Abstract

Legal protection efforts for narcotics abuse victims are based on Law Number 35 of 2009 concerning Narcotics which can be in the form of sanctions for action. This study aims to determine victims of narcotics abusers in terms of victimization based on Law Number 35 Year 2009 and legal protection for victims of narcotics abusers and the obstacles they face. Data collected from the results of research, both library research and field research, are then analyzed descriptively qualitatively, namely the method of data analysis by grouping data and selecting data obtained from research according to its quality and truth, then linked to laws and theories obtained from the literature, so obtained answers to the problems studied. Victims of narcotics abusers in terms of victimization based on Law Number 35 Year 2009 are those who unintentionally use narcotics, because they are persuaded, tricked, tricked, forced, and / or threatened to use narcotics. However, in practice those who are considered victims are those who have just been first caught red-handed with evidence that does not exceed those stipulated in the Supreme Court Circular Letter Number 4 of 2010. Legal protection for victims of narcotics abusers is carried out through rehabilitation. There are two types of rehabilitation provided, namely medical rehabilitation and social rehabilitation. The victims of abusers who were caught red-handed by the National Narcotics Agency immediately carried out rehabilitation without due process. While those who were caught red-handed by the Police, even though the evidence was under the provisions of the Circular of the Supreme Court No. 4 of 2010, the legal process continued, after that it was only rehabilitated.

Abstract

This study aims to examine and analyze: the factors that led to the occurrence of crimes in the form of persecution Klithih in the Special Region of Yogyakarta and the efforts made by the Police to prevent and overcome the crimes committed by Pelaku Klithih in the Special Region of Yogyakarta. This study uses library research library research and field research. The nature of this research is descriptive. This study uses primary data and secondary data. Data collection is done by interview. Data analysis in this study used qualitative analysis. Based on the results of the study it was concluded that, the factors that caused the crime of abuse with random victims of persecution, among others, were family factors that were not harmonious for the perpetrators, because parents were divorced. Most children are raised by one of the parents only or taken care of by their grandparents, then the freedom or control of parents is lacking, especially in association after the learning process in the school, the influence of technology in the form of vehicles that are capable and easy to get, poorly controlled and negatively impacted communication tools, juvenile psychologists in the transitional period both biologically and socially, legal sanctions that do not cause a deterrent  shock therapy effect for child offenders, as well as Polri efforts in overcoming this crime, including involving persuasive, pre emptive efforts preventive and repressive form of punishment for cases of severe children. Forms of guidance to school schools in Yogyakarta, joining Ceremonial training every Monday, other counseling efforts, patrolling during school hours by targeting school children who are playing truant, hanging out during school hours, and investigating and investigating events that occur involving both child perpetrators and victims, with existing techniques and Standard Operating Procedure.

Abstract

Penelitian ini bertujuan mengetahui proses hukum yang dilalui oleh anak ketika berhadapan dengan hukum akibat perbedaan pandangan politik pada pemilu 2019 di Kota Yogyakarta, sehingga dari proses hukum yang dijalani oleh anak dapat mewujudkan keadilan restoratif, serta mengetahui upaya yang dilakukan para penegak hukum dalam memenuhi hak-hak anak ketika menghadapi proses hukum. Pendekatan yang digunakan oleh penulis adalah pendekatan yuridis normatif. Penelitian normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau sekunder. Hasil Penelitian menunjukan penanganan terhadap anak yang berhadapan dengan hukum akibat perbedaan pandangan politik dilaksanakan sesuai dengan aturan yang berlaku yaitu dalam proses persidangannya tetap berpedoman dengan Undang-Undang No. 11 Tahun 2012 tentang Sistem Peradilan Anak, namun terkait dengan upaya-upaya non ajudikasi tidak dilakukan sesuai dengan prosedur dikarenakan  akibat tindak pidana yang dilakukan oleh anak mengaibatkan luka berat hal ini diperkuat dengan Visum Et Repertum Nomor: 015 II 2019 RSDS tanggal 8 Februari 2019.

