Abstract

This study discusses the Islamic legal perspective on the Upright Tegei tradition in the distribution of inheritance in the Lampung Pepadun Menggala community. The Upright Tegei tradition is the practice of appointing the groom as the eldest child or heir in the bride's family, especially when the woman is an only child or has no brothers. This tradition is carried out before the traditional wedding procession takes place. This study aims to determine the practice of implementing the Upright Tegei tradition in the distribution of inheritance in the Lampung Pepadun Menggala community, as well as to analyze the Islamic legal perspective on this tradition. This type of research is field research with a qualitative descriptive approach. Data were obtained through observation, interviews, and documentation, with primary data sources from traditional leaders, community leaders, and related parties, and secondary data from relevant literature. The results of the study indicate that the Upright Tegei tradition is a form of custom that aims to maintain the continuity of the family's social line, customary position, and the distribution of responsibilities in the female family. In the perspective of Islamic law, this tradition can be understood as part of the ‘urf (customs/customs) that can be accepted as long as it does not conflict with the principles of sharia, especially in terms of lineage and inheritance. Therefore, the tradition of holding tegei can be accepted in Islamic law as long as it only functions as a socio-customary recognition and does not change the provisions of lineage or inheritance rights that have been established by sharia. Based on the results of the study, the tradition of holding tegei in the distribution of inheritance is based on the view of Islamic law that adopted children receive property in the form of grants. This is because adopted children are positioned as biological children who will care for the bride's parents because they are considered the first male child in the woman's family. This research was conducted to avoid doubts in the distribution of inheritance while providing economic security for adopted children in the future. However, when examined according to Islamic law, this practice is inconsistent with the principles of justice and the provisions for inheritance distribution as stipulated in Surah An-Nisa verses 7 and 11. In Islamic teachings, giving gifts to adopted children is permitted, especially after the separation of joint assets (gono-gini) as stipulated in Article 35 of Marriage Law Number 1 of 1974. However, if the giving of gifts is excessive and does not consider the rights of legitimate heirs, it is considered contrary to the principles of justice and has the potential to trigger conflict within the family.

Abstract

 Academic burnout is a psychological condition frequently experienced by students due to excessive academic demands. High academic pressure may lead to emotional exhaustion, decreased learning motivation, and reduced academic engagement. This study aimed to examine the relationship between academic burnout and self-esteem among eleventh-grade students at SMA Malahayati. This research employed a quantitative approach with a correlational design. The participants consisted of 123 students selected through simple random sampling. Data were collected using self-esteem and academic burnout scales, and analyzed using Pearson Product Moment correlation after meeting the assumptions of normality and linearity. The results revealed a significant negative relationship between self-esteem and academic burnout, with a correlation coefficient of -0.373 and a significance value of 0.000 (p < 0.05). These findings indicate that students with higher self-esteem tend to experience lower levels of academic burnout. In conclusion, self-esteem plays an important role in reducing academic burnout among students. Therefore, efforts to enhance students’ self-esteem may contribute to improving their academic well-being and reducing burnout levels.

Abstract

Personal data protection has become an increasingly important legal issue due to the rapid development of digital technology and the growing volume of personal data processing activities. Indonesia has enacted Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) as the primary legal framework for personal data protection. However, several limitations remain within its substantive and institutional aspects, requiring further improvement. This study aims to analyze the substantive and institutional limitations of the PDP Law and to formulate an ideal reconstruction model for personal data protection in Indonesia by referring to the principles of the European Union’s General Data Protection Regulation (GDPR). This research is a normative legal study employing statutory, conceptual, and comparative approaches. The legal materials consist of primary, secondary, and tertiary legal sources, which are analyzed using a prescriptive legal method. The findings reveal that the substantive limitations of the PDP Law include the regulation of personal data protection principles, data subject rights, cross-border personal data transfers, and compliance and enforcement mechanisms. Institutional limitations are identified in the regulatory framework concerning supervisory authorities and the coordination of oversight mechanisms. The proposed reconstruction model includes strengthening personal data protection principles, enhancing data subject rights, improving cross-border data transfer mechanisms, developing an accountability-based compliance system, establishing a supervisory authority with functional independence, and reinforcing coordination among sectoral regulators. Such reconstruction is expected to create a more comprehensive, effective, and legally certain personal data protection system in Indonesia.

