The Indonesian Journal of Shariah and Justice (IJSJ) welcomes strong evidence-based empirical studies and results-focused case studies that share research in product development and clarify best practices. Abstract

Undang-Undang No. 1 Tahun 1974 tentang perkawinan, mengatur batas usia pernikahan baik laki-laki dan perempuan, namun sejak 2019 hal tersebut diperbaharui melalui Undang-undang No. 16 Tahun 2019 yang menyatakan bahwa standar minimal pernikahan bagi laki-laki dan perempuan adalah 19 tahun. Namun sejak terjadinya pandemi Covid-19 angka perkara dispensi nikah di Pengadilan Agama Manado meningkat dari 21 perkara ditahun 2019 menjadi 42 perkara ditahun 2020 dan selama tahun 2021 (per agustus 2021) tercatat ada 36 perkara. Penelitian ini dilakukan untuk mengetahui bagaimana latar belakang terjadinya dispensasi nikah di di Pengadilan Agama Manado pada masa pandemi Covid-19 dan Bagaimana tinjauan yuridis terhadap peningkatan dispensasi nikah di Pengadilan Agama Manado. Jenis penelitian ini adalah penelitian lapangan (field research) dengan menggunakan pendekatan sosiologi hukum. Adapun yang menjadi informan penelitian adalah hakim dan panitera Pengadilan Agama Manado serta pelaku dispensasi nikah atau kuasa hukum dengan menggunakan teknik purposive sampling. sedangkan metode yang digunakan dalam pengumpulan data adalah observasi, wawancara, dan dokumentasi, kemudian dianalisa menggunakan model Miles and Huberman yang dilakukan secara interaktif dan berlangsung secara terus-menerus pada setiap tahapan penelitian hingga tuntas. Hasil penelitian ini menunjukkan bahwa, pertama faktor kehamilan diluar nikah dan faktor ekonomi menjadi latar belakang terjadinya dispensasi nikah di Pengadilan Agama Manado. Kedua, dalam tinjauan yuridis pembaharuan batas usia minimal pernikahan yang diatur dalam Undang-undang No. 16 Tahun 2019 sebagai upaya pemerintah untuk menekan angka pernikahan dini, ternyata tidak cukup untuk menekan angka pernikahan dini atau dispensasi nikah di Pengadilan Agama Manado selama pandemi covid-19.

Abstract

Slavery is not a product of Islam as it existed long before the Prophet Muhammad came. Even in the Qur'an, there are strong indications that enjoying sex with an unmarried slave girl is the same as enjoying it with a legal wife, so it is not even called zina in the Qur'an. It is evident that during the pre-Islamic era, sexuality between a master and his slave girl was commonplace. This research is a literature that is sourced in the form of books, journals and previous research that has the same theme of discussion as this issue. The result of this writing is that in Islam, the master or employer having sex with a slave girl is allowed and is not called adultery because it is stated in the Al-Qur'an surah Al-Mu'minun verses 5-7. The slavery that currently occurs in Saudi Arabia with various forms of slavery, one of which is the forced sexual intercourse of the master against his slave girl, is an act that is strictly prohibited and hated in Islam because it lowers the dignity and dignity of women.

Abstract

Wedding rituals occupy a central position in the culture of the Banggai people, Central Sulawesi. The traditional ceremony is full of elements of oral and written traditions that reflect the outlook on life and local wisdom of the Banggai tribe. This paper aims to interpret and understand the traditional wedding ritual of Banggai in the context of its local culture and language through the application of a hermeneutic approach. The research data was sourced from various transcripts and traditional Banggai documents related to the wedding procession, including pantun, syair, prayer, dance, and other traditional practices. These data are then analyzed in depth to uncover the implied meaning behind traditional symbols and texts by always considering the historical background and oral traditions of the Banggai people so that the resulting interpretation is contextual and proportional. The results showed that the traditional Banggai marriage ritual was full of philosophical content and represented the values and views of life upheld by the community. This ritual also acts as a medium for cultural regeneration and transfer of knowledge passed down between generations. With a comprehensive meaning, this study hopes to enrich readers' insights about the nature and essence of the Banggai wedding tradition.