Abstract

The asymmetric autonomy granting to Special Region of Yogyakarta and Papua Province raises a new problem. In the other hand, the exercise is not maximal. On the other hand, it creates a heartburning to the other region. Base on the those things, the problem can be formulated into two things: the first, how is the comparision of autonomy granted to Special Region of Yogyakarta dan Papua Region? The second, how is the exercise of the autonomy in Special Region of Yogyakarta and the autonomy in Papua Region This Question will be explored by library research method and conceptual and comparative approach. The result of this research is, the first, the special status granted is base on the reason of jurisprudence and the analysis of politics. The second, the exercise of the authority in Special Region of Yogyakarta has exercised well, while in Papua, it has not yet worked at all.

Abstract

The provision of legal assistance in criminal cases is one of the important things that must be given to every disadvantaged society but in reality this often becomes a problem in the lives of people who cannot afford it, therefore this study aims to 1To know the role The Institute for Legal Consultation and Assistance in cases of criminal acts that occur. 2 To find out what constraints faced by the Legal Consultation and Aid Agency in handling and resolving cases of crimes that occur. This study uses a normative method which refers to the application of legal norms or norms. The research was carried out using the literature approach and legislation, then analyzed the data using qualitative analysis methods, namely data sourced directly from the field which will then be presented descriptively. In helping disadvantaged people, the role of the Institute for Consultation and Legal Aid has not been carried out optimally because it is still constrained by human resources that are not yet sufficient in several Legal Aid and Consultation Institutions this is of course important to be noticed together by all parties, because the purpose of the presence of the Legal Consultation and Assistance Agency through Law No. 16 of 2011 concerning Legal Aid is to help poor people for free.

Abstract

In Yogyakarta Non-Indigenous Indonesian Citizens may not own land with proprietary rights, this is based on the Deputy Governor s Instruction No.898 I A 1975 concerning Univormity of Policy on Granting of Land Rights Against Non-Indigenous Indonesian Citizens, in reality the Deputy Governor’s Instruction is still valid to date although DIY has fully enacted the LoGA since 1984.This research is normative legal research. This study uses primary legal material in the form of applicable legislation and secondary legal material in the form of legal literature. This study uses a legislative approach that is used to review and analyse all laws and regulations that have relevance to the legal issues being addressed. Based on the research result obtained data that the land office in DIY still applies the Deputy Governor’s instruction No.898 I A 1975 so that non-native Indonesian citizens will not be given land with a status of ownership rights, and seen from the hierarchy of legislation the Deputy Governor s instruction should be No. 898 I A 1975 may not defeat the Law 1945 Constitusion of the Republic of Indonesia, the LoGA, and the Citizenship Act where the Deputy Governors Instruction is under the Act. This also violates the principle of Lex Superior Derogate Inferiori the higher Act defeats the Law under it.

Abstract

Optimalisasi Pendapatan Asli Daerah merupakan aspek penting dalam pelaksanaan pembangunan di daerah karena semenjak berlakunya otonomi daerah, pemerintah daerah tidak lagi tergantung pada pemerintah pusat dalam melaksanakan pembangunan. PAD yang semakin besar tentunya akan memberikan kesempatan yang luas bagi daerah untuk melaksanakan pembangunan guna meningkatkan kesejahteraan masyarakat. Penelitian ini bertujuan untuk 1 mengetahui faktor yang menjadi pertimbangan dalam menentukan pilihan bentuk hukum BUMD di Kota Magelang 2 Mengetahui upaya yang dilakukan BUMD dalam memberikan kontribusi dalam meningkatkan Pendapatan Asli Daerah di Kota Magelang 3 Mengetahui kendala bagi Pemerintah Kota Magelang dalam menjalankan usaha melalui BUMD. Penelitian ini merupakan penelitian normatif yuridis dengan metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang. Data yang diperlukan terdiri dari data primer dan data sekunder. Metode analisis yang dilakukan dengan analisis kualitatif yaitu suatu metode analisis yang dilakukan dengan memberikan gambaran yang lebih jelas mengenai masalah yang diteliti. Berdasarkan hasil penelitian, maka kesimpulan dari penelitian ini adalah sebagai berikut 1 faktor-faktor yang menjadi pertimbangan dalam menentukan pilihan bentuk hukum BUMD di Kota Magelang yaitu  a Faktor kepemilikan modal usaha perusahaan daerah hanya di miliki oleh Pemerintah Daerah Kota Magelang b Faktor batas wewenang dan tanggung jawab pemilik, dimana dengan dimensi tanggung jawab perusahaan daerah untuk mendapatkan keuntungan dan sekaligus pelayanan sosial guna membantu pembangunan di daerah, maka kebijakan-kebijakan yang menyangkut masyarakat, berada di kewenangan Kepala Daerah Kota Magelang 2 Upaya-upaya yang dilakukan agar BUMD Kota Magelang dapat memberikan kontribusi dalam meningkatkan pendapatan asli daerah yaitu a Meningkatkan pendapatan dengan cara mengadakan perubahan dan inovasi di perusahaan daerah b Mengelola perusahaan secara efektif dan efisien, dimana biaya-biaya yang masih dpaat ditunda, maka kebijakan yang ditempuh dengan cara mengalokasi dananya pada hal-hal yang lebih prioritas 3 Yang menjadi kendala bagi Pemerintah Daerah Kota Magelang dalam menjalankan usaha.

