Abstract

This paper aims to review the methodology of classical hadith syariah. For this reason, the question of how the classical methodology of hadith is being pursued in this paper. The method used is qualitative with a literature study approach. The results obtained are that the Islamic scientific tradition began at the time of the Prophet (PBUH), in writing, then after entering into the time of friends then the Islamic scientific tradition was held in written form. It is also the beginning of the emergence of the tradition of hadith. Hadith shari'ah in oral form occurred during the time of the Prophet PBUH, while shari'ah hadith in written form occurred during the time of companions. The difference in scientific traditions, since the time of the Prophet, until friends also influence the use of the methodology of the tradition of tradition, even along with the development of the era of science and also the methodology in the tradition of tradition. The method used by hadith scholars in giving tradition is ijmali, which is a method that explains the meaning in general and concise. Even so a review of him in the present is very well done, especially for the development of scientific knowledge related to the tradition.

Abstract

This study offers Muhammad Abduh's ideas about awakening and advancing the backwardness of Islamic social communities which, left behind from western civilization from the perspective of the Koran. Abduh is a contemporary commentator and also a reformer of Islamic thought in the 19th century AD. This research is a library research using the maudhu'i interpretation research model. Based on Muhammad Abduh's interpretation of the verses of social community, it was found: 1). The concept of ummatan wasathan (middle society) is the best profile of society that should be applied by Muslims; 2). Ummah wahidah is an affirmation that humans are social creatures to live together and need each other; 3). Khairu ummah, is a guide to become the best and superior society by doing: al-amru bi al-ma''ruf, al-nahi 'an al-munkar, believing in Allah SWT and sticking to Islamic law; 4). The progress and decline of the Islamic community are greatly influenced by the efforts and awareness of the Islamic community to rise up and change their own destiny; and 5). Islam is present as the religion of rahmatan lil'alamin shalihun li kulli era wa al-makan. Several factors cause the backwardness and decline of the Islamic social community in various fields of life from other communities: 1). Abandoning the teachings of the Qur'an and Sunnah; 2). There is no unity and integrity of the people; and 3). Widespread understanding of jumud and taklid in religious matters.Penelitian ini menawarkan ide pemikiran Muhammad Abduh dalam membangkitkan dan memajukan keterbelakangan komunitas sosial masyarakat Islam yang jauh tertinggal dari peradaban Barat perspektif al-Quran. Abduh adalah seorang mufassir kontemporer dan juga seorang tokoh pembaharu kebangkitan pemikiran dalam Islam abad ke 19 M. Penelitian ini merupakan penelitian library research dengan menggunakan model penelitian tafsir maudhu’i. Berdasarkan penafsiran Muhammad Abduh tentang ayat-ayat komunitas sosial, ditemukan: 1). Konsep ummatan wasathan (masyarakat pertengahan) merupakan profil masyarakat terbaik yang seharusnya diterapkan oleh umat Islam; 2). Ummah wahidah merupakan penegasan bahwa manusia adalah makhluk sosial untuk hidup bersama dan saling membutuhkan; 3). Khairu ummah, merupakan tuntunan untuk menjadi masyarakat terbaik dan unggul dengan melakukan: al-amru bi al-ma’’ruf, al-nahi ‘an al-munkar, beriman kepada Allah SWT dan berpegang teguh dengan syari’at Islam; 4). Kemajuan dan kemunduran masyarakat Islam sangat dipengaruhi oleh usaha dan kesadaran masyarakat Islam untuk bangkit dan merubah nasib sendiri; dan 5). Islam hadir sebagai agama rahmatan lil’alamin shalihun li kulli zaman wa al-makan. Beberapa faktor penyebab keterbelakangan dan kemunduran komunitas sosial Islam dalam berbagai bidang kehidupan dari komunitas lain: 1). Meninggalkan ajaran al-Qur’an dan Sunnah; 2). Tidak terjalinnya persatuan dan kesatuan umat; dan 3). Menyebarluasnya paham jumud dan taklid dalam persoalan agama.

