Abstract

The phrase “other government institutions” in Article 25 of Law No. 61 of 2024, which amends Law No. 39 of 2008 concerning State Ministries, creates interpretative ambiguity due to the absence of a definition or delineation of the institutions referred to. At the same time, Article 25 of Law No. 61 of 2024 grants broader authority to the President compared to its predecessor. Therefore, it is important to examine the implications of this ambiguity for the expansion of presidential powers as formulated in Article 25. This study raises two research questions: (1) What are the possible interpretations of the phrase “other government institutions” under Law No. 61 of 2024? (2) What are the implications of such interpretative ambiguity for the limits of presidential authority? This normative legal research employs a descriptive analytical method. The study identifies several potential interpretations of the ambiguous phrase and reveals two key expansions of presidential authority influenced by it: (1) the broadening of presidential power to regulate the structure and responsibilities of government institutions across sectors and/or administrative levels; and (2) the opportunity for the President to establish and/or govern new types of institutions distinct from Ministries, Non-Ministerial Government Institutions (LPNK), and Non-Structural Institutions (LNS).

Abstract

The position of the Presidential Communication Office as a Non-structural Institution has raised both pros and cons debates that have led to a review of the urgency of the existence of this new institution. This study examines two things, first, the position, duties, functions, and institutional structure of the Presidential Communication Office and second, the urgency of the Presidential Communication Office in the Government System. The results of this study are, first, the Presidential Communication Office is a non-structural institution under and responsible to the President. Its position, functions, and duties are intended to provide support to the President in implementing communication and information on strategic policies and priority programs of the President. Second, the existence of the Presidential Communication Office needs to be reviewed in more depth, especially regarding the possibility of overlapping with the Ministry of Communication and Digital. In addition, the institutional structure of the Presidential Communication Office has the potential to conflict with the spirit of bureaucratic reform, if not followed by the arrangement of government institutions that have the same authority.

Abstract

Politik Hukum memiliki peranan penting dalam pembentukan Peraturan Perundang-Undangan Usulan Presiden di Indonesia dalam hal ini sebagai sarana tujuan negara. Politik hukum dalam pembentukan peraturan perundang-undangan terlihat jelas melalui proses legislatif yang berupaya menjawab kebutuhan nyata di masyarakat. Peran Presiden sebagai inisiator dalam sistem legislasi di Indonesia sangatlah penting dan kompleks terkait visi misi presiden saat menjabat. Hubungan antara politik hukum dan pembentukan peraturan perundang-undangan yang diusulkan oleh Presiden menunjukkan sejumlah gap yang perlu dieksplorasi lebih dalam. Perumusan masalah pada penelitian ini yaitu Bagaimana politik hukum dalam pembentukan peraturan perundang-undangan yang diusulkan oleh Presiden di Indonesia dan Bagaimana peraturan perundang-undangan usulan Presiden dalam mewujudkan tujuan negara berdasarkan prinsip negara hukum dan demokrasi. Metodologi yang digunakan adalah penelitian kualitatif dan normatif. Dalam pembentukan peraturan perundang-undangan yang diusulkan oleh Presiden Indonesia, peranan politik hukum sangat krusial dalam memastikan bahwa regulasi yang dihasilkan responsif terhadap kebutuhan masyarakat. Politik hukum yang inklusif membuka ruang partisipasi publik dalam proses legislasi, sehingga kebijakan yang dihasilkan lebih demokratis dan sesuai dengan prinsip negara hukum. Namun, efektivitas hukum dalam penegakan serta pemulihan kerugian negara menjadi indikator utama keberhasilan peraturan perundang-undangan. Perumusan politik hukum yang lebih transparan dan partisipatif menjadi kunci dalam memastikan bahwa kebijakan hukum yang dibuat oleh Presiden benar-benar mencerminkan aspirasi dan kepentingan masyarakat. Penguatan checks and balances dalam pembentukan kebijakan hukum oleh Presiden sangat penting untuk menjaga prinsip demokrasi dan keadilan dalam sistem hukum Indonesia.

Abstract

Ethics play an important role in the process of statehood, ethics are also a barrier as well as a constitutional step in strengthening the presidential system. The absence of specific regulations on presidential ethics in Indonesia's positive legal framework will have an impact on the absence of ethical standards in state practice and legal vacuums that have the potential to create ambiguity in the president's standards of behavior in carrying out his functions and authority, both in the formal scope of the state and in broader political interactions. This research aims to examine in depth the importance of presidential ethics regulation and its relationship in strengthening the presidential system of government. The method used is normative juridical with Statute Approach, Conceptual Approach and Philosophical Approach. The results of this study show that the regulation of presidential ethics is very necessary, considering the increasingly complex ethical challenges faced by state leaders in modern political dynamics. The design of the presidential ethics regulation in the Law on Presidential Institutions needs to include three main aspects: ethics in the administration of government, personal ethics of the President, and ethics in public communication. This arrangement is important to ensure that the President exercises power ethically, transparently, and accountably. With clear regulations, it is hoped that it can strengthen the presidential system of government and prevent abuse of power.

