Abstract

This study aims to analyze the practice of tarah in the sale and purchase of citrus fruit by farmers in Bangorejo District, Banyuwangi Regency, from the perspective of the Shafi'i School of Law. The approach used in this study is qualitative, with data collection techniques through observation, interviews and documentation. The results of the analysis say that tarah or pieces of weight taken by the buyer, is a form of gift from the seller whose law is sunnah, because the tarah taken by the buyer is written in the note and there is willingness from the seller, in addition, giving tarah from the seller is a form of practice to make it easier to carry out buying and selling transactions, where Allah SWT promises to give mercy to sellers who make it easier for buyers.

Abstract

Islamic economics emerges as an alternative paradigm that offers a value-based philosophical foundation through the integration of epistemology, ontology, and axiology within the framework of Islamic economic philosophy. This study aims to conceptually examine the epistemological, ontological, and axiological dimensions of Islamic economics and their integration as the foundation for the development of Islamic economic thought. Employing a qualitative descriptive approach with a library research method, the data were derived from the Qur’an, Hadith, and contemporary academic literature relevant to Islamic economics and the philosophy of science. The findings indicate that the epistemology of Islamic economics is integrative, positioning revelation as the primary source of knowledge that guides reason and empirical inquiry; its ontology views economic reality as a holistic system grounded in the principle of tawhid, in which humans function as both servants (‘abd) and vicegerents (khalifah); while its axiology is oriented toward the realization of falah through the values of justice, balance, trust, and public welfare. The integration of these three dimensions within Islamic economic philosophy affirms that Islamic economics is not merely a technical or pragmatic alternative to conventional economics, but a value-driven and ethical discipline aimed at achieving holistic and sustainable human well-being.

Abstract

Contemporary Islamic economics literature (2022–2025) tends to be dominated by analyses of technical compliance in Islamic fintech products and sukuk. However, studies highlighting the gap between compliance formality and the substantive achievement of maqasid al-shari’ah—especially regarding distributive justice—remain very limited. This research offers novelty by reconstructing the philosophical foundations of Islamic Financial Institutions (IFIs) to shift the focus from formal legality toward real social impact. Using an integrative-critical literature review method, this study synthesizes more than 25 accredited sources through thematic analysis to evaluate the regulations and practices of IFIs in Indonesia. The results show that without the integration of the amanah philosophy and the ta’lil al-ahkam approach, financial products are often trapped in "window dressing" practices without significant contribution to MSME inclusivity. Substantially, Sharia compliance must be redefined not merely as the validity of contracts, but also based on wealth distribution performance. In conclusion, regulators and Sharia supervisory boards need to adopt maqasid-based performance indicators to transform IFIs into substantive agents of falah, rather than mere replicas of conventional institutions.

Abstract

This research examines how effective micro-financing is at BSI KCP Genteng in promoting the growth of MSMEs in suburban regions. What makes this study unique is its focus on the important role that Islamic banking plays after mergers in reducing local capital obstacles. Utilizing a descriptive qualitative approach, data were collected through comprehensive interviews with branch management, marketing personnel, and MSME clients. Findings show that micro-financing plays a crucial role in enhancing working capital, increasing production capabilities, and broadening market opportunities. The discussion emphasizes that the role of this financial support goes beyond just providing funds; it acts as a strategic tool for fostering equitable economic well-being. This study suggests that Islamic financial institutions should adopt digital services and ongoing mentorship to reinforce MSMEs as the cornerstone of the local economy

Abstract

This research aims to examine the concept of sharia values in sharia banking, its integration mechanisms in financing management, as well as the influence of sharia value-based financing management on the performance of sharia banks. The research approach used is qualitative with a literature review method of various national journals and relevant scientific proceedings. Data was collected through literature searches on scientific databases such as Google Scholar and accredited national journal portals, then analyzed using systematic content analysis techniques. The results of the study show that sharia values such as monotheism, justice, trust, transparency, benefit and balance are the fundamental basis for sharia bank operations and differentiate them from conventional banking. The integration of these values in financing management is realized through the use of sharia contracts, application of the precautionary principle, compliance with sharia fatwas, and orientation to sharia maqashid. Sharia value-based financing management has been proven to have a positive effect on the performance of sharia banks, both from the financial, operational, risk management and non-financial performance aspects from a sharia maqashid perspective. Thus, strengthening the integration of sharia values in financing management is a strategic factor in improving the performance and sustainability of sharia banks.

Abstract

This study aims to analyze the implementation of the Musyarakah Mutanaqishah (MMQ) contract in home financing products of Islamic banking institutions from the perspective of fiqh muamalah. Musyarakah Mutanaqishah represents an innovative Islamic financing scheme that combines partnership principles with gradual transfer of ownership, designed to avoid interest-based transactions in housing finance. This research employs a qualitative method with a normative and conceptual approach by examining classical and contemporary fiqh muamalah literature, the fatwas issued by the National Sharia Council of the Indonesian Ulama Council (DSN-MUI), and relevant regulatory frameworks. The findings indicate that normatively, the Musyarakah Mutanaqishah contract fulfills the essential pillars and conditions of a valid Islamic contract and is legally supported by DSN-MUI Fatwa No. 73/DSN-MUI/XI/2008. The mechanism of joint ownership, payment of ujrah for asset utilization, and gradual transfer of ownership reflects the principles of justice and mutual benefit emphasized in Islamic law. However, practical implementation reveals several challenges, including the potential imbalance of risk allocation and deviations from the ideal partnership model. Therefore, strengthening substantive compliance in the application of Musyarakah Mutanaqishah is essential to ensure alignment with the principles of fiqh muamalah and the objectives of maqashid al-shariah.

