Abstract

ABSTRACT: The idea of the necessary of customary principles should be contemplated seriously in order to anticipate the community development dissanpointing to the judicial process of state. The process is a “security door” to prevent chaos in society. The process can be optional solution for justice seeker from power abuse. This research aims to find the customary trial principles that can be a development of the process as alternative dispute solution. The principles are developed based on discussed model of customary value in Rejang and Malay society in Bengkulu Province. The models are identified empirically supported by anthropology legal method and participatory rural appraisal (PRA). The research shows that the principles of customary trial is developed based on discussion model of Rejang and Malay peoples in Bengkulu based on spirit to achieve agreement. Voluntarily, collegial chairman, and open to public. The place of the trial is determined flexibly, and the trail soon conducte. The trial is conducted based on the evidence and acknowledgement of guilty from offender. The punishment is imposed by considering the violation of the breach and perpetrator condition and victim, and the trial is recorded. The execution is determined by the agreement of both parties. Abstract

The control and exploitation of aging oil and gas wells in North Aceh Regency present intricate challenges and conflicts. This article sheds light on the various conflicts arising from this issue and propose potential solutions for their resolution. This article adopts a normative legal research approach, complemented by in-depth interviews, to examine the legal dimensions of control and exploitation by local communities. The findings highlight the necessity of clear regulations in the management of old oil wells to prevent illegal drilling or unauthorized tapping. Specifically, the government should establish robust regulations concerning the mechanism for transferring old oil wells left by companies. In this context, corporations can involve local residents who engage in activities to rejuvenate the wells. While local communities rely on customary law for control and exploitation of old oil wells, the government's approach is based on statutory regulations. By addressing these legal aspects and promoting collaboration between stakeholders, a more effective and harmonious management of aging oil and gas wells can be achieved in North Aceh Regency.

Abstract

This research aims to evaluate the police's request to postpone the criminal charge reading of the blasphemy case at the North Jakarta District Court, which was not based on Indonesia's positive law. The request to postpone a trial by the police without a legal basis could be considered a form of police intervention against the trial process, which has legal criminal consequences based on Article 3 Paragraph 2 and 3 of Law Number 48 of 2009 concerning Judicial Power. Meanwhile, the request for a two-week trial postponement by the public prosecutors due to their inability to complete the criminal indictment, as well as considering the request from the police, has created an impression that the public prosecutors have complied with the request of the police. It also injured public trust that demanded a fair and transparent law enforcement process.

Abstract

Sampai dengan tahun 2016 terdapat sebanyak 156 izin usaha dalam bidang perkebunan kalapa sawit di Aceh, dengan total luasan areal lahan mencapai 752.766.40 hektar. Dari kegiatan usaha perkebunan yang beroperasi di aceh timbul beberapa permasalahan. Diantaranya terdapat tiga permasalahan utama dalam bidang usaha perkebunan di Aceh, yaitu terjadi konflik lahan, pencemaran lingkungan dan ketidakpatuhan perusahaan terhadap kewajiban sebagai pemegang izin. Jenis Penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis empiris yaitu meneliti keberlakuan hukum tekait dengan penerbitan izin tata kelola usaha perkebunan di Aceh. Hasil penelitian menunjukkan bahwa terdapat tiga permasalahan utama dalam bidang usaha perkebunan di Aceh, yaitu konflik lahan dengan masyarakat, dampak terhadap lingkungan dan kepatuhan perusahaan terhadap izin. Ketigal masalah tersebut disebabkan oleh proses dan prosedur perizinan usaha perkebunan di Aceh masih belum berjalan sesuai dengan peraturan perundang-undangan. Maka oleh itu perlu pembenahan tata-kelola dibidang perkebunan, terutama alur perizinan yang menimbulkan dampak secara sistematik dilapangan berupa konflik lahan, dampak lingkungan, serta memastikan kepatuhan perusahan terhadap izin yang telah diberikan. Oleh karena itu, penelitian ini merekomendasikan kepada Pemerintah Aceh untuk segera menindak lanjuti amanat Moratorium Lahan Perkebunan Kelapa Sawit di Aceh sebagai pintu masuk untuk pembenahan. The Improvement of Palm-Oil Trees Farm Business Permits Governance  in Aceh Until 2016, there were 156 business licenses of palm oil plantation in Aceh with a total area of 752.766.40 hectares. From that plantation business activities operated in Aceh, some problems then arise. There are three main issues of palm oil plantation business in Aceh; land conflicts, environmental pollution, and the company's non-compliance with the obligation as a permit holder. This is empiric juridical research that examine the law enforcement related to the issuance of plantation business licenses in Aceh. The result shows that there are three major issues in plantation business in Aceh. First, land conflicts with the communityc, the impact on the environment and then the company’s compliance with licenses. These three issues are caused by the licensing process and procedures of plantation business in Aceh that are not in accordance with the laws. Thus, it is necessary to improve governance in the plantation sector, especially the licensing stage which has a systematic impact on land conflicts, environmental impacts, and ensuring the company's compliance with the business licenses that have been granted. Therefore, this study recommends the Aceh Government to immediately follow up the mandate of the Land Moratorium on Oil Palm Plantations in Aceh as a priority for reform.

