Abstract

The phenomenon of emotional infidelity or emotional affair has increasingly gained attention due to its serious impact on marital harmony, even though it does not involve physical relations. This topic was chosen because, in practice, non-physical infidelity often leads to conflict, even divorce, yet its regulation in family law in both Indonesia and Brunei Darussalam remains unclear. This study aims to examine and compare how the two countries address the issue of emotional infidelity within their respective legal frameworks. This research is a normative legal study employing a comparative approach. Data were collected through library research and analysis of legal documents, including statutes, regulations, and court decisions in Indonesia and Brunei Darussalam, and then analyzed using the theory of legal pluralism and Zweigert and Kötz’s comparative law methodology. The findings reveal that Indonesia does not yet have specific provisions that explicitly categorize emotional infidelity as a legal violation, although it is often cited as grounds for divorce in religious courts. In contrast, Brunei Darussalam has stricter regulations through the Islamic Family Law Order 1999 and the Syariah Penal Code Order 2013, which classify emotional infidelity as part of moral and religious violations with clearer legal consequences. These findings are significant as they highlight a regulatory gap that affects the protection of marital institutions in Indonesia. By understanding this comparison, the study is expected to contribute to the development of Islamic family law in Indonesia, particularly in formulating more responsive regulations toward the increasingly complex phenomenon of non-physical infidelity in the digital era.

Abstract

A harmonious family (sakinah) is an important foundation for the realization of a harmonious and happy household. From a fiqh (Islamic jurisprudence) perspective, a sakinah family is defined as a family built based on piety towards Allah SWT, mutual respect and affection among family members, and the ability to properly practice Islamic law. This concept is not only discussed from a fiqh perspective but is also recognized in Indonesian positive law, where a sakinah family is defined as a family capable of living harmoniously and prosperously, with strong resilience in facing various challenges. This research aims to examine the urgency of a sakinah family as the foundation of a household from the perspectives of fiqh and positive law. The approach method used in this research is a conceptual approach. Researchers try to understand and explain the concepts and principles of Islamic law by analysing and understanding Islamic legal texts, as well as studying the urgency of a sakinah family as the foundation of the household. The results show that a sakinah family plays a vital role in building a harmonious and happy household. A sakinah family becomes a solid foundation for the realization of a quality and virtuous future generation. This research also shows that fiqh and positive law share similarities in viewing the urgency of a sakinah family. Both emphasize the importance of building a family based on piety towards Allah SWT, mutual respect and affection among family members, and the ability to properly practice Islamic law. However, there are some differences in the approaches of fiqh and positive law in realizing a sakinah family. Fiqh emphasizes spiritual and moral aspects, while positive law emphasizes legal and regulatory aspects.

Abstract

This study seeks to analyze the epistemological problems from the theories of feminism and their critical point of legalizing abortion from the perspective of sharī'ah through the analysis of fiqh dharūrāt. The method applied is descriptive-analytical with a philosophical approach that aims to analyze the paradigm behind the Dominance Theory, Critical Race Theory, and Postmodernism Theory, which feminists have promoted as the protection of women. The results of this study conclude that dominance theory provides the legality of abortion rights based on the doctrine of the sovereignty of a female’s body without being bounded by morals or other values, including religion. Critical Race Feminist theory used the standard of abortion by considering women's discrimination experiences between white women and black women that create the issue of reproductive health as a form of fulfilling the right of all women's authority to get reproductive health services and determine the future of their bodies. Similarly, postmodern theory explains the legality of abortion rights without being bound by specific moral standards, and the assessment of good and lousy abortion behavior was not left by the justification of society but by the beliefs of the woman. Based on the philosophical basis of the three feminist theories above, the standard of dharūrāt on abortion rights becomes relative and flexible. Fiqh dharūrāt provided the guidance to prevent women from being trapped into relativism so that they could remain in the guidance of revelation and guidance of the sharī'ah.

