Abstract

Penelitian ini bertujuan menganalisis pengaturan perjanjian di bawah tangan dalam perspektif hukum positif Indonesia serta proses pembuktian terkait keabsahan perjanjian tersebut. Metode yang digunakan adalah penelitian hukum normatif dengan mengkaji peraturan perundang-undangan dan literatur terkait. Hasil penelitian menunjukkan bahwa meskipun ketentuan hukum tentang perjanjian di bawah tangan cukup mendukung keberlakuan dan kekuatan mengikatnya, terdapat kendala dalam aspek pembuktian. Keabsahan perjanjian ini sangat bergantung pada pengakuan pihak-pihak yang terlibat. Jika terjadi penyangkalan, beban pembuktian beralih kepada pihak yang mengklaim keabsahan perjanjian, yang harus menghadirkan bukti tambahan, seperti saksi atau dokumen lain. Penelitian ini juga mendapati bahwa penggunaan tanda tangan elektronik dalam perjanjian di bawah tangan dapat menjadi alternatif, meskipun masih menghadapi tantangan terkait keabsahannya dalam praktik hukum. Oleh karena itu, diperlukan klarifikasi lebih lanjut dalam ketentuan hukum mengenai prosedur pembuktian untuk menciptakan kepastian hukum yang lebih baik.

Abstract

Food is one of the primary (primary) needs of humans. Food shortages can occur for various reasons, including natural and human-caused factors. For example, hoarding of food (rice) by unscrupulous traders. The Food Task Force Team of the Bali Regional Police's Special Criminal Investigation Directorate carries out routine activities such as market patrols and inspections of rice storage warehouses to curb hoarding by unscrupulous traders. Article 133 of Law Number 18 of 2012 concerning Food regulates the criminal act of hoarding or storing staple foods by food businesses. This study uses an empirical legal research method, examining the legal behavior of the community because it emphasizes field data and existing problems within the community as research subjects. The conclusion of this study is that the effectiveness of eradicating rice hoarding and violating food sanitation standards in the Bali Regional Police jurisdiction is not yet fully effective. This is due to limited monitoring facilities and infrastructure, the vast food distribution area, and low legal awareness among business actors.

Abstract

Corruption crimes which requires an active role of the Public Prosecutor’s Office not only as a public prosecutor but also as an investigator in law enforcement. The research problems addressed in this study are how the mechanism and procedures of corruption investigation are implemented at the Denpasar District Prosecutor’s Office and how the role of the Prosecutor’s Office is carried out in such investigations. This research uses empirical legal research with data collection techniques through direct interviews with prosecutors of the Special Crimes Division at the Denpasar District Prosecutor’s Office and supported by literature studies on relevant laws and legal references. The results of the research indicate that the mechanism and procedures for investigating corruption crimes at the Denpasar District Prosecutor’s Office have been implemented in accordance with criminal procedural law and internal guidelines of the Prosecutor’s Office, starting from the investigation stage, escalation of cases to formal investigation, examination of witnesses and suspects, until the case files are declared complete. Furthermore, the role of the Prosecutor’s Office in corruption investigation is strategic since it functions as the controller of the case from the early stage of investigation to prosecution, although in practice there are still technical constraints and inter-agency coordination issues that affect the effectiveness of the investigation process.

Abstract

This study focuses on the collaboration between the Transportation Agency and the Police in controlling unroadworthy vehicles in Gianyar Regency as an effort to improve traffic safety and order. The enforcement is carried out through coordinated mechanisms and in accordance with Law Number 22 of 2009 on Road Traffic and Transportation. The collaboration is implemented through public socialization, technical vehicle inspections, and joint operations, in which the Transportation Agency is responsible for technical vehicle aspects, while the Police conduct law enforcement against violations. The type of research used in this thesis is empirical legal research with a qualitative approach, conducted through field research by collecting primary and secondary data. The results show that the collaboration between the two institutions has been relatively effective; however, it still faces obstacles such as low public awareness, limited personnel and facilities, widespread Over Dimension Over Load (ODOL) violations, and the low deterrent effect of imposed sanctions

Abstract

This study examines the controversy surrounding violence in Bina Tradisi (Bintra) in the mental formation of Junior Police Officers (Bintara Remaja) within the Indonesian National Police, based on Regulation of the Chief of Police Number 8 of 2009 concerning Human Rights. The main issue lies in the vagueness of law, not a legal vacuum, as the prohibition of violence already exists but lacks clear operational guidelines. This research applies a normative legal method using statutory, conceptual, and case approaches. The findings reveal that violent practices contradict the principles of legality, proportionality, and human dignity. Therefore, regulatory reformulation, strengthened oversight, and consistent sanction enforcement are necessary to ensure professional and humanistic training.

