Abstract

Legal philosophy plays an important role in bridging the relationship between law, society, and changing times. Rooted in the principle of "ubi societas, ibi ius" which emphasizes that law and society are complementary entities, this study explores the dynamics of legal philosophy in the digital era. Normative research methods with philosophical and conceptual approaches are used to explore how basic values such as justice, human rights, and utilitarianism are adapted in the modern legal system. The digital era presents new challenges, such as data privacy, cybersecurity, and digital justice. Legal philosophy is expected to be able to develop a new conceptual framework to adapt to technological realities, including the use of artificial intelligence (AI) and big data in law enforcement. In addition, the role of legal philosophy is also seen in the development of relevant regulations, such as the protection of personal data and electronic transactions, to answer the needs of the digital era society. The history of legal philosophy shows a significant evolution of thought from ancient Greece to the modern era, which continues to be relevant in supporting the legitimacy of law and justice. In this era, legal philosophy combines ethics with technology to ensure the inclusivity, transparency, and sustainability of the legal system. This study highlights the importance of technology integration in legal education, improving digital regulations, and innovation of the justice system to maintain access to justice amidst social change.

Abstract

Currently, ARI has become a cause of death in toddlers worldwide. The etiology of ARI is caused by viruses and bacteria. In addition, it can be in the form of nutrition, exclusive breastfeeding, and environmental conditions (Asrianto et al., 2022). Minimal instillation or not knowing the instructions for Clean and Healthy Living Behavior (PHBS) in households also makes it possible to get ARI (Zolendo et al., 2022). This study aims to determine the relationship between household PHBS and the incidence of ARI in toddlers in Sindon Village, Boyolali Regency. The type of research used in this study is quantitative with a correlation analytical method. The sample selection technique is by using the purposive sampling method, and 74 respondents have been determined. The instruments in the study were the household PHBS attitude questionnaire and the toddler ARI incidence questionnaire. The results of the Chi-Square statistical test obtained a p-value of 0.001 (<0.05), so it can be interpreted that there is a relationship between household PHBS and the incidence of ARI in toddlers in Sindon Village, Boyolali Regency. The good PHBS attitude of parents will determine the possibility of ARI in toddlers. The majority of respondents behaved well and did not experience ARI. Judging from the output of this study, health education is needed regarding PHBS in household settings and ARI in the community. Priority should be given to individuals who have moderate PHBS attitudes and experience ARI.

Abstract

The importance of legal protection for the environment in Indonesia is a critical issue, as judicial decisions in environmental crime cases often fail to consider the environmental damage caused by offenders. This study identifies a research gap in the legal approach, which predominantly focuses on protecting human rights to a healthy environment while neglecting the inherent rights of the environment itself. The objective of this study is to explore the role of law in positioning the environment as a subject that deserves protection in environmental crime cases. Utilizing doctrinal legal research methodology, which examines law based on established doctrines, the study finds that environmental destruction is primarily viewed as a violation of human rights rather than a violation of the environment's own rights. The key findings suggest the necessity of a new formulation in environmental criminal law enforcement, one that is environmentally oriented. One such idea proposed is the "Community Service Orders" for corporations that commit environmental crimes, as a form of legal accountability that more inclusively addresses environmental harm.

Abstract

This paper examines the effectiveness of restitution as a means of protecting victims of sexual violence in Indonesia, focusing on its legal analysis and practical implementation. Sexual violence is a serious issue that has negative impacts on victims, including physical and psychological trauma. Restitution, as a form of compensation provided to victims, is expected to assist in recovery and deliver justice. This study employs a qualitative approach, analyzing secondary data from various literature, legal regulations, and case studies. The findings reveal that although there are regulations supporting restitution, its implementation in the field faces various challenges, such as lack of public awareness, stigma against victims, and administrative barriers. Furthermore, the existing restitution mechanisms are not fully integrated into the criminal justice system, diminishing their effectiveness in providing protection. Therefore, it is crucial to strengthen the legal system and enhance collaboration among government agencies, civil society organizations, and other relevant stakeholders to optimize restitution as a tool for protecting victims. This research is expected to contribute to the development of policies and practices for protecting victims of sexual violence in Indonesia.

Abstract

Marriage in Indonesia based on the principle of monogamy, as written in Law Number 1 of 1974 concerning Marriage which emphasizes that a man can only have one wife, as well as a woman can only have one husband. However, there is an exception that a husband can have more than one wife on the condition that he has permission from the Court and is indeed desired by the parties concerned, and the act must have a consent from the first wife. There are still irregularities that occur in the practice of polygamy, one of them is a secret polygamous marriage carried out by a man with a woman apart from his wife without the consent of the legal wife and without the permission of the Religious Court, as happened in Decision Number 1106/Pdt.G/2024/PA.Cbn. The research method uses in this article is qualitative normative by referring to applicable regulations and doctrines with case study approach and the data collection is based on document studies. The result is that polygamous marriage carried out without the permission of the first wife and the Religious Court are invalid and null and void, which results in the second marriage being considered unprecedented. The legal protection for the first wife can be various, such as the application for annulment of the second marriage submitted by the first wife and also even if indications of fraud are found in the implementations of marriage to the Office of Religious Affairs, the first wife can report it and the parties involved can be subject to criminal sanctions.