Abstract

Fenomena meningkatnya angka perceraian di Indonesia, yang sebagian besar disebabkan oleh ketidaksesuaian visi dan misi hidup dalam pernikahan, menjadi latar belakang penting dalam mengkaji ulang konsep kafa’ah dalam al-Qur’an, khususnya Q.S al-Nur ayat 26. Permasalahan utama yang dikaji adalah pemahaman penafsiran yang kaku dan kurang kontekstual terhadap ayat tersebut yang selama ini hanya menekankan aspek moral semata, tanpa mempertimbangkan dimensi kesetaraan visi, misi, dan relasi pasangan. Penelitian ini menggunakan metode kualitatif dan termasuk penelitian kepustakaan (library research) dengan pendekatan doktrinal-normatif. Data dianalisis secara deskriptif-analitis dengan teori maqāṣid al-syari’ah cum mubādalah. Argumen utama artikel ini adalah bahwa pemaknaan kafa’ah seharusnya melampaui batas tekstual dari semata kesepadanan moral menuju relasi timbal balik yang adil, setara, dan kooperatif antara laki-laki dan perempuan. Hasil penelitian ini menunjukkan bahwa kontekstualisasi kafa’ah dalam Q.S. al-Nur ayat 26 akan lebih bermakna apabila mencakup unsur kesetaraan visi-misi, kemampuan untuk menjalin relasi yang seimbang, serta keterbukaan dalam menerima perbedaan pasangan. Prinsip kesalingan yang menjadi inti pendekatan maqāṣid al-syari’ah cum mubādalah menegaskan pentingnya komitmen bersama (mitsāqan ghalīzhan), relasi kerja sama, musyawarah, kenyamanan emosional dan penerimaan mutual sebagai fondasi rumah tangga. Hasil ini penting karena memberikan paradigma baru dalam membangun keluarga yang maslahat, berbasis pada prinsip keadian gender dan maqāṣid al-syari’ah yang inklusif dan relevan sesuai kebutuhan zaman.

Abstract

Polygamy remains a sensitive issue in Indonesian society, particularly concerning gender justice and women’s protection. The differing perspectives of contemporary Muslim scholars such as Hafidin and Husein Muhammad reflect the dialectics of Islamic family law thought worth examining. This study employs normative legal research with a conceptual approach. Data were collected through a literature review of the Qur’an, hadith, Indonesia’s Marriage Law No. 1 of 1974, the Compilation of Islamic Law (KHI), and academic works discussing Hafidin and Husein Muhammad’s views. Hafidin interprets polygamy in a textualist-patriarchal manner, emphasizing outward justice such as rotation and financial support, while upholding male authority as absolute. Conversely, Husein Muhammad adopts a contextual-progressive approach that incorporates maqāṣid al-sharī‘ah, psychological aspects, and social impacts, thereby supporting stricter regulation by the state. Husein Muhammad’s perspective is more relevant in the modern context as it emphasizes substantive justice and protection for women. This highlights the importance of progressive approaches in Islamic family law to build families based on sakīnah, mawaddah, and raḥmah.

Abstract

Penelitian ini bertujuan untuk menganalisis upaya mewujudkan ketahanan keluarga pada pasangan long distance marriage (LDM) melalui perspektif mubādalah yang dikembangkan oleh Faqihuddin Abdul Qadir. Penelitian ini menggunakan metode kepustakaan (library research) dengan pendekatan kualitatif-deskriptif. Sumber data utama berasal dari karya Qirā’ah Mubādalah serta literatur hukum keluarga Islam, tafsir, dan psikologi keluarga yang relevan. Hasil penelitian menunjukkan bahwa ketahanan keluarga dalam konteks LDM dapat diwujudkan melalui penerapan lima pilar mubādalah, yaitu: komitmen pada ikatan janji yang kokoh (mitsāqan ghalīzhan), prinsip berpasangan dan berkesalingan (zawaj), sikap saling memberi kenyamanan (tarādhin), saling memperlakukan dengan baik (mu’āsyarah bil ma’ruf), dan musyawarah dalam pengambilan keputusan keluarga (musyawarah). Implementasi prinsip tersebut memperkuat ketahanan emosional, komunikasi, serta keseimbangan peran antara suami dan istri dalam menghadapi tantangan keterpisahan fisik. Perspektif mubādalah tidak hanya menekankan kesetaraan dan keadilan gender, tetapi juga menghadirkan solusi teologis, yuridis, dan praktis bagi keluarga LDM dalam menjaga keharmonisan rumah tangga. Temuan ini menegaskan bahwa penerapan prinsip kesalingan dan keadilan menjadi dasar penting dalam membangun keluarga yang sakinah, mawaddah, dan rahmah.

