Al-Qisthu: Jurnal Kajian Ilmu-Ilmu Hukum is a peer-reviewed scientific open access journal. The subject covers textual and fieldwork studies with various perspectives of law, philosophy, mysticism, history, art, theology, and many more. In the beginning the journal only served as a scholarly forum for the lecturers and professors at the State Institute of Islamic Studies. However, due to the later development with a broader readership, the journal has successfully invited scholars and researchers outside the Institute to contribute. The primary topics will publish in this journal is 1. Islamic family law; 2. Islamic criminal law; 3. Islamic political law; 4. Islamic economic law; 5. Islamic astronomy (falak studies).

Abstract

The bilateral inheritance system ensures equal rights for men and women while reflecting social justice values rooted in local traditions. However, its practice often sparks debates regarding its alignment with Islamic law. This study aims to analyze the practice of bilateral inheritance in the Dusun VII Sei. Cabang Kiri community, Langkat Regency, through the lens of maqashid syariah, focusing on equity and public benefit. Employing a semi-ethnographic design with a qualitative approach, the research involved structured interviews and thematic data analysis to understand inheritance patterns and their underlying values. The findings reveal that the bilateral inheritance system in this community aligns with the principles of maqashid syariah through family deliberation (musyawarah), fostering justice, equality, and social harmony. Such a system not only exemplifies the integration of local customary values and maqashid syariah but also serves as a relevant model for achieving justice, equality, and social harmony within Indonesia’s pluralistic legal framework. Future research is recommended to adopt comparative or interdisciplinary approaches to further explore similar practices in other indigenous communities across Indonesia.

Abstract

Fatwa Number 83 of 2023 by the Indonesian Council of Ulama (MUI) prohibits transactions with products affiliated with Israel, while Law No. 33 of 2014 on Halal Product Assurance, which grants MUI the authority to issue halal certification, does not include such a prohibition. This study examines the applicability of MUI Fatwa No. 83 of 2023 regarding the certification of products affiliated with Israel, using a juridical-empirical research method with a qualitative approach. The research concludes that there is no clear legal consequence for the halal certification of products affiliated with Israel following the issuance of the fatwa. The MUI has not provided clarity regarding the prohibition of using halal products affiliated with Israel, resulting in legal uncertainty and ambiguity about the halal status of these products and whether they will be accepted for halal certification. There are no derivative regulations regarding the halal certification status of products affiliated with Israel, leading to differing interpretations among halal support institutions. One institution includes products affiliated with Israel on a list of products deemed unfit for certification, while another considers them eligible for certification.

Abstract

The global dialogue on balancing economic development, human rights protection, and environmental preservation necessitates contributions from religions with their universal values. This article elucidates the role of Islamic law in maintaining the balance between human rights and environmental sustainability through political practices and policies in Indonesia. This study employs a descriptive-analytical method with a qualitative approach. Data collection is conducted through literature review and analyzed using content analysis. The findings of this research indicate that the concepts of maslahah (public interest) and maqasid al-shariah (objectives of Islamic law) have played a crucial role in providing fundamental principles for various sustainable policies. Islamic legal politics, through the principles of tawazun (balance) and avoiding harm, have fostered a restraint from excessive exploitation of natural resources to maintain ecological balance. The principles of maslahah and maqasid al-shariah offer a strong ethical and moral foundation for sustainable policies and support global efforts towards environmental sustainability and social welfare.

Abstract

This article discusses the conflicting understanding of marriage regulations and munakahat fiqh on the issue of nikah siri. This conflict has occurred in Sungai Penuh City to date. This article discusses three points. First, about the understanding of religious leaders in Sungai Penuh about the relationship between fikih munakahat and the Marriage Regulations. Second, about the understanding of the Marriage Registration Officer in Sungai Penuh about the relationship between fikih munakahat and the Marriage Regulations. Third, about the motives and patterns of contestation of fikih munakahat with the Marriage Law in Sungai Penuh and Sungai Penuh. This study shows that religious leaders in Sungai Penuh City still conflict between fikih munakahat, which does not require marriage registration, and marriage regulations that require marriage registration. Some are of the view that marriage registration has no substantial role except as an administrative necessity. Therefore, marriage registration is often ignored as most people ignore other administrative processes, so siri marriages are still rampant.