Abstract

This article discusses the strengthening of parental capacity in child parenting as an implementation of Islamic family law in the digital era in Sidenreng Rappang Regency. The study focuses on three issues: the reality of parenting in the digital era, supporting and inhibiting factors in the implementation of Islamic family law in parenting, and a model for strengthening parental capacity that is relevant to Islamic family law and contemporary digital life. This field research applies phenomenological and normative approaches. Primary data were obtained through in-depth interviews and observation of Muslim families in Sidenreng Rappang Regency, while secondary data were collected from books, journals, laws and regulations, the Compilation of Islamic Law, and other relevant sources. The data were analyzed qualitatively through data reduction, data display, and conclusion drawing using Baumrind’s parenting styles theory, digital literacy theory, and maqāṣid al-syarī‘ah theory. The findings show that digital-era parenting practices vary into authoritative, authoritarian, and permissive patterns. The authoritative pattern is considered the most relevant because it balances affection, communication, rules, supervision, and religious habituation. The supporting factors include the use of devices for school and communication, time limits, content monitoring, and religious values as the basis of supervision. The inhibiting factors include low parental digital literacy, inconsistent family rules, entertainment-dominated content, children’s resistance, secretive gadget use, and peer influence. The proposed model is Islamic digital parenting based on maqāṣid al-syarī‘ah through the protection of religion, life, intellect, lineage, and property.

Abstract

Post-divorce hadhanah disputes place children in a vulnerable position as two concurrently applicable legal instruments, the Compilation of Islamic Law (KHI) and Law Number 35 of 2014 on Child Protection, operate under paradigmatically different normative logics. This study analyzes the forms of preventive and repressive legal protection of children’s rights in hadhanah disputes according to both instruments using Philipus M. Hadjon’s theory of legal protection. A normative legal research method was employed with statutory and conceptual approaches, analyzed through prescriptive-analytical techniques. The findings indicate that KHI constructs preventive protection through the designation of hadhanah holders based on mumayyiz age categorization, producing normative certainty but not inherently generating substantive protection of the child’s best interests. Law No. 35 of 2014 constructs preventive protection through the adaptive best interest of the child principle, yet lacks operational parameters enabling consistent application in judicial practice. On the repressive dimension, KHI provides a custody transfer mechanism under Article 156(c) tied to a clear forum, but remains reactive-passive as it cannot operate ex officio. Law No. 35 of 2014 positions the state as an active actor through Article 59, yet without operational procedures linking it to the concrete enforcement of hadhanah rulings. Neither instrument has formed an integrated protection system due to the absence of inter-instrument coordination mechanisms during the transitional period between divorce and hadhanah rulings, as well as at the post-judgment enforcement stage.

Abstract

This study aimed to examine the effectiveness of Cognitive Behavioral Therapy (CBT) and family psychoeducation in reducing oppositional behavior among adolescents with a history of developmental relational trauma. The participant was a 17-year-old male adolescent who exhibited symptoms of irritability, emotional sensitivity, social withdrawal, interpersonal conflicts in a residential care setting, and difficulties in emotion regulation. Data were collected through clinical interviews, behavioral observations, graphic psychological tests, the Sack's Sentence Completion Test (SSCT), and intervention outcome evaluations. The assessment revealed maladaptive cognitive schemas characterized by dysfunctional core beliefs such as "I have been abandoned," "My family does not care about me," and "People are against me." These negative beliefs contributed to persistent anger, avoidance behaviors, emotional dysregulation, and oppositional responses toward authority figures and social rules. Cognitive Behavioral Therapy was delivered across five structured sessions to assist the participant in identifying automatic negative thoughts, restructuring maladaptive cognitions, developing adaptive emotion regulation strategies, practicing relaxation techniques, and enhancing constructive behavioral responses. In addition, family psychoeducation was provided to the caregiver and residential care staff to improve their understanding of the adolescent's psychological condition, strengthen social support, and foster a more supportive caregiving environment. Following the intervention, the participant demonstrated increased self-awareness, improved ability to identify emotional triggers, greater openness in interpersonal communication, and more adaptive emotional and behavioral regulation. Enhanced support from caregivers and the residential environment also contributed to the participant's psychological adjustment. These findings underscore the importance of integrating individual cognitive-behavioral interventions with systemic family-based approaches in managing oppositional behavior among adolescents with histories of relational trauma and adverse childhood experiences.

