Abstract

Funds originating from transactions inconsistent with sharia principles, customer penalties, or funds with unidentified owners pose a serious challenge for Islamic financial, business, and economic institutions. Before DSN-MUI Fatwa No. 123 of 2018, no standardized guideline governed the use of such non-recognizable income funds (Dana TBDSP), risking inconsistent practice, reduced transparency, and weakened public trust. This article examines the provisions governing Dana TBDSP under Fatwa No. 123/2018 and analyzes their relevance to contemporary issues: strengthening accountability, integration with current OJK regulations, and the application of Environmental, Social, and Governance (ESG) principles. Using a normative-juridical and comparative approach to the fatwa, regulations, and non-halal fund management practices in Malaysia and other countries, the study finds that the fatwa regulates in detail the sources of Dana TBDSP, the obligation of a special account, disbursement procedures for public benefit, prohibition of internal use, and mandatory Sharia Supervisory Board (DPS) approval. Contemporary analysis reveals the urgency of synchronizing the fatwa with POJK No. 2 of 2024 and POJK No. 51/2017, clarifying non-compliance consequences, and reporting Dana TBDSP within a sustainability framework. The article concludes that the fatwa is an important step in strengthening non-halal fund governance and recommends technical guidelines, stricter sharia audits, and Dana TBDSP-specific ESG indicators to enhance accountability and social impact

Abstract

Paid endorsement activities carried out by content creators raise issues in determining the appropriate Indonesian Standard Industrial Classification (Klasifikasi Baku Lapangan Usaha Indonesia—KBLI), as such activities may involve elements of promotion, performance, audiovisual production, content publishing, and information provision. This study examines the legal qualification of paid endorsement activities and the application of the principal activity principle in determining the appropriate KBLI code. It employs normative legal research using statutory and conceptual approaches. The findings demonstrate that paid endorsement constitutes the provision of commercial services; however, its classification must be determined based on the substance of the contractual obligation and the principal output received by the service user. The appropriate KBLI code should therefore be identified by distinguishing the principal activity from supporting stages and examining the scope and exclusions of each relevant classification. The novelty of this study lies in formulating a case-by-case analytical framework for determining the KBLI classification of content creators. These findings may improve the accuracy of KBLI registration and ensure the conformity of business legality within the risk-based business licensing system.

Abstract

This study is motivated by the growing criticism of the retributive paradigm of punishment, which is considered insufficient in addressing victims’ needs and restoring social relationships damaged by crime. In this context, restorative justice emerges as an alternative approach emphasizing dialogue, acknowledgment of wrongdoing, and reparation as central elements of dispute resolution. In Indonesia, this approach has been institutionalized through various law enforcement policies, yet it still faces challenges such as potential pressure on victims, power imbalances, and the absence of a comprehensive regulatory framework. This research employs a normative legal method with a legal-philosophical approach and analysis of statutory regulations. It utilizes primary, secondary, and tertiary legal materials through library research to examine the position of restorative justice within the modern criminal justice system and to compare it with the retributive paradigm. The findings indicate that restorative justice better reflects humanistic values and has the potential to strengthen the legitimacy of the criminal justice system. However, without clear regulation and strict oversight, it may lead to legal uncertainty and potential misuse, thus requiring careful integration within the national legal framework.

Abstract

Family disharmony is a condition marked by prolonged conflict, poor communication, neglect of responsibilities, and emotional distance among family members. This study examines the concept of family disharmony from the perspective of Indonesian family law and its impact on physical and psychological well-being. Using a normative juridical method with statutory, conceptual, and analytical approaches, this study analyzes relevant legal regulations and scholarly literature. The findings indicate that although family disharmony is not explicitly regulated, it may be interpreted as a breakdown of family relationships that obstructs the fulfillment of legal rights and obligations. Disharmony becomes legally significant when it involves violence, neglect, intimidation, or rights violations. Its impacts include physical injuries, stress-related disorders, anxiety, trauma, and impaired child development. Strengthening legal education, counseling services, early intervention, and institutional cooperation is necessary to protect family welfare.

Abstract

This study analyzes the impact of digital legal counseling on public awareness of personal data protection in cyberspace. A quantitative survey was conducted with 100 respondents. The instrument comprised 10 statement items rated on a Likert scale from 1 to 5: five items measured Digital Legal Counseling (X), and five measured Public Awareness (Y). Data analysis included validity and reliability tests, descriptive statistics, residual normality testing, and simple linear regression. The instrument demonstrated good reliability, with Cronbach’s alpha values of 0.900 for X and 0.896 for Y. All items met the validity criterion. Regression analysis yielded a coefficient of 0.514, a t-statistic of 6.356, and p < 0.001. The model produced R² = 0.292 and F = 40.40, with p < 0.001. These findings indicate that digital legal counseling has a positive and significant effect on public awareness of personal data protection in cyberspace. Digital legal counseling explains 29.2% of the variation in awareness, while the remaining 70.8% is attributable to other factors. The findings highlight the importance of delivering legal information through digital media that are accessible, practical, and relevant to everyday personal data processing risks.
