Abstract

The position of women is clear both in terms of Islamic perspective and in terms of state policies in the form of laws and regulations that have placed women in a dignified position that can develop themselves in carrying out their roles, duties and functions. On the other hand, participating in maintaining a balance between family responsibilities and work outside the household without neglecting roles in the household and maintaining social and religious culture values. The existence of women workers cannot be denied, both on a large scale role in the development of the nation and state as well as on the scale of status and family welfare by working outside the home (productive work) or social activities in irder to actualize themselves. This research seeks to find a tangent point between Islamic teachings and state policies in providing protection for the reproductive rights of female workers. The results of the study show that the concepts contained in Islamic teachings and state policies have many tangent points related to the obligation to provide protection for workers, especially female workers and the fulfillment of their rights for the benefit of mankind as a whole.

Abstract

Changes in economic structure and ideology have an impact on the way modern humans view life and family. One of the paradigms shifts that has emerged is the decision of family couples to postpone pregnancy or even not to have children. This phenomenon is even starting to spread among Indonesian society, pioneered by several public figures. This article aims to explain the childfree phenomenon from the perspective of Maqasid Syari'ah Abu Ishaq Al-Syatibi and Utilitarianism. This research is classified as qualitative research using netnographic studies using several sources on social media platforms. Supported by a library research approach. The results of the research that has been carried out show that from the perspective of Maqasid Syari'ah Abu Ishaq Al-Syatibi the phenomenon of childfree is contrary to the concept of the main goal of Maqasid Syari'ah Abu Ishaq Al-Syatibi because looking after offspring is classified as the main goal where this phenomenon eliminates the nature of a woman, and This is also not in line with the purpose of marriage. In contrast to the utilitarian perspective that childlessness has an impact on reducing the number of human populations and abandoned children throughout the world, on the other hand, women have the right and freedom to choose whether to have children or not. If the decision not to have children does not harm other people and no party feels disadvantaged, the decision can be accepted. The contribution of the results of this research can be used as material for consideration in formulating policies in responding to the childfree phenomenon so that it is more open and wiser from various points of view.

Abstract

In Islamic inheritance law, it has been explained in detail and clearly about the procedures for the distribution and transfer of inheritance to the heirs and the things that prevent the heirs from getting the inheritance from the heir. This prohibition is based on the hadith of the prophet. However, this law is not a single law, there are differences of opinion among scholars. This type of research is qualitative research, which in the study process used library material (library research) which examines library material related to Ibn Rushd's legal istinbath method in the Book of Bidayatul Mujtahid wa Nihayatul Muqtasid about the inheritance of different religions. From the results of the author's research, there are several results, namely: Ibn Rushd in deciding an Islamic law employment the Qur'an and al-Sunnah as the most premise. But since the two sources are exceptionally constrained, he too employments ijtihad as an elective strategy to unravel the developing issues of Sharia law. In fathoming the progressively complex issues of Sharia law, Ibn Rushd broadly utilized qiyas (similarity). Another result regarding inheritance from different religions, in the Bidayatul Mujtahid book, is explained: First, there is no inheritance between the two. Regarding inheritance between different religions, the book Bidayatul Mujtahid explains: First, there is no inheritance between the two. Given the concept of fiqh mawaris, a Muslim cannot inherit the property of a non-Muslim, and vice versa a non-Muslim cannot inherit the property of a Muslim. Secondly, Ats-Tsauri and the majority of the scholars of Kuffah, as well as the majority of the scholars of Basrah think that his inheritance can be passed on to Muslim heirs, but not vice versa. This opinion was also derived from Ibn Mas'ud and Ali ibn Abi Talib.