Abstract

Leadership of madrasah headmasters and teacher professionalism are the two things that determine the successful of implementation of school-based management. This study aims at knowing the effect of headmaster transformational leadership and professionalism of teachers either individually or collectively toward the successful of the implementation of School Based Management in pesantren in Agam District. This research is done by using quantitative approach. The population of this study is all teachers of Pesantren Agam Regency, 896 people. The samples were selected by Area sampling technique and Simple random sampling, as many as 227 teachers. Data analysis using correlation and regression techniques with the help of SPSS program. The results showed that the transformational leadership of madrasah headmasters and professionalism of teachers both individually and collectively have the affect toward the implementation of School Based Management in pesantren in Kabupaten Agam. Kepemimpinan kepala madrasah dan profesionalisme guru merupakan dua hal yang menentukan keberhasilan pelaksanaan manajemen berbasis sekolah. Penelitian ini bertujuan untuk mengetahui pengaruh kepemimpinan transformasional kepala madrasah dan profesionalisme guru baik secara sendiri-sendiri maupun secara bersama terhadap keberhasilan pelaksanaan Manajemen Berbasis Sekolah pada pesantren di Kabupaten Agam. Penelitian ini dilakukan dengan menggunakan pendekatan kuantitatif. Populasi penelitian ini adalah seluruh guru pesantren Kabupaten Agam berjumlah 896 orang. Sampel dipilih dengan teknik Area sampling dan Simple random sampling, sebanyak 227 orang guru. Analisis data menggunakan teknik korelasi dan regresi dengan bantuan program SPSS. Hasil Penelitian menunjukkan bahwa kepemimpinan transformasional kepala madrasah dan profesionalisme guru baik secara sendiri-sendiri maupun secara bersama berpengaruh terhadap pelaksanaan Manajemen Berbasis Sekolah pada pesantren di Kabupaten Agam.

Abstract

This study intends to identify the Islamic legal approach in determining the fatwa of the Indonesian Ulema Council Number 24 of 2017 concerning Law and Social Interaction in Social Media. This literature research is a type of philosophical normative research using an Islamic legal system approach. The results of the study conclude that the determination of the MUI fatwa on laws and guidelines for social interaction through social media uses a holistic approach to Islamic law. This major conclusion can be seen from various characteristics which is: First, the overall character (wholeness) and multidimensionality in the form of the use of universal textual arguments ('aam). Second, the character of purpose in the form of the use of various fiqh rules that emphasize the realization of benefit as the basis as well as the orientation of legal determination. Third, the cognitive character is the use of several classical fiqh ideas, but they are not used as independent arguments, but are combined with various other perspectives that are part of the fatwa arguments. Fourth, the character of openness in the form of an elaboration of the Islamic legal approach with the opinions of experts regarding the use of social media Penelitian ini bermaksud untuk mengidentifikasi pendekatan hukum Islam dalam penetapan fatwa Majelis Ulama Indonesia (MUI) Nomor 24 Tahun 2017 tentang Hukum dan Pedoman Bermuamalah Melalui Media Sosial. Penelitian pustaka ini termasuk jenis penelitian normatif filosofis dengan menggunakan pendekatan sistem hukum Islam. Hasil penelitian menyimpulkan bahwa penetapan fatwa MUI atas pedoman interaksi sosial melalui media social menggunakan pendekatan hukum Islam yang bersifat holistik. Kesimpulan besar inidapat dilihat dari berbagai karakteristik sebagai berikut: Pertama, karakter menyeluruh (wholeness) dan multidimensi dalam penggunaan dalil-dalil nas yang bersifat universal (‘aam). Kedua, karakter kebermaksudan (purpose) berupa penggunaan berbagai kaidah fikih yang menekankan kemaslahatan sebagai dasar penetapanhukum. Ketiga, karakter kognitif berupa penggunaan beberapa pemikiran fikih klasik, namun tidak dijadikan sebagai dalil independen, melainkan dipadu dengan berbagai perspektif lain yang menjadi bagian dalil fatwa. Keempat, karakter keterbukaan dalam elaborasi pendekatan hukum Islam dengan pendapat para ahli terkait penggunaan media sosial.

Abstract

Kekuasaan Kehakiman dalam konteks negara Indonesia adalah sebagai penyelenggara peradilan guna menegakan hukum dan keadilan berdasarkan Pancasila. Salah satu agenda penting di hadapi di masa depan penegakan hukum di Indonesia, dan hal utama dalam penegakan hukum adalah masalah kekuasaan kehakiman yang merdeka. Kekuasaan kehakiman tidak mungkin dapat terlepas dari konstitusi yang berlaku di Indonesia dimasa reformasi adalah masalah kekuasaan kehakiman yang merdeka sesuai ketetapan UUD 1945 . Permasalahan Kedudukan Kekuasaan Kehakiman menurut Undang-Undang Dasar 1945, Fungsi dan Wewenang Kekuasaan Kehakiman menurut UUD 1945?, berdasarkan metode penelitian hukum empiris dan penelitian hukum normatif empiris. Kekuasaan Kehakiman menurut konstitusi adalah mewujudkan cita-cita kemerdekaan Republik Indonesia yaitu: Terwujudnya masyarakat yang adil dan makmur melalui jalur hukum. Reformasi di bidang kekuasaan kehakiman ditujuhkan untuk pertama; menjadikan kekuasaan kehakiman sebagai sebuah institusi yang independen, kedua; mengembalikan fungsi yang hakiki dari kekuasaan kehakiman,untuk mewujudkan keadilan dan kepastian hukum,ketiga; menjalankan fungsi check and balances bagi institusi kenegaraan lainnya, keempat; mendoromg dan memfasilitasi serta menegakkan prinsip-prinsip negara hukum yang demokratis guna mewujudkan kedaulatan rakyat dan kelima ; melindungi martabat kemanusiaan dalam bentuk yang paling kongkrit.kemudian Berdasarkan Pasal 24 Ayat (2) Perubahan Ketiga UUD 1945, maka yang diberi wewenang oleh UUD 1945 untuk melakukan kekuasaan kehakiman adalah Mahkamah Agung beserta badan-badan peradilan di bawahnya, dan oleh Mahkamah Konstitusi. Abstract

