Abstract

Transparency is the principle to open up to the right of the people to obtain correct, honest and non-discriminatory information about governance. Transparency has an important position in implementing "Good Governance", because transparency is a way to realize accountability, and encourage the effectiveness of public participation in the process of organizing the state. The Supreme Court  is obligated to provide complete on the website of the court, either the first level, the appeal or the Supreme Court.The Yogyakarta District Court is the General Court, Industrial Relations Court Corruption Act with and Class IA. The Yogyakarta District Court has a website whose content has been fulfilled under the Supreme Court Decree No. 144 / KMA / SK / VIII / 2007 concerning Information Disclosure in Court and Decree of the Chief Justice of the Supreme Court Number: 1-144 / KMA / SK / I / 2011 But in case the news has not been updated (updated) with the latest news, the latest news is the news one month ago. Abstract

Based on administrative court act, the administrative court is only authorized to hear administrative dispute between individuals or private legal entities against government bodies or official not covering administrative disputes between government bodies or official. Settlement of disputes between agencies or government officials carried out internally with a tierred pattern that ends with the President’s decision. Three reasons for the basis of the idea of providing administrative court competencies to try disputes between government agencies or officials. First, the case law of administrative court in administrative cases between government agencies or officials. Second, the philosophy of the existence of judicial power as in institution to resolve dispute that occur within a state. Third, the right of public to know the process of government management and public decision making, including in the event of a dispute and how to resolve it. This public right is based on the principle of openness and the government works in a public space according to public law. Settlement the disputes in the administrative court with the principle of open trial to the public is a manifestation of the principle of openness. The administrative court of Thailand with the competence to resolve administrative dispute between government agencies or officials can be reference for the reform of Indonesia adminsitative court competencies in the future. Keywords: dispute, government agency or official, administrative court

Abstract

Indonesia memang sudah menjadi negara hukum dan menjunjung tinggi penegekan hukum dan HAM di seluruh wilayah hukumnya. Semua peraturan sudah dibuat sedemikian rupa demi adanya kepastian hukum dan kesejahteraan bagi warga negara Indonesia. Salah Satu kasus yang sering terjadi di Indonesia adalah kasus tindak pidana tentang kesusilaan. Adanya budaya tidak tertulis yang membuat si pelaku di cap sebagai orang jahat oleh masyarakat adalah sebuah kekeliruan yang turun menurun terjadi di Indonesia, padahal sebenarnya pelaku yang kemudian ditetapkan sebagai tersangka oleh pihak berwenang belum tentu sepenuhnya benar sebelum adanya putusan pengadilan.  Tersangka memiliki hak-hak yang sudah diatur oleh UU dan harus dihormati namun kenyataan tersebut masih susah ditemukan di Indonesia karena masyarakat yang tidak melek hukum, maka perlu adanya upaya pemerintah supaya menjadikan masyarakat lebih melek hukum dan mewujudkan kepastian hukum di negara kita tercinta Indonesia.Kata Kunci : Tindak Pidana Kesusilaan, Hak Tersangka

Abstract

Indonesia has a strategic position in international life, both from the geographical aspect and the potential of natural resources and human resources, resulting in increased traffic flow of people into and out of Indonesia. Foreigners who come to Indonesia and have an immigration permit, can only stay in Indonesia for the time specified in the immigration permit. If a foreigner comes to Indonesia, his immigration permit expires and is still within the territory of Indonesia beyond no more than 60 (sixty) days from the immigration permit granted, is subject to a load, while Foreigners who come to Indonesia, the immigration permit expires and is still within the territory of Indonesia beyond 60 (sixty) days from the deadline then the foreigner will be subject to criminal Article 124 of the Immigration Act Number 6 of 2011, with a maximum imprisonment of 2 (two) years or a maximum fine of Rp. 25,000,000- (twenty five million rupiah). The existence of a foreigner in the territory of Indonesia that exceeds the time limit for a residence permit, which is also known in the immigration field as overstay.Services and supervision in the immigration sector are carried out based on the principle of selective policy. Based on this principle, only foreigners can benefit the welfare of the people, nation and State of the Republic of Indonesia and do not endanger security and order and are not hostile towards the people, nation and the Unitary State of the Republic of Indonesia based on Pancasila and the 1945 Constitution which is permitted in and out of Indonesia.Sanctions imposed on foreign nationals who commit immigration violations are Immigration sanctions and law enforcement through Administrative sanctions and Criminal sanctions with the Criminal Justice System. Abstract

Sugarcane burning activities carried out by the company have been included in the category of environmental pollution as stipulated in the Environmental Law mentioned above. This is indicated by the entry or inclusion of substances, energy, and / or other components into the environment by human activities, so that the quality of the environment becomes down to a certain level which causes the environment to not function properly. The smoke caused by the burning is very disturbing, both directly / indirectly can pollute and / or damage the living environment of the surrounding residents. The purpose of this study was to find out, describe, and analyze how the implementation of legal protection for people as victims of burning land at the time of sugarcane harvest in Central Lampung and to formulate the concept of future legal protection for the community as victims of land burning at sugarcane harvest in Lampung Middle. This type of research used is empirical juridical. Research results The implementation of legal protection for communities as victims of environmental pollution due to the burning of sugarcane land at the time of harvest in Central Lampung did not work properly because there was no legal protection and compensation at all for the community around the sugar cane plantation. improve legislation that is considered to have weaknesses or does not fulfill the sense of justice of the community. Abstract

