Abstract

“Putusan hakim tidak adil, tidak berhati nurani, berat sebelah, menguntungkan orang kaya!”, itulah yang sering kita dengar. Padahal menurut Gustav Radbuch, putusan hakim harus memenuhi tiga unsur nilai dasar, yaitu (1) kepastian hukum, (2) keadilan, dan (3) kemanfaatan. Akhirnya dalam kaitan penemuan hukum pada Hakim Agama dapat disimpulkan bahwa: (1) kesenjangan antara hukum dan perilaku nyata memunculkan ungkapan “law in the books” dan “law in action”; (2) hakim Agama dalam menerapkan hukum berdasarkan pada hukum tertulis; (3) secara tekstual, hakim dituntut oleh undang-undang untuk menggali nilai-nilai yang hidup dalam masyarakat,

Abstract

Cancellation and inaccuracy in the description of civil case ruling MA No. 666PK / Pdt / 2011, are two different things but used for the same reasons. Related to the cancellation of land and building purchase agreement of land and building by notarial deed, not by PPAT deed, which occurred on February 13, 1990 as follows: first, the agreement was made within 6 months before the death of Indrawati Dharmaputera which was accompanied by her husband is the covert effort to get rid of the bezit rights, and, secondly, the effort for the defendant to master the budel with the title of sale and purchase and heirs. Thus, the deed of sale and purchase and the power of attorney are valid and retroactive in its application. The cancellation of the notarial deed is in accordance with the principle of probation action causa, due to the deed of inheritance which is a rebuttal of the notarial deed which is not fulfillment of the objective element in terms of achievement, because the certificate is a joint treasure between Indrawati Dharmaputera and Krishna Dharmaputera which has civil rights, can be submitted reverse.

Abstract

Among the models of "joint ownership agreements" are agreements between persons holding common land rights that agree that only one person is named in the certificate (called a nominee) while the other is not included in the certificate (called a beneficiary). This paper answers questions ranging from (1) legal protection to beneficiaries of bad faith nominee, and (2) legal settlement in the event of a dispute between nominee and beneficiary. The conclusions of this paper are (1) the protection of the law for the beneficiary of the harm done by the nominee can be done through the means of repressive law protection, namely dispute settlement in court, and (2) the legal settlement of the dispute between the nominee and the beneficiary may be settled through litigation and non-litigation, (in the form of: negotiation, mediation, conciliation and arbitration).

Abstract

This paper will examine and analyze the legal responsibilities of the Land Office, with a focus on case studies on Supreme Court Decisions. 162 K/ TUN/2012. At the end of this paper, it is concluded that: (1) the existence of this decision indicates that the settlement of land disputes can be through the media of the Adminsitration Court, (2) the content of a decision in the form of a command to the Head of the Land Office of Kendari to revoke and cross out from the land book is the responsibility of the institutional (3) if maladministration is found, personal criminal liability may be filed, and (3) as well as if there is a loss to the plaintiff it can be filed a lawsuit civil to the Official, whose responsibilities may be institutional or personal, with regard to whether or not maladminsitration exists.

Abstract

Abstract: This paper aims to analyze a legal event of transfer of inheritance land under burden of Mortgage; obstacles faced by the debtor in relation to the transfer of rights to inheritance land still burdened by the mortgage; and legal consequences if the beneficiary rejects the inheritance of land rights that are being borne by the mortgage. The end of this paper concludes three things. First, that the procedure for the transfer of rights to inheritance land that is being burdened by the mortgage right is executed after obtaining written approval from the holder of the mortgage or other party authorized to approve the removal of the burden in question. Also, the registration of the transfer of mortgages is done by recording it on the land books as well as the certificates of the related mortgages and on the land books and certificates of the rights imposed on the basis of a certificate of transfer of receivables guaranteed by inheritance. Second, the obstacles faced by the creditor associated with the transfer of rights to the inheritance land that is still burdened by the Mortgage Rights is the obstacle in the process behind the name to the heirs in the Land Office. Thirdly, the rejection of the heirs over the inheritance of land rights that are in the imposition of the Deposit Rights does not result in the Deposit Rights being burdened to be abolished

