Abstract

This study aims to analyze the influence of family economic conditions on community political participation in the 2024 Tasikmalaya Mayoral Election. The background of this study is based on the assumption that household economic well-being plays a significant role in determining the level of citizen involvement in the local democratic process. The study used a quantitative method with a survey approach to 100 respondents who were registered voters in Tasikmalaya City. Sampling was carried out using a simple random sampling technique, while data analysis used validity, reliability, normality, and simple linear regression tests with the help of IBM SPSS software. The results showed that family economic conditions had a significant effect on community political participation, with a significance value of 0.001 (<0.05), a correlation coefficient of 0.634 indicating a strong relationship, and an Adjusted R Square value of 0.396, meaning that 39.6% of the variation in political participation can be explained by economic conditions variables. This finding confirms that the better the family economic conditions, the higher the level of community political participation in the regional head election in Tasikmalaya City.

Abstract

Legal certainty is needed to create orderliness, peace, sense of security in society by providing clear direction regarding the rights and obligations of each person. Without legal certainty, there is no standard code of conduct, which can create to chaos, injustice and arbitrariness. This paper analyzes the phenomenon of the reportee absence (in absentia) in the Sentragkkumdu Investigations in the 2024 Bandung Election, using the Positivism Utilitarianism framework, specially the thoughts of John Austin (Positivism) and Jeremy Bentham (Utilitarianism). The case study focuses on the Sentragakkumdu Investigations Bandung Election, money politic`s crime cases, where investigators decided to stop the investigations process, because the reportee not present. This paper argues that decision to stop the investigation election crimes, because the reportee was`nt present is very contrary to the principle of legal certainty and the principle of criminal law to find material truth. Positivism Utilitarianism become a solution where election crime cases must be processed without the presence of the reportee, so that providing guarantee of good enforcement of regional election law and providing sense of justice for the society and all parties involved in the stages of the election regional process.

Abstract

Selection and recruitment of Bawaslu members is likely an interesting topic to discuss, consideration that this period plays a significant role in order to increase the quality of the institution and democracy itself. Within the framewrok of inclusive election, the principles of inclusive eelction, the principles of equality and non-discrimination are key points that must be implenented in al levels., including the selection and recritment of Bawaslu. In the context of West Java, the problems are implied within the implementation of this inclusiveness has been widely questioned due to fact of low participation and representation of women, disability, and indigenous people. Using qualitative descriptive approach, this study provides a comprehensive overview of the selection process conducted by Bawaslu in West Java Province. The result show that the selection process challenged several problesm that correlating with low participation by vulnerable groups, which is also consistent with their electability. The study has also found that only 14 women compared to 111 men were selected as Bawaslu members in 27 regencies/cities across West Java. This research contributes to the understanding of the complexity of regulations, governancy, and various technical problems in implementation of selection. This study also provides an insightful idea for improving future Bawaslu selection process.

Abstract

Systematic interpretation is one of the efforts to a regulation by emphasizing the optimalization of a systematic framework that underlies the normative validity of legislation. This shows that law has the character of a science, where legal research and study focus are based on the principles within the law itself. The research method used in this study employs a juridical-normative method with a library approach, where primary materials are examined through legislation and supporting legal doctrines. The research results indicate that in the study of the alleged violation Number Register: 03/Reg/LP/PB/KAB/13.23/X/2024 by Subang Regency Bawaslu, interpretation was conducted more through grammatical interpretation, whereas systematic interpretation should have been maximally employed, because after all systematic interpretation is the core character of normative legal science. As a result, efforts to interpret the article in question in the study have not been maximized.

Abstract

The integrity and security of electoral systems are crucial for the legitimacy of democratic processes. However, traditional voting methods are increasingly susceptible to manipulation, fraud, and inefficiency, prompting the exploration of blockchain technology as a solution for transparent and tamper-proof elections. This study aims to evaluate the practical deployment of blockchain technology in elections, addressing the empirical gaps in current literature and providing a multifaceted approach that considers technological, legal, and social challenges. The research employs a literature study, analyzing case studies, pilot projects, and real-world data on blockchain-based voting systems. Findings indicate that blockchain offers significant potential to enhance election security, transparency, and public trust, though challenges related to scalability, accessibility, and legal frameworks remain. The study concludes that blockchain can play a transformative role in modernizing electoral systems, but its successful integration requires overcoming these hurdles through careful planning, legal adjustments, and public engagement.

Abstract

Elections are fundamental to democracy, but the increasing frequency of fraud, voter suppression, and irregularities calls into question the integrity of electoral processes. Traditional methods of monitoring are often slow and reactive, failing to detect irregularities in real-time. The integration of Artificial Intelligence (AI) offers a promising solution for enhancing electoral integrity by enabling proactive, real-time monitoring and fraud detection. This study aims to explore how AI technologies can be integrated into election monitoring systems to detect and prevent electoral fraud in real-time. It seeks to provide a comprehensive framework for governments, election commissions, and international organizations to adopt AI-driven systems effectively. The study uses a literature review to analyze existing research on AI applications in elections, focusing on empirical studies from 2018 onwards. It synthesizes findings from case studies, electoral fraud reports, and AI performance metrics, providing a comprehensive analysis of AI's potential in election monitoring. The research demonstrates that AI can significantly enhance real-time fraud detection and improve election transparency. However, successful implementation requires addressing ethical, legal, and infrastructural challenges. The study concludes with practical recommendations for governments and election bodies to integrate AI solutions into their monitoring processes while ensuring fairness, accountability, and transparency.

