Abstract

Legal protection of human rights defenders in Indonesia is crucial for the state to fulfil, promote and develop human rights. This research focuses on the reformulation of legal obscurity in regulations that have not legitimised the protection of human rights defenders. Various forms of vulnerability of human rights defenders in fact lead to human rights violations such as Criminalisation, Victimisation, Anti-SLAPP (Strategic Lawsuit Against Public Participation), Cyber Attacks and physical attacks intended for human rights defenders which reinforce Impunity. The facts show that the activities of human rights defenders are very vulnerable, it is appropriate to require legal protection in each of their activities. The vulnerability of the activities carried out by human rights defenders, which basically aims to contribute to the quality of State administration in promoting human rights, shows that protection for human rights defenders is important to be reformulated. By considering several important issues that are the focus of the research, the protection of Human Rights Defenders consists of, for instance, legal protection, which is not only related to the establishment of laws and regulations that guarantee the protection of Human Rights Defenders, but also to the elimination of laws that have the potential to threaten, restriction and violate Human Rights Defenders, guarantees and support for the activities of Human Rights Defenders, including the effectiveness of Human Rights Defenders in the process of advocacy, such as the right to information, communication with both government and non-government organisations, and recognition of Human Rights Defenders' advocacy. This also covers the guarantee of defenders' right to immunity for their advocacy activities.

Abstract

Diplomacy is considered for the security state on mineral resources in Indonesia since Indonesia is a law country and has many mining sector possibilities which need to be secured, and created in response to reduce negative impact on mineral illegal mining activities which cause many negative results for Indonesia. Therefore, the Indonesia government needs an alternative effort which lines with the principles concluded by this research. By literatrue reviews employed for the investigation on some international practices published by reputable-indexed journals with the same issue, this research performs an information for the armed forces and the leadership of the Ministry of Law and Human Rights. In the absence of a generally accepted definition of "mineral mining activity diplomacy," the state (in this case, Indonesia) attempts to tailor its content to the requirements of the mineral resource security strategy. The study results that diplomacy involving natural resource mining has broad applicability to Indonesia since it encompasses state security policy creation and execution, as well as the establishment of permanent, cooperative international ties in the defense sector. The first step in realizing the concept's potential as a significant instrument is to conceptualize the mineral resource mining activity diplomacy for the security state in Indonesia from illegal mining activities.

Abstract

The use of enzymes in Indonesia is increasing rapidly and is used in various industries, especially FCMG. One of the enzymes that is widely used is xylanase, which is an extracellular enzyme that can hydrolyze xylan into xylose and xylo-oligosaccharides. This research aims to determine the optimum conditions for the xylanase production process from coffee cherry processing waste (CCPW) using Trichoderma viride through solid fermentation. The research method used was experimental using central composite design (CCD) in Design Expert 13.0 software. The treatment designs used were fermentation times of 24 hours, 48 ​​hours, and 72 hours; and substrate concentrations of 25%, 50%, and 75%. The experimental response analysis design was enzyme activity, protein content, and specific activity. The results of the research show that the optimum conditions for xylanase production are at a substrate concentration of 75% and a fermentation time of 24 hours with a desirability value of 0.742, which produces an enzyme activity value of 36.388 U/mL and a dissolved protein content of 0.494 mg/mL with a specific activity of 73.660. U/mg. The verification results show conformity with the formula predicted by the Design Expert 13.0 software, namely enzyme activity of 36,292 U/mL and protein content of 0.488 mg/mL with a specific activity of 74,369 U/mg

Abstract

Nationalism and Islamic identity are two concepts that are interrelated and important for Islamic education. Nationalism is an attitude of love for the homeland and nation that does not conflict with Islamic teachings as long as it does not contain fanaticism, chauvinism or superiority. The identity of a Muslim is a servant of God who surrenders to Him wholeheartedly, follows the teachings of Islam revealed by the Prophet Muhammad SAW, and strives to be a witness to truth and goodness in the world. Islamic education is a comprehensive process of developing human potential in accordance with Islamic values. Axiology of Islamic education is topics related to the purpose, objectives and values of Islamic education. The purpose of this research is to analyze the relationship and influence of nationalism and Islamic identity in the study of the axiology of Islamic education. This research uses library research, and the final results are analyzed interactively by presenting descriptive research discussions. The results of this study show that nationalism and Muslim identity can be strengthened and realized through Islamic education that is oriented towards values such as tawhid, worship, morals, knowledge, charity and da'wah. Islamic education can also make a positive contribution to nation and state building as well as global cooperation and peace by respecting diversity and universal values in accordance with Islamic law. Abstract

The problem of incomplete or non-existent land ownership proof among the community has arisen in one of the villages in Sidoarjo Regency. This is rooted in the registration of land through the Comprehensive Systematic Land Registration (PTSL) program by one of the heirs named "A". After the issuance of the certificate, other heirs raised objections regarding land ownership, leading to an unresolved dispute until now. This situation is not in line with the intended purpose of land registration, given that Indonesia has comprehensive regulations governing land matters, including dispute resolution. The persistent delay in resolving the dispute raises questions about whether there is a regulatory mismatch or implementation issues within the PTSL program. This research adopts a socio-legal research method with a socio-legal sociology approach and legal data collection techniques such as interviews, observations, and document analysis conducted at the Sidoarjo Regency ATR/BPN Office. The population includes employees of the ATR/BPN Office in Sidoarjo Regency, with samples selected purposively from the General and Personnel Substantive Group Coordinator or the PTSL Program committee or appointed officials. The research findings will be analyzed using descriptive legal data analysis. The results indicate that the implementation of the PTSL program aligns with existing regulations, despite encountering some obstacles. The identified challenges include disputes related to data forgery, conflicts among heirs, discrepancies in land measurement processes, and land occupation by individuals other than the direct owners. The ATR/BPN Office in Sidoarjo addresses these challenges by mediating disputes before PTSL registration to reach agreements. In cases where no consensus is reached, the registration process is postponed until a resolution is achieved between the parties. Additionally, in post-PTSL certificate issuance disputes, mediation is employed, and if no agreement is reached, the category may be downgraded from K2 to K1, or legal proceedings may be pursued to determine rightful ownership of the land parcel.