Abstract

This research analyzes law enforcement against corporate illegal investment involving PT Dana Oil Konsorsium (PT DOK) within the Bali Regional Police jurisdiction. Utilizing an empirical legal method with a socio-legal perspective, this study evaluates investigative measures and factors inhibiting the legal process. Findings indicate that despite repressive efforts and inter-institutional coordination, primary obstacles include limited evidence, difficulties in asset tracing, and the vast distribution of victims. However, high legal awareness among victims serves as a significant supporting factor. The author recommends strengthening regulations and law enforcement capacity to address the complexities of corporate crime. This synergy is crucial to ensure legal certainty and public protection

Abstract

Maritime safety is a fundamental aspect of sea transportation activities that must be fulfilled by every ship operator and passenger. One of the key instruments in ensuring safety at sea is the use of life jackets, as stipulated in Article 1, Number 32 of Law Number 66 of 2024 concerning Shipping, which states that lifesaving equipment, including life jackets, constitutes mandatory safety gear that must be available, in good condition, and easily accessible to passengers. This study aims to determine the level of implementation of life jacket usage regulations at Sanur Port and to identify the factors that hinder their enforcement. The research employs a juridical-empirical method with a qualitative approach, involving interviews and observations with ship operators, passengers, and port officers. Secondary data were obtained through a literature review of relevant laws and maritime safety regulations. The findings indicate that the implementation level of life jacket usage regulations at Sanur Port remains suboptimal, as evidenced by passengers’ low awareness, weak supervision by officers, and the limited quantity and quality of available life jackets. Therefore, enhanced public awareness campaigns, stricter supervision, and stronger law enforcement are required to ensure that the application of Article 1, Number 32 of Law Number 66 of 2024 is effective in supporting maritime safety at Sanur Port.

Abstract

The environment is a habitat that significantly influences the survival of living beings. From year to year, environmental problems continue to increase and tend to be uncontrollable. A common problem faced by major cities in Indonesia is the rapid growth of the population in urban areas. The history of environmental management in urban areas, particularly concerning shade trees, indicates that there have been policy changes over time. Data from the Denpasar City Environmental and Sanitation Agency indicate that over the past five years, there has been a significant increase in the number of public complaints regarding the illegal cutting of shade trees. The cutting of shade trees is often carried out carelessly without considering its ecological impact. Currently, although there have been Denpasar Mayor Regulation Number 42 of 2018, which regulates the procedures for cutting shade trees, Its implementation still faces various obstacles. Implementing a policy is not an easy matter, especially in achieving common goals

Abstract

Online gambling businesses utilize social media influencers who provide paid endorsement and marketing services. These influencers promote their sites with the promise of lucrative payments. Article 45 paragraph 3 of Law Number 1 of 2024 regulates advertising for online gambling companies. Using an empirical legal research approach, this study relies on data collected from interviews and field observations. This study uses a descriptive approach to explain the current situation of the phenomenon related to the law enforcement efforts of the Bali Police Cyber Investigation Directorate. The study concludes that law enforcement is carried out through online patrols, monitoring accounts, conducting investigations, managing investigations, and then sending suspects and evidence to the prosecutor's office for legal proceedings. Obstacles in the enforcement process include internally the lack of tools to directly block online gambling sites and externally the low level of legal awareness in the community.

Abstract

This study aims to understand and analyze the role of the Bali Regional Police Water and Air Directorate (Ditpolairud Polda Bali) in conducting maritime patrols to prevent criminal acts in the waters of Bali Province, as well as to identify the obstacles encountered in carrying out these duties. This study employs a sociological approach, which is then analyzed qualitatively using a descriptive-analytical method. The results indicate that Ditpolairud Polda Bali plays a strategic role in maintaining the security of the waters through regular maritime patrols and the development of coastal communities. However, the implementation of patrols still faces several challenges, including limited facilities and infrastructure, personnel shortages, and unpredictable weather and geographical conditions. The conclusion of this study is that the role of the Bali Police Marine and Air Directorate in conducting sea patrols has been running quite well and contributes to efforts to prevent criminal acts in the waters of Bali Province. Nonetheless, there is a need to improve capacity, both in terms of facilities and infrastructure, the quality of human resources, and inter-agency coordination so that task implementation can run more optimally in the future.
