Abstract

This study aims to analyze the axiological values underlying Qibla direction determination from the perspectives of Islamic astronomy (ʿilm al-falak) and ethical philosophy. The research employs a descriptive qualitative method with a limited field study and an interdisciplinary approach. Data were collected through literature review, observation, and measurements conducted at several prayer rooms within UIN Syekh Wasil Kediri, including geographic coordinates, Qibla calculations using spherical trigonometry, and verification through GPS, compass measurements, and astronomical applications. The findings reveal that Qibla determination has evolved from classical astronomical methods to the use of modern technologies that enable more accurate measurements. Variations in Qibla direction results are influenced by differences in coordinate data, instrument precision, geographical and environmental conditions, and human error. From an axiological perspective, Qibla accuracy possesses not only technical significance but also reflects values of truth, utility, moral responsibility, and scientific integrity. Ethical principles such as objectivity, methodological verification, data transparency, openness to correction, and epistemic justice are essential for ensuring the validity and accountability of Qibla determination. These findings demonstrate that Qibla direction determination constitutes a scientific practice that integrates astronomical accuracy, ethical responsibility, and spiritual values.

Abstract

This study examines the dynamics of Uang Panai’ in the marriages of the Bugis Makassar ethnic group in Sentani, Papua: between tradition and social reality, focusing on how the tradition of Uang Panai’ evolves, how it is practiced, and the social and economic impacts arising from its implementation.The research employs a qualitative method, with data collected through observation, interviews, and documentation involving customary actors, families of prospective brides and grooms, and community leaders of the Bugis-Makassar.The findings show that Uang Panai’ remains an important tradition that determines social status and family dignity, with the amount determined based on factors such as lineage, education, occupation, and the economic condition of the bride. The practice of Uang Panai’ has significant social impacts, serving as a symbol of prestige as well as a source of family pride, but it can also cause delays or even prevent marriage if its demands are not met. Economically, Uang Panai’ often becomes a heavy burden for prospective grooms, encouraging them to migrate or increase their income before marriage.These findings reveal a negotiation between efforts to preserve tradition and adapt to the socio-economic realities of the local community, showing that the practice of Uang Panai’ has undergone changes in value and meaning in the context of migration and cultural acculturation in Papua.

Abstract

This study aims to analyze the relational pattern between Islamic law, customary law, and national law in Indonesia from the perspective of philosophy of science and law. This research uses a normative method with a conceptual approach, through the examination of legal documents, statutory regulations, literature, and relevant court decisions. The research materials consist of primary legal materials in the form of books and journals on Islamic law, customary law, and national law, as well as secondary materials in the form of legal dictionaries and encyclopedias. The analysis is conducted descriptively and analytically through the stages of editing, classification, verification, analysis, and drawing conclusions. The results of the study show that Islamic law, customary law, and national law are complementary, harmonious, and responsive to the dynamics of society. Islamic law provides a sharia basis, customary law is flexible and contextual, while national law integrates the principles of Pancasila and the 1945 Constitution. The relationship among the three includes ontological, epistemological, and axiological dimensions, thereby forming a national legal system that is fair, contextual, and socially just. The conclusion of this study emphasizes the need for a flexible, normative, and interconnected model of legal relations, with the strengthening of dispute resolution institutions based on local wisdom to effectively support legal pluralism.

Abstract

This study aims to comprehensively analyze the role of mediators in resolving divorce cases at the Makassar Class 1A Religious Court from an Islamic legal perspective and examine the factors that contribute to the success and failure of mediation based on sharia principles. The study uses an empirical normative legal method with a statute approach and a conceptual approach. Primary legal sources include PERMA No. 1 of 2016, Law No. 1 of 1974, Law No. 7 of 1989, the Compilation of Islamic Law, and related MUI Fatwas. Secondary sources include fiqh books (Al-Mughni, Bidāyat al-Mujtahid), scientific journals, and data from Makassar Religious Court decisions from 2021-2023. Data collection was conducted through in-depth interviews with mediator judges, employee mediators, and the parties to the case, as well as document studies. The analysis uses the theory of maqāṣid syarī'ah (especially ḥifẓ al-nasl and ḥifẓ al-nafs), maslaḥah mursalah, and sadd al-dzarī'ah. The study found three main findings. First, the stages of mediation in the Makassar Religious Court include pre-mediation (in accordance with QS. An-Nisa: 35 concerning the appointment of hakamain), the mediation process with a reframing approach and religious counseling, and the preparation of a peace deed. Second, the factors for the success of mediation according to Islamic law are the competence of the mediator as a just hakam, the good faith of the parties (husn al-niyyah), and a psychological-sociological approach that maintains the family's welfare. Third, the factors for failure include a strong desire for divorce due to sharia reasons (continuous disputes, domestic violence, nusyuz), absence without a valid reason (lack of good faith), and the limited number of certified mediators. The success rate of mediation at the Makassar Religious Court is only around 10-15% of the total cases mediated (2021-2023).
