Abstract

In the notary science known as the "Notary Protocol", is the State Archive which must be kept and maintained by a notary. Once the importance of the storage and security of the notarial protocol, to the notary who has died, there is an obligation of the heir to inform and submit notary protocol to the Regional Supervisory Board (Majelis Pengawas Daerah/MPD), then the Regional Supervisory Board (MPD) designates another notary as the notary receiver of the protocol to receive and store the notary protocol. Notary protocols which are not submitted to other notaries result in harm to the parties, especially if they are a problem and need to be verified in court by the parties or parties concerned. The authority of the Regional Supervisory Board (MPD) is to request a notary protocol to the heirs of a notary who has died.

Abstract

In this modern age, one of the forms and movements of endowments that attracted the attention of scholars and scholars is cash waqf. In Islamic history, cash waqf developed well in the days of the Bani Mamluks and Ottoman Turks. Basically wakaf is an instrument maliyah, so wakaf not only serves as a mere ritual worship but also social function. Waqf is a form of a steady expression of faith and a high sense of solidarity among fellow human beings, so it is an attempt to manifest and maintain vertical relationships (hablun min Allah) and horizontal relationships (hablun min al-nas). In the context of Indonesia, the enactment of the Law of the Republic of Indonesia no. 41 of 2004 on Wakaf directed to empower wakaf which is one of the instruments in building the socio-economic life of Muslims. The presence of Wakaf Law is a momentum of wakaf empowerment productively. In this paper will be elaborated discussion of waqf in general, followed discussion of cash waqf, as well as views of the mujathid cleric about cash waqf.

Abstract

One of the social reactions to evil is to impose criminal punishment on the perpetrator by constantly changing and perfecting what kind of punishment should be imposed by looking at the purpose of the imposition, which is the object of the study of the penology. on the other hand, in the jinayah fiqh study known qisas. This paper is present in order to describe and analyze criminal qisas, with the focus of the study in the perspective of penology. The conclusions of this paper are: first, there are at least five theories of penology, namely (1) retribution, (2) deterrence, (3) rehabilitation, (4) incapacitation, and (5) restoration. Secondly, qisas is to punish the perpetrators in accordance with their deeds, which are based on the QS. Al-Baqaarah (2): 178-179 and QS. al-Ma'idah (4): 45. Thirdly, qisas in its implementation has included five penalty theories as in penology, namely: retribution, deterence, reformation, incapacitation, and restoration.

Abstract

This paper aims to determine the existence and strength of executives certificate of liability to the property rights of apartment units as a guarantee of debt in credit agreements in the bank. The legal basis for the execution of encumbrance over apartment units is provided in Article 20 of the IRA (the Insurance Rights Act). The object of encumbrance is sold through a public tender in the manner prescribed in the prevailing laws and regulations. The holders of the encumbrance entitlements are entitled to take all or part of the proceeds for the repayment of the receivables, with the right that precedes it from the other creditor. The result shows that banks will not dare to provide loans or credit to the community without any guarantee. The ownership rights of apartment units can be used as the object of credit guarantee and tied with mortgage rights.

Abstract

Facing the Qibla is a legitimate requirement in the salat. In some recent astronomical literature mentioned that the meaning of the direction of Qibla is the closest distance to the Kaaba. In the literature books of fiqh as well as classical celestial sphere is not mentioned meaning Qibla direction as the closest distance to the Kaaba (Mecca). Qiblah word in the verse means "shatrah" and "jihah" where both have a sense of direction facing, without indicating whether the direction of the nearest or farthest. This paper explore the concept of the meaning of the closest distance in defining the direction facing the Qiblah. Meaning the search starts from facing the Qibla direction by fuqoha 'followed by the meaning of facing the Qibla direction by the astronomer or an astronomer at the time of the Prophet until today. In that search will be sought from since when appearing purport Qibla direction as the closest distance and who within the scientific community.

