Abstract

The Constitutional Court's decision Number 46/PUU-VIII/2010 concerning the status of children born out of wedlock is a revolutionary decision made by the Constitutional Court. The decision stated that children born out of wedlock not only have a civil relationship with the mother and their mother's family, but also have a civil relationship with their biological father and biological father's family which can be proven based on the development of science and technology. The changes that occur in Article 43 paragraph (1) have implications for Islamic family law in Indonesia. The new law is interesting if reviewed using maqāṣid syarī'ah analysis with library research, with documentation data collection techniques, and uses two data sources, primary and secondary. The results showed that according to the maqāṣid syarī'ah analysis, the Constitutional Court's decision did not violate the the rules of syara', because it contained maṣlaḥah (goodness) and did not contain elements of ḍarar (damage) in the decision. This decision is also in line with the principles of maqāṣid syarī'ah, namely the principles of ḥifẓ al-dīn (protection of faith or religion), ḥifẓ al-nafs (protection of life), ḥifẓ al-‘aql (protection of intellect), ḥifẓ al-nasl (protection of lineage or ancestry) and ḥifẓ al-māl (protection of property or wealth). The implication of this decision is that children born out of wedlock have the same rights as children born from legal marriages, namely the right to lineage to their biological father, to earn a living, inheritance and equality before the law.

Abstract

 A bride-to-be after performing ijab and kobul in the presence of the ruler, starting with the bridegroom shaking hands with the guardian or guardian representing him is witnessed and approved by the witnesses who attend the wedding agreement, then in this case there are rights and obligations that must be in Fahmi by both and fulfilled as they should be. This research will examine how the efforts to fulfill the livelihood of santri who still live in the boarding school lirboyo HM Al-Mahrusiyah kediri city and studied with the sociology of Islamic law. This research is a field research that explains and describes data obtained from the field, and analyzes it. Using qualitative research methods, the subject in this study was a husband who still lives in a family boarding school, which numbers three families, equipped with primary data sources and secondary data. The data collection is taken with two steps, namely semi-structured interviews and documentation. Research reveals that husbands who still live in the cottage can carry out both, namely taking religious education and providing a living for the family properly and fulfilled but can not be done optimally, the efforts of the husbands are broadly disturbed psychically because they are responsible for providing a living born and inward and some are not disturbed because they feel they have assets and to know how the salaf hut, In social symptoms that arise when unable to meet in person when in need of an inner living cannot be fulfilled or delayed until the two meet again.

Abstract

In adjudicating a case, the court as the executor of judicial power of course sees whether it has the authority to adjudicate the case submitted by the plaintiff based on the absolute competence of each court within a particular judicial institution. However, in practice, there are courts in the general judiciary which consider the case being submitted by the plaintiff to be their authority, even though when referring to the applicable provisions, the case submitted by the plaintiff is essentially a case whose authority lies with the court in the religious court institution. This study discusses how the legal considerations of judges are based and how the judges' decisions match the absolute competence limits of religious courts in the Judicial Review Decision Number 672 PK/Pdt/2016. This study uses a normative legal research type by using a law approach and a case approach in analyzing legal problems. The results of this study can be concluded as follows: First, in the consideration of the panel of judges in the court of first instance until the cassation, there was an error in applying the law in which the panel of judges was fixated on the title of the lawsuit against the law which actually the substance of the lawsuit is an inheritance case between people who are Muslims who are under the authority of the Kediri Regency Religious Court, not the Kediri Regency District Court. Second, the decision of the panel of judges which stated that the district court was not authorized to hear the case in the Judicial Review Decision Number 672 PK/Pdt/2016 was in accordance with the absolute competence limit of the religious court.

Abstract

 In Islam, marriage is a sacred stage and is clearly regulated religion. One of them is the presence of guardian judges in marriage, although, in its application to differences of opinion among scholars, its presence in the wedding ceremony is a must. This paper tries to describe the position of guardian judges in marriage from the perspective of maslahah mursalah by using a qualitative descriptive approach. The author tries to present the problem of marriage in the Jombang Regency area and presents data based on a theoretical framework so that a complete conclusion can be drawn. The results of this study are that in several marriage problems in Jombang Regency, the Guardian Judge is one of the solutions for the benefit of the bride whose guardian does not meet the requirements for marriage.

