Abstract

Hukum bukan sekadar sistem normatif, melainkan instrumen dinamis untuk menciptakan perubahan sosial. Penelitian ini mengkaji penerapan teori hukum Roscoe Pound sebagai alat rekayasa sosial melalui peran strategis Mahkamah Konstitusi Indonesia. Fokus penelitian ini adalah menganalisis bagaimana putusan-putusan Mahkamah Konstitusi berkontribusi dalam mengubah struktur sosial, menegakkan keadilan substantif, dan mendorong terbentuknya tatanan hukum yang responsif terhadap dinamika masyarakat. Melalui metode penelitian hukum normatif dengan pendekatan konseptual dan analisis doktrinal, penelitian ini mengkaji sejumlah putusan Mahkamah Konstitusi yang berdampak pada perubahan sosial. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi telah berperan aktif dalam rekayasa sosial melalui penafsiran konstitusi yang progresif, membuka ruang perbaikan sistem hukum, melindungi hak-hak konstitusional, dan menyelesaikan konflik sosial politik. Penelitian ini menyimpulkan bahwa penerapan teori Roscoe Pound melalui Mahkamah Konstitusi memiliki potensi yang signifikan dalam mengubah tatanan hukum dan sosial Indonesia menuju tatanan yang lebih adil, demokratis, dan responsif terhadap perubahan.

Abstract

Cyberwarfare is a form of warfare that cannot be explicitly addressed by existing international law. While most experts agree that legal restrictions must apply to this phenomenon, However, the international community has not been able to reach a consensus on how international humanitarian law (IHL) can be adapted. After outlining several cyber conflicts, this article argues that this issue is still unresolved academically. We use descriptive research methods to look for adequate and sufficient descriptions of processes, objects, activities, and people. Some parts of the Hague Convention and the Geneva Convention may indeed be relevant to cyber warfare, but their specific relevance cannot respond to this phenomenon. This is confirmed by the emergence of the virtual world, which is more recent when compared to the birth of the instrument. Many cyberattacks unavoidably result in losses for the parties, making these breaches more likely in cyber conflicts than in conventional wars. States have strong incentives to engage in cyberattacks, despite the risk of being accused of war crimes. With this in mind, this article also argues that IHL should evolve to encourage the creation of a legal umbrella against cyber warfare in some situations and provide better guidance for states in carrying out these types of attacks.

Abstract

Penelitian ini bertujuan untuk menganalisis bagaimana strategi kampanye Partai Amanat Nasional (PAN) melalui pemanfaatan Verrell Bramasta sebagai public figure di media sosial TikTok. Sebagai platform yang banyak diminati oleh generasi muda khususnya generasi Z, TikTok digunakan untuk membangun interaksi yang lebih personal dan menarik perhatian bagi generasi muda sebagai mayoritas dari pemilih pada pemilu 2024 ini. Metode penelitian yang digunakan adalah kualitatif dengan menganalisis konten pada video kampanye Verrell Bramasta dan menggunakan tinjauan literatur dari jurnal serta artikel ilmiah. Hasil penelitian menunjukkan bahwa penggunaan Verrell Bramasta secara efektif mampu meningkatkan daya tarik visual dan emosional pada konten kampanye, serta gaya komunikasinya yang santai dan dekat dengan generasi muda, khususnya generasi Z. Namun, terdapat pula tantangan dalam memastikan relevansi pesan politik bagi masyarakat luas. Strategi Partai Amanat Nasional (PAN) bersama Verrel Bramasta ini menyoroti pentingnya sinergi antara public figure dan partai politik dalam membangun citra yang inklusif di era digital ini.

Abstract

Konstitusi adalah fondasi dari sistem hukum ketatanegaraan suatu negara, berfungsi sebagai hukum tertinggi yang mengatur struktur, wewenang, dan hubungan antar lembaga negara. Dalam konteks Indonesia, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945) tidak hanya berperan sebagai dasar hukum yang tertinggi, tetapi juga mencerminkan nilai-nilai, cita-cita, dan aspirasi bangsa. Penelitian ini bertujuan untuk menganalisis peran konstitusi dalam sistem hukum ketatanegaraan Indonesia serta mengidentifikasi berbagai tantangan yang dihadapi dalam pelaksanaannya. Metode yang digunakan adalah tinjauan pustaka dengan pendekatan literatur review, yang mencakup kajian terhadap sumber-sumber relevan seperti buku teks hukum, artikel jurnal, dokumen resmi, dan hasil penelitian sebelumnya. Hasil penelitian menunjukkan bahwa konstitusi memiliki kontribusi yang signifikan dalam menjaga stabilitas politik, distribusi kekuasaan, dan penegakan supremasi hukum. Namun, berbagai tantangan seperti korupsi, konflik kepentingan, pelanggaran hak asasi manusia, dan penafsiran konstitusi yang tidak konsisten sering kali menghalangi penerapannya. Untuk meningkatkan efektivitas konstitusi, direkomendasikan langkah-langkah seperti penguatan lembaga demokrasi, peningkatan pendidikan hukum dan politik, reformasi anti-korupsi, serta penegakan hukum yang lebih tegas. Penelitian ini menggarisbawahi pentingnya konstitusi sebagai instrumen utama dalam menciptakan sistem hukum ketatanegaraan yang adil, demokratis, dan berkelanjutan.

