Abstract

ABSTRACT: Article 165 verse (2) of Law Number 11 on Governing of Aceh states that the Government of Aceh and the government of district and municipality based on its authority may provide license related to investment, both domestic and foreign, by reference to national standard operational procedures. Article 165 verse (5) adds that further stipulations concerning the license will be regulated in local laws (qanun). For this purpose, the Aceh Qanun Number 5 of 2009 on Investment has been promulgated. However, there are still legal obstacles in developing both domestic and foreign investment in Aceh. The purpose of this review is to understand and elaborate several stipulations in central government legislation and regulation which are potentially hindrance the investment in the Province of Aceh and also to understand and elaborate several  stipulations in provincial government legislation and regulation which are potentially hindrance investment in Aceh. Data for this review were obtained through juridical legal research. Besides, as additional, researcher/reviewer also conducted interview with informants. The finding shows that stipulations in legislation and regulation of central government which are hindrance investment can be found in various sources  including UUPM, UUKPB PBS, UUPT, UUK, UUKeh., UUP, UUPAg, and Permenkeu. Abstract

ABSTRACT: The article discusses on the role of law in preserving customs to encourage the unity of a society. The contention of the article is that the existence of law and customs may assist members of society to live in harmony as both law and customs established rules that organized human behavior.  Human life will be in chaos in the absence of law and customs as the people will not be able to organize the manner they should interact with one another. This article will try to answer the problem on how does law preserved customs that was used to unite the society. The article shows that law needs the support of custom to understand the need of the society, while custom requires the support of law in order for the people to notice the existence of the practice and at the same time, able to be understood by the people at large. Customs are able to produce social accord as customs are embedded with the spirit of ushering good relationship thus encourages man to live harmoniously.  On the other hand, unity propounded by law is founded by force as punishment becomes the basis for obedience. The Role of Law in Preserving Customs to Encourage the Unity of a Society

Abstract

This article discusses aspects of law enforcement related to the criminal act of burning peatlands in Riau Province. The main focus is on law enforcement efforts carried out against environmental crimes, especially those related to peatland burning. Using the case of peatland burning in Riau Province as an example, this article presents an overview of the challenges and steps that can be taken in law enforcement against this serious environmental crime. The discussion involved the role of law enforcement agencies, existing regulations, obstacles in the law enforcement process, as well as strategies to increase prosecution for these violations. The research results show that law enforcement on the criminal act of burning peatlands is necessary to reduce the occurrence of peatland fires caused by human actions. Law enforcement regarding this issue is the main concern, with various aspects such as the role of law enforcement officers, cross-sectoral cooperation, and obstacles experienced in the law enforcement process being the main focus of discussion. Law enforcement against criminal acts of land burning in Riau does not seem to be running optimally.

Abstract

Pelaksanaan Pilkada serentak tahun 2020 kembali dilaksanakan setelah sebelumnya mengalami penundaan. Pemerintah memutuskan untuk melaksanakan Pilkada pada bulan Desember 2020, dengan mengeluarkan Perpu No. 2 Tahun 2020. Langkah yang diambil Pemerintah melahirkan pro dan kontra dikalangan masyarakat termasuk penye-lenggara, hal tersebut sangat rasional mengingat keadaan penyebaran Covid-19 masih terus mengalami peningkatan. Disadari atau tidak, kebijakan tersebut menguji eksistensi nilai mulia dari tujuan hukum yakni keadilan. Penelitian ini adalah penelitian yuridis normatif dengan menggunakan pendekatan peraturan perundang-undangan, pendekatan konsep dan pendekatan teori. Adapun hasil penelitian ialah: Pertama, Perppu No. 2 Tahun 2020 tidak mengatur terkait dengan metode dan pelaksanaan Pilkada saat pandemi melainkan hanya mengatur waktu pemungutan suara. Kedua, terdapat beberapa tahapan yang menyulitkan pemilih, penyelenggara dan peserta yakni tahapan pemuktahiran data, pencalonan bagi calon peraseorangan dan tidak adanya kampanye dalam bentuk rapat umum. Ketiga, mekanisme penanganan pelanggaran Pilkada tetap mengacu pada metode saat keadaan normal. Switching the Value of Handling Local Election 2020 in the Middle of Pandemi Covid-19  The implementation of the simultaneous regional elections in 2020 was held after previously experiencing delays. The government decided to carry out the Pilkada (electiosn) in December 2020, by issuing Perpu No. 2 of 2020. The steps taken by the Government resulted in pros and cons among the public, including the organizers, this is very rational considering the spread of Covid-19 pandemic is still increasing. Whether we realize it or not, this policy tests the existence of the noble value of the goal of law, namely justice. This research is a normative juridical study using a statutory regulation approach, a conceptual approach and a theoretical approach. The research shows, first, that Perppu No.2 / 2020 does not regulate the method and implementation of Pilkada during a pandemic but only regulates the timing of voting. Second, there are several stages that make it difficult for voters, organizers and participants, namely the stages of updating data, nominating individual candidates and the absence of a campaign in the form of a general meeting. Third, the mechanism for handling election violations still refers to the method during normal circumstances.