Abstract

Tujuan perkawinan adalah untuk menciptakan keluarga yang harmonis, jauh dari kata perceraian. Akan tetapi, tidak menutup kemungkinan rumah tangga yang dibangun sedemikian rupa akan berakhir oleh sebab-sebab yang sulit dihindari. Untuk meminimalisir sebab-sebab terjadinya perceraian, suami istri dapat melakukan suatu perjanjian, salah satunya adalah shighat taklik talak. Taklik talak merupakan salah satu perjanjian yang diadakan dalam perkawinan, dalam hal ini sighat taklik diucapkan oleh suami setelah akad nikah, yang isi dari sighat taklik talak tersebut telah ditentukan dalam Peraturan Menteri Agama RI No. 2 tahun 2000, pengucapannya tidak wajib dan tidak menjadi syarat sahnya sebuah perkawinan. Namun jika sighat taklik talak tersebut telah diucapkan maka tidak dapat dicabut kembali. Implementasinya di desa Buduran dan desa Plakaran taklik talak tidak di lafadzkan, akan tetapi suami langsung mananda tanganinya. Permasalahannya di sini adalah apakah suami paham terhadap sighat isi taklik talak yang ia tanda tangani atau hanya memenuhi perintah dari petugas KUA saja, dan bagaimana keterkaitan antara pemahaman sighat taklik talak dengan tercapainya tujuan perkawinan menurut KHI pasal 3. Penelitian ini merupakan penelitian lapangan (field research), yaitu penelitian yang dilakukan di desa Buduran dan desa Plakaran, Kecamatan Arosbaya, Kabupaten Bangkalan, Penelitian ini menggunakan pendekatan kualitatif dengan analisis deskriptif, dimana kehadiran peneliti di lapangan sangat diperlukan. Sumber data utama penelitian kualitatif adalah kata-kata dan tindakan, selebihnya adalah data tambahan seperti dokumen. Metode pengumpulan data yang digunakan peneliti adalah dengan menggunakan metode wawancara, observasi dan dokumentasi. Subyek penelitiannya yaitu para suami yang meninggalkan istri.Implementasi taklik talak di lakukan oleh istri yang di tinggalkan suaminya tanpa adanya penyelesaian perceraian, dikarekan suami merasa kecewa dan sakit hati kepada istri atau juga karean suami meninggaalkan istri dan kawin lagi dengan wanita lain bahkan juga karena tidak adanya biaya perkara.

Abstract

Marriage is an inner and outer bond between a man and a woman as husband and wife to form a happy and eternal family (household) based on God Almighty. Marriage is a legal action, so things or actions that arise as a result of marriage are legal actions that get legal protection. If the marriage is not legally registered, then matters relating to the consequences of marriage cannot be legally resolved. The researcher describes the program from the KUA Kedungadem District in reducing the number of unregistered marriages. File collection methods used are in-depth interviews and documentation techniques. Based on the results of research related to the effectiveness of the Kedungadem Religious Affairs Office program in reducing the number of unregistered marriages in 2017 in terms of time and material, the implementation tends to be effective and successful in reducing the number of unregistered marriages that do not exceed 5 or 0% of unregistered married couples, then in 2018 the time and the implementation was effective and 3 couples did unregistered marriages, so it did not exceed the program target, and then in 2019, this increased to 8 couples who did unregistered marriages so that the program was not successful in reducing the number of unregistered marriages. The program is running and less effective as well as increasing the number of couples who marry sirri. Marriages that meet the requirements and pillars according to religion without being registered at the Office of Religious Affairs are legal enough, but based on regulations in the Indonesian state, marriage is still enforced and is registered in the form of a marriage certificate so that it has legal force. Abstract

