Jurnal Yusthima (Yusthika Mahasaraswati) merupakan jurnal yang dimiliki oleh Program Studi Magister Hukum Fakultas Hukum Universitas Mahasaraswati Denpasar. Jurnal ini memiliki frekuensi penerbitan 2 (dua) kali setahun, yaitu periode bulan Maret dan September. Ruang lingkup tema dalam Jurnal ini adalah berkaitan dengan pengembangan Ilmu Hukum, yang bertujuan untuk memberikan gambaran permasalahan hukum yang terjadi di masyarakat dan diperoleh dari hasil-hasil penelitian dengan mengedepankan sifat orisinalitas, kekhususan dan kemutakhiran artikel pada setiap terbitannya. Abstract

This study analyzes the position of Balinese women's inheritance rights within a gender-just customary law system in the Customary Villages of Badung Regency. Employing a juridical-empirical method across four villages (Mengwi, Sibang Gede, Petang, and Jimbaran), it examines the interaction between patrilineal traditions (purusa) and national legal reforms. Findings reveal that while traditional systems restrict women's rights over ancestral property, significant dynamics have emerged following PERMA No. 3 of 2017 and the MDA Bali Decree No. 04/2023. Gender justice implementation varies; urban areas exhibit greater flexibility through family agreements, whereas agricultural regions develop informal compensation mechanisms. Primary obstacles include deep-rooted patrilineal philosophy, social pressure, and women's economic dependence. The study concludes that achieving a gender-just inheritance system requires synergy between internal transformations of local wisdom and protective national legal frameworks, while preserving Balinese cultural identity.

Abstract

Drug-related offenses constitute serious crimes addressed through strict penal policies, one of which is the establishment of special minimum penalties under Law Number 35 of 2009 on Narcotics. However, in judicial practice, the application of such minimum penalties is not always implemented rigidly, as reflected in Supreme Court Decision Number 1278 K/Pid.Sus/2022, which imposed a sentence below the statutory minimum on a narcotics user possessing a very small quantity of evidence. This study aims to analyze the application of the principle of justice in the imposition of sentences below the statutory minimum and to examine the legal rationality underlying such a decision within the framework of the Indonesian sentencing system. This research employs a normative legal research method using statutory, historical, and conceptual approaches, through an examination of relevant legislation, criminal law doctrines, and court decisions. The findings indicate that the imposition of a sentence below the statutory minimum in this decision reflects an effort to realize substantive justice through the application of the principles of proportionality and individualized sentencing. The decision demonstrates that justice is not always synonymous with the mechanical application of the law, but rather requires an interpretation that takes into account the concrete circumstances of the case, the degree of the offender’s culpability, and the objectives of punishment. Accordingly, this study underscores the importance of balancing legal certainty and substantive justice to ensure that the sentencing system remains grounded in humanitarian values without undermining legal legitimacy.

Abstract

The new paradigm of correctional system is the transformation from a prison system to a correctional system. One effort to avoid arbitrary behavior and subjective assessments in the implementation of training, then every decision to be given to individual inmates must be approved and approved through the Correctional Observation Team (TPP) Session. Although the legal framework has clearly established the TPP Session as a standard procedure, in operational practice there are still strong indications of procedural discrepancies. The research method used in this study is an empirical legal research method with qualitative research characteristics and analytical descriptive specifications. Data were collected through interviews, literature, and documentation. The collected data were analyzed using qualitative analysis methods. The results of the discussion obtained indicate that the Implementation of the TPP Session at the Class IIA Bangli Narcotics Prison prioritizes the principles of objectivity, transparency, and accountability. The TPP Session is held for the process of coaching and determining sanctions for violations. In its implementation, the presence of inmates in the session uses a representative system for training, while for violation cases it is mandatory to be included in the TPP session. The urgency of ensuring the rights of inmates through the implementation of TPP hearings is to fulfill human rights indicators, including 1) Procedural Justice & Non-Discrimination, 2) Rights to Self-Development & Rehabilitation, 3) Rights to be Heard and Accountable, 4) Rights to Health and Humane Treatment. Obstacles encountered in providing inmates' rights through TPP hearings include, first, overcapacity and second, inadequate human resources with assessment competencies. Efforts are being made to overcome these obstacles through employee competency in the TPP hearing mechanism to ensure the proper fulfillment of inmates' human rights.

Abstract

Doxing, as a form of cybercrime, has become a serious threat to individual privacy rights in the digital era. The practice of disclosing personal data without consent not only violates human dignity but also infringes upon the constitutional right to security guaranteed under Article 28G paragraph (1) of the 1945 Indonesian Constitution. In Indonesia, doxing is regulated under the Electronic Information and Transactions Law (ITE Law) and the Personal Data Protection Law (PDP Law). However, these two regulations emphasize different aspects: the ITE Law focuses on cybercrime’s technical dimension, while the PDP Law emphasizes the protection of personal data subjects’ rights. This difference creates normative disharmony in terms of definition, offense characteristics, and sentencing disparity, which results in legal uncertainty and weak protection for doxing victims. Using normative legal research methods, this study examines the disharmony between the ITE Law and PDP Law and its implications for privacy protection. The findings show that without regulatory harmonization, the PDP Law as lex specialis cannot optimally protect victims. Therefore, harmonization of regulations, strengthening of the personal data supervisory authority, and enhancing the capacity of law enforcement officers are urgently needed to ensure legal certainty and effective privacy protection in Indonesia.
