcement still raises questions and legal uncertainty.

Abstract

Advancements in technology have simplified various daily activities. However, this progress has also been exploited by illegal online loan services (pinjol) offering loans to people with low financial literacy, making it difficult to distinguish between legal and illegal services. Technologically-based loan solutions, originally intended to meet the community's urgent and long-term needs, have now been misused. This development has led to many risks and has given rise to various criminal acts, including fraud, extortion, and threats related to information and technology. The purpose of this study is normative juridical, using secondary data with qualitative data analysis methods. In Criminal Decision Number 438/Pid.Sus/2020/PN Jkt Utr, there is an explanation regarding legal protection for online loan borrowers against extortion or threats by debt collectors through electronic media. The judge decided on the second alternative accusation in the name of the defendant, Dede Supardi Bin H.Supriadi, based on Article 45, paragraph (4) Jo. Article 27, paragraph (4) of the Law of the Republic of Indonesia No. 19 of 2016 is an amendment of Law No. 11 of 2008 on Information and Electronic Transactions and Law No. 8 of 1981 on Criminal Procedure Law. Criminal charges can be imposed on the debt collectors involved in this case.

Abstract

Situbondo Sekai Community gathers individuals who have a sense of interest in Japanese culture and anime, or wibu for short. Interests and hobbies are one of the main reasons this community was formed. A very foreign culture is increasingly turning into a reality that eventually blends into society. Similarly, the Situbondo Sekai community takes cultural values from Japan, which they then use as the main foundation in building solidarity. Basically, a wibu's identity is based on his or her actions that are directly accepted by the outside community and subjective assessments from other individuals. So that in the end it will form a new knowledge that has been objectivized and agreed upon. Wibu are just like any other human being, what makes their label different from others is the community they choose. The community can represent their role in the context of interactions between fellow individuals.

Abstract

This research aims to find out and analyze legal assistance for women and children by a team of advocates at the Pati Religious Court. The rights of women and children are one of the obligations of an ex-husband after divorce, namely providing iddah support, muta'ah and madhiyyah support as well as costs. Education for children from underage to adulthood is the responsibility of a wife. So that in the divorce divorce case carried out by the husband at the Pati religious court, the team of advocates received attention. The research method used in this writing is empirical juridical, with the specifications of this research using qualitative descriptive research, legal assistance for women and children by the profit advocate team is felt by the profit advocate team to be less than optimal, especially considering the situation of the client, who is the Defendant and The client is just a housewife. In this case, advocates as legal representatives provide legal assistance to women and children after divorce free of charge in order to obtain equal justice or equality before the law. This aims to uphold the principles of civil procedural law within the scope of the Pati religious court, and the team profit advocate in Pati district. However, in reality, this matter is not paid enough attention by law enforcers who are profit advocates in Pati district. And it is hoped that this is a form of service effort by the profit advocate team in accordance with the advocate's oath in accordance with article 4 of the Law of the Republic of Indonesia Number 18 of 2003 concerning Advocates in conjunction with the letter from the chairman of the Supreme Court of the Republic of Indonesia Number: 73KMA/HK.01/IX/2015 September 25 2015 regarding the oath of lawyers.

Abstract

Communitarianism is the idea that human identities are largely shaped by different kinds of constitutive communities (or social relations) and that this conception of human nature should inform our moral and political judgments as well as policies and institutions. We live most of our lives in communities, similar to lions who live in social groups rather than individualistic tigers who live alone most of the time. Those communities shape, and ought to shape, our moral and political judgments and we have a strong obligation to support and nourish the particular communities that provide meaning for our lives, without which we’d be disoriented, deeply lonely, and incapable of informed moral and political judgment.

Abstract

The aim of this research is to formulate a family leadership model as an Islamic educational institution. This research method uses a qualitative approach. The data collection techniques used are documentation studies and text studies in order to find information or data about family leadership as an Islamic educational institution. The data collected was analyzed using content analysis techniques and explained descriptively. The results of the research show that the family leadership model as an Islamic education institution for individuals will have an ideal Muslim personality (moral), so parents are expected to provide guidance and provide qudwah for family leadership as an Islamic education institution. Among them, namely; provide guidance on faith and morals, guidance on worship, community mental development and intellectual development.

