Al-Qisthu: Jurnal Kajian Ilmu-Ilmu Hukum is a peer-reviewed scientific open access journal. The subject covers textual and fieldwork studies with various perspectives of law, philosophy, mysticism, history, art, theology, and many more. In the beginning the journal only served as a scholarly forum for the lecturers and professors at the State Institute of Islamic Studies. However, due to the later development with a broader readership, the journal has successfully invited scholars and researchers outside the Institute to contribute. Abstract

تهدف هذه المقالة إلى شرح موقف جمع الأحكام الإسلامية بإندونيسيا بين آراء علماء الفقه المختلفة فيما يتعلق بقانون نكاح الزنا الحامل. وهذه الحالة، فإن جمع الأحكام الإسلامية فصل ٥٣ يسمح بنكاح الزنا الحامل، حينما ذهب بعض الفقهاء مكروه نكاح الزنا، وذهب بعضهم حرامًا مطلقًا، وذهب آخرون بجوازه بشروط. اعتمد الباحث المنهج النوعي. باستقراء البيانات من جمع الأحكام الإسلامية بإندونيسيا والكتب الفقهية، والمصادر الثانوية، ثم قدم الباحث بطريقة وصفية تحليلية. واستنتج الباحث إلى أن الرأي الذي اختاره جمع الأحكام الإسلامية فصل  ٥٣  هو الرأي المرجوح بين آراء الفقهاء. بينما فإن اختيار هذا الرأي ليس محظورًا على الإطلاق ولا يجعل جمع الأحكام الإسلامية مخالفًا للفقه، لا سيما، تكاتف هذا الرأي بخلال النظر في مصالح المجتمع الإندونيسي.

Abstract

This article discusses the views of the organizational figures of the Lembaga Dakwah Islam Indonesia (Indonesian Islamic Da'wah Organization) and the Nahdhatul Ulama of Bandar Lampung City regarding the Family Planning program whose laws are often debated by the general public. Those who think that the family planning program is legal can be based on government recommendations, while those who think that the law is prohibited are based on the views of certain religious groups or organizations. This study uses a qualitative-descriptive approach. Data were collected through interviews with organizational figures from the Indonesian Islamic Da'wah Institute and Nahdhatul Ulama in Bandar Lampung City. This study found that there is a tendency to prohibit or prohibit the Indonesian Islamic Da'wah Organization against the Family Planning program if the consideration is economic difficulties. However, for birth control, this organization offers the azl method known in Islamic fiqh. Meanwhile, Nahdhatul Ulama figures fully support the Family Planning program run by the government, because there is benefit and there is no element of conflict with Islamic law in principle.

Abstract

This study is intended to examine the practice of iddah by women who are abandoned by their husbands in Besuki District, Situbondo Regency, East Java, from the perspective of Jasser Auda's maqashid sharia. They continued to go out of their homes to work when sharia required them to observe the iddah for four months and ten days in the form of not traveling from home after their husbands died. However, it was precisely because of the reason for the death of the husband that the widows left home to work and earn income to support their children. This type of research is juridical-empirical. Primary data sources were obtained by interviewing religious leaders, residents, and widows whose husbands died. By using Jasser Auda's maqashid sharia theory, this study concludes that women who are undergoing the iddah of the death of their husbands are forbidden to marry, but they are still allowed to work outside the home to provide for their lives and provide for their children.

Abstract

This study aims to analyze the series of marriage traditions in the Gunung Meriah community, Aceh, using the theory of 'urf. The series of traditions consist of ubengan, wearing sindur, kembar mayang, dulungan, lempar sirih, and bakar menyan, all of which are carried out after the ijab-qabul. This study uses a qualitative approach with ethnographic data collection. The results show that the people of Gunung Meriah maintain a series of traditions around marriage because they are considered good. However, by using the 'urf approach, it can be seen that some of the series of traditions are classified as 'urf sahihah or traditions that do not conflict with Islamic law, which consist of ubengan, pakai sindur, kembar mayang, and dulungan. Meanwhile, some other traditions have the potential to be classified as 'urf fasidah or traditions that are contrary to Islamic law, namely lempar sirih and bakar menyan. In the tradition of lempar sirih, if the betel is thrown away, then it is classified as a bad deed, while if the betel is taken, then it is considered good. In the tradition of bakar menyan, if it is intended to summon the spirits of ancestors, then it is forbidden, whereas if the intention is simply to smell, then it is not forbidden.

Abstract

This study is intended to examine the formulation of the results of the 2019 Plenary Meeting of The Supreme Court of the Republic of Indonesia relating to the nafkah madhiyah for children. This formulation is important, because previously the Supreme Court through its decision number 608K/AG/2003 stated that a child's nafkah madhiyah cannot be prosecuted after a husband and wife divorce, so this Supreme Court decision is often used as jurisprudence by judges to reject lawsuits about nafkah madhiyah for child. However, by issuing the formulation of the results of the plenary meeting, The Supreme Court opened up the opportunity for a lawsuit regarding the nafkah madhiyah for child. This study is a normative legal study by relying on library data, then providing an ushul fiqh approach, especially mashlahah analysis. This study shows that the plenary meeting of the Supreme Court chambers in 2019 not only provided a different formulation from the previous decision, but also showed a different paradigm in viewing the livelihood of children. If the previous The Supreme Court decision views the nafkah madhiyah for child as li al-intifa', that is, living as the fulfillment of benefits only and cannot be prosecuted if the benefits have been fulfilled even though the material is not provided, then the formulation of the Plenary Meeting of the Supreme Court positions the nafkah madhiyah for child as li al-tamlik, namely maintenance as a child's property that can be sued if the material is not fulfilled. This formula contains useful values, in accordance with Islamic law, and is relevant to laws and regulations related to children's rights, human rights, and the elimination of domestic violence.