Abstract

Pasal 18B ayat (2) UUD NRI Tahun 1945 mengamanatkan perlindungan konstitusional terhadap kesatuan masyarakat hukum adat. Namun, perlindungan kontitusional KMHA belum mewujudkan keadilan bagi KMHA itu sendiri. Penelitian ini menggunaan pendekatan sosio-legal, dalam rangka menjawab masalah yang diteliti. Faktor-faktor penyebab belum terwujudknya keadilan bagi KMHA Sedulur Sikep adalah: (1) Belum adanya Undang-Undang khusus tentang KMHA serta keragaman Istilah yang dipakai untuk menyebutkan KMHA, (2) Ego sektoral para pihak, (3) Pengakuan keberadaan KMHA Sedulur Sikep Pati belum dituangkan didalam Perda. Ketiga alasan tersebut berdampak pada konflik yang sering terjadi antara pemerintah dengan KMHA Sedulur Sikep. Constitutional Protection of Indigenous Community in Achieving Social Justice Article 18B paragraph (2) of the Indonesia Constitution 1945 mandates the constitutional protection towards indigenous communities. However, the protection still cannot bring justice for the community. This research uses a socio-legal approach in order to answer research questions. The factors of why Sedulur Sikep Community has not get justice are: (1) There is no any specified law regarding indigenous community and various terminology used to refer to the indigenous  community groups; (2) The sectoral ego of the involved parties (3) The recognition of Sedulur Sikep Community has not been embodied into Regional Regulations. Those three factors result the conflicts oftenly happens between the regional government and the Sedulur Sikep Community, which depict a clear gap between them.

Abstract

ABSTRACT: The crime of trafficking increases in Indonesia. It is caused by several factors such a proverty, lack of education, fraudulent, sexual harassment and economic problem. This research identifies several problem, namely; sexual harrasment in conflict areas, domestic violence, the force as sexual object, organized threat, baby trafficking and human rgan trading. Abstract

Tobacco excise is the largest contributor to revenue in the state budget collected by the Directorate General of Customs and Excise (DGCE). On the other hand, the largest prosecution carried out by DGCE from the top 10 (ten) prosecutions is the prosecution of tobacco products (cigarettes), the success of these prosecutions is inseparable from the administrative authority specifically granted by the Law to the DGCE. This study aims to find out wheter the DGCE authotiy has been exercised with the correct authority. In this study, researchers used doctrinal legal research with qualitative method with primary data. The research shows that law enforcement carried out by customs and excise officials is the administrative authority and this authority is not unlimited. It is appropriate for policy makers to harmonize the procedures for prosecution with limits of authority owned and to provide in-depth understanding thus customs and excise officials.

Abstract

A trust agreement is a special agreement in banking gives the bank the right and authority to manage the customer's assets as stated to the agreement The assets of trust assets are the property of the customer, the management of the assets must be separately carried out to implement the Prudential Principle and Pacta Sunt Servanda in banking contract. This Legal Research use normative positivist with the using of Statute and Conseptual Approach along with three research sources. This Legal Research focus on the Legal Consequences in the Trustee Agreement and Liability of Bank in the case of Bank include the Settlor’s asset as the Insolvency Asset. The Research result are Bank only as a manager of Asset so every legal conduct must have approval of Settlor so If the asset is included the Insolvency Asset is a contract and law violation so it should be fixed by the contractual dispute settlement. Tanggung Jawab Bank dalam Trustee Agreement pada Keadaan Kepailitan Perjanjian kepercayaan adalah perjanjian khusus dibidang perbankan yang memberi-kan hak dan wewenang kepada bank untuk mengelola aset pelanggan sebagaimana dinyatakan dalam perjanjian. Aset kepercayaan adalah milik pelanggan, pengelolaan aset harus dilakukan secara terpisah untuk menerapkan Prinsip Kehati-hatian dan Pacta Sunt Servanda dalam kontrak perbankan. Penelitian Hukum ini menggunakan metode positivis normatif dengan menggunakan undang-undang dan pendekatan konseptual bersama dengan tiga sumber penelitian. Penelitian Hukum ini fokus pada konsekuensi hukum dalam perjanjian perwaliamanatan dan Pertang-gungjawaban Bank dalam kasus Bank termasuk aset Settlor sebagai Aset Kepailitan. Hasil Penelitian adalah bank hanya sebagai manajer Aset sehingga setiap tindakan hukum harus memiliki persetujuan Settlor sehingga jika aset dimasukkan Aset Aset Kepailitan adalah kontrak dan pelanggaran hukum sehingga harus diperbaiki dengan penyelesaian sengketa kontrak.