The number of pornography in Indonesia increase from year to year. Data from National Commission for Child Protection (KPAI) in 2016 there are 587 cases of pornography crimes. Law No. 44 of 2008 concerning pornography (pornography act), Law No. 11 of 2008 concerning Electronic Information and Technology (ITE Act) not maximally ensnare the perpetrators of crime. The victims of this crime are also widespread in all circles even to children. In fact, in many cases the position of the perpetrator is also a victim. This paper will examine two important points: how cyber porn reviews in psychiatric studies, and how to protect victims of cyber porn crime in Indonesia. This paper highlights that the crime of cyber porn in legislation in Indonesia still has many weaknesses, especially related between victim and perpetrator of this crime. Furthermore, this paper asserts that the importance of victim protection for cyber porn in Indonesia. Keywords :cyber porn, victimology, victim and pornography

Abstract

The authority of the Judicial Commission as an external supervisory body designed in the 1945 Constitution does not provide a constitutional basis that is ideal enough to play a role in the performance and behavior of judges. This was strengthened after the issuance of the Constitutional Court Decision No. 005 / PUU-VI / 2006 which states that it is unconstitutional and does not have the legal force to bind norms concerning supervision of constitutional judges because they are considered to cause legal uncertainty (rechtsonzekerheid). Based on these problems, this paper is intended to examine aspects of the authority that the KY has in a functional-constitutional manner. the authority of the Judicial Commission needs to be constitutionally strengthened through constitutional amendments so as not to be easily swayed by other legal products under it. In addition to the continued constitution amendment, it is necessary to provide executive authority to the KY through improving the law so that in exercising its authority effectively. This is intended so that the Judicial Commission can exercise its authority independently as long as it is based on constitutional law and has strong and binding legal force.Keywords : supervision of judges, constitutional amendments, judicial power

Abstract

Kekerasan dalam rumah tangga merupakan tindak pidana yang telah mengalami metamorfosa status di ranah hukum pidana nasional, jika sebelumnya hanya dianggap sebagai tindak pidana umum yaitu penganiayaan dalam KUHP yang tidak memiliki kekhususan subyek, saat ini telah mengalami spesifikasi dimulai dengan bergantinya jenis tindak pidana yang diatur khusus dalam Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga yang otomatis menjadi "lex specialis derogat legi generali", alasan utama dalam perubahan dasar hukum tindak pidana KDRT dapat dikaji lebih dalam dengan kajian viktimologi, kajian yang memandang sebuah kejadian hukum dari sudut pandang korban, baik dari kepentingan korban (mencegah terjadinya viktimisasi) maupun sebagai upaya pencegahan terjadinya tindak pidana selanjutnya di masa depan. Hasil dari tinjauan viktimologi mengenai alasan utama terjadinya perubahan dasar hukum tindak pidana KDRT adalah tidak terakomodirnya kepentingan-kepentingan yang bersifat privat karena tindak pidana ini berada pada ranah domestic violence. Seiring penegakan hukum baru dalam perkara KDRT, masih banyak ditemui kendala-kendala yang dihadapi terutama dari pihak korban perempuan (istri), baik saat sebelum melaporkan kasus KDRTnya sampai setelah proses hukum KDRTnya berakhir, kendala yang dihadapi saat ini masih berkutat pada masalah tidak terakomodirnya kepentingan-kepentingan privat terutama dari pihak korban dan pelaku yang memiliki ikatan keluarga, sehingga aturan-aturan yang dimiliki saat ini yang mengatur dan mengakomodir kepentingan korban KDRT (UU PKRDT dan UU No 13 Tahun 2006 tentang Perlindungan Saksi dan Korban) masih membutuhkan pembenahan dalam rancangannya, sehingga tujuan dari penyelesaian perkara tindak pidana kekerasan dalam rumah tangga dapat berakhir tanpa menghancurkan salah satu pihak maupun keduanya (korban-pelaku-dan statusnya sebagai suami istri).

Abstract

Geographical indications is a trade name associated on the packaging of the product function shows the origin of a product, where the place of origin of the product quality hinting strongly influenced by place of origin so that the product is unique value. Small and medium industry Sangiran is one of a small industrial area of Sragen which has a special quality because it is affected by natural factors, human and combinations that are able to create products unique and special characters. The prospect of the registration of a geographical indication on the small and medium industry handicraft product  Sangiran Sragen is very promising because small and medium industry totaled sixty scattered in Sragen variations craft products products generated. For that, the indispensable role of Government in the implementation of the registration of a geographical indication on the small and medium industry handicraft products Sangiran Sragen to get legal protection and has a reputation that can enhance competitiveness of the region Sragen. Keywords:  Geographical Indications, Small Medium Industry, Legal Protection, Sangiran.
