Abstract

Bullying is a critical global public health issue with well-documented impacts on adolescent mental health. In Indonesia, particularly in Java and Sumatra, the high prevalence of bullying presents a significant threat to youth, who are especially vulnerable during their developmental years. This paper explores the relationship between bullying and suicidal behaviors—namely suicidal considerations, planning, and attempts—among adolescents in these regions. A quantitative research design using both bivariate and multivariate statistical techniques, comprising a sample of 7,391 students sourced from the Global School Health Survey 2015, indicates that adolescents who experience bullying are significantly more likely to engage in suicidal tendencies including suicidal considerations, planning, and attempts. The findings emphasise the necessity for targeted interventions to mitigate bullying and promote mental health for adolescents. The paper concludes with recommendations for anti-bullying policies, mental health interventions and further research.

Abstract

Tulisan ini bertujuan untuk menguraikan dan menganalisis mengenai penggunaan teknologi informasi dan komunikasi pada penyelenggaraan peradilan di Indonesia dan urgensi penggunaan artificial Intelegence (AI) sebagai alat untuk mewujudkan asas peradilan yang sederhana, cepat dan berbiaya ringan. Metode penelitian ini adalah yuridis normatif yang bersifat deskriptif analitis, pendekatan peraturan perundang-undangan dan pendekatan konseptual. Kesimpulan dari penelitian ini bahwa Pemanfaatan teknologi AI dalam praktik hukum Indonesia sudah dimulai tentu saja salah satunya oleh Mahkamah Agung menggunakan aplikasi smart majelis untuk memilih majelis hakim secara otomatis berdasarkan faktor-faktor tertentu. Disamping itu, penggunakan aplikasi AI untuk mengoptimalkan perangkat hukum yang menjadi kebutuhan pencari keadilan dalam menjangkau dan mendapatkan keadilan (acces to court to justice), bahkan bersifat condition sine qua non untuk mewujudkan peradilan yang sederhana, cepat, dan berbiaya ringan. Oleh karena itu, penulis mendorong untuk penggunaan AI pada penyelenggaraan sidang secara elektronik (e-court) telah dilakukan Mahkamah Agung dan 4 (empat) lingkungan peradilan dibawahnya

Abstract

In industrial relations practices, job transfers or reassignment of duties are essential tools used by employers to manage human resources efficiently. Job transfer involves the reassignment of an employee’s position or work location for various reasons, such as operational efficiency or career development. However, employees may refuse the transfer, potentially leading to conflict and possibly resulting in Termination of Employment (TOE). According to Indonesia’s Law Number 13 of 2003 on Labor and Government Regulation Number 35 of 2021, transfer refusal must adhere to specific procedures to avoid TOE. These regulations ensure that job transfers are conducted fairly, respecting employee rights, and require bipartite or tripartite negotiation in case of disputes. When transfer refusal leads to TOE, employees are entitled to fair compensation per employment regulations. This study aims to examine the legal implications of transfer refusal on employment status and how applicable legal procedures protect workers' rights within industrial relations.

Abstract

This research aims to analyse the legal protection of children from mixed marriages in Indonesia, focusing on the issue of citizenship and basic rights of children. In the context of Indonesian law, the citizenship of children of mixed marriages is often an issue of legal uncertainty, impacting on children's inheritance rights, education, health and social welfare. Although Indonesia has a legal basis that provides for limited dual citizenship for children of mixed marriages, the implementation of the existing law still faces challenges, including unclear procedures, lack of socialisation, and uncertainty in inheritance and parenting rights. This study concludes that the government's efforts to provide legal protection have been made, but there are still legal loopholes that jeopardise children's rights. Therefore, it is recommended that the government strengthen the implementation of the law, conduct more intensive socialisation, and formulate more specific regulations to protect the rights of children in mixed marriages. This research provides a scientific contribution in understanding the dynamics of child rights protection in Indonesia, especially in the context of dual citizenship, and provides policy recommendations for improving the Indonesian legal system.

Abstract

This study aims to analyse the criminal responsibility of women involved in drug trafficking, especially those who are used as tools by other parties by using their names or identities as recipients of narcotics packages. The main focus of this research is to understand the factors that influence women's involvement in drug networks as well as the legal implications faced by women in the criminal justice system. The hypothesis of this research is whether women involved in drug trafficking as recipients of narcotics packages, whose names are used by other parties, can be exempted from criminal liability if there is no proven intent and power over the goods. The approach used in this research is normative law by analysing legislation and related literature. The results show that women are often trapped in narcotics networks due to exploitation and manipulation of other parties. Therefore, there is a need for legal policy reforms that are more responsive to gender issues and the protection of women's rights in drug cases. This research contributes to the development of criminal law that is more just and sensitive to social and gender factors in drug law enforcement.