Abstract

Humans as social beings need the help of other humans in meeting their daily needs. In meeting these needs, one of the ways used is to buy goods in a non-cash manner. However, often the payment is not smooth, so as an effort then the creditor/lessee using debt collector to take seizure or seizure of motor vehicles. The conclusions of this paper are: (1) the legal relationship between the debt collector and the debtor that is the debt collector in performing his work acts as a lessor based on a power of attorney given by the lessor to the debt collector to collect or take forcibly the collateral object from the debtor, as provided in Article 1792 and Article 1795 Civil Code concerning special power of attorney; and (2) the legal protection of debt collector taking the motor vehicle of credit guarantee object can be applied if the debt collector in conducting its action does not violate the provisions of Article 368 of the Criminal Code (extortion); in addition, in the lease agreement there is a clause which excludes Article 1266 Civil Code , so retrieval of the lease object does not require a judge's verdict.

Abstract

Authentic deeds in agreements made by notaries do not rule out the possibility to bring up legal matters and cause lawsuit case from the parties in the deed. The limitation of accountability of notaries can be required as long as they are still authorized to perform the duties of a notary. However, if the notary has passed away in the making of the deed, it becomes a legal matter and has harmed the parties. then what happens in interpretations of positive law is the one that must bear the punishment for damages made by the notary, based on a decision that has the legal binding verdict (inkracht) is the heir of the notary.

Abstract

In order to improve the welfare of public servants, the Government provides official housing, which of them can be owned by leasing. The payments are through the withholding of the civil servant's salary each month, and a lease agreement is made in the presence of a Notary Public. After the expiration of the lease period, the Government issues Letter of Release of Rights to the civil servant made before the Notary. The conclusion of this writing is: first, the authenticity of the deed of sale and purchase of government land purchased by Public Servant is valid and has perfect proof power, but in the case for the handling of ownership in the Land Office, the deed of sale and sale can not be used as the requirements, but the Deed or Letter of Release of Rights of the government made before the Notary. Secondly, the legal protection for Civil Servants who buy a State house for residence is a regulation through legislation, consisting of arrangements concerning the procedure of granting property rights to a civil servant or his heirs of the official housing he buys.

Abstract

Improvements in "comparition" writing errors (the act of present in the public officials) shall be in accordance with the procedures under applicable laws, since essentially what is contained in the authentic deed must be true, so that the authenticity of the Deed is evident can be maintained. This is the duty of the Notary, because he must ensure that documents of the constraints such as the identity and the evidence are true. The end of this paper concludes that (1) the composition of the deed is not in accordance with the provisions imposed by the law regulating the category of a violation, and (2) the civil notary liability on the deed made, in this case the responsibility to the material truth of the deed, in the construction of the act against the law, so that if from the mistake material or material damage occurs then the notary is obliged to repair or replace the loss.

Abstract

The Deed of Sale Purchase is based on the issue of accounts payable as stated in the Deed of Recognition of Debt, which on the one hand contains the responsibility of Notary in applying the principle of prudence in measuring the legitimacy to make a transition on the guarantee of the certificate made on behalf of the creditor as collateral for the debtor to obtain the receivable. This Deed of Recognition of Debt is reinforced by the agreement payable receivable agreed upon by the parties, which may be followed by the Deed of Sale of Sale as collateral against the debt repayment if the debtor is defaulted. At the end of this paper concluded that: (1) the recognition of the debt with the guarantee of the right to land can be done by selling the power under the Deed of Recognition of Debt with the guarantee of land rights, and this is not contradictory to the legislation, and (2) The responsibility of the Notary as the official the general author of authentic deeds attaches to civil liability when making a mistake in carrying out his position, with due regard to aspects of making against the law or wanprestasi.