Abstract

AbstractThe people of South Halmahera, especially Bahu Village, have a prohibition on marriage in the month of Muharram, they are not allowed to hold weddings, the prohibition on marriage is due to several influencing factors, the customary rules that prohibit marriage in the month of Muharram are a fear factor, the community believes that if they violate tradition they will experience disaster, such as the wedding not going smoothly, the family is not harmonious, the family economy will decline and it will be difficult to restore it, and the psychological factor is that people who violate the customary rules of marriage during the month of Muharram often have arguments in their households, there is no peace and discomfort. Meanwhile, in the sociological theory of Islamic law, the factors that influence the prohibition of marriage in the month of Muharram must also be seen from a historical, social and religious perspective. On the other hand, the tradition of prohibiting marriage during the month of Muharram is maintained because the custom of using traditional figures as role models is inherited from ancestors. The aim of the research is to determine the community's understanding of the custom of prohibiting marriage in the month of Muharram in Bahu1 Village, to find out the factors that influence community compliance with the custom of prohibiting marriage in the month of Muharram, to find out the community's obedience to the custom of prohibiting marriage in the month of Muharram from an Islamic Legal Sociology Perspective. The data collection method is through surveys, documentation and in-depth interviews with the community related to the research objectives. Data analysis is carried out by data reduction and data presentation, namely the process of compiling complex information in a systematic form so that it is simpler and its meaning can be understood. Results and discussion, consider factors that show that the obedience of the Bahu Village community to the prohibition of marriage in the month of Muharram can be understood as the result of a complex interaction between social, cultural and Islamic legal factors. Abstract

Decision Number 5/Pdt.G/2019/PN Bms relates to the case of annulment of the engagement by Agus Suyitno to his fiancé, Sri Subur Lestari. In this case, the Panel of Judges imposed a fine on Agus to pay compensation to Sri Subur Lestari in the form of substantial immaterial losses. This is based on the Jurisprudence of the Supreme Court Number 3191 K/Pdt/1984. This study uses a problem approach in the form of a statutory approach (statute approach) and a case approach (case approach). And the results of this study state that the decision delivered by the judge can be categorized as a progressive decision because it is in accordance with applicable legal procedures and refers to the jurisprudence or the previous judge's decision so that it can be used as a reference by the judge in deciding a case related to the annulment of the engagement. Keywords: Engagement cancellation fines and progressive verdict ABSTRAK Putusan No. 5/Pdt.G/2019/PN.Bms berkaitan dengan kasus pembatalan pertunangan yang dilakukan oleh Agus Suyitno terhadap tunangannya bernama Sri Subur Lestari. Dalam kasus ini, Majelis Hakim memberikan sanksi denda kepada Agus untuk membayar ganti rugi kepada Sri Subur Lestari berupa kerugian immateriil yang cukup besar. Abstract

Abstrak Penelitian ini mengkaji implementasi konsep ahli waris pengganti menurut Hazairin dalam Kompilasi Hukum Islam (KHI) di Indonesia, dengan pendekatan yuridis-normatif. Konsep ini terutama diatur dalam Pasal 185 KHI sebagai upaya menjawab kompleksitas hukum kewarisan Islam dengan menekankan pada keadilan sosial. Metode penelitian dilakukan melalui studi pustaka dengan membandingkan putusan pengadilan agama terkait, untuk meneliti penerapan konsep tersebut dalam praktik. Hasil penelitian menunjukkan penerapan yang konsisten oleh pengadilan agama dalam melindungi hak-hak ahli waris dan memastikan pembagian harta waris yang adil. Secara teoretis, penelitian ini mengkonfirmasi kemampuan hukum Islam untuk beradaptasi dengan perubahan sosial melalui ijtihad, sementara secara praktis memberikan kepastian hukum dan mengurangi potensi konflik di dalam keluarga. Studi ini merekomendasikan penelitian lebih lanjut untuk melakukan analisis perbandingan antar wilayah di Indonesia dan menerapkan pendekatan interdisipliner untuk memahami dampak budaya secara sosial serta mengevaluasi kebijakan yang memperkuat prinsip keadilan dalam hukum kewarisan. Abstract This research delves into the use of substitute heirs as outlined by Hazairin in the Kompilasi Hukum Islam (KHI) in Indonesia taking a juridical-normative approach. The concept, governed by Article 185 of the KHI aims to navigate the intricacies of Islamic inheritance law with a focus on promoting social fairness. The study methodology entails a review of literature and comparison of court rulings pertaining to this concept to assess its practical implementation. The results reveal an application by religious courts in safeguarding heirs rights and ensuring an equal distribution of assets. In theory the research validates laws capability to adapt to societal changes through ijtihad while in practice offering legal clarity and mitigating potential family conflicts. Suggestions, for studies include conducting comparative analyses across different Indonesian regions and employing interdisciplinary approaches to comprehend societal cultural influences and assess policies that reinforce justice principles within inheritance laws.