Abstract

This study aims to analyze the implications of the open proportional representation system on the quality of political representation in the Indonesian Regional People's Representative Council (DPRD), particularly in relation to the substantive performance of representatives, patterns of relations with constituents, and the dynamics of political nancing. The study uses a qualitative, normative-empirical approach, using analysis of election legislation and literature review of secondary data in the form of DPRD performance reports, publications from election monitoring institutions, and relevant academic literature. The results show that while the open proportional representation system procedurally expands voter choice and strengthens electoral legitimacy, substantively, this system encourages political personalization, intra-party competition, and representatives' orientation toward individual electoral interests. Political representation tends to shift from a substantive model to a narrow, transactional electoral model. Furthermore, this system has implications for increasing political costs, which are correlated with the practice of money politics and a tendency towards political corruption due to pressure to recoup campaign funds. Thus, the open proportional representation system does not automatically improve the quality of political representation in the DPRD but instead operates problematically in the context of weak party institutions and political nancing regulations in Indonesia.

Abstract

This study analyzes the institutional strengthening of Indonesia’s Election Supervisory Body (Bawaslu) through the application of the COSO Internal Control - Integrated Framework. Using a normative–descriptive approach, it examines how the five COSO components control environment, risk assessment, control activities, information and communication, and monitoring are reflected in Bawaslu’s governance system. The research focuses on the 2025 Chairperson’s Decree on risk management as a landmark policy institutionalizing internal control within Bawaslu’s organizational architecture. Drawing from contemporary governance and public integrity theories (Scott, 2021; OECD, 2020; IDEA, 2021), this paper argues that COSO serves as an integrative model linking accountability, transparency, and risk-based management in electoral institutions. The findings reveal that aligning COSO principles with Bawaslu’s risk governance enhances institutional resilience and reinforces its legitimacy as a guardian of electoral justice.

Abstract

This study aims to analyse the causative factors of Vote Recounts (PSU) in the 2024 General Election in Indramayu Regency and formulate a sustainable supervision strategy roadmap as a preventive measure. The method used is qualitative with a case study approach, where data was collected through observation, in-depth interviews, and document analysis related to the implementation of vote counting and the determination of PSU in three polling stations (TPS). The research findings reveal that the root causes of PSU are multidimensional, resulting from the intersection of regulatory, human resource, and contextual factors. The primary factor is the deficiency in understanding and inconsistency in interpretation of technical regulations, particularly regarding voter classification in Article 24 of the General Election Commission Regulation (PKPU) Number 25 of 2023, by voters, KPPS officers, and witnesses. This disparity in perception leads to procedural violations such as voting by migrant voters without Form A5 which legitimizes result annulments. Dysfunctional socialization and the pressure from electoral dynamics with numerous participants exacerbate the situation. Based on these findings, this study recommends a paradigm shift in supervision from reactive to proactive-predictive through the implementation of a sustainable supervision roadmap. This roadmap is proposed based on an integrated cycle comprising: (1) vulnerability mapping using initial data (such as voter lists) to predict vulnerable points in the logistics and vote-counting stages; (2) development of measurable supervision indicators; and (3) formulation of adaptive operational strategies, including intensive digital space monitoring. The implementation of this roadmap is expected to function as an early warning system to prevent the recurrence of PSU in future elections.

Abstract

This research presents an in-depth and comprehensive analysis of the dynamics, implementation, and effectiveness of electoral dispute resolution within the context of the 2024 simultaneous Regional Head Elections (Pilkada Serentak) in West Java Province. The study aims to evaluate the performance of the West Java Provincial Election Supervisory Agency (Bawaslu) in carrying out its quasi-judicial function, with a specific focus on two main dispute taxonomies: Disputes Between Election Participants (PSAP) and Disputes Between Participants and Election Organizers (PSPP). Adopting an empirical legal research (socio-legal research) method combined with doctrinal analysis, the study examines primary data from the 2024 Final Report of the West Java Bawaslu Dispute Resolution Division, as well as analyzes compliance with the regulatory framework of Bawaslu Regulation Number 2 of 2020. The research findings reveal that in 2024, West Java Bawaslu managed 16 requests for inter-participant disputes, predominantly involving campaign props conflicts, all of which were successfully resolved through an expedited procedure mechanism that emphasized restorative justice. On the other hand, there were 14 requests for process disputes, with a significant registration rejection rate (50%) due to the election participants' lack of knowledge regarding material requirements and legal standing. The study also highlights Bawaslu's success in correcting the administrative decisions of the General Election Commission (KPU) through adjudication rulings that granted the petitions in Cimahi City and Bogor Regency, asserting Bawaslu's role as the guardian of substantive justice. This report recommends the necessity of strengthening the capacity of ad hoc mediators, revising regulations related to the dispute threshold, and intensifying legal education for election participants to improve the quality of procedural democracy in Indonesia.