Abstract

This study aims to find out the dialectic of formulating the age limit for marriage which took place from the pre-independence period until the issuance of Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Adjudicating Applications for Marriage Dispensation. The demand to determine the age limit was first voiced by the women's movement explicitly during the colonial period due to the large number of daughters being married off. Child marriage has been detrimental and has a bad impact on the lives of girls. This research is a normative legal research that uses a statutory approach, a conceptual approach and a historical (historical) approach. The results of this study prove that the formulation of the politically negotiated age limit after the independence period did not receive special attention by the Government. Interests in other matters concerning the approval of the Marriage Law are generally more important. The issue of the age limit has received a lot of criticism after Article 7 of Law No. 1/1974 on marriage was judged to be casuistic in terms of legal material and judicial practice. With the promulgation of PERMA Number 5 of 2019 it becomes the determinant of the legal vacuum regarding the application of the age limit rule and the process of adjudicating marriage dispensation cases by judges in the Religious Courts.

Abstract

This study aims to explore the extent to which the relevance of Islamic legal norms to the spirit of non-violence, especially in the household, considering that the topic of domestic violence is not a specific discussion or has received little attention in discussions on Islamic law. This study uses a normative juridical approach. Data was collected using documentation techniques on Islamic legal literature, in the form of fiqh books, as well as the texts of the Koran and Hadith. This study shows that acts of domestic violence are prohibited in Islam. Islamic law in this topic is very relevant to the spirit of non-violence and laws and regulations in Indonesia related to acts of violence, both in general and in the family context.

Abstract

This article explains the application for marriage certificate which was rejected by the Religious Court. This research is focused on what are the reasons that lead to the rejection of the application and what are the efforts, both legal and non-legal, made by the applicant whose application was rejected. This study uses a normative-empirical legal research method with a judicial case study approach. Data was collected from documents and from informants through interviews. The source of the document is in the form of a request document and a judge's decision at the Class 1A Padang Religious Court; while interviews were conducted with applicants whose applications were rejected, from officials at the Office of Religious Affairs, and from officers from the Population and Civil Registry Service. This study shows that there are five reasons for rejection by the Religious Court Class 1A Padang of filing a marriage certificate application, namely because the applicant is still married to another person, the guardian who is marrying is invalid, the marriage is still under public, witnesses cannot provide information that can accepted, and the applicant was not present at the trial. The efforts made by the applicant whose application was rejected were only in the form of non-legal efforts. Of all the cases examined, none of the applicants made further legal efforts in the form of cassation due to their ignorance. They made other efforts in the form of re-marriage at the Office of Religious Affairs and determining the origin of the children.

Abstract

There are various views regarding the beginning of the day, both from the perspective of jurisprudence and astronomy. The study of the beginning of the day has long been of concern to previous researchers. The beginning of the day is closely related to the calendar, so existing writings always associate the beginning of the day with the calendar system. In particular, this paper seeks to explain the concept of the Hijriah Hour which is then analyzed in order to find out whether the use of the concept is possible and to find out how the concept of the Hijriah Hour is related to the concept of the beginning of the day. This research is a library research with qualitative analysis methods. The primary source in this study was the book Jam Hijriah by E. Darmawan Abdullah, which was supplemented by other supporting books and writings. After being analyzed, it was found that the Hijri Clock concept would be difficult to use globally. However, the concept of this Hijri Hour is in line with the view of the sunset in the concept of the beginning of the day. But the difference here is that in the Hijri calendar it only makes maghrib a change of day, not a change of hours. While the concept of the Hijri Hour requires that maghrib is the momentum of the change of day as well as the change of hours.

Abstract

This study discusses the authority of customary law in the practice of forced marriage in the community of Lekuk Limapuluh Tumbu Lempur, Kerinci, Jambi. Forced marriages were carried out against men and women who went out together and only returned after 20.00. They have to get married, even though they are not willing to do so, they are not even asked to be willing at all. This study uses a qualitative descriptive method. Data collection is done by observation, interviews, and documentation. This study shows that the decision to implement forced marriages was issued by four elements holding customary authority, namely the depati, ninik mamak, alim ulama, and cerdik pandai. This punishment is enforced in order to maintain religious rules, because a man and a woman who travel together until late at night have the potential to commit various violations of religious norms, especially adultery. The application of the forced marriage rule is intended as a preventive measure against these violations. Here the role of adat is to make forced marriage as a customary punishment intended to maintain religious norms.