Abstract

The debate over religion-based regional regulations (perda) has become a significant discourse in studies of state–religion relations at the local level, particularly within the context of democracy and societal pluralism. This article aims to analyze the dynamics of the implementation of Regional Regulation No. 12 of 2009 and its revision through Regional Regulation No. 7 of 2014 in Tasikmalaya City, a region known for its religious character and Muslim-majority population. This study employs a descriptive qualitative method using document study and policy discourse analysis approaches. The findings reveal that Regional Regulation No. 12 of 2009 sparked controversy due to its perceived discriminatory nature against minority groups and its lack of procedural legislative rigor, which led to ineffective implementation. The revision in Regional Regulation No. 7 of 2014 demonstrates a shift toward more inclusive language and editorial format, yet it retains ideological elements that favor the dominant religious majority. These findings highlight the ambivalence that arises when moral aspirations of the community are formalized into local policy, potentially conflicting with constitutional principles. This study contributes to a deeper understanding of identity politics in subnational legislation.

Abstract

Arranged marriages remain significant in Muslim Kerinci society, where cultural traditions and Islamic values shape family life. This study explores the factors sustaining marital harmony and how women negotiate agency within family expectations and religious norms. Using a qualitative approach with in-depth interviews involving community leaders, scholars, and couples in Air Hangat Barat District, the research highlights the interplay between structural norms and individual choices. Findings show that shared religious values, moderation in household management, tolerance of shortcomings, supportive parental roles, and affection rooted in Islamic teachings are key to harmonious families. While cultural and religious frameworks function as structural constraints, women exercise agency by negotiating their roles and influencing marital outcomes. The study’s novelty lies in integrating Islamic perspectives with sociological and gender theories to explain how tradition, faith, and agency interact to sustain arranged marriages in contemporary Muslim contexts.

Abstract

Tradisi pernikahan di Indonesia mencerminkan kekayaan budaya yang sarat makna sosial dan spiritual, salah satunya adalah praktik berciyay pada masyarakat Tanjung Harapan, Kalimantan Barat. Penelitian ini bertujuan untuk menganalisis nilai-nilai maslahah yang terkandung dalam tradisi berciyay serta relevansinya dalam konteks sosial dan ajaran Islam. Metode yang digunakan adalah kualitatif dengan pendekatan etnografis dan analisis menggunakan teori maslahah, melalui observasi partisipatif dan wawancara dengan tokoh adat, agama, dan masyarakat. Hasil penelitian menunjukkan bahwa berciyay berfungsi sebagai sarana penguatan solidaritas sosial, simbol perlindungan spiritual bagi pengantin, serta pengikat harmoni antarwarga, dan dapat dikategorikan sebagai maslahah tahsiniyyah dalam kerangka ‘urf shahih. Temuan ini menunjukkan bahwa pelestarian tradisi lokal dapat berjalan seiring dengan nilai-nilai Islam selama dilakukan secara kontekstual dan adaptif. Penelitian ini memberikan kontribusi teoritis dalam memperluas cakupan analisis maslahah dalam studi budaya lokal serta menawarkan pendekatan pelestarian tradisi yang tidak hanya normatif, tetapi juga kritis dan transformatif.

Abstract

The weton tradition in Javanese culture remains a significant cultural heritage that influences marriage decisions in various communities, including in Kepuh Kembeng Village, Lamongan. This study aims to analyze how local society responds to weton incompatibility in marriage and to what extent such cultural values affect their social life. The research employs a qualitative descriptive method, with data collected through observations and interviews involving community leaders, religious figures, and couples who experienced weton differences. The findings reveal that although weton is still respected, it is no longer viewed as an absolute barrier to marriage. Values of social harmony and collective deliberation serve as key social mechanisms that enable negotiation between cultural traditions and family interests. Using Talcott Parsons’ structural functionalism, the weton tradition is interpreted as a flexible symbolic system that functions to maintain social order rather than as a rigid normative constraint. This study contributes to the discourse on living law and enriches the understanding of the interplay between cultural tradition and religious values in contemporary Muslim Javanese society.
