Abstract

This research aims to compare the regulation of the termination of employment relationship between the Law No. 13 of 2003 on employment and the Law No. 11 of 2020 on job creation. This is a normative legal research which applies statutory, conceptual, and Sosiological approaches.This research finds out that the Law No. 13 of 2003 on employment narrows the space for employers to terminate the employment relationship. On the other hands, the Law No. 11 of 2020 on job creation as stipulates in Article 81 Point 37 amendments to Article 151 paragraph (2) wider space for employers to terminate the employment relationship unilaterally only by giving the labor a notice on the reason of such termination without any confirmation from LPPHI. Regarding labor’s rights, Article 156 of Law Number 13 of 2003 stipulate that the awarding severance payment, long service pay, and compensation for entitlements are in accordance with existing laws and regulations.

Abstract

This study aims to determine the implementation of the encumbrance of Mortgage in the joint property bank credit agreement and the execution of the object of Mortgage guarantee that has not been disclosed in Decision Number: 676/Pdt.G.PLW/2016/PN. JKT.Sel. This type of research uses normative research. The results of the study of the imposition of Mortgage in the bank credit agreement on joint assets after the death of the late Bambang Heryanto had to wait for the decision of the Religious Courts regarding the distribution of inheritance and the obligation to pay debts of the late Bambang Heryanto. While the form of execution of the object of mortgage is carried out by auction execution of the object of dispute.There are 4 main stages in the auction of collateral goods, namely Auction Preparation, Auction Implementation, Auction Minutes, Bookkeeping and Auction Reports.

Abstract

This study aims to find out and understand how the enforcement of waqf land certification in East Lombok Regency. Another aims which hopefully reached by this study is the identification of what factors that become the obstacles in the waqf land certification process. The type of research used is empirical legal research with a statutory approach, conceptual approach, empirical or sociological approach. The mechanism of research used by this study within the process to determine the research sample is Random Sampling Technique. Respondents used were located in three sub-districts, with each sub-district included of five respondents so that the total number of respondents used was 15. While the total number of informants used to complete this research was six informants. Data analysis was carried out qualitatively. The results of the analysis show that firstly, the implementation of waqf land certification in East Lombok Regency has not been implemented as stated in the law. This is due to a lack of public understanding of the procedures for waqf land. Secondly, factors and obstacles in the certification process are caused by the simplification of the attitude of the community towards the importance of waqf land certification, the community also feels strong enough not to certify as long as the physical building is built on the waqf land. Seeing the implementation and obstacles above, there are several suggestions and suggestions in overcoming this, namely the need to further intensify coordination between the Office of the Ministry of Religion and the Office of the National Land Agency (BPN), in order to quickly conduct outreach and socialization to the community.

Abstract

This research aims to find out the form of debt restructuring in pandemic covid-19 in SMS finance Branch of Mataram and the impact of restructuring to the credit agreement for the debtor. The method of this research is empirical legal research using statute, conceptual and sociological approaches. The result of this research experienced that based on the Financial Service Authority (OJK) Regulation Number 11/POJK.03/2020 concerning National Economic Stimulus as the policy concerning Countercyclical of the impact of spreading Corona Virus Diseases 2019. Debt restructuration is the effort to repair that is conducted in credit activity to debtor who finds the difficulties situation to fulfil the obligation. It provides to debtors who find the credit problems with certain criteria, for instance, debtor that still find the difficult situation the payment (main credit and/or credit interest) due to the decline financial condition causes some problems.

Abstract

This study describes the implementation procedure of partnership agreement between PT. Grab and food vendors, and identifies the solution in the case of default. This study is a normative-empirical one. The partnership between PT. Grab and food vendors is written in agreements. Agreement points are submitted electronically. Rights and obligations for both parties are managed in Article 5.1 and 5.2 regarding requirements and general provisions in Grab App. In the case of default, both parties agree to undertake colloquial negotiation, considering social and customary law.

Abstract

This research aims to find out the implementation and the obstacles that occur in the implementation of construction contracts between the Office of Public Works and Housing of West Nusa Tenggara Province and PT. Bunga Raya Lestari in the construction/rehabilitation of roads and bridges in region Sumbawa I. This is an empirical legal research by observing field data as the main source of research. Construction services activities require a form of written engagement between service providers and users of construction services called construction work contracts. A construction work contract is an important document that contains provisions that affect the rights and obligations for service users and service providers that are made in detail and must be look at all aspects, especially the legal aspects. Construction contract made between the Office of Public Works and Housing (PUPR) of West Nusa Tenggara Province and PT. Bunga Raya Lestari to carry out the construction/rehabilitation of roads and bridges in the region Sumbawa I, made legally and applicable as a law for those who make it. The contract phase is divided into three, namely the pre-contract, the contract and the post-contract. This road and bridge construction/rehabilitation activity is also inseparable from the obstacles that occur, such as non-technical obstacles and technical obstacles.

Abstract

Tujuan Penelitian menjelaskan proses jual beli rumah subsidi dengan cara oper kredit dibawah tangan dan mengetahui perlindungan hukum pembeli dalam jual beli rumah subsidi secara oper kredit dibawah tangan. Jenis penelitian hukum Normatif-Empiris menggunakan metode pendekatan peraturan perundang-undangan, konseptual dan sosiologis. Kesimpulan: pertama, penjual dan pembeli melengkapi semua dokumen persyaratan jual beli rumah pada umumnya, kemudian membuat perjanjian guna penulasan sisa cicilan pemilik rumah subsidi oper kredit ke bank beralih kepada pembeli. Kedua, pembeli dapat meminta ganti kerugian dengan melakukan gugatan kepengadilan negeri atas dasar wanprestasi atau Perbuatan melawan hukum.

Abstract

This research aims to study the legal protection against the portersin climbing National Park of Rinjani Mountain as well as the factors that affect such legal protection.This study is an empirical legal research that uses facts taken from human behavior.This research shows that: there are still many portersdo not have a licence as a porter from the Office of National Park of Rinjani Mountain which results in lack of legal protection which can be provided by trekking organizers, whereas working as a porter is a high-risk job for the reason that the terrain traversed is very steep, namely the mountain.

Abstract

This study aims to determine how Selebgram will provide legal relationship and legal protection toward the online shop in the endorsement agreement in the event of a default. This research uses the empirical normative legal method. Based on the research results, the legal relationship between endorsement agreements made by celebgram in Mataram with online shops is a form of certain service agreements, which are one type of work agreement regulated in the Civil Code (KUHPerdata) article 1601 and article 1617. The legal protections provided by the program on the online shop is compensation in the form of refunds and goods based on preventive and repressive legal protection, and the form of compensation is regulated in Article 19 of the Consumer Protection Lawthat regulated responsibilities of business actors/endorsement service providers.

Abstract

This study describes the process of granting rights to cultivate over protected forest area to neighbour community in Pengoros Village. This study is a normative-empirical one, with statute, conceptual, and sociological approach. Protected forest area is an area that is free from any activity as its existence is protected by the state, in 2002, the Government established the forest area as a protected one according to the Decree of Minister of Forestry No 8214/kpts-II on September, 9th 2002 of the Establishment of Forest Area. This establishment indicated that any activity is restricted over the land. Normatively, the rights granted by the Sub-District Government had been valid as the grants had been granted before the establishment of protected forest area. On the contrary, the establishment of the protected forest area is argued as legally invalid as according to the Law No 41 of 1999 of Forestry, protected forest area is established over land that is non-forest and ownerless.