Customary inheritance law in Indonesia has diversity based on regional customs, one of which is waiting for Tubang with a female mayoral inheritance system as the sole heir to receive an inheritance. This paper seeks to understand the system and analysis of Islamic law on the practice of customary inheritance in the village of Pajar Bulan-West Lampung. This type of research is qualitative-empirical and uses the theory of 'urf as an analytical knife. This study found that the practice of inheritance the costom waiting for Tubang in the Semendo community in Pajar Bulan village is carried out in three systems: First, the female mayoral system (the eldest daughter), that is, those who are entitled to receive the inheritance in full and not divided. Second, the male mayorate system which replaces the female mayorate as a waiting Tubang through family deliberations. Third, the ngangkit marriage system, namely the marriage of sons from families who do not have daughters waiting for Tubang to women from relatives who are found waiting for Tubang. Meanwhile, the practice of customary inheritance, waiting for Tubang, is analyzed from sources of Islamic law ('urf). So it can be grouped into three categories: first in terms of form, the customary inheritance of waiting for Tubang is included in the category of customary customs in deeds (al-'urf al-'amaliyah). Both in terms of value, the practice of inheritance waiting for tubang is included in the customary category which is in line with shari'ah principles (al-'urf al-shahih). Thirdly, in terms of scope, the practice of customary inheritance of waiting for Tubang is included in the category of general customs (al'urf al-'am) which applies to the Semendo community of Pajar Bulan Village.

Abstract

Abstract Indonesia is a unitary state consisting of thousands of large and small islands, and consists of various tribes, cultures and religions, and has the motto Bhinneka Tunggal Ika. The motto describes the diversity in Indonesia but all of them are one unit, such a diverse society will mingle and interact together in the life of society, nation and state. Interaction between tribes, races and religions is the initial door for people to know each other so that from this interaction some go to the marriage stage, some even get married even though they are constrained by different religions. This is gradually feared to cause a problem, if it refers to the norms that exist in religion regarding certain boundaries regarding marriage. Recently, there has been a decision by the Surabaya District Court Number 916/Pdt.P/2022/PN.Sby. which grants requests for interfaith marriages. This determination certainly attracts attention when considering the rules contained in the UUP that marriage is valid if it is carried out according to the laws of each religious belief. The purpose of this study is to examine how the judge's considerations in determining the marriage application case study decision Number 916/Pdt.P/2022/PN.Sby. and how the applicable regulations and norms regarding marriage. This type of research is (library research), namely by tracing sources of data or literature obtained from applicable regulations, books and others that have relevant. This research is descriptive analytical using a normative juridical approach. The results of this study indicate that the judges allow interfaith marriages by considering that each applicant remains in his position to carry out marriages by sticking to their respective beliefs and referring to Article 35 letter (a) of Law Number 23 of 2006 concerning Population Administration. It is hoped that this paper can provide views to the public regarding the problems of implementing interfaith marriages in Indonesia. Keywords: Determination, interfaith marriage, marriage law. Abstrak Indonesia adalah sebuah negara kesatuan yang terdiri dari atas ribuan pulau besar dan kecil, serta terdiri dari berbagai suku, budaya serta agama, dan memiliki semboyan Bhinneka Tunggal Ika. Semboyan tersebut menggambarkan keberagaman di Indonesia tetapi semuanya itu merupakan satu kesatuan, masyarakat yang begitu beragam tersebut akan membaur serta berinteraksi bersama dalam kehidupan bermasyarakat, berbangsa dan bernegara. Interaksi antar suku, ras dan agama adalah pintu awal masyarakat saling mengetahui sehingga dari interaksi tersebut ada yang berjalan ke tahap perkawinan, bahkan terdapat pula yang melakukan pernikahan walaupun terkendala beda agama. Hal tersebut lambat laun dikhawatirkan menimbulkan sebuah permasalahan, jika merujuk pada norma-norma yang ada dalam agama tentang batasan-batasan tertentu mengenai perkawinan. Dewasa ini muncul sebuah penetapan Pengadilan Negeri Surabaya Nomor 916/Pdt.P/2022/PN.Sby. yang mengabulkan permohonan untuk melangsungkan pernikahan beda agama. Penetepan tersebut tentu menarik perhatian jika mengingat aturan yang terdapat dalam UUP bahwa sahnya perkawinan apabila dilakukan menurut hukum masing-masing agama kepercayaan. Tujuan penelitian ini adalah menela’ah bagaimana pertimbangan hakim dalam menetapkan permohonan perkawinan studi kasus putusan Nomor 916/Pdt.P/2022/PN.Sby. dan bagaimana peraturan yang berlaku serta norma-norma mengenai perkawinan. Jenis penelitian ini merupakan (library research), yaitu dengan menelusuri sumber-sumber data atau literatur yang diperoleh dari aturan yang berlaku, buku-buku dan lainnya yang memiliki hubungan relevan. Penelitian ini bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif. Hasil penelitian ini menunjukkan bahwa hakim mengizinkan perkawinan beda agama dengan menimbang para pemohon masing-masing tetap pada pendiriannya untuk melangsungkan perkawinan dengan tetap pada kepercayaannya masing-masing serta merujuk pasal 35 huruf (a) UndangUndang Nomor 23 Tahun 2006 Tentang Administrasi Kependudukan. Diharapkan tulisan ini dapat memberikan pandangan kepada khalayak mengenai problematika pelaksanaan perkawinan beda agama di Indonesia. Abstract

