Abstract

AbstrakPembentukan Peraturan Daerah di era otonomi sekarang ini masih mengalami berbagai masalah, fenomena negatif mulai dari tidak efektifnya pemberlakuan perda sampai dengan ditentangnya perda tersebut yang dirasa kurang relevan dengan kebutuhan dan bertentangan dengan kepentingan masyarakat. Hal ini disebabkan oleh berbagai banyak hal salah satunya adalah karena kurangnya partisipasi aktif masyarakat dalam pembuatan peraturan daerah mulai dari proses penentuan kebijakan, perencanaan, pelaksanaan, pengawasan, pengendalian, sampai dengan tahap evaluasi terhadap peraturan daedah tersebut. penelitian ini bertujuan untuk mendeskripsikan faktor-faktor yang menjadi penyebab kurang efektifnya pemberlakuan peraturan daerah dan pemberian rekomendasi terhadap masalah dalam penetapannya. Penelitian ini menggunakan pendekatan kualitatif. Data yang di peroleh dengan cara penelitian lapangan (field research), kemudian data tersebut di analisis dengan analisis normatif-filosofis. Hasil penelitian menunjukan bahwa partisipasi aktif masyarakat sangat diperlukan dalam pembentukan peraturan daerah agar tidak terjadi pertentangan di waktu penetapan peraturan daerah tersebut.Kata Kunci : Partisipasi masyarakat, Problematik, Implementasi, Peraturan Daerah AbstractThe formation of Regional Regulations in the current era of autonomy is still experiencing various problems, negative phenomena ranging from ineffective enforcement of local regulations to the opposition of the perda is considered less relevant to the needs and contrary to the interests of society. This is caused by many things, one of which is the lack of active participation of the community in the making of regional regulations starting from the process of determining the policy, planning, implementation, supervision, controlling, up to the evaluation stage of the regulation of daedah. this study aims to describe the factors that cause the lack of effective implementation of local regulations and recommendation of the problem in its determination. This research uses qualitative approach. Data obtained by field research (field research), then the data is analyzed by normative-philosophical analysis. The results of the study indicate that the active participation of the community is necessary in the formation of local regulations in order to avoid conflicts at the time of determination of the regional regulations.Keywords: Society participation, Problematic, Implementation, Local Regulation

Abstract

Jobs would not be able to absorb the number of job seekers from year to year continues to grow. Urgent necessities of life as the main reason for job seekers to mempeerbaiki family economy. The desire to change the fate of the quick way to create these job seekers decided to work the family land with the hope that the high salary would make their fortune and family soon changed. All the risks that exist taken without regard to the risk faced when it comes to happen forgery of documents as had been required by Act No. 39 of 2004 regarding the Placement passage and Protection of Indonesian Workers Abroad. Department of Labor Kendal in addressing complaints submitted by the public when there is a problem of falsification of documents using the mediation. The approach used in this study is a sociological juridical approach is in dealing with the issues discussed by the regulations in force then corresponds to the realities in society. The method used is descriptive qualitative. Data was collected by interviewing the parties involved in research, direct observation and recording of documents. Results from this study that the protection of pre-placement for CTKI (Indonesian Labor candidate) is in accordance with Law No. 39 of 2004 regarding the Placement passage and Protection of Indonesian Workers Abroad. Policies implemented by the Department of Labor in the face of falsification of documents by way of mediation or deliberation of the relevant parties. Needed guidance and supervision of CTKI and PPTKIS, and education for the entire community. In addition, inter-sectoral cooperation. Integrated Services One-Stop will be implemented by the Department of Labor Kendal as a form of government attention to protect its citizens who want to go abroad so that does not happen again falsification of documents.Keywords: Protection Policy Law, Penal Mediation, Department of Labor, Falsification of Documents

Abstract

The Restorative Justice Policy in Wonosobo District Police is conducted to create a sense of justice and humanity, prioritizing the interests of victims and perpetrators to reach an agreement together to seek a solution to the crime and its implications by emphasizing on recovery rather than retaliation.The method used is sociological juridical research. Specification of research that writer use that is descriptive qualitative. Data collection techniques with interviews to the parties involved in research, direct observation and document recording.Factors that hamper the investigator unit laka then Polres Wonosobo in the implementation of restorative justice that there are families of victims who do not want to forgive the perpetrators because the losses suffered by the victim is large enough that the victim's family demanded a substantial amount of compensation where the family of perpetrators who came from ordinary family Find it difficult to meet the demands of the victim's family and there is still a negative stigma of the community, especially the victims against law enforcement officers in applying the concept of restorative justice.Keword :Restorative Justice, Criminal Act, Traffic accident.