Abstract

ABSTRAK. Negara Indonesia merupakan negara yang kaya dengan perbedaan baik bahasa, budaya termasuk agama yang dianut oleh penduduknya, sehingga karena perbedaan ini tentunya akan mengalami berbagai permasalahan dalam melakukan hubungan antar sesama penduduk. Sebagai negara yang berdasarkan hukum (rechtstaat), maka bagi penduduk Indonesia semua permasalahan yang ada akan diselesaikan secara hukum. Permasalahan yang dialami oleh pemeluk agama di Indonesia diantaranya adalah terjadi penyalahgunaan dan/atau penodaan agama terhadap suatu agama yang dianut. Permasalahan ini terus terjadi dan semakin meningkat dari tahun-tahun. Oleh karena itu perlu kajian yang mendalam untuk mengatasi permasalahan yang ada. Dalam hal ini yang ingin dikaji adalah perlindungan hukum yang diberikan oleh negara kepada pemeluk agama di Indonesia dan bagaimanakah ketentuan tentang pemeluk agama dalam Islam. Penulisan ini mengunakan kepustakaan untuk mengumpulkan bahan bacaan dari peraturan perundang-undangan dan referensi berupa literatur, makalah, jurnal dan tulisan-tulisan lainnya yang berkaitan dengan masalah yang dikaji. Law Protection by a State for Religion Believers in Indonesia and Its Comparison with Islamic Laws  ABSTRACT. Indonesia is a diverse country with a great language, culture including religion differences of its population it will have various problems in the relationship between the members of the population. As a state based on law, the citizens face existing problems should be resolved legally. The problems experienced by religion in Indonesia including fraud and/or blasphemy against a the religion values. The problems persist and there are increasing. Therefore it needs a research to overcome them. It needs to be examined by the legal protection granted by the state to religions in Indonesia and how the provisions on religion in Islam. This is a literature research conducted by collecting reading material on the legislations and the form of literature references, papers, journals, and other writings relating to the problems.

Abstract

ABSTRACT: Ijtihad as a legal source beside al-Quran and Sunnah is an effort to create the law on he religious problem that has not been mentioned particulary n the sources, but in progress, it causes the differences in practice of state leaders from the prophet and the era after the prophet. This research explores the influence of it on the practice of state in Islam history cousing th differences on each period or era. All practices done has a legal based both al-Quran and Sunnah although it is just general, because ijtihad is also done based on both legal sources. This research applies juridical historical approach by looking at the basis sources of it in al-Quran and Sunnah and also the progress of it from the prophet era and the following era in deciding the policies on state progressing problem. Ijtihad and Its Influence on the Development of State in Islam History