The focus of this study is to determine the psychological factors that influence the behavior of Muslim investors in the capital market. Besides, it is to find out the psychological factors of Muslim investors can be used to predict the type of investment (stocks, mutual funds, bonds) chosen by Muslim investors. This research is exploratory. This study tries to provide an overview of the influence of psychological factors on investment choices and the behavior of Muslim investors in the capital market. To prove the hypothesis that has been made, a linear regression analysis technique is used which is carried out on the results of the questionnaire that has been filled by the respondents. Linear regression analysis using SPSS version 16.0. The independent variables tested were psychological factors which included; Overconfidence; Data Mining; Status Quo; Social Interaction; Emotion; Mental Accounting; Representativeness; Familiarity; Considering The Past; Fear and Greed; Self Control; and Loss Aversion. The dependent variable tested is Muslim investor behavior which includes; risk seeker (likes risk) and risk averter (fear of risk). Overall, R values of 0.653 and R square (R2) of 0.426 were obtained. the coefficient of determination of 13.78% states that the type of investment influenced by psychological factors is only 13.78% and the capital is 86.22% influenced by other factors.

Abstract

This study explore the concept of Kyai Sholeh Darat's makrifat in Syar al-Ḥikam to bridge the general public so that they can know makrifat, and can be reached by today's society. This research method is qualitative research. While the data extracted comes from library information or commonly referred to as a literature study to obtain some data and information. The source of the data was taken from the book, namely the book Syarh al-Ḥikam by Kyai Sholeh Darat, while the supporting data were taken from other sources such as analyzing books, the internet, and other information related to the title of this study. The results of this study indicate that the concept of makrifat put forward by Kyai Sholeh Darat can cross now between groups so that it can be reached in this condition. A person who is wise today is someone who remembers Allah and needs Him so that he can help in everything that is faced, be it with technology, or other activities related to the day, both in social, cultural, economic, and political relations.Studi ini membahas tentang  konsep makrifat Kyai Sholeh Darat dalam Syarḥ al-Ḥikam untuk menjembatani masyarakat awam agar mampu mengetahui makrifat, dan dapat dipahami oleh masyarakat sekarang ini. Metode penelitian ini merupakan penelitian kualitatif. Sedangkan data yang digali berasal dari informasi pustaka atau biasa disebut dengan studi pustaka (library research) untuk mendapatkan beberapa data dan informasi. Sumber data diambil dari buku utama yaitu kitab Syarh al-Ḥikam karya Kyai Sholeh Darat, sedangkan data pendukungnya diambil dari sumber-sumber yang lain seperti menganalisa buku-buku, internet dan informasi lainya yang berhubungan dengan judul penelitian ini. Hasil penelitian ini menunjukan bahwa konsep makrifat yang dikemukakan oleh Kyai Sholeh Darat yakni ini mampu melintasi antar kalangan, sehingga dipahami dalam kondisi sekarang ini. Seorang yang makrifat pada zaman sekarang ini adalah sesorang yang senantiasa mengingat Allah dan butuh kepada-Nya, sehingga mampu mengambil kebaikan dalam setiap apa yang dihadapi, baik itu dengan teknologi, maupun aktifitas lain yang berkaitan dengan kehidupan sehari-hari, baik dalam hubungan sosial, budaya, ekonomi dan politik.