Abstract

Based on the phenomenon that accounting practices in SMEs are still very low, but financial management in SMEs should require good accounting skills by the business owner. The required application system is the Accounting Information System. The object of this study is the Culinary SMEs in Cirebon City, West Java.The population in this study is culinary business owners in Cirebon City, West Java, which is as many as 1075 culinary entrepreneurs according to Cirebon Satu Data 2022. While the sample in this study was set at 92 culinary entrepreneurs with sampling measured using a formula to determine the sample size (Yamane, 1970) Purposive sampling is the sampling strategy utilized in this study. SMEs with historical business management records meet the sample requirements. Primary data are the data type employed in this investigation. The utilization of accounting information has been shown to positively impact the success of culinary SMEs in Cirebon City, West Java, according to the results of the hypothesis test that was conducted. The attainment of corporate success is significantly influenced by accounting information. Among other things, planning and supporting decision-making in corporate management are two areas in which accounting information may help. It is clear from the discussion's outcomes that using accounting information has an impact on a company's ability to succeed in.

Abstract

In this paper, the author will discuss the thoughts of Fatima Mernissi in criticizing the hadis on women’s leadership. From the results of her investigation, Mernissi criticized Abu Bakrah in relation to the narration of the hadis as follows: 1) Abu Bakrah is difficult to trace his lineage because he was originally a slave who was freed when he joined the Muslims. 2) Abu Bakrah was sentenced to qazaf, because he could not prove the charge of zina against al-Mughirah ibn Syu’bah at the time of the Caliph Umar bin al-Khattab. 3) Looking at the historical context, why did Abu Bakrah remember this hadis (which, if correctly uttered by the Prophet, means that he has passed a period of approximately 25 years) after knowing Aisha had lost the war, while the initial stance he took was neutral. Based on this rule, Mernissi concluded that Abu Bakrah was a narrator who was rejected, and his hadis was not acceptable. Based on the foregoing reasons, Mernissi concluded that even though the hadis was contained in Sahih al-Bukhari, it was still debated by the jurists. According to her, this hadis is used as an argument to displace women in the decision-making process.

Abstract

The soap opera "Cinta Fitri" is one of the most popular TV drama series (soap operas) not only in Indonesia but also in Singapore (MdEntertainment). This paper focuses on the phenomenon of soap operas and gender representation in Indonesian media. The research methods that will be used in this research include content analysis, case studies, surveys and statistical analysis, literature studies, and comparative analysis. The Indonesian soap opera "Cinta Fitri" captivates audiences with its portrayal of personal struggles and complex relationships. Lead characters Fitri and Farrel challenge traditional gender norms, resonating with viewers. The show's popularity is fueled by its relatable storyline, strong character dynamics, and dedicated fan base, making it a cultural phenomenon in Indonesia. "Cinta Fitri" is an Indonesian soap opera that was successful because it presented an evocative story, strong characters who challenged traditional gender norms, and received fanatical support from the audience. By focusing on personal conflicts and relationships between characters, this soap opera shows its appeal and becomes a cultural phenomenon that influences views on gender in Indonesia.

Abstract

According to Shaw et.al. (2018) the constitutional court is one of the forces behind the revival of comparative studies of constitutional law in the last two decades. The establishment of a constitutional court as the main feature of constitutional reform in new democracies. The purpose of this research is to find out the form of the decision Number 49/Puu-IX/2011 regarding the abolition of Article 59 paragraph 2 of Law Number 7 of 2020, and to find out the impact of Number 49/Puu-IX/2011 concerning the abolition of Article 59 paragraph 2 of the Law. - Law number 7 of 2020?. The method used is normative juridical because it discusses a decision of Law number 7 of 2020 concerning article 59 paragraph 2 which is deleted. The results of the study show 1) Decision Number 49/Puu-IX/2011 which deletes the Manuscript Law 7/2020 Article 59 paragraph (2). 2) The provisions in Article 59 Paragraph (2) were deleted in the results of the revision of the Constitutional Court Law or Law Number 7 of 2020 which was ratified by the DPR. This decision has a polemic impact on the community because it is considered a scenario for the DPR and the President to submit the Constitutional Court's decision, so that the DPR and the President no longer have an assessment of the Constitutional Court. The public considers that this decision is related to the work copyright law because with the abolition of article 59th paragraph 2 it can allow everything that is abolished in the work copyright law to be in vain because it is still under the authority of the president and the DPR.

Abstract

This study aims to determine the effect of the application of accounting information, performance measurement systems and reward systems to managerial performance in modern retail companies in Cirebon City. The number of samples used in this study amounted to 76 people. The research sample consisted of lowerlevel managers (lower management) to top (top management). The results showed that the application of management accounting information had an effect on managerial performance, the performance measurement system had no effect on managerial performance, and the reward system had a significant effect on employee performance, while simultaneously significantly affected the performance of modern retail companies in Cirebon
