Abstract

A Penitentiary is an implementing institution of the criminal system that functions to foster prisoners, including in this case women who undergo criminal punishment are required to participate in a whole series of formation activities in prisons. In this case, the effectiveness of the formation of prisoners can set a good example and example to others, especially for women, children, and elderly prisoners. Then the supporting factors can be used as examples for better in the future and factors that can hinder the coaching can be found better solutions. The purpose of this study is to determine the pattern of coaching female, child, and elderly prisoners and determine the inhibiting and supporting factors of coaching. To overcome problems in the implementation of the development of women, children, and elderly prisoners, synergy is needed between all parties involved, ranging from prisoners, correctional officers, and related agencies to cooperate in the implementation of training for women, children, and elderly prisoners. For this reason, it is necessary to handle and coach to achieve better goals, and if the prisoner has come out, it will create an independent character and have a better leadership spirit

Abstract

The development of information technology has changed many aspects of life, including government administration, for example, the application "elektronik siap nikah dan hamil" (ELSIMIL) as a marriage registration process at the Office of Religious Affairs (KUA), which is used to simplify the marriage administration process. This article aims to understand how this application works and identify the efficiency and accuracy of marriage registration, as well as public response to the use of technology in marriage registration administration. KUA Purworejo, Pasuruan is used as a research location, the research methods include empirical juridical data collection, data processing, and drawing descriptive-analytical conclusions. The findings of this study show that the ELSIMIL certificate as a mandatory requirement for registering as a bride-to-be at KUA has been implemented well. These benefits are in the form of better accessibility and availability of KUA services for the community, both through online services and offline services when people visit the KUA office. It also enhances cooperation among institutions, civil society organizations, or other religious institutions, which automatically helps KUA expand the range of services and resources available to the community. ELSIMIL certificate as a condition for holding a marriage, can treat brides-to-be who have health risks that are not ideal for pregnancy preparation.

Abstract

This article explores the plastic waste-based payment policy implemented on the Suroboyo Bus Service in Indonesia, examining its alignment with the principles of a Green Constitution. The Green Constitution concept emphasizes the integration of environmental protection into legal frameworks. This study aims to analyze the Suroboyo Bus Service Plastic Waste Payment Policy in the context of the Green Constitution. Our analysis covers various aspects, including the historical background, legal norms, policy effectiveness, and the importance of community participation. The study employs normative-empirical research methods, examining the legal norms underpinning the Suroboyo Bus Service policy and its implementation. Quantitative data is collected through questionnaires distributed to the Suroboyo Bus Service users, revealing insights into public awareness, attitudes, and perceptions regarding the policy. Analysis of legal norms indicates a harmonization between the Suroboyo Bus Service policy and the Green Constitution principles outlined in the 1945 Indonesian Constitution. However, the study identifies a legal vacuum in waste management, suggesting more explicit guidelines are needed. The article also underscores the importance of collaborative efforts between the government and community organizations in efficient waste management.

Abstract

This article describes the victory of female village head candidates in village head elections as a rare occurrence, mainly due to the lack of access for women to leadership positions due to a solid patriarchal culture. However, after being elected, women proved to have the competence to lead, showing that women can become leaders at the village level. Cultural shifts, especially in Javanese culture, have allowed women to be involved in the public sphere, including in organizations such as the the Pemberdayaan dan Kesejahteraan Keluarga (PKK), Dasawisma, and others. This paper uses a qualitative approach and case studies to examine the phenomenon. Data were obtained through observation, dialogue, and in-depth interviews. The results show that women can gather and mobilize political power from multiple sources to influence voters and dominate the dynamics of village democracy. Habitus of leadership, symbolic dominance, hegemony of social institutions, and kinship became the main instruments utilized by female village head candidates. They draw on leadership experience in social solid and kinship institutions to win village head elections.

Abstract

Unregistered child marriage has become a custom in the Lumbang community. Nevertheless, the Lumbang community registered their marriage with the State when they had children. The existence of this phenomenon shows that the Lumbang community adopts more than one norm regarding child marriage. This article will reflect on the legal practices in the Lumbang community regarding child marriage. This article is an empirical legal research with a legal anthropology approach. This article uses John Griffith's theory of legal pluralism as a means of uncovering the facts of legal practice in the Lumbang community. This research shows that legal pluralism occurs strongly in the practice of unregistered child marriage in Lumbang. The practice of strong legal pluralism occurs through the incorporation of religion-adult law, State-adult law, and the distinction of State-adult law. The community conducts unregistered child marriage as a convergence of customary-religious norms as well as divergence of norms due to restrictions on the minimum age of marriage by the State. Then, the State will register the marriage when they have children as a form of convergence of State-adult norms.

Abstract

 This article explores the opportunities and difficulties that exist for affective control in the Legal Aid Post-Room of the Religious Court (Pengadilan Agama) of Surabaya. Humans and non-human entities coexist in this space, entwined in a relational way to be present together. The ethnographic methodology was selected to get empirical data gathered via five months of observation and interactive discussion. Regarding interpersonal relationships, language use, and the physical space of the Legal Aid Post, the paper contends that Legal Aid workers, informants, and guests are all intertwined. The research findings show ethnographically the atmosphere of the service and reporting process in the Legal Aid Post space as part of the performance in the theater of equality and non-discrimination to demonstrate the sympathetic attitude of Legal Aid officers towards informants. These findings ultimately affirm the presence of emotional atmospheres at certain moments in the Legal Aid Post space, necessitating officers to exhibit creativity. The focus on linguistic expressions to approach feelings and atmospheres in the Legal Aid Post space, in turn, can affect the quality of service. The role of material arrangement, semantic content, and affective experience is utilized to serve the impoverished community in shaping their experiences in seeking justice and the semantic content of what is said

Abstract

This article examines Islamic law and ethics used to analyze the position and ethics of persons with intellectual disabilities in marriage. They have the same right to marry without discrimination or stigma. Literary and descriptive methods were used in this study, as well as document comparison. The study found that Islamic scholars of various schools expressed their opinions about the marriages of people with intellectual disabilities and their legal responsibilities. Although the majority of madhhabs recognize that their marriages are valid, there are questions about their responsibilities after the marriage. This issue is addressed in several edicts of scholars; Some of them allow marriage if there is sexual attraction. However, the question of how they can take responsibility and consent in the context of sexuality is still the subject of discussion.  To determine whether people with intellectual disabilities can fulfill their marital obligations, the concept of responsibility, both etymological and terminological, is discussed. Studies show that a person's ability to take responsibility is affected by their level of disability. This perspective discusses the impact of Islamic law and the daily lives of people with intellectual disabilities, such as the possibility of guardianship or representation in decisions about marriage and sexuality. According to this study, the personal responsibilities and rights of people with intellectual disabilities should be carefully considered.
