Abstract

Divorce is a central issue in Islamic family law because it terminates the marital relationship and produces legal consequences for husbands, wives, and children. This study aims to analyze divorce trends in Indonesia based on wife-initiated divorce (cerai gugat) and husband-initiated divorce proceedings (cerai talak), and to interpret the pattern from the perspective of Islamic family law. The study employs library research with descriptive statistical and normative juridical approaches. The primary data consist of secondary data on Religious Court cases published by the Directorate General of Religious Courts, Statistics Indonesia, and the National Commission on Violence Against Women. The main analytical period is 2021–2024, while acknowledging that statistical definitions and coverage vary across sources: some refer to decided cases, while others refer to processed cases or recorded divorce events. Analysis uses frequencies, percentages, annual changes, and comparisons between cerai gugat and cerai talak. The findings demonstrate a consistent dominance of cerai gugat over cerai talak. Published court-case recapitulations report 337,343 cerai gugat and 110,400 cerai talak in 2021; 374,101 and 122,306 in 2022; and 340,327 and 107,278 in 2023. For 2024, a Komnas Perempuan report citing BADILAG data records 374,484 cerai gugat and 113,704 cerai talak, although the figures must be interpreted according to the source's statistical coverage. From the perspective of Islamic family law, the dominance of cerai gugat should not simply be interpreted as women's preference for divorce, but also as an indicator of women's use of legal access when marital rights, safety, or family sustainability can no longer be maintained. The study recommends strengthening family resilience, premarital education, mediation, protection of women and children's rights, and standardization of judicial statistics. (Komnas Perempuan, 2025)

Abstract

The development of the global economic system which is increasingly based on creativity and innovation has encouraged the transformation of the role of copyright from mere moral protection to an economic asset of high commercial value which can be used as collateral for debts. Normatively, the position of copyright as an intangible movable object that can be burdened with fiduciary guarantees has been recognized based on Law Number 28 of 2014 concerning Copyright and Law Number 42 of 1999 concerning Fiduciary Guarantees. However, this legal recognition has not been balanced with adequate regulations regarding the mechanism for executing fiduciary guarantees when the debtor experiences default, especially in providing legal protection to third parties who have a legitimate legal relationship with the object of the guarantee, such as license holders or recipients of the transfer of economic rights. This research aims to analyze the regulation and implementation of legal protection for third parties and to formulate an ideal concept of legal protection to realize legal certainty and justice. This research uses a normative legal research method with a statutory approach, a conceptual approach, and a juridical analysis approach to legal materials. The research results show that the current provisions for the execution of fiduciary guarantees are still focused on fulfilling creditor rights and have not taken into account the special characteristics of copyright which can be utilized by several parties simultaneously. In addition, the less-than-optimal implementation of the principle of publicity due to the separation of the copyright registration system at the Directorate General of Intellectual Property and the registration of fiduciary guarantees at the Directorate General of General Legal Administration has the potential to cause financial and legal losses for third parties acting in good faith. To overcome these problems, this study recommends its implementation through the formulation of a Publicity and Third-Party Protection Integration Model in Copyright Fiduciary Guarantees. This model includes five important stages, namely verification of the legal status of copyright, integration of registration data between institutions, notification of pre-execution notification to third parties, provision of objection channels before execution is carried out, and guarantee of protection for the continuation of a valid license agreement after the execution process is completed.

Abstract

This study analyzes and reconstructs the concept of nafaqah (financial maintenance) for Muslim families in the digital economy era, adopting a contemporary fiqh perspective rooted in Maqāṣid al-Sharī‘ah. The digital economy's rapid evolution has significantly altered income patterns, asset forms, and gender roles within families, necessitating a reinterpretation of traditional nafaqah provisions. Employing a normative legal research methodology with descriptive-analytical and comparative approaches, this article identifies new challenges in fulfilling nafaqah obligations, such as the flexibility of digital income sources and shifting financial responsibilities between spouses. The findings indicate that the scope of nafaqah needs to be broadened to include digital assets, substantial non-material support, and consideration of wives' productive contributions beyond direct income. This reconstruction is grounded in the principles of Maqāṣid al-Sharī‘ah, particularly hifz al-nasl (protection of progeny), hifz al-mal (protection of wealth), and the realization of justice (al-‘adalah) and public welfare (maslahah ‘ammah). The conclusion is that through the Maqāṣid al-Sharī‘ah approach, the concept of nafaqah can be reformulated to be more adaptive, equitable, and relevant to the digital economic reality, ensuring the sustainability and well-being of Muslim families amidst socio-economic transformations.