Abstract

Socio-historically, the role and contribution of women often do not receive the attention they deserve in the history of Islamic civilization. Many historical records tend to emphasize male figures and ignore or underestimate the contributions of women. This creates a significant gap in understanding regarding the position and role of women in Islamic history. This paper tries to describe two things. First, the position of women in Islamic history. Second, the implications of women's position in Islamic history on Indonesian family law. Because, basically, the process of forming laws in Indonesia is the position of women in the past. This type of research, using literature research with the research properties of descriptive-prescriptive analysis. While the approach used is the historical approach.  The results of this study show: First, the portrait of the position of women in Islamic history, especially in pre-Islamic and Islamic thought (interpretation and jurisprudence) women are placed in the second position after men. Second, the family law that was formed was a lot of descriptive content, exploitation, because it was formed based on the history of women's position in Islam which was charged with male culture.

Abstract

Pernikahan merupakan peristiwa hukum yang sakral, oleh karena itu keabsahan status perkawinan menjadi hal penting yang harus diperhatikan. Kemudian timbul suatu persoalan yakni bagaimana bila pernikahan yang didasarkan pada aturan Agama namun tidak dilakukan pencatatan di Kantor Pencatatan Nikah atau Kantor Urusan Agama. Hal tersebut tentunya akan menimbulkan dampak negatif, salah satunya perlindungan hukum dan kepastian hukum terhadap anak yang dilahirkan dari hubungan suami-istri. Namun hal menarik lainnya, pemerintah telah berupaya untuk membentuk suatu kebijakan yakni pasangan yang telah melangsungkan pernikahan secara sirri dapat dicatatkan status pernikahannya pada Kartu Keluarga dengan tujuan memberikan perlindungan hukum bagi pasangan nikah sirri. Kebijakan ini kemudian menimbulkan pertanyaan, bagaimana fungsi lembaga Isbat Nikah ketika melihat fenomena legitimasi pernikahan sirri yang dicatatkan pada Kartu Keluarga. Metode penelitian ini dilakukan menggunakan metode deskriptif kualitatif dengan melakukan pendekatan wawancara terstruktur dan dokumentasi penelitian. Adapun hasil dari penelitian ini ialah anak yang dihasilkan dari pernikahan secara sirri menjadi legal statusnya sebagai anak sah dibuktikan dengan pencatatan administrasi kependudukan. Namun dalam keabsahan, secara yuridis formal masih perlu untuk dilakukan Isbat nikah. Status yang ada pada Kartu Keluarga dan Akta Kelahiran anak yang menunjukkan status pernikahan yang belum tercatat dapat dijadikan alat bukti bagi hakim untuk menyetujui prosedur Isbat Nikah.

Abstract

Beberapa pasangan pernikahan terpaksa harus terpisahkan jarak disebabkan berbagai faktor. Pernikahan jarak jauh merupakan situasi disaat pasangan terpisah secara fisik. Seiring dengan kemajuan teknologi komunikasi, pasangan yang terpisah oleh ribuan kilometer kini dapat menjaga keterhubungan melalui berbagai platform digital. Salah satu aspek yang semakin mencuat dalam konteks ini adalah praktik seks virtual. Seks virtual merupakan suatu aktivitas penggunaan internet untuk aktivitas kesenangan seksual yang terkadang diikuti oleh masturbasi. Meskipun dianggap sebagai sesuatu yang solutif, praktik ini memunculkan pertanyaan esensial tentang etika, moralitas, dan nilai-nilai agama. Penelitian ini bertujuan untuk menganalisis dan menemukan pendapat ulama kontemporer, dan pandangan mahasiswa STDI Imam Syafi'i Jember tentang seks virtual, serta solusi bagi pasangan pernikahan jarak jauh. Penelitian ini menggunakan pendekatan kualitatif dengan jenis penelitian studi kasus. Hasil penelitian ini menunjukkan bahwa pandangan mahasiswa STDI Imam Syafi'i Jember tentang seks virtual pada pasangan pernikahan jarak jauh terbagi menjadi pandangan positif dan pandangan negatif. Pandangan positif meliputi sesuatu yang boleh antara suami-istri, perbuatan yang sah dilakukan, dan aman dari segi privasi. Adapun pandangan negatif meliputi sesuatu yang tabu, tidak etis dan menyalahi etika, dan tidak aman terhadap kebocoran data.