Abstract

Fraud has been around for more than twenty centuries. The world continues to grapple with the devastating impact of financial crime. In this digital age, financial fraud is more sophisticated than ever. This article discusses the origins of fraud, its development, and technological advances in fraud prevention and security. In simple terms, fraud is deception with the intent to illegally gain financial advantage over a person or an entity. It refers to dishonest acts that deprive a person or entity of money or legal rights. Fraud requires the intentional misrepresentation of facts to convince someone to hand over money or property, unlike outright theft, which requires stealth or force. The crime of fraud is a form of crime that harms society financially and psychologically. This research aims to analyze various aspects related to fraud, including the motives of the perpetrators, the methods used, and the impact on victims and society. The impact of this crime is financially, emotionally, and psychologically detrimental to victims, and can undermine public trust in institutions and individuals. Through an in-depth understanding of the motives, methods, and impacts of fraud, this research contributes to the development of more effective prevention and law enforcement strategies. Preventive measures involving public education on the risks of fraud, increased legal awareness, and enhanced cooperation between law enforcement agencies and the private sector can be the first step in combating this phenomenon. In addition, strict and fair law enforcement against fraud perpetrators is also necessary to ensure justice for victims and minimize the possibility of similar crimes occurring in the future.

Abstract

Rowosari Village is an agrarian community with advanced agricultural and agricultural processing sectors. These sectors have been well-developed for a long time and receive support from various parties. One of the significant agricultural processing enterprises is owned by Mr. Rudi. The agricultural products processed include rice and corn. The growth of this enterprise involves many parties providing support in the form of funds and processing machines. Additionally, there is a cooperative and farmer groups established by Mr. Rudi himself, which have significantly assisted his business. The purpose of this research is to dissect the networks built within and outside of production relations and how the owner has managed to expand the agricultural processing business to its current size using Social Network theory by focusing on the concept of Embeddedness. This research uses qualitative methods with an ethnographic approach, as the focus of the study lies on the community, specifically the agricultural processing business situated in a rural society.

Abstract

This research explores changes in fashion styles among Jember University students in the digital era, which are influenced by social media, digital platforms and international cultural migration. Traditional clothing styles have undergone significant changes due to the influence of foreign cultures in design and materials. Students, as active users of social media and the internet, are the main targets of this change, often exposed to the latest fashion trends and campus events that demand a fashionable appearance. Interviews with two FISIP students at the University of Jember revealed that social media greatly influences the way they dress, reflecting Jean Baudrillard's theory about consumer society. According to Baudrillard, consumption not only fulfills basic needs but also functions as a symbol of identity and social status. Jember University students follow fashion trends to express themselves and demonstrate social affiliation, despite facing challenges such as financial management and disrupted academic priorities. This research uses a case study-based qualitative approach, with semi-structured interviews and field observations to obtain in-depth data. Thematic analysis was carried out to identify main themes such as economic conditions, the influence of fashion trends, and the role of social media. This research shows that changes in student fashion styles are not only a fashion phenomenon, but also reflect broader social and cultural dynamics in the digital era. Baudrillard's theory provides a foundation for understanding how symbolic consumption and the influence of social media influence college students' clothing style choices, as well as their impact on their cultural and socio-economic identities.

Abstract

Thrifting has become a popular culture in contemporary society because it contains branded goods that are the favorite of teenagers. Branded goods available in thrifting are offered at low prices, making many people target them. However, their interest in branded goods is not only to fulfill their body needs, but is more inclined to self-image in social life. With many people wanting to image themselves through branded goods, thrifting has become a popular culture today, especially among teenagers. Without realizing it, they are playing with the signs and symbols in the clothes, so that teenagers' consumption is shaped by the desire for sign value. The purpose of this research is to describe the symbol games that occur in thrifting culture and lead to their desire to get it, so that the original reality is replaced with a fake reality. This research uses a qualitative method, the approach used is phenomenology which is used to understand the symbol games in individuals involved in thrifting culture.
