Abstract

Akad Ijarah Muntahiyah Bi al-Tamlik (IMBT) is a lease agreement that ends with the transfer of property rights by way of sale and purchase or grants at the end of the lease period. The ijarah contract and the sale and purchase contract are connected with a promise. Based on the DSN-MUI fatwa number: 27/DSN-MUI/III/2002 concerning IMBT, the promise (wa'ad) is non-binding, thus causing legal uncertainty for LKS and customers. Then the DSN-MUI issued a fatwa number: 85/DSN-MUI/XII/2012. Then the promise (wa'ad) in the IMBT contract became binding (mulzim). Of course, this has an impact on the occurrence of ta'alluq risk and has the potential to meet conditional buying and selling. This research uses normative juridical methods with a statutory and conceptual approach. The results of the analysis show that the legal status of fulfilling promises (wa'ad) in every Sharia transaction and business is binding (mulzim) and has caused many benefits for the Islamic economic community, such as legal certainty and guaranteed contract continuity, especially in the IMBT contract. Viewed from the point of view of Indonesian Civil Law, IMBT contracts or contracts are included in non-named agreements. This is contained in Article 1319, which arises from the principle of freedom of contract (Article 1338), and IMBT contracts also meet the requirements of valid agreements as contained in Article 1320 of the Civil Code and the legal consequences caused by IMBT contracts, namely rights and obligations.

The results of this study indicate that waqf can be a solution in responding to the challenges of economic globalization by using waqf for social security programs, or a profitable investment for poverty eradication programs. And the solution to the globalization of education is to use waqf funds to support the operations of educational institutions, as well as provide facilities and scholarships for students so that they can continue to experience education without being burdened with costs. And finally, the solution in responding to the challenges of globalization is to make the status of land as a waqf so that it is not easily converted into industrial land that causes climate damage.

Abstract

This paper aims to describe the development of Islamic psychology studies in Indonesia and find an epistemological framework developed by Islamic psychology experts in Indonesia. By utilizing the discourse analysis approach, this study has succeeded in showing that the development of Islamic Psychology studies in Indonesia can be said to be quite dynamic and productive. The reviewers and pioneers of discourse on Islamic Psychology, with their differing backgrounds, have sought to lay the epistemological foundation for the development of Islamic Psychology in the country. The development of Islamic psychology has been pursued through two patterns, namely idealistic patterns and pragmatic (realistic) patterns. Epistemologically, the discourse of Islamic Psychology in Indonesia is characterized by three approaches to understanding the human soul, namely the bayani approach; those with thematic interpretations, speculative philosophical-rational approaches, and a sufistic (irfani) approach that look more closely at the problem of the human soul are based on the spiritual experience of Sufism experts. The three approaches are taken to be able to understand the human soul as a whole. Departing from these three approaches, Islamic Psychology experts in Indonesia then succeeded in formulating various methods that can be taken to produce Islamic Psychology studies that are expected to answer the challenges of Muslims in Indonesia. However, the study of Islamic psychology in Indonesia tends to still be dominated by the epistemological style of bayani and irfani. The burhani approach, even though it has been used, but still tends to attempt to formulate philosophical concepts and soar. This approach has not yet been translated into empirical and applicative research methods (tajribi).

Abstract

Economic growth has contracted due to the COVID-19 pandemic. Based on the history of previous economic and financial crises, the banking sector is one of the most sensitive sectors during a crisis. Investors consider these conditions for their investment decisions. This paper aims to find the factors that determine the stock price of Islamic banking on three observation variables: profit, debt equity ratio (DER), and cash flow from operating (CFO). This study used a quantitative approach with secondary data sources from financial statements and company stock prices. The sample was selected purposively from Islamic banking stocks listed on the Indonesian Sharia Stock Index (ISSI). Data analysis used panel data regression using the E-Views 10 application. The findings of this study are that earnings and DER significantly determine the share price of Islamic banking based on a partial test. Profit has a positive effect, while DER has a negative impact. These findings illustrate that expectations for investment in Islamic banking stocks remained stable during the pandemic. The company's fundamental factors determine the demand for Islamic bank shares.

Abstract

This study aims to determine the relationship between parenting patterns and sexual abuse behavior in children in Tegal Regency, Central Java Province. To answer these problems, this paper uses a case approach method, as well as a conceptual approach. The results of this study can be concluded that parenting is a capital for children to reach the maturity process. Family is the first social environment that individuals encounter since they were born into the world. The first family environment is the father, mother and the individual himself. The relationship between the individual and his parents is a reciprocal relationship where there is interaction in it. So it is proper as a good parent to be able to apply parenting that will form a good child's personality starting from an early age. The influence of increasingly sophisticated digital technology also has an impact on sexual violence against children, so parents are also required to monitor addictive behavior related to digital technology and prevent negative impacts due to long-term use of digital devices. Suggestions for parents to need to determine the right parenting pattern and improve the quality and quantity of communication with children and have a good trusting relationship so that the problem of sexual abuse behavior in children can be overcome and avoided.

Abstract

This study aims to analyze the implementation of Good Amil Governance (GAG) in zakat management organizations (OPZ) and the efficiency of zakat distribution in Indonesia. This study uses a qualitative method with a literature study approach through secondary data tracing in the annual reports of zakat management organizations, journals, books and the official website of OPZ in Indonesia. The results showed that most of the OPZ had implemented the GAG principles thoroughly. In addition, the problem of inefficiency in the distribution of zakat in Indonesia has been overcome by the National Amil Zakat Agency (BAZNAS) through the issuance of the decision of the chairman of BAZNAS No. 33 of 2019 through identification of the Mustahik Identification Number (NIM). This research is expected to have implications for improving the application of governance and coordination of zakat distribution by OPZ in Indonesia.
