anun: Jurnal Ilmu Hukum (KJIH), the Indonesian Journal of Autonomy Law, is an international journal dedicated to the study of autonomy law within the framework of national and international legal systems. Published thrice annually (April, August, December), KJIH provides valuable insights for scholars, policy analysts, policymakers, and practitioners. Managed by the Faculty of Law at Syiah Kuala University in Banda Aceh, Indonesia, KJIH has been fostering legal scholarship since its establishment in June 1991, with the ISSN: 0854 – 5499 and e-ISSN (Online): 2527 – 8428. In 2020, it received national accreditation (SINTA 2) from the Ministry of Research and Technology of the Republic of Indonesia and the National Research and Innovation Agency. KJIH is actively pursuing indexing in prestigious databases like Scopus, Web of Science and other global indexes. We publish in English for accessibility, not as a political statement. The Editorial Board shall not be responsible for views expressed in every article.

ABSTRACT: Fisheries management will determine the sustainability of fisheries resources in Indonesia. The concept of sustainable fisheries management is a response to occupation of the development of growth which lead to increased utilization of fish resources. This paper wants to answer how the concept of the implementation of sustainable fisheries management, as well as its importance for Indonesia. ABSTRACT: In accordance to Article 22 Number 5, 1960 states that the ownership right of land can be issued based on customary law and the procedure of issuing the title right ruled by the law as regulated by Government Regulation. In fact, recently such regulation has not been enacted yet; hence it cause different views on issuing the ownership right of land. Therefore, the problem raised in this research are what is the legal basis regarding the issuance of the title right based on customary law and what is the position such right based on the issuance. To answer the questions, this research is conducted towards the legislation, doctrines, and previous researches that are relevant to this research. The research shows that the legal basis for the issuance of such right is the customary principles found in customary law, the value of customary law in the place. Substantially, the customary ownership right has similar position as ownership right issued based on government decision, the distinction is on the ownership right proof of certificate of the right that is issued based on government decision but the land owned by customary right namely physical owning evidence and the acknowledgement of the people living the in the place where the right issued. This article examines how Aceh’s government border policy prevents human trafficking and its challenges. Act Number 43, 2008 on State’s Territory regulates the territorial borders of the state guaranteeing sovereignty and law-abiding in the territory, sovereignty, rights enforcement, and rules of managing state territory and its borders, including monitoring of borders. A Governor in every region bordering others must manage the region of borders and protect the territory, based on PERKA of the BNPP Number 4, 2019 on the Delegation of State’s Border Governance in the ambit of the Indonesia National Body for Governing Border (BNPP). This paper utilizes normative-emperical research methods, in order to analyses the issue in the law and its challenges in its application. Aceh provinces including some regional, including North Aceh, East Aceh, and Sabang borders is included in a bordering region with other states, which prone to human trafficking. The Aceh Government and Regionals/Municipals Governments has not issued the policy on governing the borders’ areas, so it is remain challenges in future. Additionally, a better coordination among the law enforcement agencies and establishing the territory and border offices at the provincial and district levels can help to prevent human trafficking in Aceh Province.

Penelitian ini dilakukan untuk mengetahui bagaimana korelasi rekam sidang korupsi dalam menunjang ketelitian hakim dalam rangka menjatuhkan sanksi pidana terhadap pelaku korupsi. Dari penelitian ditawarkan model pengelolaan hasil rekam sidang korupsi yang dilakukan oleh hakim di pengadilan. Hal ini dilandasi bahwa penegakan hukum terkait tindak pidana korupsi memerlukan tingkat ketelitian dan kecermatan, namun tak boleh sengaja diperlambat. Metode yang digunakan dalam penelitian ini adalah kualitatif, yang dilakukan melalui proses wawancara terhadap hakim dan jaksa KPK. Pendekatan penelitiannya adalah yuridis normatif dan partisipatif. Melalui penelitian ini diketahui bahwa perekaman persidangan tindak pidana korupsi sangat penting dilakukan karena dapat membantu terkait kelengkapan berita acara persidangan. Penggunaan perekaman persidangan akan menghindari keraguan masyarakat atas putusan yang dilakukan oleh hakim, karena semua fakta persidangan dapat diputar kembali melalui video yang dihasilkan dalam perekaman tersebut. Pengelolaan hasil rekam sidang juga dapat digunakan panitera dalam penulisan berita acara persidangan dengan hasil yang lebih baik. Disarankan agar semua perkara tindak pidana korupsi dapat dilakukan perekaman persidangan untuk lebih memudahkan penulisan berita acara terutama untuk panitera pengganti. Utilization of Corruption Trial Recording to Make A Justice Decision This study aims to find out how the correlation of corruption trial records in supporting the accuracy of judges in order to impose criminal sanctions against corruptors. The research offers a model for managing the results of records of corruption trials conducted by judges in court. This is based on that law enforcement related to corruption requires a level of accuracy and accuracy, but it should not be intentionally slowed down. This study uses a qualitative method, which is carried out through an interview process with KPK judges and prosecutors. The research approach is normative and participatory juridical. Through this research, it is known that the recording of trials of corruption is very important because it can help related to the completeness of the minutes of the trial. The use of court recording will avoid public doubts over the judge's decision, because all the facts of the trial can be played back through the video produced in the recording. Management of the results of court records can also be used by court clerks in writing minutes of proceedings with better results. It is recommended that all cases of corruption can be recorded in a trial to make it easier to write the minutes, especially for substitute registrars.