Abstract

Death registration is a population administration service aimed at providing legal certainty for individuals after death. However, a challenge arises when reporting the death of an individual who does not possess a Population Identification Number (NIK). Current legislation does not specifically outline the death registration procedure under these circumstances, while the Population Administration Information System (SIAK) operates strictly on an NIK basis. This study aims to analyze the authority of the Population and Civil Registration Office (Disdukcapil) in registering deaths without an NIK, the resulting legal consequences, and future legal concepts. This research employs a normative juridical method with statutory, conceptual, case, historical, and comparative approaches. The results indicate that the absence of an NIK does not eliminate the state's obligation to register a death. Disdukcapil exercises administrative discretion and utilizes the Absolute Responsibility Statement (SPTJM) as a solution to overcome the legal vacuum. The legal consequences of this registration implicate the alteration of the legal subject's status, the opening of inheritance rights, and the protection of state data validity. Future concepts require the reconstruction of specific population administration regulations, the strengthening of an adaptive SIAK, cross-agency data integration, and the standardization of operational procedures nationally to guarantee legal certainty.

Abstract

The agricultural sector is crucial for national food security, with subsidized fertilizer serving as an instrument to maintain farmers' purchasing power. However, its distribution often faces challenges in the form of price fluctuations above the HET (Highest Retail Price) and leakage into the non-subsidized sector. In response, the government issued Presidential Regulation No. 6 of 2025 in conjunction with Presidential Regulation No. 113 of 2025 to tighten supervision. This study aims to analyze the legal construction of this governance and its implications for economic criminal law. The method used is a doctrinal-normative juridical analysis with descriptive analysis. Primary legal sources are Presidential Regulation No. 6 of 2025 and Law No. 7 of 2014 concerning Trade, while secondary sources are from scientific literature. Data were collected through a literature review and structured field observations. The results show that Presidential Regulation No. 6 of 2025 strengthens the digitalization of real-time monitoring systems to facilitate criminal evidence. This regulation establishes layered sanctions, including administrative sanctions, imprisonment/fines via the Trade Law, and Emergency Law No. 7 of 1955 as an anchor for economic crimes. Law enforcement continues to prioritize the principle of ultimum remedium, which prioritizes criminal sanctions for substantive malicious intent (mens rea), while strengthening corporate responsibility and the function of the KP3 (Commission for Supervision and Protection of Food and Agriculture). In conclusion, distribution irregularities at the distributor and retailer levels are systematic, harming farmers. Implementing an integrated distribution scheme and consistent law enforcement are essential prerequisites for legal certainty and equitable food sovereignty.

Abstract

This research is motivated by the urgency of legal protection for Jakarta's Kota Tua area, a historical heritage area threatened by physical damage and the pressures of urban development. The objective of the study is to analyze the effectiveness of the implementation of Law Number 11 of 2010 and regional regulations in ensuring legal certainty and preserving cultural heritage. The research method used is normative juridical with a descriptive analytical approach, utilizing primary and secondary legal materials through literature studies and field observations. The results indicate that legal protection by 2026 has evolved toward a collaborative model that integrates conservation with the Transit-Oriented Development (TOD) concept and digitalization through an e-Inventory system. However, the effectiveness of law enforcement is still hampered by issues of private ownership, high restoration costs without adequate incentives, and weak criminal sanctions. In conclusion, despite a comprehensive legal framework, the physical protection and substantive historical value of Jakarta's Kota Tua remain partial. The establishment of a single authority and the provision of concrete compensation to private building owners are necessary to ensure the sustainability of cultural heritage for future generations.

Abstract

This study examines the legal consequences and forms of liability arising from a notary’s negligence in facilitating the signing of a notarial deed through an online motorcycle-taxi courier outside the notary’s territorial authority. The research employs a normative juridical method using statutory and conceptual approaches. The analysis focuses on the provisions governing the authenticity of deeds, the territorial authority of notaries, the obligation to read and witness the signing of deeds, and civil, administrative, and ethical liability. The study finds that delivery of a deed to be signed through a courier cannot replace the notary’s direct presence and supervision. When the signing is conducted without simultaneous presence of the appearers, witnesses, and notary, and especially when it occurs beyond the notary’s territorial authority, the deed is exposed to formal defects. Such defects may result in the deed having evidentiary value only as a private deed, without automatically eliminating the underlying civil agreement when its substantive requirements remain fulfilled. The notary may also face civil claims for reimbursement of costs, compensation, and interest, as well as administrative and professional ethical sanctions. Therefore, efficiency in notarial services must not override the mandatory formalities intended to safeguard identity, free consent, legal capacity, and certainty of evidence.