Abstract

This study aims to analyse the criminal liability of the perpetrators of embezzlement of Hajj and Umrah funds in the Indonesian criminal justice system and evaluate the effectiveness of legal sanctions applied to tackle these criminal acts. This research uses a normative juridical method with a descriptive qualitative approach, which focuses on analysing the laws and regulations and their application in cases of embezzlement of Hajj and Umrah funds. The results show that although there are clear regulations related to the embezzlement of Hajj and Umrah funds, law enforcement is still hampered by various factors, such as the lack of supervision of worship trip organisers and the less-than-optimal sanctions applied. This research suggests the need to strengthen supervision, increase the capacity of law enforcers, enforce firmer sanctions, and improve the regulation of Hajj and Umrah fund management. Thus, this study contributes to the improvement of the legal system and management of Hajj and Umrah funds in Indonesia.

Abstract

This research aims to analyse the role of the Witness and Victim Protection Agency (LPSK) in providing legal protection to victims of sexual violence in Indonesia. This research uses normative juridical methodology with a qualitative approach to evaluate the effectiveness of protection provided by LPSK in the context of Indonesian law. Based on the findings, the legal protection provided by LPSK is based on clear regulations, including Law No. 13/2006 on Witness and Victim Protection and Law No. 12/2022 on the Elimination of Sexual Violence. However, the effectiveness of the protection is still affected by factors such as limited resources of LPSK, social stigma against victims, and low legal awareness in the community. Therefore, this study recommends increasing the capacity of LPSK, legal counselling, and eliminating social stigma to increase the effectiveness of protection for victims of sexual violence.

Abstract

This research aims to analyse the legal certainty in the application of Value Added Tax (VAT) on e-commerce transactions in Indonesia. Using a normative juridical approach with a qualitative descriptive method, this research evaluates the implementation of applicable tax regulations, particularly the Minister of Finance Regulation Number 60/PMK.03/2022, which regulates VAT obligations for e-commerce businesses. The results show that despite clear regulations, the implementation of VAT in the e-commerce sector still faces obstacles, such as the lack of understanding of business actors, especially MSMEs, regarding their tax obligations. In addition, challenges arise from unclear rules regarding cross-border transactions as well as entrepreneurs who are not registered as Taxable Entrepreneurs (PKP). Therefore, this study recommends the need for strengthening regulations, more intensive socialisation to business actors, and increased supervision so that tax compliance can be maximised, so that the e-commerce sector can make a greater contribution to the Indonesian economy.

Abstract

This research aims to analyse the mechanism of proof of money laundering crime (TPPU) originating from the proceeds of corruption in Indonesia. One of the main focuses in this research is the application of the reversal of the burden of proof system stipulated in Law Number 8 Year 2010 on the Prevention and Eradication of Money Laundering Crimes (Anti-Money Laundering Law). This research hypothesis argues that the reversal of the burden of proof system can be an effective instrument in proving money laundering crimes originating from corruption, by utilising the role of financial institutions, transaction analysis by PPATK, and synergy between law enforcement officials. The research method used is juridical-normative with an analytical descriptive approach, which examines the applicable legislation, as well as the practice of its application in the Indonesian judicial system. The results show that despite technical obstacles in proof, such as difficulties in tracing the origin of laundered assets, the application of reversal of the burden of proof provides significant advantages for law enforcement. It is hoped that the application of strict sanctions against ML offenders can provide a deterrent effect while increasing the effectiveness of corruption eradication in Indonesia.

Abstract

With the growing popularity of online games in Indonesia, numerous players purchase virtual items within these games. This study focuses on two primary objectives. First, it seeks to analyze the legal protection available to online game players in Indonesia against the unilateral shutdown of game servers by Electronic System Providers, as regulated under Article 1694 of the Civil Code. If an online game server is closed unilaterally, virtual items owned by players, considered akin to goods, may be affected. Second, the study aims to explore solutions for addressing losses incurred by players due to such server closures. Utilizing a normative juridical approach with an emphasis on Article 1694 of the Civil Code, the research relies primarily on library-based data collection techniques. The findings indicate that online game players, as rightful owners of virtual items, are entitled to the full restitution of their items. Virtual items, though non-physical, are treated similarly to tangible goods. In cases where these items are deleted or lost due to server shutdowns, Electronic System Providers bear responsibility for returning the affected players’ virtual goods. Dispute resolution can be pursued through litigation or non-litigation methods, including consultation, conciliation, mediation, and negotiation.