Socially, the family is the smallest community in society which is formed through a legal engagement (marriage), as well as according to Islamic law. With the formation of a family, what inevitably happens is the emergence of family conflicts which can arise from internal (family) and can also be external (outside parties) as happened in the City of Kediri, with as many as 325 cases of family conflicts that ended in lawsuits for divorce or divorce only in a relatively short period of time, namely the last 6 months in 2022. Understanding the conflicts that occur in the family aims to avoid the general societal stigma that conflict is something negative, even though there are positive things from conflict if you take lessons from conflict such as being aware of each other's shortcomings and being able to open to each other. Therefore, according to the author, the Sociology of Islamic Law is the right approach to use in understanding conflict in the family. By understanding the Sociology of Islamic Law, the rules for fostering a family will be understood by every member of the family, such as the rules that Allah SWT stipulates in QS. A-Rum: 21, QS. At-Tahrim: 6 and so on. The method used in this study uses a qualitative research approach the type used in this research is a type of field research or field, it can also be said as empirical or sociological research. In conclusion, as far as we all know, the stigma of conflict is something bad, of course, this is not the case if we look at it from the other side (social and Islamic law). An understanding of life, namely sociology, and Islamic law to resolve all family conflicts is the most important part to be known together to realize dreams in the family, namely sakinah mawaddah warohmah.

Abstract

The purpose of this research is to find out the background factors and description of the tradition of prohibiting Ngalor Ngulon marriage in Purwoharjo Village from the Perspective of Jassir Auda's System Theory. This research method uses qualitative field research with a conceptual approach using Jassir Auda's systems theory concept. The research data was generated through direct interviews with the people of Purwoharjo Village, Purwoharjo District, Banyuwangi Regency as the research location. The conclusion of this study is that the Ngalor Ngulon Marriage Prohibition tradition is prohibited in Purwoharjo Village due to several factors, namely habit or customs, lack of religious knowledge, belief, and social structure. Based on Jasser Auda's view, the purpose of Islamic law must be universal so that Islamic law can be accepted anytime, anywhere, and in all circumstances, with the aim of the common good rather than individuals. A system for dealing with problems must be in accordance with the goals of Islam itself. Referring to the Ngalor Ngulon Marriage Prohibition tradition, it can be preserved by removing fasid or harmful elements in the custom. This is because this tradition is a custom or custom of Purwoharjo Village which cannot be simply erased. This tradition also does not necessarily prohibit marriage, but only in certain directions, namely Ngalor Ngulon.
