Abstract

Throughout the history of Islamic teachings that have been brought by Rasulullah SAW since 14 centuries ago, the scholars have always placed maslahah as the main principle in Islamic sharia. Sharia's goal is to achieve maslahah. Sharia's ultimate goal is known as maqashid al-syariah. A Muslim's life will achieve worldly and ukhrawi happiness by applying the concept of maslahah, both in ijtihad and determining the value of services and goods. Modern economic theory, on the other hand, holds that the primary goal of a consumer is to obtain the greatest level of satisfaction (maximization of utility). With this goal in mind, a consumer will tend to spend his money in order to achieve the greatest level of satisfaction. As a result, there is one fundamental value contained in maximizing utility, namely the existence of an isyraf (wasteful) attitude. Despite the fact that isyraf is among the forbidden nature and satanic acts condemned by the Koran. The theme discussed in this study, which employs a descriptive qualitative methodology, is the implementation of maslahah in the opinion of Imam al-Ghazali, a prominent Islamic scholar known for his thoughts on the concept of maslahah and maqashid al-syariah. The findings show that the concept of maslahah that he proposes for human welfare can actually accommodate all human needs and is more comprehensive than the concept of utility in the modern economy.

Abstract

The practice of Islamic economics during the time of Rasulullah SAW, the generation of companions (khulafa ar-rasyidun), and afterward played a significant role in the development of prosperity and social justice. Furthermore, every adherent is required to apply fiqh law in the development of the Islamic economy. However, in today's world, trading practices have spread to international networks, resulting in dumping. Dumping is the practice of exporters selling products at relatively lower prices than normal prices. The goal of this research is to discover why Imam Suyuthi believes that dumping (siyasah al-ighraq) in trade is permissible. Although Imam Suyuthi, the founder of the leading Syafi'iyah school in 9th century Hijriyah, did not specifically discuss dumping law, he did explain various fiqh principles (Qaidat al-Fiqh) in his work Al-Asybah Wa An-Nadzair, so that he could reformulate every event that has not and will not appear in classical fiqh problems. The authors are well aware that the term dumping (Siyasat al-ighraq) was not found during the time of Rasulullah SAW, so Islamic law researchers linked the policy of Amir al-Mukminin, Caliph Umar bin Khatab RA.. This is library research (Library research), and the authors use a qualitative research method, which is a type of research in which data is obtained from documentation data, such as books, laws, and so on. In terms of analyzing the constituent data using analytical descriptive analysis, the goal is to describe and analyze the data in depth. While the approach model employed is historical and social in nature. Imam Suyuthi's viewpoint on the practice of dumping in trade, citing the need to eliminate harm and the importance of government policies in meeting the needs of its citizens. Imam Khawarizmi proposed "maintaining the purpose of syara' (in establishing law) by avoiding human damage

Abstract

The phenomenon of fear of being different (xenophobia), which has recently emerged in the global world, has made the issue of hospitality an urgent one to be seriously reviewed. Following Mona Siddique's argument (2015) that the problem of friendliness towards people of other religions actually boils down to a tug-of-war between two factors that attract each other within a person, namely moral factors and legal factors, This paper mainly focuses on discussing how the contestation between these two factors occurs within a student and how it affects their response to issues of hospitality towards others, to anticipate xenophobia among young Muslims in the future. This paper concludes that there is a hierarchy of value systems (represented by moral and legal values) within the students that influence their responses to issues between religious communities in general and hospitality to religious communities in particular. At this point, the potential for santri and Islamic scholarship among mahasantri significantly increases this value system and, in the end, produces very positive implications for their good understanding of hospitality towards non-Muslims
