Abstract

The Indonesian government is actively pursuing infrastructure development, with railway projects being a key focus due to their high demand in Jakarta and its surrounding regions. However, the complexity of railway projects often leads to delays and numerous changes, resulting in scope modifications that necessitate change orders, which have negative consequences for the project. Managing these risks effectively is essential to mitigate their impact on project costs and performance. This study proposes a solution through the application of risk management using a qualitative method known as the Probability Impact Matrix, which helps assess the most significant risks leading to change orders. The research aims to identify and assess the risks responsible for contract change orders in the Double-Double Track Development Project. It uses a mixed-method approach, focusing on two main phases: risk identification and risk assessment. The study examines five risk factors, including project-related factors (X1), owner-related factors (X2), contractor-related factors (X3), design-related factors (X4), and external factors (X5). The results demonstrate that all five variables significantly influence changes in project scope, with risk levels ranging from moderate to high. These findings provide valuable insights for project owners, consultants, contractors, and other stakeholders involved in construction project management. The study serves as a reference for decision-making and the implementation of control measures to minimize the negative impact of change orders.

Abstract

This research explores the relationship between resilience sources and job satisfaction in post-COVID-19 Indonesia, emphasizing the mediating roles of vision, purpose, and empathy. Resilience, defined as the ability to adapt to adversity, has evolved from an individual trait to encompass organizational factors, especially in the context of significant disruptions like the COVID-19 pandemic. The study aims to fill existing literature gaps by analyzing how these resilience sources impact job satisfaction among Indonesian employees, thereby enhancing understanding of resilience in a local context. Using a quantitative approach, data were collected from 101 respondents, revealing a positive correlation between resilience and job satisfaction. Findings indicate that while resilience significantly predicts job satisfaction, vision, purpose, and empathy do not serve as effective mediators in this relationship. Additionally, age was found not to correlate with resilience, whereas senior managers exhibited higher resilience scores compared to lower-level employees. The research concludes that, despite the expected mediating roles of vision, purpose, and empathy, organizational resilience remains paramount for enhancing job satisfaction in a post-pandemic landscape.

Abstract

Drug abuse is one of the major challenges in global society. Data in the World Drug Report issued by UNODC shows that around 292 million people in the world will use drugs in 2024. The significant impact of this occurs in the younger generation. This study aims to analyze the experiences of clients undergoing inpatient rehabilitation at the Rehabilitation Center of the National Narcotics Agency (BNN) Indonesia using the Therapeutic Community (TC) method. This method facilitates social interaction and learning from shared experiences in an environment that supports the recovery process. Through semi-structured interviews with six clients from various provinces, this study found that cultural sensitivity plays an important role in increasing the effectiveness of rehabilitation. Clients can find their identity, form close relationships with fellow residents based on similar backgrounds, and understand diversity in the community. However, challenges arise from cultural differences that sometimes clash with TC values, requiring adaptation and understanding among clients. The results of the study indicate that the TC method at the BNN Rehabilitation Center was derived not only to contribute to the reduction of maladaptive behavior, but also to encourage the development of communication skills, emotional management, and independence. Although clients feel many benefits from the rehabilitation process, there is a need to increase recreational activities to prevent boredom. This study recommends the need for a more inclusive approach in understanding the cultural diversity of clients for more optimal results in drug rehabilitation.

Abstract

This study aims to analyse the effect of free trade zone (FTZ) on economic growth, with  a case study of Timor Leste’s Special Administrative Region of Oecusse-Ambeno (RAEOA). The study employs  a descriptive analysis  method  using secondary data and  literature study. The results show that FTZs can have a positive impact on a country’s economic growth but the impact depends on various factors such as government policies, infrastructure, and political stability. In the case of Timor Leste, the RAEOA, formed in 2002 has been attracting investment and contributing to the development of key industries such as agriculture, tourism, and fisheries, as well as natural resources such as oil and gas, However, the region still faces various economic challenges such as poverty, unemployment, and lack of infrastructure. Therefore, the study suggests that Timor Leste government carefully design the spillover mechanism of FTZ to ensure that the economic growth goal is followed by the social and economic impact in a way that results in more sustainable and equitable development.

Abstract

The conflict in Papua has evolved into an increasingly complex situation, with the separatist movement led by the Free Papua Organization (OPM) seeking to break away from Indonesia. This study examines the role of the Indonesian National Armed Forces (TNI) in supporting the acceleration of regional development in Papua amidst the ongoing conflict involving the Free Papua Organization (OPM). The primary objective is to analyze the TNI’s use of a "smart power" strategy that combines soft, hard, and diplomatic approaches to address security challenges while promoting socio-economic development. Employing a qualitative research method, this study gathers data through in-depth interviews, case studies, and secondary sources, including reports, documents, and media coverage. The results indicate that the TNI’s operations significantly contribute to infrastructure development, human resource improvement, and basic service delivery in Papua, despite persistent security threats from OPM. Strategies such as territorial engagement, community empowerment, and inclusive social communication have proven effective in mitigating conflict impacts. The findings also highlight the challenges posed by international narratives on human rights violations, requiring a balanced approach that fosters local trust and international accountability.

