Abstract

This study analyzes the impact of zakat and employment opportunities on poverty as well as the moderating role of employment opportunities in the zakat-poverty relationship. Using panel data regression with Eviews, the findings show differences between the baseline model and the interaction model. In the basic model, zakat and employment opportunities have a negative and significant effect on poverty. However, in the interaction model, both variables are insignificant, and the moderating effect of employment opportunities is also insignificant (P-value 0.2887). This result shows that employment opportunity does not strengthen or weaken the relationship between zakat and poverty reduction. This may be due to the distribution of zakat that is not well-targeted or consumptive, as well as unequal or low-quality employment opportunities. To increase the role of zakat in poverty alleviation, strategic steps are needed such as more productive distribution of zakat, skills training, and increasing access to decent work

Abstract

This study aims to analyze the influence of Zakat and DOKA on poverty levels using Economic Growth as a moderating variable. Operationalizing panel data from two administrative regions (districts and cities) in Aceh during the 2019-2021 period, the analysis models used are multiple regression and moderated regression analysis. The research results show that Zakat and DOKA in that year had no effect in reducing poverty in Aceh. However, increasing GRDP moderates the influence of Zakat and DOKA on poverty, making these two instruments more effective in reducing poverty levels and increasing economic prosperity.

Abstract

Our research study aims to examine and analyze the impact of zakat distribution by Baitul Mal on reducing poverty levels in the West-South region of Aceh. Utilizing panel data from 8 regencies and cities over the period 2013-2021, the analytical model employed is panel regression with a fixed effect approach. Our study reveals that zakat distribution significantly reduces poverty levels. The larger the amount of zakat distributed, the lower the poverty level. These findings imply that regional government efforts to reduce poverty, particularly in the West-South region of Aceh, can be implemented through policy interventions related to zakat distribution. Regional governments, through Baitul Mal, must ensure that zakat recipients are indeed from the poor group.

Abstract

The purpose of this research is to analyze the legal considerations and consequences arising from the issuance of Tenggarong District Court Decision Number 91/Pdt.G/2019, which resolved a dispute over the sale and purchase of freehold land involving the Plaintiff (Warda), Defendant I (Octavianus P), Defendant II (Ahmad Rakbini), and the Co-Defendant (National Land Agency Office, Kutai Kartanegara Regency). The research was initiated due to the Plaintiff's lawsuit filed at the Tenggarong District Court, stemming from challenges in transferring or changing the ownership name of a plot of land purchased privately from Defendant II. These difficulties arose because the Defendants' current addresses were unknown, preventing the completion of administrative requirements for registration with the National Land Agency. Consequently, the Plaintiff sought a court ruling to validate the payment receipt as evidence of the land purchase. This study employs a normative juridical method with a descriptive approach, utilizing secondary data sources and qualitative analysis. The findings indicate that the court partially granted the Plaintiff's claims, legally authorizing the transfer of land ownership from the Defendant to the Plaintiff, based on a private sale agreement and supported by a payment receipt. The court issued the decision in verstek since the Defendants, including the Co-Defendant, did not attend the proceedings, provide information, or appoint legal representation.

Abstract

The Indonesian Constitution recognizes indigenous legal communities as part of the wealth of the Unitary State of the Republic of Indonesia whose existence and rights are guaranteed. One such group is the Minangkabau community, which is often involved in customary land ownership disputes. Internal and external conflicts in society. Many things cause these conflicts: non-transparent deliberation processes, lack of openness in the termination of customary land, inadequate compensation, and lack of guarantees from private companies. This study uses a descriptive empirical legal approach with primary data sourced from the field. Disputes are resolved through customary procedures, which usually involve the implementation of customary systems, deliberation, consensus through negotiation or mediation between local customs and companies (or representing companies) → Formulation of customary land disputes. Then the decision is formalized by registering the agreement with a notary or court so that it can be [legally] enforced. However, dispute resolution can be facilitated by a third party, for example, the territorial government approach that provides support in negotiations or finding agreements

Abstract

Good governance plays a crucial role in influencing economic growth in a region, which subsequently contributes to poverty reduction. However, high poverty levels and uneven economic growth can negatively impact local communities. This study examines the effects of transparency, accountability, participation, and equity on poverty alleviation in West Aceh Regency. A mixed-methods approach, combining quantitative and qualitative techniques with a triangulation design, was employed. The study involved 379 respondents who were major recipients of social assistance from three sub-districts: Kaway XVI, Samatiga, and Woyla. Data were collected through questionnaires, and additional insights were obtained from three government officials involved in poverty alleviation efforts at BAPEDDA West Aceh Regency. Data analysis utilized multiple linear regression with SPSS 22. The findings indicate that transparency significantly and positively influences poverty alleviation by ensuring that aid distribution is targeted and effectively managed. Accountability also has a significant positive effect, as it integrates community involvement from planning to program evaluation. Participation contributes positively by aligning programs with local needs and enhancing implementation success. Lastly, equity positively impacts poverty alleviation by promoting fair resource distribution, enabling programs to effectively reach all societal levels, including vulnerable groups.

Abstract

Human trafficking across national borders represents a critical challenge to Indonesia's national security and human rights protection. This study aims to evaluate the effectiveness of international cooperation mechanisms in counter-trafficking efforts and analyze the strategic approaches implemented by Lemhannas RI (Indonesia's National Resilience Institute) and BNPP (National Border Management Agency) in combating transnational crime at Indonesia's borders. This research employs a descriptive-qualitative methodology through document analysis, policy review, and examination of legal frameworks, including the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW, ratified through Law No. 7/1984), Law No. 21/2007 on Human Trafficking Eradication, and the Palermo Protocol standards. The results reveal that while Indonesia has established a progressive legal framework, implementation faces challenges due to economic disparities, demographic pressures, and patriarchal norms. International cooperation mechanisms show limited effectiveness due to jurisdictional complexities and weak cross-border coordination. The strategic approaches by Lemhannas RI and BNPP require strengthened inter-agency collaboration and enhanced border control mechanisms, particularly in vulnerable maritime regions. The study concludes that effective human trafficking eradication demands an integrated approach combining robust law enforcement, enhanced international cooperation, and targeted socio-economic interventions. Recommendations include strengthening maritime border surveillance, developing comprehensive victim protection programs, and establishing more effective international cooperation mechanisms.

Abstract

The research analyzes the urgency and success probability of restorative justice implementation in business dispute resolution. The study employs normative legal research methodology through statutory and conceptual approaches. Legal material collection utilizes literature studies by identifying, gathering, and inventorying relevant primary and secondary legal sources. The analysis results demonstrate that restorative justice application becomes essential in business dispute resolution as it provides efficient, economical solutions while preserving business relationships. The mechanism serves as a strategic alternative to rigid and costly litigation, strengthening legal certainty and business climate competitiveness in Indonesia. The success rate of restorative justice in business dispute resolution shows promising potential when supported by parties' willingness, competent facilitators, and clear regulatory frameworks.