Abstract

In the food industry, problems are often found in optimizing production results for maximum profits. The lack of knowledge to determine feasible and optimal solutions in entrepreneurship for UMKM can affect the income of these UMKM. In UMKM Pempek Cik Lin, several problems are faced to increase their profits, namely limited production resources and capital, resulting in less optimal production and the ability to increase profits from sales results. This case study was completed with the simplex method's linear programming integer model. A comparison was also carried out with the help of lingo software. The result of this study is that the completion of linear programming using the simplex method shows a maximum profit of Rp. 75,000 with the type of submarine pempek produced as many as ten pcs and pempek lenjer as many as ten pcs. Meanwhile, the settlement using lingo software obtained the most significant maximum profit, Rp. 85,000 with the type of pempek kapal selam produced as many as fourteen pcs and pempek lenjer as many as zero pcs. From this comparison, the most significant optimization results were obtained using lingo software so that UMKM Pempek Cik Lin has the picture needed if they have limitations in terms of production raw materials so that the business can increase their income

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi kreditur berkaitan dengan aset pihak ketiga yang dijadikan sebagai harta pailit. Di Indonesia, ketika debitur tidak dapat membayarkan hutang maka seluruh aset miliknya akan disita. Namun, terdapat pengecualian bagi harta milik kreditur separatis yang digunakan sebagai bagian dari harta pailit. Salah satu contoh kasusnya adalah pada Putusan Mahkamah Agung Nomor 1240K/Pdt.Sus-Pailit/2023 sehingga menimbulkan pertanyaan mengenai perlindungan hukum bagi kreditur separatis sebagai pihak ketiga. Metode yang digunakan dalam penelitian ini adalah hukum normatif dengan pendekatan pada regulasi yang ada. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi kreditur yang memiliki jaminan kebendaan diatur dalam Undang-Undang Kepailitan dan Penundaan Kewajiban Pembayaran Utang dan berhak untuk menjual aset yang menjadi jaminan tersebut serta dapat menerima hasil penjualannya seolah-olah kepailitan tidak sedang berlangsung. Dalam konteks perlindungan preventif, perjanjian kredit yang melibatkan jaminan kebendaan dari pihak ketiga harus dilaksanakan sesuai dengan ketentuan yang berlaku. Sementara dalam aspek represif, kreditur memiliki hak untuk mengambil langkah hukum, termasuk mengajukan peninjauan kembali, guna melindungi kepentingan dan hak-haknya.

Abstract

This research examines the legal protection provided to creditors when a peace agreement is canceled due to unlawful acts by a debtor during suspension of debt payment obligation proceedings. The suspension of debt payment obligation aims to restructure debt and facilitate a mutually beneficial settlement. However, debtors sometimes engage in unlawful actions involving their assets, harming creditors. One such case is Supreme Court Decision No. 440K/Pdt.Sus-Pailit/2024, where PT. Prowell Energi Indonesia, as the PKPU debtor, caused harm to creditors by nullifying a peace agreement. Using a normative legal methodology with a statutory approach, the study finds that the Bankruptcy and Suspension of Debt Payments Obligation Law provides essential legal protection for creditors whose rights are harmed by debtor misconduct. Preventive protection includes applying bankruptcy law principles such as balance and business continuity, requiring debtors to disclose all relevant information honestly and ensure fair remuneration for the administrator’s services throughout the Bankruptcy and Suspension of Debt Payments Obligation Law process. Additionally, repressive protection within the Bankruptcy and Suspension of Debt Payments Obligation Law stipulates that actions by debtors that harm creditors or display bad faith in asset management may result in the termination of the suspension of debt payment obligation process and a declaration of bankruptcy. This research underscores the role of the Bankruptcy and Suspension of Debt Payments Obligation Law in safeguarding creditors’ rights, enforcing debtor accountability, and ensuring a fair and balanced debt restructuring process.

Abstract

Daerah Istimewa Yogyakarta (DIY) saat ini menjadi salah satu destinasi yang banyak dikunjungi oleh wisatawan lokal ataupun wisatawan asing. Hal menarik dari destinasi wisata di DIY salah satunya adalah budaya, Kabupaten Bantul menjadi salah satu kabupaten yang memiliki banyak destinasi wisata. Potensi wsita yang ada seperti monument budaya, gua sejarah, dan kerajaan. Penelitian ini bertujuan untuk mengetahui apakah vlogger melalui YouTube channels dapat menarik wisatawan untuk mengunjungi destinasi di DIY. Motede penelitian yang dilakukan adalah menggunakan metode kuantitatif dengan menyebarkan kuesioner melalui Google Form. Hasil dari penelitian ini yaitu vlogger dapat memberi dampak yang signifikan kepada wisatawan untuk mengunjungi destinasi yang ada di DIY, serta memberi informasi destinasi wisata.

Abstract