Abstract

This study aims to analyze the representation of Wuling's brand identity in the media of Antaranews, one of the leading news portals in Indonesia. Using a qualitative approach with a content analysis method, this study eval_uated 50 articles published in the period 2017 to 2023. The results of the analysis show that Wuling has succeeded in building a positive image through an emphasis on product quality, technological innovation, and after-sales service. However, there are challenges related to negative perceptions that are still attached to brands from China, especially regarding prices that are considered high. The study also found that the marketing communication strategies implemented by Wuling, including advertising campaigns and the use of social media, contributed to creating a positive buzz around their products. Thus, the study concludes that although Wuling has been successful in some aspects, market education and response to criticism are important steps to strengthen the brand's position in the Indonesian automotive market. These findings are expected to provide insights for the development of more effective communication strategies for Wuling and other brands in a competitive industry.

Abstract

The Job Creation Law and Government Regulation No. 8 of 2021 introduces an individual company owned by one individual. This can confuse personal and corporate interests and obscure responsibilities between directors and shareholders and is vulnerable the risk of bankruptcy. Analyzing the role of directors in the bankruptcy process through legal positivism is important to understand legal responsibilities and protections. Additionally, advances in artificial intelligence (AI) can improve decision-making efficiency and accuracy. The purpose of this study is to identify and analyze the role of directors in the bankruptcy process individual companies through the lens of positivism, as well as to explore the integration of artificial intelligence in improving board decision-making. The research method used is normative juridical, using a legislative approach and an analytical approach. The results of the study show that the board of directors has an important role in managing the bankruptcy process, especially in data-driven decision-making. In the event of bankruptcy, the board of directors faces certain legal consequences in accordance with Articles 16, 69 paragraphs (1), 97, and 104 of Law No. 37 of 2004 concerning Bankruptcy, as well as Article 93 of Law No. 40 of 2007 concerning Limited Liability Companies. Artificial intelligence has been proven help directors in analyzing risks and predicting outcomes, making decisions more informative and strategic. This study concludes that the application of positivism and artificial intelligence in the analysis of the role of directors in the bankruptcy process improves the effectiveness and efficiency of decision-making, especially in complex situations.

Abstract

Injustice in bankruptcy requirements between State-Owned Enterprises and private companies creates legal uncertainty and unfair treatment in restructuring processes. State-Owned Enterprises often receive more protection compared to private companies, even though both are subject to Law No. 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations. Article 2 paragraph (5) of this law stipulates that bankruptcy petitions against State-Owned Enterprises operating in the public interest can only be filed by the Minister of Finance, resulting in unequal legal treatment and raising questions about fairness in the bankruptcy system in Indonesia. This disparity negatively impacts business competition and public trust in the legal system. The purpose of this study is to analyze the injustice in bankruptcy requirements between State-Owned Enterprises and private companies, as well as to explore how artificial intelligence can be integrated to address these issues. The research method used is normative juridical, using a statutory approach and an analytical approach. The research findings indicate that the injustice in bankruptcy requirements is primarily caused by the differing legal treatment and policies that favor State-Owned Enterprises. The utilization of AI in bankruptcy data analysis and decision-making can assist in identifying patterns of injustice and provide more equitable and transparent recommendations. Artificial intelligence has the potential to address injustices in bankruptcy requirements between state-owned enterprises and private companies by enhancing transparency, accuracy, and fairness in legal processes. Its implementation requires clear regulatory support and collaboration among the government, legal institutions, and the private sector.

Abstract

Health services must be oriented towards meeting consumer demands and expectations, which are closely related to service quality. However, there are still problems in its implementation, such as discrimination against BPJS patients, who often get different treatment compared to non-BPJS patients, both in service quality and access to health facilities. According to Article 28H Paragraph (1) of the 1945 Constitution, everyone has the right to a prosperous life and decent health services. The objective of this study is to identify the role of artificial intelligence in reducing and preventing discrimination against BPJS patients in Health services, and to analyse how legal regulations can support the application of AI to ensure the creation of fair and non-discriminatory health services. [Methods] The research method used is normative juridical, using a statutory approach and an analytical approach. The results show that AI has significant potential in detecting and preventing discrimination, for example through algorithms that monitor the treatment of patients in real-time. However, the application of AI must be supported by a clear legal framework to ensure that the use of this technology does not exacerbate inequality, but rather supports equitable access to health services. The conclusion of this study is that artificial intelligence can be an effective solution in addressing discrimination of BPJS patients, as long as it is integrated with policies and regulations that protect the rights of patients, as well as ensuring oversight and accountability on the part of healthcare providers.

Abstract

Legal protection for patients in dental practice is becoming increasingly important with advancements in technology, including artificial intelligence. Positivism provides a framework for analyzing this protection, as outlined in Article 276 of Law Number 17 of 2023 concerning Health, which guarantees patients' right to complete information regarding their health condition and the medical procedures to be performed. However, challenges in implementing regulations often arise, particularly regarding the lack of clarity in the information provided by dentists to patients. The purpose of this study is to analyze the application of artificial intelligence in enhancing legal protection for patients in dental practice, as well as to explore legal protections for patients in dental practice from a positivist perspective. The research method used is normative juridical, using a statutory approach and an analytical approach. The research findings indicate that the application of AI in dentistry enhances legal protection for patients by improving diagnostic accuracy and reducing medical errors. AI also supports better data management and decision-making while increasing transparency and accountability. From a positivist perspective, the emphasis on clear regulations is crucial for protecting patients' rights, ensuring that AI not only improves service quality but also strengthens legal protection. The application of artificial intelligence in dental practice can enhance legal protection for patients by improving service quality and reducing the risk of medical errors. From a positivist perspective, the use of this technology aligns with legal principles aimed at protecting patients' rights and ensuring justice in medical practices.