Abstract

This study analyzes the implementation of the principles of good governance in the formation of laws and regulations in Indonesia. While principles such as transparency, participation, accountability, and effectiveness are expected to improve the quality of regulation and public trust, the practice still faces various challenges. Overlapping regulations, a lack of substantial public participation, and the accountability of legislative institutions influenced by political interests are the main obstacles. This study uses a normative juridical approach to evaluate the extent to which these principles are applied and their impact on the quality of regulations. The results of the analysis show that the ineffectiveness of the implementation of good governance principles contributes to the low quality of laws and regulations, as well as reduces public trust in the government. Therefore, reforms are needed in the legislative process to ensure that the principles of good governance are effectively integrated, in order to achieve sustainable legal development that is responsive to the needs of society.

Abstract

This study evaluates the application of the principles  of clean and good governance by the General Election Commission (KPU) in the implementation of the 2024 Election. Although the KPU is expected to be able to hold transparent, accountable, and participatory elections, the practice still faces a variety of significant challenges. The problem of managing the Permanent Voter List (DPT), uneven distribution of logistics, and the practice of money politics are the main obstacles in achieving this goal. This study uses a normative juridical approach to analyze the extent to which the principles of good governance are applied and their impact on the quality of election implementation. The results of the analysis show that despite progress in voter participation, structural and technical challenges still need to be addressed to improve election integrity. Therefore, reforms are needed in the election process to ensure that the principles of good governance are effectively integrated, in order to achieve better elections with integrity.

Abstract

This research aims to determine the process of canceling a land sale and purchase by the seller because the buyer defaulted, the legal consequences of canceling the land sale and purchase agreement by the seller because the buyer defaulted. The research method used in this research is descriptive analytical. The research results of the sale and purchase agreement process are valid and have binding force since an agreement is reached between the seller and the buyer. The sale and purchase agreement is based on the validity of the contract and other agreement principles. An agreement can be null and void (van rechtswege neiting) or can be canceled (vernietigbaar), if an agreement does not meet the requirements specified in accordance with Article 1320 of the Civil Code, namely if it does not fulfill subjective requirements (they agree to bind themselves, are competent to make an agreement) and objective conditions (a certain thing, a lawful cause). The legal consequences that arise for the buyer if they default, the buyer is required to pay compensation for losses suffered by the seller, pay court costs if sued in court, and fulfill the agreement if it continues

Abstract

Tax law is a powerful tool to force taxpayers to comply with their tax obligations. This research uses descriptive analysis that describes the applicable laws and regulations related to criminal law policies in the application of the principle of restorative justice in tax criminal investigations. The purpose of tax audit is as a law enforcement effort by the Directorate General of Taxes (DGT) against taxpayers in carrying out tax obligations, which is based on the ultimum remedium principle that prioritizes administrative sanctions before criminal sanctions. It is expected that the tax education initiative will be able to improve the quality and effectiveness of tax education activities.

Abstract

The purpose of this study is to explore the role of correctional institutions in shaping the character of prisoners. The concept of inmate development in correctional institutions is analyzed and a normative juridical approach is used to review and analyze laws and regulations related to the concept of inmate development in shaping their character. The results showed that there are still various obstacles to the successful implementation of an activity, the large number of prisoners makes the correctional institution over capacity where the capacity as of December 2023 should only be 1,200 people but there are 1,280 people in it so that there is an overcapacity of 6% things like this are the obstacles most often encountered against the success of empowerment in correctional institutions, besides that several obstacles are encountered to maximize coaching. The lack of budget in the process of fostering Wargabinaan often hinders the implementation of the coaching program, which causes prison officers to prepare funding efforts that can help the implementation by forming cooperatives among fellow prison officers, however, even that has not been able to meet the financing to the maximum so that the purpose of coaching is not maximally achieved. In an effort to empower prisoners, prison officers maximize prison officers in fostering prison officers with the aim that after the prisoner comes out / finishes serving his sentence, he can re-interact with the community.

Abstract

Regional Autonomy in Indonesia is a very important part of government governance. Regional Autonomy is a concept that gives freedom and authority to regional governments to manage local resources and interests in accordance with the needs and characteristics of the region. Sustainable development referred to in the context of the Sustainable Development Goals (SDGs) requires attention to economic, social and environmental aspects simultaneously. In Indonesia, the challenges in achieving sustainable development goals are still very large. opportunities and challenges that arise from the implementation of Sustainable Development Goals (SDGs) in the regions need to be optimized and addressed as best as possible in a way that is well understood so that sustainable development goals can be achieved effectively.