Abstract

Special autonomy funds are regulated in Law Number 11 Year 2006 regarding the Government of Aceh basically provides a great opportunity for Aceh to improve the provision of public services and foster economic development in the region . Special autonomy fund is valid for a period of 20 ( twenty ) years , with details for the first year until the fifteenth year in the amount equivalent to 2 % ( two percent ) ceiling National General Allocation Fund and for the sixteenth to the twentieth year the amount equivalent to 1 % ( one percent ) of the National General Allocation Fund ceiling . Abstract

ABSTRAK: Pada tataran praktik, SEMA No. 7 Tahun 2014 yang menyatakan pengajuan Peninjauan Kembali hanya boleh satu kali mengesampingkan Putusan MK No. 34/PUU-XI/2013 yang membatalkan Pasal 268 ayat (3) KUHAP yang menyatakan pengajuan Peninjauan Kembali boleh dilakukan berkali-kali. Penolakan perkara pengajuan Peninjauan Kembali yang kedua kali yang diajukan oleh Michael Titus Igweh dalam Putusan MA No. 144 PK/Pid.Sus/2016 menunjukkan bahwa SEMA No. 7 Tahun 2014 memiliki daya kekuatan yang mengikat para hakim-hakim dari pada Putusan MK No. 34/PUU-XI/2013. Penelitian ini bertujuan mengetahui kekuatan hukum mengikat SEMA No. 7 Tahun 2014 tentang Pengajuan Permohonan Peninjauan Kembali dalam Perkara Pidana. Penelitian ini menggunakan metode penelitian yuridis normatif. Hasil penelitian menunjukkan SEMA No. 7 Tahun 2014 tidak memiliki kekuatan hukum mengikat dan tidak termasuk jenis peraturan perundang-undangan sebagaimana yang disebutkan dalam Pasal 7 dan Pasal 8 Undang-Undang No. 12 Tahun 2011. SEMA hanya-lah suatu produk peraturan kebijakan yang berisikan petunjuk teknis untuk menja-lankan tugas publik. Landasan hukum pemberlakuan SEMA No. 7 Tahun 2014 memi-liki materi pengaturan yang sama dengan materi Pasal 268 ayat (3) KUHAP yang telah dibatalkan oleh MK No. 34/PUU-XI/2013, secara otomatis juga ikut membatalkan materi pasal yang dijadikan landasan hukum pemberlakuan SEMA tersebut sehing-ga pembentukannya cacat formil dan tidak memiliki kekuatan hukum mengikat. Disarankan Mahkamah Agung perlu melakukan penyempurnaan terhadap SEMA No. 7 Tahun 2014 agar tidak bertentangan dengan Putusan MK No. 34/PUU-XI/2013. The Binding Precedent of The Supreme Court Circular Number 7, 2014 on The Application of Judicial Review in a Criminal Case ABSTRACT: In practice, the Supreme Court Directive (SEMA) Number 7, 2014 stating that the application is only permitted once time which disregarded the Constitutional Court Decision Number 34/PUU-XI/2013 which nullified Article 268 (3) of Indonesia Criminal Justice Procedure Act (KUHAP) stating the application of the review could be done more than one. Michael Titus Igweh brings that SEMA Number 7, 2014 the application of the review is rejected for the second time case in the Supreme Court Decision Number 144 PK/Pid.Sus/2016 shows, 2014 has a binding power for judges from the Constitutional Court Decision Number 34/PUU-XI/2013. This research aims to know the binding legal power of the Supreme Court Circular Number 7, 2014 on the application review of criminal case. This is a normative juridical research method. The research shows that the Supreme Court Directive (SEMA) Number 7, 2014 has not binding legal power and it is not included in this type of statutes as mentioned in Article 7 and Article 8 of Law Number 12, 2011. The Supreme Court Directive (SEMA) is simply a product of regulatory policy which only contains technical instruction to perform of public duties. The legal basis used in the implementation of The Supreme Court Directive (SEMA)  Number 7, 2014, has the material the same arrangement with the substance of Article 268 (3) Criminal Procedure Code (KUHAP) has been nullified by the Constitutional Court Number 34/PUU-X/2013, the automatically also nullified the material section which is used The legal basis of Supreme Court Directive (SEMA) it is unprocedured produce and has not binding legal power. It is recommended that the Supreme Court should revise the Circular of the Supreme Court Number 7, 2014 hence it does not violates the Decision of the Constitutional Court Number 34/PUU-XI/2013.
