Abstract

Customs in every place often experience changes because they are flexible. Activities, habits, and religion that impact good or bad moral values can change what occurs. Researchers identify the occurrence of cultural change midodareni; in addition, researchers get the problem of these changes by looking at the side of Islamic law. The research was conducted in Jawa Tondano (Jaton), North Sulawesi Province, with a sociological approach and the concept of sari. Data was collected by interviewing religious leaders and traditional community leaders. The analysis carries out using theory tradition. The findings are that midodareni became one of the traditions that experienced significant changes. This change influences factors of marriage, ethnicity/tribe immigrants who incidentally are the majority of Muslims in the sense that there is the influence of religion, namely Islam, so that the tradition is readjusted so as not to eliminate ancestral heritage and does not conflict with beliefs. In terms of analysis, the practice includes traditional authentic or changes allowed in Islamic teachings; midodareni is one example of a form of development of Islam that adapt to existing rules. So that this custom can be an innovation against other traditions where customary changes if they meet the moral values the local community believes.

Abstract

Penelitian ini mengkaji peran simbolis perempuan dalam pelaksanaan adat Saro Badaka di Desa Umaloya, yang merupakan bagian integral dari ritual perkawinan tradisional. Adat Saro Badaka tidak hanya merefleksikan nilai-nilai budaya lokal, tetapi juga mengandung makna keagamaan yang dalam, khususnya dalam konteks Hukum Islam. Fokus utama penelitian ini adalah pada bagaimana peran perempuan dalam prosesi ini menggambarkan simbolisme kasih sayang, doa, dan keseimbangan, serta bagaimana nilai-nilai ini selaras dengan prinsip-prinsip dalam Hukum Islam. Melalui metode kualitatif, dengan pendekatan etnografis dan wawancara mendalam, penelitian ini menemukan bahwa perempuan memegang peranan sentral sebagai pelaksana utama adat, yang melibatkan mereka dalam aktivitas-aktivitas simbolis seperti penyiapan bedak, penyalaan lilin, dan pembagian makanan. Peran ini tidak hanya menunjukkan kedudukan perempuan dalam struktur sosial-budaya masyarakat Desa Umaloya, tetapi juga memperlihatkan bagaimana mereka menjadi penyalur utama nilai-nilai Islami dalam konteks pernikahan. Hasil penelitian ini menunjukkan bahwa pelaksanaan adat Saro Badaka, yang dipimpin oleh perempuan, menjadi medium untuk mengekspresikan prinsip-prinsip Hukum Islam, seperti kasih sayang, persatuan, dan kesucian, yang selaras dengan ajaran Islam. Dengan demikian, penelitian ini memberikan wawasan baru tentang keterkaitan antara adat istiadat lokal dan penerapan Hukum Islam dalam kehidupan masyarakat, serta peran signifikan yang dimainkan oleh perempuan dalam mempertahankan tradisi ini.

Abstract

In multicultural societies, the regulation of worship loudspeakers, particularly those affecting the Muslim community, has sparked significant debate, ranging from strong support to outright rejection. This study seeks to explore the social tensions arising from these regulations, focusing on the culturally diverse regions of Bali and Manado. Employing a qualitative approach, interviews were conducted with religious leaders, community figures, and local government officials to gain insight into the community's reactions. The findings reveal two predominant responses. On one hand, some view the regulations as unnecessary, believing that the established tradition of tolerance has allowed diverse religious practices to coexist peacefully without significant issues related to loudspeakers. On the other hand, others feel that the loudspeaker use is excessive, disturbing their rest and seeking quieter times. Some members of the Muslim community perceive the regulation as discriminatory, noting that other religious groups might also use loudspeakers at higher volumes. This study offers valuable insights for policymakers on how regulatory interventions can influence social harmony in diverse environments, highlighting the importance of adjusting regulations to respect religious diversity and equitably manage public auditory spaces.

Abstract

Wedding rituals occupy a central position in the culture of the Banggai people, Central Sulawesi. The traditional ceremony is full of elements of oral and written traditions that reflect the outlook on life and local wisdom of the Banggai tribe. This paper aims to interpret and understand the traditional wedding ritual of Banggai in the context of its local culture and language through the application of a hermeneutic approach. The research data was sourced from various transcripts and traditional Banggai documents related to the wedding procession, including pantun, syair, prayer, dance, and other traditional practices. These data are then analyzed in depth to uncover the implied meaning behind traditional symbols and texts by always considering the historical background and oral traditions of the Banggai people so that the resulting interpretation is contextual and proportional. The results showed that the traditional Banggai marriage ritual was full of philosophical content and represented the values and views of life upheld by the community. This ritual also acts as a medium for cultural regeneration and transfer of knowledge passed down between generations. With a comprehensive meaning, this study hopes to enrich readers' insights about the nature and essence of the Banggai wedding tradition.

Abstract

Nilai saham perusahaan dapat dipengaruhi oleh beberapa faktor diantaranya return on equity, ukuran perusahaan, dan price earning ratio. Penelitian ini bertujuan untuk membuktikan secara empiris pengaruh Price Earning Ratio terhadap harga saham yang terdaftar pada Jakarta Islamic Index (JII). Metode penelitian yang digunakan dalam penelitian ini adalah penelitian kuantitatif dengan melakukan pengumpulan populasi antara lain beberapa perusahaan yang terdaftar di Jakarta Islamic Index dengan sampel 8 perusahaan yang tidak pernah delisting selama priode 2018-2021 di Jakarta Islamic Index. Analisis data menggunakan analisis regresi linear sederhana yang digunakan untuk mengetahui hubungan antara variabel dependen dengan variabel independen dengan menggunakan aplikasi SPSS. Selain analisis regresi sederhana, uji normalitas juga dilakukan untuk mengetahui apakah data yang akan diolah nantinya benar atau dapat terdistribusi secara baik. Hasil penelitian ini menunjukan bahwa Price Earning Ratio memiliki pengaruh positif terhadap harga saham di Jakarta Islmic Index. Investasi dilakukan khusus pada saham-saham yang berada pada Jakarta Islamic Index (JII) ternyata mendapatkan nilai positif yang menandakan bahwa ketika nilai Price Earning Ratio (PER) itu mengalami kenaikan.