ABSTRAK. Pengelolaan pertambangan mineral bukan logam dan batuan merupakan salah satu urusan pemerintahan yang dibagi secara konkuren antara pemerintah pusat, pemerintah provinsi dan pemerintah kabupaten/kota. Studi ini bertujuan untuk memetakan harmonisasi pengaturan kewenangan pengelolaan pertambangan mineral bukan logam dan batuan melalui pemberian izin pertambangan rakyat. Penelitian hukum yang menggunakan optik doktrinal ini menunjukkan bahwa terjadi disharmonisasi horizontal antar undang-undang yang mengatur kewenangan pemberian izin pertambangan rakyat. UU No. 23 Tahun 2014 memberikan kewenangan pemberian izin pada pemerintah provinsi, sedangkan UU No. 4 Tahun 2009 memberikan kewenangan pemberian izin pada pemerintah kabupaten/kota. Kondisi disharmonisasi tersebut menimbulkan ketidakpastian hukum bagi pengusaha pertambangan sehingga akan mempengaruhi iklim usaha pertambangan rakyat di daerah, sehingga disarankan agar pemerintah pusat dan dewan perwakilan rakyat (DPR), perlu meninjau kembali kewenangan pemberian izin pertambangan rakyat, dengan mengembalikan kewenangan tersebut dari perspektif rezim hukum pemerintahan daerah kepada pemerintah kabupaten/kota, karena rentang kendalinya dengan pelaku dan wilayah pertambangan lebih singkat sehingga cenderung lebih berdayaguna dan berhasilguna. Harmonization of Regulation Local Government Authority in The Management of Non-Metal Mineral and Rock Mining ABSTRACT. Mineral non-metal and rocks mining management is one of the government affairs are shared concurrently between the central government, provincial government and district/city governments. This study aims to mapping the harmonization of authority regulation in the management of non-metallic mineral and rock mining through the granting of people permits mining. This legal research that used the doctrinal optical shows that there is horizontal disharmony between the governing legislation in the licensing mining authority. Law No. 23 of 2014 granting the authorizes of licenses to the provincial government, while Law No. 4 of 2009 provides the authority to grant permission to the district/city government. The disharmony conditions create legal uncertainty for mining entrepreneurs that will affect people's mining business climate in the area, so it is suggested that the central government and the parliament (DPR), need to review the authority regulation in the management of non-metallic mineral and rock mining, to restore the authority of licensing in the perspective of local government legal regime area to the district/city, because of its control range with actors and mining areas tend to be shorter so effective and efficient.

ABSTRAK: Implementasi penerapan ajaran turut serta dalam kasus tindak pidana korupsi tidak sesuai dengan teori pertanggungjawaban pidana. Hal ini disebabkan penerapan ajaran ini yang tidak sesuai dan tidak memenuhi unsur keadilan. Implikasinya adalah para pelaku tindak pidana korupsi tidak bisa dihukum setimpal dengan apa yang telah diperbuatnya. Selama ini para pelaku tindak pidana korupsi itu dijerat dengan Pasal 55 KUHP yang mengakibatkan pelaku utama tindak pidana korupsi tersebut tidak tersentuh hukum. Upaya hukum yang dapat dilakukan terhadap adanya pelaku lain yang tersangkut dalam tindak pidana korupsi yang sedang diperiksa adalah dengan melakukan penyelidikan dan penyidikan secara mendalam terhadap adanya pelaku baru yang melakukan tindak pidana korupsi tersebut. Pemerintah harus menyempurnakan Undang-Undang Nomor 31 Tahun 1999 Jo Undang-Undang Nomor 20 Tahun 2001 tentang Tindak Pidana Korupsi, agar semua pelaku tindak pidana korupsi dapat tersentuh hukum. Joint Criminal Enterprise Principle Implementation in Corruption Cases Related to Criminal Liability Theories ABSTRACT: The research shows that the implementation of the principle of joint criminal enterprise is not in accordance with theories of criminal responsibility as the implementation is not based on the justice elements, it results from the perpetrators of corruption cases cannot be punished fairly and balanced as what they have committed towards the case of corruption, recently, the corruption perpetrators is imposed by Article 55 of KUHP causing the principals of the corruption case is not being punished. The legal efforts that can be done towards the perpetrators are that are committing the corruption crime that is being investigated are by conducting investigation and the accusation process deeply towards the new perpetrators committing the crime. It proves that the corruption case is committed jointly; hence by finding new suspects would bring justice, usefulness and certainty of laws. It is recommended that the Government of Republic of Indonesia should immediately revise or complement the Act Number 31, 1999 in relation to the Act Number 20, 2001 on the Corruption Crime, hence all the perpetrators of the corruption cases can be punished and touched by the law and there are no one of the perpetrators are free from the imposition of law.

