Abstract

The prohibition and restriction of school study tours in Indonesia following the 2024 Ciater bus crash have been imposed almost entirely through circular letters (surat edaran) issued by governors and education agencies. This article examines the legal defect of that instrument and proposes a reformulation grounded in empirical evidence. Using a socio-legal approach that combines statutory and conceptual analysis with a quantitative survey of 157 secondary school students across Bogor and the Greater Jakarta area, the study finds three problems. First, study tours intersect with at least five legal regimes: road transport safety, educational levies, child protection, the division of governmental affairs, and the right to education, yet are governed only by beleidsregel, or policy rule, which sit outside the hierarchy of legislation under Law No. 12 of 2011, carry no sanctions, and cannot be judicially reviewed. Second, successive and inconsistent circulars across regions have produced legal uncertainty and unequal treatment of students in comparable situations. Third, survey data show strong student support for low-cost, local educational visits, including visits to correctional institutions (mean 4.26 of 5; 87.3% agreement), with support driven more by legal knowledge and moral-religious belief than by fear of imprisonment. The article argues that the state should shift from prohibition by circular to standard-setting through a properly enacted regulation governing vehicle roadworthiness, cost ceilings, voluntariness, and educational substance.

Abstract

Article 5 of Law Number 20 of 2025 concerning the Criminal Procedure Code includes the phrase "other legally justifiable actions" regarding investigators' authority, creating room for discretion beyond their explicitly defined powers. Although this formulation is necessary to accommodate dynamic investigative needs, the absence of rigid boundaries engenders a potential for abuse of authority and case fabrication. This study aims to analyze the legal parameters of "other actions" within the investigators' authority and examine them through the concept of sadd al-dharī‘ah as a preventive approach against case fabrication. This normative legal research employs statutory, conceptual, and case approaches, with legal materials analyzed qualitatively using deductive reasoning. The findings indicate that "other actions" do not confer unlimited authority; rather, such measures must strictly align with investigative objectives, possess a clear legal basis, and be executed proportionally and responsibly. From the perspective of sadd al-dharī‘ah, these limitations serve as a crucial preventive mechanism to block any pathways leading to the adverse consequences of case fabrication. Consequently, the interpretation of "other actions" must be clearly delineated to ensure a balance between investigative flexibility, legal certainty, the protection of human rights, and substantive justice.

Abstract

The Constitutional Court Decision Number 90/PUU-XXI/2023 provides a new legal interpretation regarding the age requirements for presidential and vice-presidential candidates as regulated under Article 169 letter q of Law Number 7 of 2017 concerning General Elections. The ruling establishes that presidential and vice-presidential candidates must be at least 40 years of age or currently or previously hold an office elected through general elections, including regional head elections. This study formulates three legal issues: the legal reasoning of the Constitutional Court judges in Decision Number 90/PUU-XXI/2023, the implications of the ruling on the Indonesian electoral system—specifically regarding candidacy requirements for President and Vice President—and the perspective of Islamic law on the decision. This research aims to analyze these three issues juridically and normatively. The methodology employed is normative legal research utilizing a statutory approach, case approach, and conceptual approach. The legal materials comprise primary, secondary, and tertiary legal sources, which were analyzed qualitatively. The findings demonstrate that the judges' considerations in Decision Number 90/PUU-XXI/2023 were grounded in evaluating the right to equal opportunities in governance, the relevance of holding an elected public office, and limits on applying the open legal policy doctrine. The decision impacts candidacy requirements in Indonesia's electoral system by introducing an alternative qualification for candidates under 40 years old who currently or previously hold an office filled through general elections, including regional heads. From an Islamic law perspective, this provision can be examined through core leadership principles emphasizing trustworthiness (amanah), justice ('adalah), capability (kafa'ah), and public interest (maslahah), indicating that age is not the sole determinant of leadership eligibility.

Abstract

Abstract

The development of digital technology has transformed gold trading and investment activities into online transactions, thereby raising legal issues concerning copyright protection for the ideas, systems, and methods employed in these transactions. This study aims to analyze the legal protection of ideas in online gold trading in Indonesia, the legal rationale for why the online gold trading system implemented by PT Pegadaian (Persero) is not recognized as the work of Arie Indra Manurung, and the judges' legal considerations in Decision Number 40/Pdt.Sus-HKI/Cipta/2022/PN Niaga Jkt.Pst. This study employs a normative juridical method utilizing statutory and case approaches. The legal materials used comprise primary, secondary, and tertiary legal materials, which were analyzed qualitatively and juridically. The results indicate that copyright protection arises automatically once a creation is fixed in a tangible form. However, ideas, procedures, systems, methods, concepts, principles, discoveries, and data are excluded from copyright protection. The online gold trading system claimed under “Goldgram” is essentially a system or business method that does not qualify as a copyright-protected work. Consequently, the similarities between “Goldgram” and Pegadaian's Tabungan Emas product do not inherently prove copyright infringement. The judges' considerations were primarily based on the statutory exclusion of systems and methods from copyrightability. Therefore, copyright protects the expression of an idea, not the idea, system, or business method itself.