Abstract

Mucikari merupakan kegiatan yang diatur di dalam KUHP dan sangat bertentangan dengan kesusilaan, disebutkan istilah mucikari yang tergolong sebagai kejahatan kesusilaan yang diatur dalam BAB XIV Buku ke-II KUHP.. Pada hakikatnya pertanggungjawaban pidana adalah suatu bentuk mekanisme yang diciptakan untuk bereaksi atas pelanggaran suatu perbuatan tertentu yang telah disepakati. Unsur kesalahan merupakan unsur utama dalam pertanggungjawaban pidana. Hal ini disebabkan karena mucikari tidak terlibat secara langsung pada saat dilakukan penggerebekan oleh pihak yang berwajib, sedangkan pelaku prostitusi terlibat langsung ketika dilakukan penangkapan, dan langsung bisa dibuktikan karena sudah tertangkap tangan. Metode pendekatan yang digunakan adalah yuridis normatif yaitu sebuah penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan pustaka atau data sekunder belaka dengan menggunakan metode berpikir deduktif. Spesifikasi penulisan menggunakan deskriptif analisis, sumber dan jenis data yang digunakan adalah data sekunder. Metode pengumpulan data dengan melakukan pengumpulan data menggunakan metode pengumpulan data sekunder. Permasalahan dianalisis dengan teori pertanggungjawaban pidana, teori sistem hukum dan teori keadilan. Pertanggungjawaban pelaku tindak pidana pencurian dalam keadaan memberatkan dalam putusan Nomor 28/Pid.B/2017/PN Dps bahwa majelis hakim memutus perbuatannya menyatakan terdakwa I KR, terdakwa II IMS dan terdakwa III WT terbukti secara sah dan bersalah melakukan tindak pidana memudahkan dilakukannya perbuatan cabul oleh orang lain dengan orang lain dan menjadikannya sebagai mata pencaharian dengan pidana penjara masing-masing 4 (empat) bulan 7 (tujuh) hari. Pada peraturan pemerintah daerah masing-masing yang mengambil kebijaksanaan dengan tindakan-tindakan tertentu yang dapat dikategorikan sebagai tindakan represif, dalam arti melakukan tindakan-tindakan terhadap prostitusi yang ada dalam masyarakat, dengan tidak melaksanakan hukum pidana yang masih berlaku ataupun suatu kebijakan operasional.

Abstract

ABSTRAKPenelitian ini berjudul Analisa Kebijakan Formulasi Hukum Pidana Dalam Penanggulangan Tindak Pidana Korupsi. Tujuan Penelitian ini : 1) Untuk mengetahui dan menganalisis kebijakan formulasi tindak pidana korupsi dalam perundang-undangan yang berlaku saat ini. 2) Untuk mengetahui dan menganalisis kebijakan formulasi tindak pidana korupsi yang akan datang.Hasil Penelitian : a) Kebijakan formulasi hukum pidana khususnya mengenai formulasi tindak pidana korupsi saat ini, memiliki sejumlah kelemahan yang mendasar, sebagi berikut: 1) Kebijakan hukum pidana dalam hal tindak pidana korupsi yang berlaku saat ini, tindak mencantumkan kualifikasi delik apakah sebagai “pelanggaran” atau “kejahatan”. Kebijakan Hukum pidana dalam hal tindak pidana korupsi saat ini tidak memberikan pengertian atau batasan-batasan yuridis mengenai “permufakatan jahat”, “tindak pidana dalam hal pembantuan atau pembatu” (medeplichtige) dan “pengulangan tindak pidana”(recidive). 2) Kebijakan hukum pidana dalam hal pemberantasan tidak pidana korupsi, masih tersebar di beberapa perundang-undangan dan menggunakan sanksi berdasarkan undang-undang yang berbeda, hal ini dapat menimbulkan persoalan terutama dalam aspek keadilan. b) Mencermati kelemahan yang terdapat dalam kebijakan hukum pidana mengenai tindak pidana korupsi saat ini, serta kelemahan-kelemahan yang terdapat dalam RUU Tentang Pemberantasan Tindak Pidana Korupsi yang disusun oleh pemerintah (Naskah bulan Agustus 2008), maka sebaiknya dilakukan pembaharuan terhadap kebijakan hukum pidana mengenai tindak pidana korupsi untuk yang akan datang, dengan memperhatikan hal-hal sebagai berikut: 1) Rumusan tindak pidana korupsi tetap menekankan pada unsur “merugikan keuangan atau perekonomian negara”. memberikan pengertian yuridis mengenai “Permufakatan jahat”, serta “pengulangan tindak pidana” (recedive). 2) Mencantumkan pemberatan pidana atau pemidanaan untuk tindak pidana korupsi khususnya pada lingkup “suap” dan “pemerasan dalam jabatan” yang dilakukan oleh penegak hukum terhadap perkara-perkara hukum yang sedang diperiksa.Kata Kunci : Analisa Kebijakan, Hukum Pidana, Tindak Pidana Korupsi ABSTRACT  This research entitled Policy Analysis of Criminal Law Formulation in Countering Corruption Crime. The purpose of this study: 1) To know and analyze the formulation policy of corruption in the current legislation. 2) To know and analyze the formulation policy of corruption crime that will come.Result of research: a) Formulation policy of criminal law especially concerning formulation of corruption crime at this time, has some fundamental weakness, as follows: 1) Criminal law policy in case of corruption crime in effect now, "Or" crime ". The criminal law policy in the case of corruption currently does not provide juridical definition or constraints on "malicious conspiracy", "meditlichtige and recidive". 2) Criminal law policy in the case of non-criminal corruption eradication, still scattered in several legislation and using sanctions based on different laws, this can cause problems especially in the aspect of justice. b) Paying close attention to the weaknesses contained in the criminal law policy regarding the current corruption crime, and the weaknesses contained in the Draft Law on Corruption Eradication made by the government (Manuscript of August 2008), it is advisable to update the criminal law policy regarding criminal corruption for the future, taking into account the following matters: 1) The formulation of criminal corruption still emphasizes the element of "harming the finance or economy of the country". provide a juridical understanding of "conspiracy", and "recedive". 2) Include a criminal or criminal penalty for corruption, particularly in the sphere of "bribery" and "extortion in office" committed by law enforcers against the legal cases being examined. Abstract

