Abstract

Corruption crimes not only cause legal losses, but also significant economic losses to state finances. One of the legal instruments used to recover these losses is additional punishment in the form of restitution. The Public Prosecutor (JPU) has a strategic role in executing restitution based on a court decision that has permanent legal force. This research aims to analyze the authority of the Public Prosecutor in executing restitution and examine the implementation mechanism within the framework of the Non-Tax State Revenue (PNBP) system. By using the normative juridical method, this research examines applicable legal provisions such as the Criminal Procedure Code, Anti-Corruption Law, Prosecutor's Office Law, and Non-Tax State Revenue Law, and is analyzed through a legal policy and economic approach. The results of the study show that the authority of the prosecutor in the execution of restitution already has a strong legal basis, but its implementation still faces challenges such as difficulties in tracking assets, overlapping rules, and not optimal institutional synergy. The mechanism for depositing restitution as PNBP also requires system integration, transparency, and increased institutional capacity in order to make a real contribution to the recovery of state finances. This study recommends reforming execution procedures, strengthening inter-agency cooperation, and developing an information technology-based reporting system to improve the effectiveness and accountability of restitution execution in Indonesia.

THE CONSTITUTIONALITY OF THE ESTABLISHMENT OF THE LAW ON THE INSTITUTION OF THE PEOPLE'S CONSULTATIVE ASSEMBLY (MPR) OF THE REPUBLIC OF INDONESIA AS A FORM OF MANIFESTATION OF ARTICLE 2 PARAGRAPH (1) OF THE 1945 CONSTITUTION OF THE REPUBLIC OF INDONESIA Monitasari, Restu Gusti

Abstract

This study discusses two main problems: first, constitutional values in the institutional arrangements of People's Consultative Assembly of the Republic of Indonesia (MPR RI) based on the 1945 Constitution of the Republic of Indonesia in the development of legislation in Indonesia; second, the urgency of the establishment of the MPR RI Institutional Law as an implementation of Article 2 paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The article states that "The People's Consultative Assembly consists of members of the People's Representative Council and the Regional Representative Council who are elected through general elections and further regulated by law." Therefore, a special law is needed to regulate the MPR, as also explained in the appendix to Law Number 12 of 2011. However, until now, the MPR institution is still regulated together with the House of Representatives (DPR), the Regional Representative Board (DPD), and the Regional House of Representatives (DPRD) in Law Number 2 of 2018 (UUMD3), which has the potential to cause confusion because the four institutions have different positions, functions, and authorities. This study uses a normative legal method with a descriptive analytical approach that is perspective in nature to provide solutions to the problems of state institutional arrangements in Indonesia. The results of the study show that based on Article 2 paragraph (1) of The 1945 Constitution of the Republic of Indonesia post- amendment, a special law is needed regarding the MPR institution. The regulation of the MPR in one joint legal product with DPR, DPD, and DPRD not only creates ambiguity in society, but also contradicts the characteristics of each institution from a historical, philosophical, sociological, and legal perspective. Therefore, it is necessary to establish a separate MPR Institutional Law from the UUMD3.

Abstract

The study aimed to determine the viability and vigor of rice seeds harvested by farmers. The study was conducted in April 2025 in Pare Kranggan Village, Temanggung, by taking several samples of dry rice harvested by farmers. The samples were dried and then tested for viability and vigor. Each seed was placed in a petri dish containing 100 seeds and replicated three times. This study was designed using a Completely Randomized Design. Observations were made for 14 days, observing seed germination (viability) and seed vigor. The results showed that seeds with a germination rate (viability) above 85% were only obtained from two sample farmers. Seed viability significantly influences the seed vigor index, with seeds with high viability also having a high vigor index. High vigor seeds are indicated by seeds with a high germination rate, namely with a vigor index above 20. One factor influencing low seed viability and vigor is that at harvest, the rice is not yet fully physiologically ripe.

Abstract

Asset forfeiture in corruption is an important legal enforcement instrument that aims not only to punish perpetrators but also to recover state financial losses. Perpetrators of corruption crimes are not only individuals but also corporations, both legal and non-legal entities. The research problems in this study are: how the regulation of corporate asset forfeiture as an effort to recover state financial losses in corruption crimes is formulated and how the enforcement of corporate asset forfeiture is carried out as a means of recovering state financial losses in corruption crimes. The theories employed in this study include law enforcement theory and asset forfeiture theory. This research applies a normative juridical method with an approach based on legislation, legal doctrines and relevant case studies. The results show that corporate asset forfeiture is a strategic measure which has to be a priority in the law enforcement agenda against corruption. Although Indonesia already has several legal instruments governing asset forfeiture, in reality, the implementation is still hindered by various challenges, such as regulatory, institutional and inter-agency coordination. Law enforcement often emphasizes the ultimum remedy approach, resulting in criminal sanctions against corporations to be overlooked and replaced by administrative sanctions. In fact, criminal prosecution of corporations is not only important as the state's measure to penalize crime, but also serves to restore state financial losses through seizure and confusion of illegal profits. This study recommends strengthening regulations through the enactment of the Asset Forfeiture Bill, enhancing the capability of law enforcement officers in understanding the concept of corporate crime and establishing a special agency to handle asset forfeiture professionally and transparently.

Abstract

Differences in cultural backgrounds often create obstacles in the process of interaction between individuals. This study discusses the case of interaction between students of ethnic groups from eastern Indonesia and students of Javanese ethnicity in the Surakarta campus environment. The presence of students from eastern Indonesia in the context of higher education in Java creates a complex intercultural meeting space. Differences in values, norms, and communication styles between these two ethnic groups often create barriers to building social relationships. This study aims to identify the forms of communication accommodation strategies employed by both parties in their efforts to build effective communication. The approach used is a phenomenological approach to explore the direct experiences of informants in the process of cross-cultural interaction. The theory used is Communication Accommodation Theory to analyze how individuals adapt their communication styles to achieve mutual understanding. Data collection techniques were conducted through in-depth interviews with three student informants from the eastern region and one Javanese ethnic student informant. The results of the study indicate that the most dominant communication barriers manifested in the form of differences in language style, perceptions of emotional expressions, and cultural stereotypes. The accommodation strategies employed include convergence by Eastern students as a form of adaptation to the majority culture, and divergence in the context of preserving cultural identity.