Abstract

This article intends to know the status of the Hand Arrest Operation (OTT) carried out by the Corruption Eradication Commission (KPK) according to the views of legal practitioners. With a normative approach, this study examines the problems legal practitioners face more deeply. There is a difference between Hand-Arrest and Arrested Operations. It means that Hand Arrest Operations (OTT) and Being Arrested (TT) are the same if the procedure follows the rules set, namely Article 18 of the Criminal Code. It is in line with the views of practitioners of law.

Abstract

In the evolving landscape of global economics, the significant role of women in the informal economy, particularly housewives, remains underexplored. This study examines the gender dynamics and economic contributions of housewives in the informal economy, focusing on the context of Islamic values and multicultural societies in Poigar Village. Using a qualitative approach, this research delves into how housewives balance domestic responsibilities and economic activities, particularly through cake sales, to enhance family well-being. Key findings highlight the motivations driving housewives to engage in informal economic activities, such as economic necessity, skill utilization, and the pursuit of financial independence. Additionally, these activities are shown to significantly improve family income, enhance financial stability, and foster social recognition. From an Islamic perspective, these efforts align with principles of family cooperation, economic empowerment, and spiritual reward. The study underscores the importance of policies that support women in informal economies, such as access to capital, skill training, and social acknowledgment of their contributions. Future research should explore broader and more diverse samples to generalize findings and examine the long-term impacts of women's economic participation in similar contexts.

Abstract

This study discusses slander in the context of inheritance according to Islamic law, especially in the context of inheritance restrictions from the perspective of Qiyas Musawi and Istinbath. The focus is on the issue of interfaith inheritance that is increasingly important in contemporary Islamic legal thought. The debate over the division of inheritance between non-Muslim heirs and the principles of traditional Islamic law is in the spotlight. This research uses an in-depth literature analysis method of relevant Islamic Legal sources to understand the views and solutions proposed by him. The results highlight the complexity and tension between traditional views of scholars and challenging contemporary perspectives, particularly in the context of Indonesia's religiously diverse society. This study provides a deep understanding of the issue of interfaith inheritance in Islamic law, investigating the perspectives of Qiyas Musawi and Istinbath, as well as their implications in the context of inheritance law in Indonesia.

Abstract

The integration between Tasyri's Philosophy and Sharia Philosophy in the context of Islamic law reform in Indonesia is the main focus of this study, especially in understanding how Islamic legal values can be applied effectively in the modern legislation system. The urgency of reforming Islamic law to answer the challenges of the times and the importance of understanding the relationship between the principles of tasyri' – as the basis for the formation of law – and sharia as the entire Islamic legal system that governs the lives of Muslims, are emphasized in the introduction. This research uses a qualitative approach with normative analysis, combining literature studies, the study of classical legal texts, and the interpretation of the views of contemporary scholars in Indonesia. The data obtained were critically analyzed to identify how Tasyri and Sharia Philosophy principles can be adapted into legislation responsive to social changes and the Indonesian context. The study results show that integrating Tasyri' and Sharia Philosophy in the reform of Islamic law in Indonesia allows the application of Islamic law that is more relevant to the needs of the times and enriches the legislation process with a strong ethical and moral basis. The main challenge in this integration is ensuring harmony between classical texts and modern social realities in Indonesia so that Islamic law continues to function as a dynamic and adaptive system, as a representation of religious law. Integrasi antara Filsafat Tasyri' dan Filsafat Syariah dalam konteks reformasi hukum Islam di Indonesia menjadi fokus utama penelitian ini, terutama dalam memahami bagaimana nilai-nilai hukum Islam dapat diterapkan secara efektif dalam sistem legislasi modern. Urgensi reformasi hukum Islam untuk menjawab tantangan zaman dan pentingnya memahami hubungan antara prinsip-prinsip tasyri' – sebagai dasar pembentukan hukum – dan syariah sebagai sistem hukum Islam secara keseluruhan yang mengatur kehidupan umat Muslim, ditekankan dalam pengantar. Penelitian ini menggunakan pendekatan kualitatif dengan analisis normatif, menggabungkan studi literatur, studi teks hukum klasik, dan interpretasi pandangan ulama kontemporer di Indonesia. Data yang diperoleh dianalisis secara kritis untuk mengidentifikasi bagaimana prinsip-prinsip Tasyri' dan Filsafat Syariah dapat diadaptasi ke dalam legislasi yang responsif terhadap perubahan sosial dan konteks Indonesia. Hasil studi menunjukkan bahwa integrasi Tasyri' dan Filsafat Syariah dalam reformasi hukum Islam di Indonesia memungkinkan penerapan hukum Islam yang lebih relevan dengan kebutuhan zaman dan memperkaya proses legislasi dengan dasar etika dan moral yang kuat. Tantangan utama dalam integrasi ini adalah memastikan keselarasan antara teks-teks klasik dan realitas sosial modern di Indonesia sehingga hukum Islam tetap berfungsi sebagai sistem yang dinamis dan adaptif, sebagai representasi dari hukum agama.