Islam gives references, beliefs, and ways of life so that human beings are able to overcome the problems in the world, and reach to everlasting happiness in the afterlife. Zakat is one aspect of Islamic teachings that potential to be an instrument of empowerment of the ummah and poverty alleviation, and become a symbol of harmonious relationships among human beings. The Birth of Act Number 23 Year 2011 on the Management of Zakat marks a new era of national zakat transformation that has spawned a new paradigm of zakat management in the country. Which BAZNAS acts as a regulator of zakat management nationally, is expected to perform its duties and functions in an accountable and professional. Here UPZ has a very important role for BAZNAS. Similarly UPZ Office Ministry of Religious Affairs SalatigaIt is interesting to discuss how the implementation of Act Number 23 of 201 on Zakat Management, what constraints arise in the management of the collection of zakat on UPZ Office of Religious Affairs Ministry of Salatiga City, and how the solution to the barriers of management of zakat collection at UPZ Office Ministry of Religious Affairs Salatiga .Implementation of Law Number 23 Year 2011 on Zakat Management requires the integration and synergy of all lines of government, scholars, community leaders and zakat managers, socialization and training of professional zakat management and optimization of BAZNAS role in UPZ empowerment. Abstract

Coordination and Controlling function of the Police Investigators on the process of criminal investigations by the Civil Servant Investigators has been regulated in the Criminal Law Code of Criminal Procedure, Law of the Republic of Indonesia Number 2 of 2002 on the Indonesian National Police, and the Regulations of the Indonesian National Police Chief number 6 of 2010 concerning investigations management by the Civil Servants investigators and the Regulation of the Indonesian National Police Chief number 20 of 2010 on Coordination, Supervision and Development Investigations for Civil Servants Investigators. Coordination activities include notification of commencement of the investigation, providing investigative assistance to the civil servants Investigator (in the form of technical assistance, tactical aid, relief efforts to force, and consulting assistance), submission of case files, the transfer of suspects and material evidence, termination of the investigation, information exchange, regular meetings, and joint investigations. While controlling function includes to attend and give instructions in case the title is held civil servant investigator, ask for and examine the progress of the investigation report of the civil servant investigators, examine the results of the investigation file and then going to the General Prosecutor, with the ranks of supervision civil servant investigators as requested by agency investigators led civil servants, perform data collection on the number of civil servant investigator, institution and area of assignment civil servant investigator, handling the case made by the civil servant investigators and aid the investigation, and analyze and evaluate the implementation of the investigation by the civil servants investigators. In practice in the field, coordination and controlling function does not ensure an optimal, even in defiance of regulations. Keywords: Coordination, Controlling and Investigation.

Abstract

Drug trafficking in Indonesia is legal for medical purposes but illegal for recreational use. Drug abuse is a serious problem, but drug abusers still have human rights, including the right to rehabilitation. This study examines the criminalization of drug abuse, especially by law enforcement officials, and the potential for a more balanced approach that combines legal and health perspectives. Using sociological juridical methods, the study analyzes the legal framework, law enforcement practices, and their impact on drug users. The findings highlight the need for a more in-depth approach that prioritizes rehabilitation and treatment alongside criminal sanctions. This approach would better address the root causes of drug abuse and promote effective prevention and eradication strategies.

Abstract

Article 2 and Article 3 of the Law on Corruption should be recognized as the most frequently used article by law enforcement officers in ensnaring corrupt perpetrators who have harmed the State's finances. In the implementation of the element "can harm the state finances" often raises the problem that is 1) Is the element of financial losses of the state in corruption crime is the actual loss or potential loss 2) Who is authorized to calculate and declare that there has been a loss of state finances in the criminal act of corruption 3) How method of calculating the financial losses of the state in the criminal act of corruption. Through normative juridical research by means of research literature then research result that to give more legal certainty and justice, element can harm state finance must be understood as actual loss of state finance (actual loss), while most authorized official in counting loss of state finance is BPK RI by using the method of calculation that is adjusted to the modus operandi. Keywords : harm the state finance