Abstract

This research aims to determine the quality of public services in the health by conducting a case study of health services at Palue Health Center, analyzing constraints that hinder optimization of health services and offering solutions as an effort to resolve these problems so that health services in Palue Health Center can be optimal.The research is descriptive and empirical research, the approach method used is empirical juridical approach. The research is located in Palue Health Center, Palue District, Sikka Regency, East Nusa Tenggara Province. Primary data collection by observation and interview techniques, secondary by library research. The research result were analyzed by qualitative methods and presented descriptively. Public services in the health sector at Palue Health Center have not been optimal. This is based on 5 five basic health service requirements and 5 five public service indicators Parasuraman et al. and 4 four indicators of the fulfillment of the right to health. Constraints that cause health services are not optimal, among others, facilities and infrastructure that are inadequate, incomplete and damaged, lack of workforce, competency in human resources and community participation in appreciating services held by Palue Health Center and government policies that hamper improvement service quality. Efforts to optimize health service including improving and completing advice and infrastructure, to increase the competency of health and non-health workers in accordance with The Minimum Standard of Health Service in The District City and government policies that accommodate the fullfilment of the rights of Palue Health Center and remote and very remote areas based on applicable laws and regulations.

Abstract

Penelitian ini bertujuan menganalisis proses pengambilan kebijakan yang dilakukan oleh penyidik Polda Daerah Istimewa Yogyakarta dalam pengungkapan tindak kejahatan transaksi elektronik, selain bertujuan mengatahui hambatan dalam mengambilan kebijakan. Jenis penelitian yang dipakai oleh penulis adalah penulisan normatif. Penelitian normatif ini dilakukan penulis untuk menganalisis terkait pengambilan kebijakan penyidikan dalam pengungkapan tindak kejahatan informasi dan transaksi elektronik. Hasil penelitian menunjukan bahwa kebijakan hukum yang diambil oleh penyidik dalam pengungkapan tindak pidana kejahatan informasi dan transaksi elektronik disebabkan adanya identitas pelaku yang dipalsukan, sehingga menyulitkan prosedur penangkapan. Berdasarkan mekanisme ini penyidik melakukan pengambilan kebijakan dengan merubah identitas pelaku pada saat penangkapan, hal ini di dasarkan dalam Pasal 6 dan 7 dalam Kitab Undang-Undang Hukum Acara Pidana yang kemudian juga dikuatkan dalam Pasal 18 Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian Negara. Hambatan dalam pengambilan kebijakan hukum pengungkapan kejahatan eletronik dan informatika karena membutuhkan biaya, keberadaan pelaku di tempat yang jauh dari wilayah hukum kejadian dari tempat pelaporan korban.

Abstract

This study aims to know the implementation of Regional Regulation Number 5 of 2016 concerning Village Official in the village official selection organization and factors that cause the lawsuit to Yogyakarta State Administration Court. This study used normative juridical approach through descriptive qualitative study. The study used primary data that was obtained through observation and interview and secondary data that was collected through books review and documents like constitution and others that related to this study. The data was then analyzed qualitatively. The result reveals that the implementation of Regional Regulation of Bantul Regency Number 5 of 2016 concerning Village Official does not resemble the original regulation. It can be seen that the society or the official does not fully understand every article of the regulation and that can lead to misperception. The misperception of the regulation directs to incorrect implementation. This is what is considered as fatal mistakes by the society so that this can be used as a basis for filling a lawsuit to the State Administration Court.