Abstract

ABSTRACT: Indonesian legal system recognizes 5 (five) formal legal sources, namely; act, judge decision, treaty, expert view, and customary law. Custom subsystem is unwritten law or more well known as customary law. The source of customary law has been implemented earlier before the written one followed by modern society. However, in the fact, customary law development in material meaning and judicial customary law in the meaning of formal law always faces constraints especially from positivism legal concept from time to time. Therefore, this research aims to focus on the history of the development of judicial customary law in Indonesia since the colonial period 1602 till the period after the MoU Helsinki in Aceh. The historic legal approach is applied by exploring how acts provide space for enhancing the system. ABSTRAK: Perjanjian Anjak Piutang termasuk ke dalam perjanjian tidak bernama, karena tidak diatur secara tegas di dalam KUHPerdata. Lahirnya perjanjian ini adalah berdasarkan asas kebebasan mengadakan perjanjian atau partij otonomi yang berlaku di dalam Hukum Perjanjian. Bila kegiatan anjak piutang dilakukan dalam bentuk membeli piutang dari Client oleh Factor, disini berlaku ketentuan tentang jual beli yang diatur di dalam KUHPerdata. Pasal 1457 KUHPerdata. Di samping itu juga berlaku ketentuan tentang jual piutang Pasal 1534 dan Pasal 1535 KUHPerdata. Penyerahan piutang atas nama harus dilakukan melalui suatu akta, baik akta otentik maupun akta di bawah tangan. Akta penyerahan hak tersebut dikenal dengan sebutan cessie. Loan Divergence Mechanism in Factoring Agreement ABSTRACT: Factoring agreement includes in unnamed agreement, as it is not clearly ruled in the Civil Code. It comes based on the freedom principle of making the agreement or  partij otonomi exists in the agreement law. If the factoring is done by buying Clients  factor, it is regulated by trading laws of the Civil Code. It is found in Article1457 of the Civil Code. Apart from that, there is also the trade agreement in Articles 1534 and 1535 of the Code. The submission of it  based on the name must be done through an act, either authentic or not. The Act is known as cessie.

Abstract

Anak-anak yang belum mencapai usia tertentu atau belum kawin, pertumbuhan dan perkembangannya dapat dipengaruhi karena orang tua tidak cakap melakukan tindakan hukum, orang tua meninggal dunia atau orang tua dicabut kekuasaan orang tua terhadap anaknya. Berkaitan dengan hal tersebut, maka perlu adanya lembaga pengganti kekuasaan orang tua terhadap anak. Perwalian merupakan lembaga pengganti kekuasaan orang tua terhadap anak. KUH Perdata, UU No. 1/1974 dan KHI merupakan bagian dari hukum tertulis di Indonesia. penyebab anak berada di bawah perwalian, hak dan kewajiban anak serta hak dan kewajiban wali dan pula penyebab berakhirnya perwalian, hal-hal tersebut berbeda menurut konsep ketiga-tiga hukum tertulis di atas. Perwalian meliputi pengurusan si anak dan hartanya. Dalam pelaksanaan perwalian oleh wali diharapkan memberi akibat yang positif terhadap anak dan hartanya, bukan menimbulkan akibat yang sebaliknya. Guardianship by Concept of Written Law in Indonesia Children who have not reached a certain age or have not married, growth and development can be influenced because parents are not capable of taking legal action, parents died or parents deprived of parental power over their children. In this regard, it is necessary to have a substitute for parent power over the child. Guardianship is a substitute for the power of parents against children. Civil Code, Law No. 1/1974 and KHI are part of the written law in Indonesia. the cause of the child under the guardianship, the rights and obligations of the child and the rights and duties of the guardian and also the cause of the termination of the guardianship, these matters differ according to the three-three laws of the above. Guardianship covers the management of the child and his property. In the guardianship of the trustee is expected to give a positive effect on the child and his property, not cause the opposite effect.

Abstract

ABSTRACT: Rigth to information in one of the human right regulated in he 1945 Constitution. The implementation of such right for the citizen is further regulated in the Act Number 14, 2008 regarding the Openness of Public Information. This paper explores the information openness of the judicial intitution as a public institution. Basically, such openness is not the new thing in Indonesian justice procedure system. Article 195 f the Indonesian Penal Law states that all decision are valid and enforcable if it is stated in te open trial for the public. Aticle 13 (1) of the Act Number 48, 2009 regarding the Justice Authority also provides that each trial process is open for public unless he Act states conversely. Article 20 of he Act Number 4, 2004 regarding the Justice Power also states the same thing as the Act Number 48, 2009. however, the decision that is more accessible to public is the decision of the Supreme Court. Contrastly, the decision of the first instance court and the court of appeal have not been able to be accessed yet. Therefore, in the era of public information openness, such information should be easily and quickly accessed by the public through electronic and printed media court official websites, started from the court of the first intance.
