Abstract

This study critically examines the minimum marriage age standards in classical fiqh through an epistemological integration of the Islamic turats specifically the concept of rushd in Maqasid al-Shari’ah and neuroscientific findings on the maturation of the prefrontal cortex (PFC). A normative-comparative approach based on library research was employed, drawing on primary sources such as classical fiqh texts (al-Umm, Bidayat al-Mujtahid, al-Mughni), Indonesian legislation, and reputable neuroscience journals. The study found that rushd al-akl in the Islamic tradition is epistemically compatible with biopsychological maturity in neuroscience. Data on marriage dispensations in Indonesia from 2019 to 2023 show an approval rate of 81–87%, indicating that judges still rely solely on bulugh as a consideration. The proposed synthesis of rushd and biopsychological concepts strengthens the normative foundation for reforming the marriage age by integrating the Maqasid of hifz al-nasl and hifz al-'aql with neurobiological evidence.

Abstract

This study aims to analyze the concept of spouse selection in the marriage chapter of Fath al-Mu'in through the lens of maqāṣid al-syarī'ah, examining the extent to which its criteria compatibility (kafā'ah), religiosity (dīn), lineage (nasab), and physical attractiveness align with the higher objectives of Islamic law in preserving lineage (ḥifẕ al-nasl), preserving reason (ḥifẕ al-‘aql), and realizing family welfare (maṣlaḥah al-usrah). This research employs a qualitative method through library research and content analysis of the primary text of Fath al-Mu'in, compared against classical and contemporary maqāṣid al-syarī'ah frameworks, cross-madhhab juristic opinions, and Indonesian family-law regulations. The findings indicate that the spouse-selection criteria in Fath al-Mu'in are generally consistent with maqāṣid al-syarī'ah in the dimensions of ḥifẕ al-nasl and ḥifẕ al-dīn, although certain aspects particularly the emphasis on nasab-based kafā'ah and social status require contextual reinterpretation to avoid reinforcing social inequality in contemporary marriage practice.

Abstract

The study of linguistic expressions (lafaz) in Islamic legal theory (ushul fiqh) plays an important role in understanding the meanings of the Qur’an and Hadith as the primary sources of Islamic law. One of the linguistic aspects discussed by Muslim scholars is the use of meaning through haqiqah (literal meaning) and majaz (figurative meaning). This study aims to analyze the concepts of haqiqah and majaz, explain their position in understanding Islamic legal texts, and examine their implications for the process of legal deduction (istinbath al-ahkam). This research employs a library research method with a descriptive-analytical approach by reviewing relevant literature in ushul fiqh, Qur’anic exegesis, and academic journals. The findings indicate that literal meaning should be prioritized in interpreting a text, while figurative meaning may be applied when supported by clear contextual evidence.

Abstract

The practice of land grabbing in Indonesia has increased alongside the expansion of investment, infrastructure development, plantations, and mining activities, which may reduce communities' access to land as a primary source of livelihood. This study aims to analyze the protection of community rights against land grabbing from the perspectives of agrarian law and Islamic law and to formulate an integrative legal protection model. This research employs a normative legal method using statutory, conceptual, and comparative approaches through library research. The findings indicate that national agrarian law and Islamic law share common principles by emphasizing justice, public welfare, and the protection of rights in agrarian resource management. Strengthening agrarian reform, recognizing indigenous communities, improving land governance transparency, enhancing public participation, and enforcing the law are essential measures to prevent land grabbing. The integration of these two legal systems is expected to create a fair and sustainable land management system.

Abstract

This study aims to analyze the concept of qiwāmah from the perspective of Islamic law, examine the legal position of the husband as the head of the family under Article 79 of the Compilation of Islamic Law (Kompilasi Hukum Islam), and identify the limits of the husband's authority and responsibilities within marital relations. This research employs normative legal research using statutory and conceptual approaches. The data were collected through library research on the Qur'an, Hadith, the Compilation of Islamic Law, and relevant scholarly literature, and were analyzed qualitatively using a descriptive-analytical method. The findings reveal that qiwamah constitutes a mandate of leadership based on the husband's responsibility to provide financial support, protection, guidance, and care for the family. Article 79 of the Compilation of Islamic Law does not grant the husband absolute authority; rather, it places his leadership within the framework of balanced rights and obligation.
