Abstract

Cerai online menjadi alternatif yang relevan untuk menjaga keberlangsungan proses hukum tanpa tatap muka. Pandemi COVID-19 mendorong digitalisasi layanan peradilan, termasuk dalam perkara perceraian di pengadilan agama. Penelitian ini mengkaji pelaksanaan cerai online pasca pandemi, dengan fokus pada efektivitas dan tantangan yang dihadapi. Melalui metode pendekatan kualitatif dan analisis data serta wawancara, ditemukan bahwa cerai online mempermudah akses, menghemat waktu, dan biaya. Namun, hambatan seperti keterbatasan teknologi, rendahnya literasi digital, serta belum optimalnya regulasi masih menjadi kendala. Diperlukan penguatan sistem dan sosialisasi yang lebih luas agar cerai online dapat berjalan optimal dan adil bagi masyarakat. Hasil dari penelitian yang kami dapat adalah perceraian digital di pengadilan agama pasca Covid-19 mempermudah akses dan efisiensi melalui sistem e-Court pelaksanaan cerai online memerlukan kerangka hukum yang adaptif agar dapat memberikan kepastian dan perlindungan hukum bagi para pihak yang berperkara.

Abstract

: Legal analysis regarding the consumption of khamr and its impact on human health from the perspective of Islamic criminal law (Fiqh Jinayah) and the objectives of sharia (Maqāṣid al-Syarīʿah) shows that khamr, which includes all intoxicating substances, is prohibited because it damages the mind and body. This prohibition, which was first found in QS. An-Nahl (16): 67 and QS. Al-Baqarah (2): 219, further clarified through QS. An-Nisa (4): 43 which prohibits the consumption of khamr during prayer, until it is finally confirmed in the QS. Al-Maidah (5): 90-91 as an act of Satan that destroys happiness. Legal sanctions against khamr consumption do not only take the form of flogging, but also include social, medical and psychological rehabilitation approaches, reflecting sharia wisdom in protecting the mind, body and social life. The aim of sharia is to maintain human physical and mental safety, as well as comprehensive social welfare.

Abstract

The sandwich generation faces complex dilemmas between family responsibilities and personal aspirations, including marriage decisions. This study aims to identify factors causing marriage delay among sandwich generation students at Universitas Insan Cita Indonesia and analyze them from Islamic perspective. The research employed qualitative case study approach with in-depth interviews of students aged 20-30 years. Data analysis used triangulation from Al-Qur'an, hadith, four imam schools, maqashid syariah.. Results identified four main factors: economic pressure requiring respondents to bear 70-80% of family needs, difficulty finding partners who understand sandwich generation conditions, concerns about creating new sandwich generation, and emotional-mental unpreparedness. From Islamic perspective, marriage delay can be justified through syariah principles as efforts to establish readiness. The study concludes that marriage delay represents rational response aligned with Islamic syariah principles. Special support programs and contextual Islamic marriage education are needed to accommodate sandwich generation needs.

Abstract

This research employs a normative juridical method. Primary legal materials used include the Marriage Law and Decision Number 124/Pdt.G/2023/MS.Bna. Data analysis is conducted systematically based on library research, involving primary, secondary, and tertiary legal sources. The results of the study show that the judges' consideration in rejecting the isbat nikah petition in Decision Number 124/Pdt.G/2023/MS. Bna was based on the fact that the first petitioner was still legally married to another woman, with the marriage duly registered at the Office of Religious Affairs (KUA). Juridically, the rejection is valid and in accordance with the prevailing legal provisions, particularly referring to Supreme Court Circular (SEMA) Number 3 of 2018, which states that isbat nikah petitions for polygamous marriages based on unregistered (sirri) marriages must be declared inadmissible.

Abstract

This research examines the concept of Haqqul 'Abdi Muqaddamun 'Ala Haqqillah (human rights take precedence over Allah's rights), which is a fiqh principle that emphasizes the importance of prioritizing the fulfillment of human rights in certain situations to prevent social damage or greater injustice. By using a normative and comparative analysis approach to Islamic sharia texts, this study connects this concept with the principles of Maqashid Syariah, which aims to realize benefit through the protection of religion, soul, mind, property and descendants. The results of the analysis show that the Haqqul 'Abdi concept is not only relevant in protecting individual rights, but also supports the application of the principles of restorative justice in modern Islamic law. In the context of Maqashid Syariah, this concept is the foundation for creating social harmony, upholding justice, and ensuring the sustainable welfare of the people.

Abstract

The primary obligation of a husband toward his wife and children is to provide financial support (nafaqah). This obligation ceases for the wife in the event of a divorce; however, it remains valid for the children. After a divorce, the husband, as the father, is still responsible for supporting his children until they reach adulthood. This principle contrasts with the decision made by the Panel of Judges at the Talu Religious Court in Decision Number 581/Pdt.G/2021/PA.Talu, in which the judges rejected the claim for madhiyah (past) child support after the divorce. This study aims to answer two main questions: What were the legal considerations of the Panel of Judges in Decision Number 581/Pdt.G/2021/PA. Talu, the ex-wife’s lawsuit against her former husband for five years of unpaid child support was rejected. This rejection is considered to lack legal justice for both the wife and the child.

Abstract

The Hijri calendar plays a crucial role in Islam as it serves as the primary reference for determining worship times, such as prayer, fasting, zakat, and hajj. This study aims to examine the sharia basis for the use of the Hijri calendar, the views of scholars of interpretation and jurisprudence (fuqaha) regarding the function of the crescent moon, and the problematic differences in methods for determining the beginning of the Hijri month in Indonesia. The study employed a qualitative approach with a library study method through content analysis of primary sources in the form of the Qur'an, classical and modern tafsir books, and hisab and rukyat literature, along with secondary sources in the form of books and academic articles. The results of the study indicate that the determination of the beginning of the Hijri month is divided into three categories, namely shahr syar'i (based on ru'yatul hilāl or istikmāl),

Abstract

This study aims to examine the construction of inheritance flexibility according to Syaḥrūr, identify the underlying assumptions that shape his divergent interpretation, and analyze its implications for classical exegetical frameworks. Employing Karl Mannheim’s sociology of knowledge, the study finds that Syaḥrūr views inheritance verses as establishing minimum and maximum limits, allowing women’s shares to approach those of men depending on economic contribution and socio-historical contexts. Second, his approach is grounded in the concept of ṡubūt an-naṣ wa taghayyur al-muhtawā, which posits that the Qur’anic text is fixed while its meanings may evolve. Third, through his ḥudūd theory, Syaḥrūr enacts a significant paradigm shift by rejecting the classical notion of qaṭ’iyyah ad-dilālah, thereby reopening the space for ijtihad in Islamic inheritance law.