Abstract

This study aims to understand the social construction of long-distance marriage (LDM) in Jenangan Village using the social construction theory of Peter L. Berger and Thomas Luckmann, this research was conducted with a qualitative approach, through interviews and documentation as data collection methods. The results show that the social construction of long-distance marriage goes through three stages: externalization, objectivation, and internalization. Long-distance marriage (LDM) in Jenangan Village is socially constructed as a valid and accepted choice, with the main focus on fulfilling the family's economic needs. The people of Jenangan Village recognize that LDM is a reality that requires high commitment and patience. Externalizing actions, such as choosing LDM to meet economic needs, has become an objectively accepted norm in the community. Although challenges such as limited communication and lack of togetherness are part of the reality, this social norm is internalized by individuals who live it as part of the way to achieve economic goals and realize their dreams.

Abstract

Tradisi Rokat merupakan prosesi pembersihan diri atau ruwatan yang wajib dijalani oleh anak yang masuk dalam kategori Pandhaba sebelum akad nikah. Tradisi ini sering dianggap membutuhkan biaya yang besar dan dikaitkan dengan mitos-mitos yang mengarah pada kemusyrikan. Penelitian ini bertujuan untuk memahami praktik pelaksanaan tradisi Rokat Pandhaba penganten di Desa Dawuhan Mangli serta menganalisis konstruksi masyarakat terhadap tradisi tersebut. Data diperoleh melalui studi lapangan (field research) menggunakan pendekatan hukum empiris. Teknik pengumpulan data meliputi wawancara dengan tokoh masyarakat, observasi langsung saat ritual berlangsung, serta dokumentasi berupa foto dan rekaman terkait tradisi ini. Analisis data dilakukan menggunakan model Miles dan Huberman, yaitu reduksi data, penyajian data, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa Rokat Pandhaba wajib dijalankan bagi anak kategori Pandhaba melalui rangkaian ritual yang dipimpin oleh Kiai Rokat (Imam Rokat) pada malam hari, diawali dengan pembacaan Al-Qur’an 30 juz. Setelah itu, dilakukan ritual mandi dengan perlengkapan yang ditentukan oleh Kiai Rokat, dilanjutkan oleh sanak keluarga, dan diakhiri dengan doa serta pembagian sesajen. Tradisi Rokat Pandhaba penganten dikonstruksikan oleh masyarakat sebagai sarana penyucian jasmani dan rohani serta penolak bala, seperti kesialan dan ketidakdamaian dalam lingkungan keluarga, yang merepresentasikan eksternalisasi nilai tradisi leluhur

Abstract

The phenomenon of toxic masculinity emerges from misinterpretations of masculinity, particularly within the context of household relations. The view that positions men as superior and women as secondary has generated unequal relational practices that contradict the principles of gender justice in Islam. This article aims to analyze QS. Al-Baqarah verse 233 as a theological basis for re-examining the concept of nafāqah (financial and non-financial support) and gender relations in Islamic jurisprudence, as well as to assess the extent to which this verse can serve as a counter-narrative to toxic masculinity. This research employs a qualitative approach through library research using the thematic exegesis (tafsīr maudhu‘ī) method, combined with content and comparative analysis of classical and contemporary exegetical works and relevant fiqh literature. The findings reveal three key points: (1) the social construction that places women as a secondary gender contributes to the marginalization of domestic roles that are, in fact, essential; (2) the categorization of masculine–feminine traits is often based on flawed cultural constructs, leading to the legitimization of toxic masculinity; (3) Qur’an Surah Al-Baqarah verse 233 emphasizes a comprehensive notion of nafāqah, which includes material, emotional, and service-based responsibilities of husbands, particularly during childbirth and breastfeeding periods. These findings highlight that the verse offers a paradigm of participatory and service-oriented leadership rather than domination. This article provides conceptual implications for developing a more gender-equitable Islamic discourse and for reconstructing household relations free from toxic masculinity.