ABSTRACT: International law of the sea has ruled that a coastal state and foreign ship have a right to and certain power in straits including Indonesia towards the Malaka Strait. It is one of the straits used as international shipping lane. UNCLOS 1982 admits that there is a transit passage right for foreign vessels shipping over the strait and it cannot be called by Indonesia as a coastal state directly faces the strait. In several matters, the passage is a border for the acknowledgement of Indonesia sovereignty over its territory. On the other side, international law provides the right for foreign vessels to have a passage without getting permission from Indonesia. However, a coastal state is also acknowledged its right to defend the sea from damage. The prevention principle is one of the reasons that can be justified by the state to maintain and protect the sea from damage caused by the using of the sea, by the passage right. The purpose of this research is to identify cyber warfare as a model of War, its position in the perspective of international law, and the steps taken by the state in minimizing losses arising from cyber warfare. This research is normative research using conceptual and statute approaches to answer the problems in this research. The analysis used is content analysis. The study results indicate a need for a common understanding of cyber warfare as a new model of war agreed upon by countries in practice. Normative cyber warfare in international law has to be applied universally. The periodic simulations of cyber defense and artificial intelligence are needed in minimizing the losses caused by cyber warfare. The recommendation is to formulate a definition of cyber warfare universally agreed upon and the state's agreement on the meaning of cyber warfare in international law perspectives.

Penelitian ini ingin menjawab keberadaan pihak-pihak yang dapat mengajukan gugatan ke pengadilan apabila terjadinya kerugian akibat perbuatan melawan hukum dalam lingkungan hidup. Perbuatan melawan hukum yang menimbulkan kerugian akibat pencemaran atau perusakan lingkungan yang dilakukan oleh pengusaha atau penanggungjawab usaha dan/atau perusakan lingkungan hidup. Penyelesaian sengketa lingkungan hidup melalui pengadilan dapat dilakukan melalui gugatan perdata biasa yang diajukan oleh pihak korban atau anggota masyarakat biasa yang mengalami kerugian. Dengan melakukan studi dokumen, ditemukan bahwa dengan berlakunya Undang-Undang Nomor 32 Tahun 2009 telah memberikan kesempatan untuk mengajukan gugatan melalui legal standing/LSM, prosedur class action atau melalui citizen suit yang merupakan hak gugat tanpa adanya kepentingan hukum. Pemerintah atau Pemerintah Daerah sebagai penanggung jawab di bidang lingkungan hidup juga dapat mengajukan gugatan terhadap pelaku pencemaran dan/ atau perusakan lingkungan hidup untuk kepentingan dan kesejahteraan masyarakat. Right to Submit a Law in the Environmental Disputes This study wants to answer the existence of parties who can file a lawsuit to the court if there is an unlawful act that results in a loss to the environment. Unlawful acts that cause losses due to pollution or environmental damage carried out by employers or business people responsible for and/or environmental damage. Settlement of environmental disputes through a court can be carried out through civil lawsuit filed by victims or community who suffer losses. By conducting document studies, it was found that with the enactment of Law No. 32 of 2009, it has provided an opportunity to file a lawsuit through legal standing, class action or through citizen suits which constitute a claim right without any legal interest. The Government or Regional Government as the person in charge of the environmental sector can also file a lawsuit against the perpetrators of environmental pollution and/or damage for the benefit and welfare of the community.

ABSTRAK. Pendidikan belum mendapat porsi istimewa dalam Undang-Undang Pemerintah Aceh. Beda dengan Undang-Undang Penyelenggaraan Keistimewaan Aceh yang memberi posisi istimewa untuk pendidikan. Keberadaan pendidikan dayah sendiri sebagai landasan yuridis, masih perlu dikritisi. Sejumlah hal yang harus diperhatikan antara lain mengenai klasifikasi dayah, yang mencerminkan intervensi pendidikan dayah oleh pemerintah. Selain itu, registrasi dayah akan berimplikasi kepada ketergantungan dayah kepada pemerintah secara berlebihan, karena hal itu dilakukan terkait dengan anggaran. Sejumlah kendala pendidikan dayah antara lain kendala dalam penyusunan kurikulum, manajemen, ekonomi, dan kendala regenerasi. Dayah Education After the Law on Government of Aceh ABSTRACT. Education has not received a special portion in the Law on the Government of Aceh. Differences with the Law on the Implementation of Privileged Aceh which gives a privileged position to education. The existence of education dayah itself as a juridical basis, still to be scrutinized. Some things to consider include the classification dayah, reflecting the Islamic boarding school education intervention by the government. In addition, registration will dayah dayah implies dependence on government excess, since it is done related to the budget. A number of constraints include constraints dayah education curriculum development, management, economics, and constraints regeneration.