Abstract

This study aims to analyze the influence of Sharia Governance, Good Corporate Governance (GCG), and the Sharia Supervisory Board (DPS) on fraud prevention in Sharia Commercial Banks in Indonesia during the 2019–2024 period. Even though governance implementation in Islamic banking continues to be strengthened, fraud cases still occur, so the effectiveness of Sharia supervisory mechanisms needs further examination. Moreover, previous research results still show inconsistent findings and generally have not tested these three variables simultaneously in Sharia Commercial Banks. This study uses a quantitative approach with a causal associative research type and utilizes secondary data sourced from annual reports, Good Corporate Governance reports, Sharia Governance reports, and Sharia Supervisory Board reports. The sample is determined using a purposive sampling technique, resulting in 12 Sharia Commercial Banks with 72 observations over six years. The analysis was conducted using panel data regression with a Fixed Effect Model (FEM) approach. The study results show that Sharia Governance has a positive and significant effect on fraud prevention. Meanwhile, Good Corporate Governance and the Sharia Supervisory Board show a positive influence, but they do not have a significant partial effect yet. Simultaneously, all three variables have a positive and significant effect on fraud prevention. This study contributes to enriching the literature on the effectiveness of Sharia governance by testing the integrated mechanism of three oversight systems in Sharia Commercial Banks in Indonesia. The findings suggest the importance of strengthening Sharia-based and spiritual governance oversight systems by the Financial Services Authority (OJK) and Sharia Commercial Banks to enhance fraud prevention effectiveness and maintain public trust.

Abstract

This study aims to systematically review the integration of maqasid al-shariah into Islamic bank risk management and to develop a conceptual framework linking Shariah values, risk categories, governance, and sustainability. The study employs a Systematic Literature Review (SLR) approach following the PRISMA guidelines. Data were collected from Scopus, Web of Science, and Google Scholar using combinations of the keywords "maqasid al-shariah," "Islamic banking," "risk management," "Shariah governance," and "sustainable finance" with the Boolean operators AND and OR. The review was limited to peer-reviewed articles published in English between 2015 and 2026. Of the 135 records initially identified, 105 remained after duplicate removal, 45 articles were assessed through full-text screening, and 15 studies met the inclusion criteria for the final synthesis. The selected studies were analyzed using thematic analysis to identify major themes, research gaps, and conceptual relationships among the variables. The findings reveal that maqasid al-shariah has predominantly been employed as a normative framework for performance evaluation rather than as an operational foundation for risk management. The literature on financial risk, Shariah compliance risk, digital risk, governance, and sustainability also remains fragmented. Furthermore, no comprehensive model has explicitly translated the objectives of maqasid al-shariah into the processes of risk identification, measurement, mitigation, and monitoring. This study proposes an integrative maqasid-based risk governance framework that positions the protection of religion (hifz al-din), wealth (hifz al-mal), life (hifz al-nafs), intellect (hifz al-'aql), and progeny (hifz al-nasl) as the ethical foundation of Islamic bank risk management. The findings provide practical implications for regulators, Shariah Supervisory Boards, and Islamic bank management in developing risk management systems that are more equitable, accountable, and sustainable.

Abstract

Zakat is an Islamic economic instrument with significant potential to support social welfare and poverty alleviation in Indonesia. However, previous studies have largely examined zakat management from institutional, normative, or digitalization perspectives separately, while limited research has integrated data-driven management as a comprehensive framework for optimizing zakat collection and distribution. This study aims to analyze the optimization of data-driven zakat management in supporting poverty alleviation in Indonesia and proposes an integrated perspective linking data utilization, digital technology, and mustahik empowerment. The study employed a qualitative approach using library research. Data were collected from scholarly books, journal articles, official reports of the National Board of Zakat (BAZNAS), publications of the Center for Strategic Studies of BAZNAS (Puskas BAZNAS), Central Bureau of Statistics (BPS) data, zakat regulations, and other relevant academic literature. Data were analyzed using the interactive model of Miles, Huberman, and Saldaña, encompassing data collection, data condensation, data display, and conclusion drawing. The findings reveal three main points: first, data-driven management can improve the accuracy and effectiveness of zakat collection and distribution; second, the utilization of digital technologies, including zakat information systems, Big Data, Artificial Intelligence, and Geographic Information Systems, strengthens evidence-based decision-making and the targeting of mustahik empowerment programs; and third, fragmented databases, limited data quality, human resource capacity, and data security remain major challenges. Practically, the findings provide a strategic basis for BAZNAS and Zakat Management Organizations to develop integrated, secure, and evidence-based zakat management systems that enhance institutional accountability and strengthen zakat’s contribution to sustainable poverty alleviation in Indonesia.

Abstract

Bank Muamalat is the first Islamic bank. By carrying the name of Sharia, Bank Muamalat implements the Islamic Sharia system with several contracts applied in it. Islamic Bank is a Bank that in carrying out its business activities is based on Sharia Principles and according to its type consists of Islamic Commercial Banks and Islamic. This study aims to determine and analyze the implementation of the qordh and wakalah bil ujroh contracts in financing. In order to achieve this goal, here the researcher uses a descriptive qualitative method. In collecting data, the study collected from several data sources such as interviews with related parties, namely sub-branch managers, academics representing universities and practitioners. And in this study reveals the facts of the incident, conditions and variables that occurred when this study was taking place by presenting what actually happened after carrying out a financing agreement properly and in its implementation it was in accordance with the rules of the DSN MUI. However, in this financing system there is something that is still lacking, namely in terms of officers marketing financing, because in terms of financing, the person in charge is relationship marketing funding, not relationship marketing landing.
