Abstract

The enactment of Law Number 1 of 2023 concerning the Criminal Code and Law Number 20 of 2025 concerning the Criminal Procedure Code marks an integrated shift in Indonesian criminal law from a predominantly retributive orientation toward corrective, rehabilitative, and restorative justice. Fraud and embezzlement are offenses against property that cause directly measurable losses and frequently intersect with civil disputes. This study analyzes the legal characteristics of fraud and embezzlement under the National Criminal Code and examines the requirements, stages, and legal consequences of restorative settlement under the National Criminal Procedure Code. The research employs normative legal research using statutory and conceptual approaches, supported by primary, secondary, and tertiary legal materials that are analyzed qualitatively through grammatical, systematic, and teleological interpretation. The study finds that fraud under Article 492 and embezzlement under Article 486, each carrying a maximum imprisonment of four years, may in principle enter a restorative mechanism because their penalties fall within the statutory threshold. Nevertheless, eligibility must be tested through the voluntariness of the parties, full restoration of the victim’s loss, the offender’s record, the public impact of the offense, and the absence of prohibited categories. The new procedural framework strengthens legal certainty by requiring written agreements, fulfillment of restoration, termination of proceedings, and court confirmation. Effective implementation therefore depends on consistent inter-institutional standards, transparent supervision, and protection against coercion or transactional impunity.

Abstract

Students' motivation to perform salat (Islamic prayer) is influenced by various experiences that shape their awareness and commitment to worship. This study aims to explore the lived experiences of students at the Faculty of Da'wah and Communication, UIN Ar-Raniry Banda Aceh, in understanding their motivation to perform salat based on Self-Determination Theory using a transcendental phenomenological approach. This study employed a qualitative research method with a transcendental phenomenological approach. Six students were selected as participants through purposive sampling. Data were collected through in-depth interviews and observations and were analyzed using the stages of transcendental phenomenological analysis. The findings revealed two major themes: intrinsic motivation and extrinsic motivation. Intrinsic motivation was reflected in participants' awareness of obeying Allah SWT, fulfilling their spiritual needs, attaining inner peace, and improving the quality of their worship. Meanwhile, extrinsic motivation was shaped by family habituation, peer support, and Islamic preaching media, all of which strengthened their consistency in performing salat. The findings indicate that motivation to perform salat develops through the internalization of religious values, with external factors serving as reinforcing influences, while intrinsic motivation functions as the primary driving force for sustaining worship. This study extends the application of Self-Determination Theory within the context of Islamic worship and provides implications for the development of Islamic Guidance and Counseling services and religious development programs in higher education institutions.

Abstract

The advancement of digital technology has transformed evidentiary practice in Indonesian courts, including divorce cases before Religious Courts. Electronic evidence such as chat screenshots and social media posts is now commonly submitted by litigants to support their claims. This article examines the application of electronic evidence in Decision Number 1257/Pdt.G/2024/PA.Mlg of the Malang Religious Court in light of Law Number 1 of 2024 on the Second Amendment to the Electronic Information and Transactions Law (ITE Law). Using a normative juridical method with statute and case approaches, this study finds that the panel of judges admitted five items of electronic evidence submitted by the respondent-husband, namely printed online news, social media screenshots, and WhatsApp conversation captures, and accorded them full evidentiary weight since their content was not contested by the opposing party. Rather than proving the grounds for divorce, this evidence became a decisive consideration in awarding child custody (hadhanah) to the father. The study further finds that the panel still grounded its reasoning in Article 5 of Law Number 11 of 2008 as amended by Law Number 19 of 2016, without explicit reference to Law Number 1 of 2024, even though the latter was already in force when the decision was rendered indicating a gap in updating statutory citation practice in religious court adjudication.

Abstract

Social skills are important abilities that students need to support effective communication, cooperation, and interaction in the school environment. However, there are still students who have not been able to demonstrate social skills optimally. Therefore, this study was conducted to determine the effect of the Make A Match educational game in group guidance services on students' social skills. This study employed a quantitative method with a One Group Pretest-Posttest design, which is included in the Pre-Experimental Design category. The research subjects consisted of six seventh-grade students of SMP Negeri 25 Banjarmasin selected through purposive sampling. The research data were collected using a social skills questionnaire that had passed validity and reliability testing. The data were analyzed using descriptive statistics and the Wilcoxon Signed Rank Test. The results showed an improvement in students' social skills, indicated by an increase in the mean score from 105.33 before the treatment to 154.67 after the treatment. In addition, the hypothesis testing result obtained a significance value of 0.027 (< 0.05), indicating that the alternative hypothesis was accepted. Thus, the use of the Make A Match educational game in group guidance services was proven effective in improving students' social skills. his study was conducted on a limited sample of six students using a One Group Pretest-Posttest design without a control group. Therefore, the findings are limited to the research subjects and should be generalized with caution. Nevertheless, the results indicate that the Make A Match educational game can be used as an alternative technique in group guidance services to improve students' social skills.
