Abstract

This research aims to find out the debt settlement agreement of Bank Indonesia Liquidity Assistance (BLBI) with delivery asset which released Syafruddin Arsyad Tumenggung from all lawsuit. The method of this research is normative legal research using statute, conceptual, and case approaches. The result of this research experienced that debt settlement agreement of Bank Indonesia Liquidity Assistance (BLBI) with delivery asset is an agreement which is created by human. The consideration of Supreme Court Judges to Syafruddin Arsyad Tumenggung which was released from all lawsuits due to the agreement, therefore the appropriate settlement is in the civil court.

Abstract

The purpose of this study is to find out the basis of the judge's consideration in deciding the case of default in the cooperation agreement and job appointment of the earthquake-resistant house and its legal consequences as stated in the Mataram District Court Decision No. 194 / Pdt.G / 2020 / PN Mtr. This is a normative legal research. This research finds out that the judge's consideration in deciding the case of default as stated in the Mataram District Court Decision No. 194 / Pdt.G / 2020 / PN Mtr is based on the legal expert opinion regarding the default, the propositions and arguments of the lawsuit and also the evidence from the plaintiff. As for the legal consequence of the breach of such agreements results in the Defendant pays the losses suffered by the plaintiff and the costs of the case.

Abstract

This study aims to determine the basis for judges' considerations in adjudicating and deciding gender change cases in the Yogyakarta District Court. This research uses normative research. The purpose and benefit of this research is to find out what is the basis for the judge's consideration in deciding and adjudicating this gender change case in the Yogyakarta District Court and its legal consequences after the judgment of compensation was handed down by the judge. The results of this study are the judges' considerations in deciding the applicant's petition, namely transgender perpetrators are assessed in terms of the background of the applicant's actions for sex change, the applicant's physical and psychological condition as well as witness testimony from the applicant's closest person. person, namely transgender perpetrators and the legal consequences of the recording. civil applicants related to Law Number 24 of 2013 concerning Population Administration.

Abstract

This study describes the practice of divorce in Apitaik Village Community, and observes the effectivity of Article 39 paragraph (1) of the Marriage Law, as well as identifies factors affecting the divorce practice. This study is a descriptive normative-empirical one. Data in this study consists on interview as primary ones, and laws and regulations as secondary ones. Results of this study show that the divorce practice in Apitaik Village Community is still verbally completed by husbands. Likewise, the reconciliation is also verbally completed. Implying from these practices, the provision of Article 39 paragraph (1) is considered unfeasible. This is due to several factors. The first and the second are that the community assumes that divorcing officially is time consuming and bothering. Moreover, they consider completing the divorce verbally is more economical than the official ones. The other is the lack of legal awareness of locals. In addition, distant Religious Court office may lead to locals’ reluctance to officially proceed their divorce.

Abstract

This study describes the process of land ownership transfer application obtained from purchasing. It focuses on the time period from purchasing to application submission according to Article 103 Paragraph (1) and (7) of the Regulation of Ministry of Agrarian No 3 of 1997. This study is a normative-empirical one, with statute, conceptual, and sociological approaches. Results of this study show that according to the Regulation, application submission is no later than 7 days after purchasing. In the other word, it neglects Paragraph (7) that allows application submission exceeding 7 days. The Agrarian Office does not proceed application that is submitted more than 7 days. In the case it exceeds 7 days, applicant is to renew and adjust the deeds and its date.

Abstract

Migrant worker is an alternative in order to minimize unemployment number in Indonesia. BP2MI is an agency who has responsibilities to protect Indonesian migrant worker in time of pre-placement, placement and post placement. The aims of this research are to know the role of BP2MI Mataram in the protection of migrant worker during pre-placement time and implementation of Government Regulation Number 90 of 2019 on BP2MI. This research is qualified as empirical legal research. From research result, it is shows that form of legal protection in pre-placement phase are administratively and technically. However, it implementation of migrant worker protection by BP2MI Mataram is delivered by pre-placement protection.

Abstract

This study aims to find out and explain about the implementation of the lease agreement of the stalls owned by the cooperation of AL-Mutmainnah Islamic Boarding School and to find out the settlement of dispute in the event of default of such agreement. This study is an empirical legal research. The results of the study show that the implementation of the lease agreement of the stalls is carried out in the form of a standard agreement which is embodied into a agreement letter. The form of dispute resolution of the lease agreement of the stands owned by the cooperation of AL-Mutmainnah Islamic Boarding School Cooperative is by way of an out-court resolution (non-litigation), by way of negotiation and mediation through deliberation to reach consensus or through amicable settlement which directly involves both parties.

Abstract

This research aims are to know how the implementation of provision specific loans between Bank NTB Sharia with UMKM IPEMI member and how is the default settlement mechanism will be taken by Bank NTB Sharia if another party breach the contract. This research is qualified as normative empirical legal research. the research result shows that Bank NTB Sharia provide convenience for the UMK in the loan process until it realization with bigger opportunity, because of UMKM IPEMI is an association which have big success rate and also contribute in regional economy empowerment. The dispute settlement mechanism is conducted by the Bank NTB Sharia according to Article 55 Law Number 21 of 2008 and Article 26 of Murabahah Loans Contract of Bank NTB Sharia.

Abstract

This study aims to determine the basis for the judge's considerations in Decision Number 245/PDT.G/2018/PN.Mtr and the legal consequences arising from the loss of customer credit guarantee documents at Bank NTB. The method used by the author in this study is a normative research method. The result of the research is that the Panel of Judges stated that the Defendant's actions were against the law so that the Defendant had to pay compensation to the Plaintiff and pay the court costs incurred in this trial as a result of the unlawful acts committed.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana pertimbangan hakim dalam Putusan Pengadilan Negeri Mataram Nomor 239/Pdt.G/2020/PN.Mtr dan pertanggungjawaban penjual yang wanprestasi dalam perjanjian jual beli mobil. Penelitian dilaksanakan dengan mengaplikasikan metode penelitian normatif yang menggunakan pendekatan undang-undang, pendekatan konseptual, dan pendekatan kasus. Perjanjian jual beli mobil yang menjadi objek jaminan fidusia tersebut adalah sah sebagaimana diatur dalam Pasal 1458 KUHPerdata dan penjual dinyatakan wanprestasi karena tidak menyerahkan BPKB. Penjual bertanggungjawab untuk menyerahkan BPKB kepada pembeli. Majelis hakim menghukum lembaga finance untuk menyerahkan BPKB kepada pihak ketiga (penggugat).