Abstract

Rasulullah, Muhammad SAW, succeeded in changing the uncivilized society into the civilized one as well as the Jahiliyah society into the educated one. The key to the success was his appropriate teaching concept and his sincerity. There were some representative and dominant educational approaches and methods that were developed by Rasulullah, Muhammad SAW, in teaching his Shahabah as adults. One approach that he used was the philosophycal approach. Meanwhile, the methods that he used were the exemplary and affectionate methods. Rasulullah, Muhammad SAW telah berhasil membina masyarakat dari masyarakat yang paling biadab menjadi masyarakat yang paling beradab, dari masyarakat jahiliyah menjadi masyarakat yang terdidik. Kunci keberhasilan pendidikan yang beliau lakukan adalah: konsep ajaran yang beliau sampaikan adalah ajaran yang benar dan tepat, kesungguhan dan keikhlasan beliau dalam melaksanakan tugas. Ada beberapa pendekatan dan metode pendidikan yang dipandang representatif dan dominan yang dikembangkan oleh Rasulullah SAW dalam mendidik para sahabat sebagai orang dewasa. Pendekatan yang digunakan salah satunya adalah pendekatan filosofis, sedang metode yang digunakan beliau diantaranya metode keteladanan, metode lemah lembut dan kasih sayang.

Abstract

The discussion of marriage guardian is one of the pillars that must exist in a marriage, illegitimate marriage without the presence of a guardian. The Compilation of Islamic Law (KHI) as the law governing Muslim marriages in Indonesia requires guardians as a legal condition of marriage (articles 14 and 19). However, on the other hand, one of the Muslim intellectuals, Siti Musdah Mulia, stated an opposing idea, that guardians are not included in the pillars of marriage. The results showed that the Musdah Mulia thinking generally led to the typology of liberal Islamic thought. Specifically on the issue of the absence of guardians in marriage, Musdah's opinions are not too contrary to the text; Musdah's attention to gender places a substantial portion in establishing the law; and the Musdah idea is not only channeled in the form of thought alone but also poured into the form of a legal regulation draft (CLD-KHI) so that the law applies comprehensively and can be applied clearly and can achieve justice and social benefit in the midst of the people. Then based on this, a specific typology of Musdah Mulia's thought was obtained about the absence of guardians in the marriage harmony leading to progressive Islamic thought. And Musdah Mulia's ideas about the lack of marriage guardians have sufficient relevance to the renewal of Islamic family law in Indonesia.

Abstract

The research is focused on finding the social, geographical, and religious context of the sawéran tradition in the Muslim community of Pasirtamiang, the dynamics of the message narrative in the sawéran lyrics, and the Islamic values and messages contained therein. This focus is important so that the dialectic between religion and culture, which is sometimes seen as a form of syncretism that endangers religion's existence, can be clarified. In this writing, the Muslim community of Pasirtamiang shows a fairly representative model of religious and cultural dialectics so that their people can preserve their cultural heritage without losing their Islamic identity. The research used explanative methods to find causal relationships between local wisdom facts identified by participant observation and in-depth interviews. The results showed that the socio-geographic and religious factors of the Pasirtamiang community also influenced the development process of the sawéran tradition. The format and substance of the sawéran content have transformed, the lyrics are simpler, and the Islamic values are emphasized, both technically and substantially. Islamic values in the lyrics sawéran are classified into divine, spiritual, and moral values. Overall, the content of sawéran's lyrics is an integral part of the Islamic message.Penelitian difokuskan untuk menemukan konteks sosial, geografis, dan religius tradisi sawéran dalam masyarakat muslim Pasirtamiang, dinamika narasi pesan dalam lirik saweran, serta nilai dan pesan Islam yang terkandung di dalamnya. Fokus ini penting supaya dialektika antara agama dan budaya, yang terkadang ditengarai sebagai bentuk sinkretisme yang membahayakan eksistensi agama, dapat diklarifikasi. Dalam tulisan ini, masyarakat muslim Pasirtamiang menunjukkan model dialektika agama dan budaya yang cukup representatif sehingga masyarakatnya dapat melestarikan warisan budaya tanpa kehilangan identitas keislamannya. Penelitian ini menggunakan metode eksplanatif untuk menemukan hubungan kausalitas antara fakta kearifan lokal yang diidentifikasi melalui observasi partisipan dan wawancara mendalam. Hasil penelitian menunjukkan bahwa faktor sosial-geografis dan keagamaan masyarakat Pasirtamiang turut mempengaruhi proses perkembangan tradisi sawéran. Format dan substansi isi sawéran telah mengalami transformasi, penuturan liriknya lebih sederhana dan semakin menegaskan nilai-nilai keislaman, baik secara teknis maupun substansial. Nilai-nilai Islam dalam lirik sawéran diklasifikasikan menjadi nilai ketuhanan, spiritual, dan moral. Secara keseluruhan, isi lirik sawéran merupakan bagian tak terpisahkan dari pesan Islam.