Abstract

Perkembangan teknologi digital, khususnya artificial intelligence (AI), big data, dan digital forensics, telah membawa perubahan signifikan dalam kerja aparat penegak hukum di berbagai negara. Penelitian ini bertujuan untuk mengkaji secara komparatif pengaruh teknologi digital terhadap efektivitas, transparansi, dan akuntabilitas aparat penegak hukum di Indonesia, Korea Selatan, dan Amerika Serikat. Pendekatan yuridis-komparatif digunakan untuk menganalisis bagaimana masing-masing negara merespons tantangan dan peluang yang muncul dari integrasi teknologi ke dalam sistem hukum mereka. Korea Selatan dan Amerika Serikat telah mengembangkan kerangka hukum serta infrastruktur teknologi yang memungkinkan pemanfaatan AI dalam proses investigasi, analisis kejahatan, dan prediksi kriminalitas. Sementara itu, Indonesia masih menghadapi berbagai hambatan, termasuk keterbatasan regulasi, sumber daya manusia, dan kesiapan teknologi. Temuan awal menunjukkan bahwa pemanfaatan teknologi digital mampu meningkatkan efisiensi kerja aparat penegak hukum, namun juga menimbulkan persoalan etis dan hukum baru, seperti pelanggaran privasi dan bias algoritma. Penelitian ini merekomendasikan perlunya reformasi regulatif dan peningkatan kapasitas teknologi hukum di Indonesia untuk mengejar ketertinggalan dari negara-negara dengan sistem hukum yang lebih maju. Studi ini diharapkan menjadi kontribusi akademik dalam mendorong pembaruan sistem penegakan hukum Indonesia yang adaptif terhadap perkembangan digital global.

Abstract

This article explores the relevance and actualization of the value of pengayoman (protective leadership) as a philosophical and constitutional foundation for strengthening the presidency in Indonesia’s post-Reform era. Rooted in Indonesian legal traditions, particularly through Soepomo’s concept of Manunggaling Kawula Gusti and Sahardjo’s Banyan Tree symbol, pengayoman is framed as an indigenous legal principle where the President acts as the people's protector. Employing a juridical-conceptual and socio-legal approach, the study analyzes how pengayoman, once paternalistic and integralistic, can be recontextualized within a democratic and human rights-oriented presidential system. The findings demonstrate that while Indonesia’s governance model has evolved, the spirit of pengayoman remains relevant as a moral and legal compass for executing presidential power fairly, transparently, and inclusively. This paper also presents normative recommendations for drafting the Presidential Institution Law to embed pengayoman as a constitutional principle, reinforcing the legitimacy and accountability of the presidency today.

Abstract

The presidential institution is a crucial body within Indonesia’s constitutional system. Given its full and comprehensive authority, neutrality in the exercise of its power is essential. To safeguard this neutrality, it is necessary to limit the president from holding any other position outside the presidency. If the president concurrently holds another office, there is a concern that they may lose neutrality and act in favor of their own group, which could lead to public distrust toward the presidential institution and negatively impact the democratization process in Indonesia. Based on this condition, the formulated research problems are: what are the impacts and risks of the president holding multiple positions in government, and how should such dual roles ideally be restricted? The method used in this research is normative juridical, focusing on the study of secondary data. Based on the analysis conducted, it can be concluded that holding multiple positions can lead to unfavorable conditions in the performance of duties. Specifically, if the president concurrently holds another position that influences the government, it may damage the reputation of the presidential institution, as it creates the potential for unfairness and favoritism toward a particular group or interest. Therefore, limitations are necessary to prevent the president from holding other positions, which can be done by establishing legal norms to be included in legislation, such as constitutional amendments or the creation of a specific law regarding the presidential institution and related matters. This will help the presidential institution maintain its neutrality and independence.

Abstract

Women migrant workers in the domestic sector are the most vulnerable group in the labor structure, mainly due to the lack of formal recognition in national law and weak protection of their basic rights. In Indonesia, despite their significant economic contribution, existing regulations are still partial and do not address the substance of gender-based justice. This article analyzes legal protection for women migrant workers through a feminist legal theory approach to uncover structural inequalities and patriarchal biases in the labor law system. The research employs a normative method with a conceptual and legislative approach, as well as a systematic analysis of primary and secondary data. The results of the study show that domestic workers are still not recognized as subjects of formal employment relationships, leaving them trapped in private workspaces with minimal state oversight. A feminist approach is used to evaluate this injustice and recommend transformative legal reforms, including the ratification of ILO Convention No. 189 and the harmonization of national regulations based on gender justice to provide substantial and inclusive justice for women migrant workers.

Abstract

This study examines the rights to freedom of association and education for Indonesian migrant workers (PMI) within international and domestic (Hong Kong and Indonesia) legal frameworks. The research questions focus on how legal norms regulate these rights and the structural, cultural, and legal barriers faced by PMI. An empirical legal approach combines legislative analysis (UDHR Article 26, ICESCR Articles 13-14, ICMW Article 43, and Hong Kong local regulations) with a case study of PMI experiences. Primary data were collected from interviews with PMI, diaspora communities, and NGOs, while secondary data came from legal documents and reports. Descriptive qualitative analysis reveals that, despite international norms guaranteeing education rights, PMI face exploitation, long working hours, and limited employer support, restricting access. The Open University program offers opportunities, but success depends on individual initiative and community support. Collaboration between governments and NGOs is essential for inclusive education access.

Abstract

The exploitation of Indonesian migrant workers (PMI) continues despite the enforcement of national regulations such as Law No. 21 of 2007 on the Eradication of Human Trafficking and Law No. 18 of 2017 on the Protection of Migrant Workers. The research question addressed is: why does the Indonesian penal system fail to deter the exploitation of migrant workers? This study employs a normative legal method, using statutory and case study approaches, particularly analyzing court decisions and human rights institution reports. The findings reveal that the ineffectiveness of criminal sanctions, weak implementation of restitution, and a dominant administrative approach in resolving exploitation cases are the main causes of the failure to achieve the objectives of punishment. Therefore, a reformulation of the penal approach is necessary, including harsher sentencing, an expansion of corporate criminal liability, and the integration of restorative justice principles to ensure real protection for migrant workers.