Abstract

In Muhammad Syahrur's view, waris is hududullahh which means that the maximum limit for a son is two daughters, and the minimum limit for a daughter is one boy. This research is qualitative research with the type of research library research which aims to reveal how Muhammad Syahrur's thoughts about inheritance with an analysis knife Compilation of Islamic Law. The data analysis process uses content analysis techniques, which are research techniques by looking for regular shapes, structures, and patterns in the text and making conclusions based on the regularities found. The results of this study: 1) Muhammad Syahrur rereads the inheritance verse which is hududullahh. If the heirs consist of one son and two daughters, then the share of the daughter may not be less than 25% and the share for the son may not be greater than 50%. 2) The contribution of Muhammad Syahrur's thoughts on inheritance to the development of inheritance law in Indonesia is by positioning the inheritance portion for women as al-Hadd al-'Adna (minimum limit). With this, Syahrur wants to say that women may or even have the right to get more shares than one man, provided that they do not exceed al-Hadd al'Ala for men. Thus women can get more shares than what has been determined by QS. An-Nisa verse 11 and article 176 KHI as long as it does not exceed the male share (½).

Abstract

This article discusses the competence of religious courts in adjudicating disputes over interfaith inheritance between Muslims and non-Muslims. This can happen inseparably from the social and cultural conditions of people in Indonesia who are pluralism with various backgrounds such as ethnicity, customs, different languages, and belief or religious factors. But on the other hand, there are differences in views between the fuqaha regarding the heritage of different religions. If the heir and heir, both the heir as the plaintiff and the defendant, have differences in religion, then the practice of law enforcement in the court against the inheritance case creates a dispute over competence between the religious court and the district court. This study examines through legislation, legal literature in accordance with the research being discussed and uses Islamic law to answer the author's problem formulation by analyzing decision number 1854 / Pdt.G / 2013 / PA.Plg. The results of the research that can be concluded are that when viewed from a juridical point of view, religious courts are authorized to adjudicate cases of disputes over inheritance between religions. This can happen because it is based on jurisprudence 51K/AG/1999. The function of jurisprudence can be used as the best way given by judges to communities that have family pluralism as a solution in resolving cases of inheritance disputes between religions. However, when viewed from the normative side of Islamic law, religious courts are authorized to adjudicate inheritance disputes with parties of different religions. This can happen because it is based on the interpretation of Yusuf Al-Qardawi and the ijtihad of the supreme court for a sense of justice for families whose pluralism of beliefs. The inheritance is not counted as heirs but is counted as a mandatory will of no more than 1/3 part.

Abstract

This study investigates the issue, specifically the process of registering child adoption at the Population and Civil Registration Office of Klaten Regency, as well as the legal consequences of adopted children related to guardianship and inheritance after adoption. The research method employed is empirical research, descriptive research, a qualitative research approach, primary and secondary data sources, data collection techniques involving observation and interviews, and data analysis techniques involving reduction, presentation, and conclusion drawing. According to the findings of this study, the process of recording child adoption is divided into three stages: filing for adoption at the Social Service for Women's Empowerment, Child Protection, and Family Planning in Klaten Regency, determining the Islamic District or Religious Court, and finally recording child adoption at the Population and Population Service Office. Civil Registration in the Regency of Klaten. Meanwhile, it is concerned with the legal consequences of child adoption, such as guardianship and inheritance. The Civil Code and the Compilation of Islamic Law have different legal consequences after adoption. The legal consequences of adopting children in relation to guardianship and inheritance differ in the Civil Code (KUHPer) and the Compilation of Islamic Law (KHI). In the Civil Code, the civil relationship between biological parents and children is severed, whereas in the KHI, the opposite is true. Adopted children are heirs in the KUHPer, but not in the KHI, where mandatory will replace them. As a result, the family can determine the applicable law through a court order.