Abstract

At the present time the development of social media so rapidly, which of course affect the pattern of community life. But this development is often misused, one of which is cyberpor. This paper aims to describe and analyze pornography in the perspective of Indonesian Penal Code and Islamic Criminal Law. At the end of the paper it is concluded that, first, pronography in Indonesian criminal law is defined as drawings, sketches, illustrations, photographs, writings, sounds, sounds, moving pictures, animations, cartoons, conversations, gestures, or other forms of communication through various forms of communication media and/or public performances, containing obscenity or sexual exploitation in violation of moral norms in society. The regulation is contained in the Criminal Code (Article 282), in Act Number 44 of 2008 on Pornography, and in Law Number 11 Year 2008 on Information and Electronic Transactions. Secondly, that pornography in Islamic Law includes adultery that is not punished (hadd), but still makes the perpetrators sinful. The sanction for the perpetrators of pornography is ta'zir, which the determination of sanctions is the right of the state leader in accordance with the level of crime committed.

Abstract

One of the important events experienced by man is death, that is the final process of human life. Because it is a legal event, the death has legal consequences, namely the law of inheritance, is the event of the transfer of property left by the dead to the heirs. In Islamic law, inheritance law is a law that regulates all things concerning the transfer of rights and / or obligations on one's property after he dies to his heirs. In Islamic law there are six principles, are (1) the principle of ijbary, (2) the principle of waratha, (3) the principle of thuluthay al-mal, (4) bilateral principle, (5) the principle of equity or equilibrium, 6) individual principles. While in the Islamic heritage in Indonesia there are three principles adopted, as in the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI), are: (1) the principle of ijbary, (2) the principle of waratsa, and (3) bilateral principle.

Abstract

Humans interact with other humans to exchange potentials, whose goal is to create more diverse interactions. In this interaction sometimes humans become predators for other humans. Under these conditions, Islam is present to impose its limitations, in the form of news, orders, and prohibitions. One of the prohibitions in the Qur'an is the spin and the circulation of wealth only on the wealthy people, so it needs to be a fair distribution of wealth. The discussion in this paper begins with a discussion of the distribution and ethics, so that raises the various concepts of ethical axioms of some of the opinions of Muslim Economists. The Islamic economic system departs from an awareness of ethics, in contrast to other economic systems. Furthermore, will be described Islamic philanthropy as a manifestation of the axiom of distribution ethics, both obligatory and sunnah philanthropic. Through these philanthropic teachings, Islam wants to reduce the negative nature of human beings, even make it as a buffer of Islam (Rukun Islam). That is, without implementing it means someone's Islam will collapse. This is a realistic account of the ethical distribution initiated by Islam. Implementation of Islamic philanthropy and accompanied by knowledge of sharia is the first step in the form of community welfare.

Abstract

The issue of multi-party presidential governance in Indonesia remains an unfinished homework to date, many political experts and Constitutional Law have inferred the ineffectiveness of presidential systems in multi-party models. On the other hand, our Constitution has affirmed through its characteristics that Indonesia embraces a presidential government system, but it is applied in multiparty political construction. Since the beginning of the general election, Indonesia still uses the proportional system with various color additions district. Because of the proportional success that has been used since the first election, it may be necessary to try new things by using the district system with a variety of variations so as not to undermine democracy. The parliamentary threshold model and the tightening of conditions for parties to follow the election will slowly simplify the party. Nevertheless, the high standard of parliamentary threshold creates much criticism, the small party feels aggrieved and says it is against democracy.

Abstract

Often the violence perpetrated by a group of people against suspected perpetrators of certain acts of crime, sometimes even people doing things that are beyond the boundaries of humanity, called "citizen vigilantism". This paper is a description of the persecution in fiqh jinayah and positive criminal law. The conclusion of this paper is that in fiqh jinayah persecution consists of (1) due to deliberate and (2) due to negligence, whose object consists of: (1) regarding parts of the human body, (2) removes the meaning of limbs, wounds on the head, (4) injuries to other limbs, and (5) other injuries, while the punishment is qisas, if forgiven then replaced diyah, and if forgiven then replaced ta'zir. Whereas in the Indonesian Penal Code, persecution consists of due to "deliberate" or "negligence", which is divided into (1) ordinary abuse, (2) minor persecution, (3) plain old-planned persecution, (4) severe persecution and (5) persecution weight with a planned first.
