Abstract

The Purpose of writing this articles is to find out the interactions and habits of the people on major holidays between religious communities in North Sulawesi. This study uses qualitative research methods, with data collection techniques based on observations, interviews and documentation studies, as well as sociological approaches with studies cross-sectional. The results of this study show that interfaith visits, especially by each family, are still strongly bound by kinship but have distance and boundaries from each religion. Then, there are legal causes and legal consequences that occur from customary law visit when religious feast day are smaller in scope, namely the family which will automatically influence the interaction of the people of North Sulawesi.

Abstract

Wedding rituals occupy a central position in the culture of the Banggai people, Central Sulawesi. The traditional ceremony is full of elements of oral and written traditions that reflect the outlook on life and local wisdom of the Banggai tribe. This paper aims to interpret and understand the traditional wedding ritual of Banggai in the context of its local culture and language through the application of a hermeneutic approach. The research data was sourced from various transcripts and traditional Banggai documents related to the wedding procession, including pantun, syair, prayer, dance, and other traditional practices. These data are then analyzed in depth to uncover the implied meaning behind traditional symbols and texts by always considering the historical background and oral traditions of the Banggai people so that the resulting interpretation is contextual and proportional. The results showed that the traditional Banggai marriage ritual was full of philosophical content and represented the values and views of life upheld by the community. This ritual also acts as a medium for cultural regeneration and transfer of knowledge passed down between generations. With a comprehensive meaning, this study hopes to enrich readers' insights about the nature and essence of the Banggai wedding tradition.

Abstract

This study analyzes the phenomenon of domestic violence (KDRT) in Semarang City by focusing on public understanding of the hadith prohibiting domestic violence, the implementation of religious values in daily life, and its synergy with positive law. Data shows an increase in domestic violence cases in Semarang City over the past three years, which includes physical, psychological, sexual, and economic neglect. With a descriptive qualitative approach, this study collects data through interviews with judges, advocates, security forces, and the community, as well as analysis of legal documents and related hadiths. The results of the study show that the community has a diverse understanding of the hadith prohibiting domestic violence, depending on the educational and professional background. Although some societies have applied hadith values, the practice is often limited to the prohibition of physical violence, while psychological and economic violence is still frequent. This study also found that the synergy between hadith, positive law, and community legal culture has not been fully realized, so more integrated religious and legal education is needed. Recommendations include increased social campaigns, economic empowerment, and collaboration between legal institutions and religious leaders to create harmonious, prosperous, and violence-free families.

Abstract

Penelitian ini menginvestigasi peran dan signifikansi sertifikat Elsimil dalam konteks administrasi perkawinan di Kantor Urusan Agama (KUA) Kota Selatan, Gorontalo, Indonesia. Dengan mengadopsi pendekatan sosiologis, penelitian ini menggunakan wawancara mendalam dengan calon pengantin, petugas KUA dan tokoh agama setempat, serta analisis dokumen terkait kebijakan dan regulasi. Temuan penelitian menunjukkan bahwa sertifikat Elsimil memiliki peran strategis dalam pencegahan stunting, memberikan pendampingan kepada calon pengantin, dan memastikan kelayakan untuk melangsungkan pernikahan. Namun, tantangan implementasinya adalah kurangnya informasi yang merata di masyarakat dan rendahnya pemahaman calon pengantin menunjukkan perlunya penyuluhan yang lebih massif dan intensif. Implikasinya mencakup perlunya perubahan regulasi administrasi perkawinan, tata kelola administrasi perkawinan, dan peningkatan penyuluhan efektif di masyarakat. Penelitian ini menjadi referensi bagi masyarakat terhadap evaluasi kebijakan dan program edukasi guna mendukung hak dan kewajiban calon pengantin demi kesejahteraan generasi mendatang.

Abstract

This study explores the phenomenon of identity forgery in marriage registration in Indonesia, an issue that undermines the legitimacy of marital unions and creates complex legal, social, and administrative consequences. Using a normative juridical approach, this research examines statutory regulations, court decisions, and official reports to identify the primary forms of identity forgery, ranging from falsifying personal identification documents to manipulating marital and religious status. The analysis reveals that the absence of an integrated, real-time population database, heavy reliance on physical documents, insufficient verification mechanisms, limited staff training, and low legal literacy are key systemic weaknesses that enable identity forgery to persist. Under Indonesian law, marriages based on forged identities are subject to annulment, which may lead to disputes over property, inheritance, and child custody. Although the law protects the rights of children born from annulled marriages, the administrative and legal complexities remain significant. The study concludes by recommending the urgent development of an integrated digital identity verification system, continuous training for registration officers, strengthened internal and external oversight, and enhanced public legal education. These measures are necessary to safeguard the integrity of marriage law in Indonesia and prevent further abuse of the system.

Abstract

This research explores the alignment and divergence of the principles of Mapalus with Islamic legal and ethical frameworks, contributing to the broader discourse on integrating local wisdom with Islamic values in multicultural societies. Mapalus, a communal tradition rooted in the Christian-majority Minahasan society, has been adopted by the Muslim minority by applying Maqāṣid Syarī’ah principles, particularly in community well-being, justice, and property protection. Through empirical data from interviews with religious leaders and community members, the study highlights how Islamic jurisprudence guides modifications to traditional Mapalus practices, ensuring compliance with religious obligations while preserving core cultural values. The research reveals that while Islamic values of justice, reciprocity, and mutual assistance align with Mapalus' cooperative ethos, certain rituals require adaptation or exclusion to adhere to Islamic law. This integration is facilitated by the involvement of religious leaders, who mediate potential conflicts and help maintain social harmony. The study concludes that Mapalus is a model for successfully integrating local wisdom with Islamic values in a multicultural context, demonstrating the flexibility of cultural practices and religious principles in fostering unity and cooperation across diverse communities.

Abstract

The harmonization between Islamic law and positive law regarding polygamy in Indonesia presents significant legal and social challenges. This study aims to explore the complex interactions and conflicts between these legal systems using a structuralist epistemological approach. The research is conducted through an in-depth literature review that analyzes the intersections of Islamic doctrines and civil regulations, specifically focusing on how these structures influence the interpretation and implementation of polygamy-related laws. Findings reveal that while Islamic law allows polygamy under strict conditions, positive law imposes additional constraints to ensure fairness and protect the rights of all individuals involved. The study underscores a significant gap between the legal provisions and their practical enforcement, often influenced by cultural perceptions and social norms. Conclusively, the research suggests that achieving harmonization requires not only legal reforms but also cultural and educational efforts to address the disparities in polygamy's practice and regulation, aiming to uphold both religious traditions and human rights standards. The outcome emphasizes the necessity for a nuanced approach that considers both legal frameworks and the socio-cultural context of Indonesia
