Abstract

This research is based on the ambiguity of street naming norms in statutory regulations, this causes the legality of street naming in the Mojokerto city government area to be questioned. Based on this description, the author formulates the problem formulation as follows: (1) What is the authority of the Mojokerto City Government in naming roads? (2) What is the legality of naming roads belonging to the Mojokerto city government?This research uses a normative juridical research type with a statutory approach, a historical approach and a conceptual approach using primary legal materials and secondary legal materials.The research results from this thesis show that the Mojokerto City Government does not have direct authority to name roads in its area. There is a lack of normative legal regulations in regulating transitional conditions in the naming of landforms, especially roads. The legality of naming roads belonging to the Mojokerto city government can be questioned due to the absence of statutory norms that order local governments to form legal products related to street naming.

Abstract

This study aims to examine the legal aspects of the restoration of political rights of former convicts in the Constitutional Court Decision Number 4/PUU/VII/2009, with a focus on the protection of human rights in the constitution. The decision is important in the context of changes in the law governing political rights for former convicts in Indonesia, which were previously limited by the existing legal system. In this decision, the Constitutional Court ruled that restrictions on political rights for former convicts were not in line with the principles of human rights guaranteed in the 1945 Constitution. This study uses a normative approach by analyzing laws and regulations, Constitutional Court decisions, and legal doctrines related to human rights and political rights. The results of the study indicate that the restoration of political rights for former convicts is an important step in ensuring the protection of human rights, as well as creating a more rehabilitative and inclusive criminal justice system. In addition, the decision also has important implications for efforts to improve the legal system in Indonesia, which should pay more attention to the rehabilitation of convicts and the restoration of their social status after serving their sentence.

Abstract

Rapid developments in digital technology have increased the complexity of cybercrime and posed new challenges in its detection. Unlike traditional crimes, evidence in cyber cases relies on electronic evidence that has special characteristics, such as digital formats that are susceptible to change, storage on remote servers, and connections to aspects of digital forensics. The aim of this research is to analyze the evidentiary mechanism in cybercrime cases based on the Criminal Procedure Law (KUHAP), the Electronic Transaction Information Law (UU ITE) and other related laws and regulations. The research methodology used is normative law with case studies of legislative approaches and court decisions regarding the validity of electronic evidence. The study found that although electronic evidence is recognized as valid evidence in Indonesia's criminal justice system, obstacles to its implementation remain, including inconsistent legal interpretations, a lack of operational standards for digital forensic investigations, and limited human resources in law enforcement agencies. Therefore, to ensure the validity of evidence in cyber crimes, it is necessary to harmonize laws and regulations, increase the capacity of law enforcement officials, and strengthen cooperation between institutions.

Abstract

This study examines the effectiveness of Law No. 11 of 2012 on the Juvenile Criminal Justice System in providing protection for children in conflict with the law (ABH). The law establishes various provisions related to the age limits of children, the types of penalties that can be imposed, and alternative actions as protective measures. Furthermore, this study identifies the factors that contribute to minors becoming perpetrators of sexual abuse and violence. Based on the latest systematic review, key influencing factors include family dynamics, past experiences of violence, and an unsupportive social environment. These findings indicate that effective law enforcement must consider the psychosocial aspectsof children and emphasize rehabilitative and preventive approaches in addressing ABH.

Abstract

The provisions of the 1945 Constitution Article 1 paragraph (3) "The State of Indonesia is a State of Law". In addition to being a state of law, Indonesia is also a democratic state. In the concept of democracy, the government of a country is a government of the people, by the people, and for the people (principle of democracy). One of the important moments for the state of Indonesia to adopt a democratic system is the implementation of elections. Elections are also a means to encourage accountability and public control over the state, direct elections will make prospective leaders in the election contest do various ways to attract public sympathy to be able to vote for them. Even with methods that violate the constitution are also carried out. As is often the case in society during the election period, namely money politics . Legal regulations related to money politics in Law no. 7 of 2017 concerning elections include several special articles that prohibit the practice of money politics, but legal loopholes in election regulations include unclear definitions and ambiguous exceptions. Law enforcement against the practice of money politics in Indonesia still faces many challenges. This study uses a library study method supported by relevant research. The results of the study show that the root of the problem of the emergence of money politics is the existence of legal loopholes, weak supervision and a proportional election system that opens up opportunities for the development of money politics. The problem of money politics needs to be analyzed to obtain an effective strategy in preventing it. Money politics is not in accordance with the principles of democratic theory which demands freedom and justice. Elections are said to be fair if all people have the same right to choose leaders by not violating the rule of law.

Abstract

This study aims to analyze the legal protection for children who commit theft, as examined in Decision Number 33/Pid.Sus-Anak/2018/PN Gns, focusing on how such protection is provided under Law Number 11 of 2012 concerning the Juvenile Justice System and the consequences of the absence of legal protection in sentencing children for theft. Using a normative legal research method that emphasizes positive law in the form of legislation and secondary legal materials as the primary sources, this study employs a statutory and case approach. The findings indicate that the decision has not optimally provided legal protection for children, as it does not fully adhere to the principle of the best interests of the child or the principle that deprivation of liberty and criminal sanctions should be a last resort. Moreover, the rights of children as offenders are not fully upheld, including the right not to be separated from their parents against their will. Consequently, if a child is sentenced to imprisonment, their relationship with their parents is severed, potentially leading to significant psychological and social impacts.

Abstract

This research aims to determine, the effect of applying the Problem-Based Learning (PBL) model on students’ learning outcomes for Economics subjects in class XI of SMA Negeri 6 Gorontalo Utara. This quantitative research uses a Quasi-Experimental Design research (Pseudo experiment), with a sample size of 30 students. The results showed that there is an effect of applying the Problem-Based Learning (PBL) model, proven to significantly improve the learning outcomes of grade XI students in economic subjects at SMA Negeri Gorontalo Utara, as shown by the Sig. (2-tailed) of 0.000, which is smaller than the significance level of 0.05. The Problem Based Learning (PBL) model allows students to be more active, critical, and independent in understanding concepts by linking theory with real problems.

Abstract

The rapid development of the Internet of Things (IoT) in Indonesia brings new challenges in personal data protection. This study aims to analyze the suitability of the legal framework in Indonesia in protecting personal data collected by IoT devices. This study identifies data collection and use practices, as well as uncovers existing legal loopholes. This study intends to conduct an in-depth analysis of the level of compliance with personal data protection laws in the context of IoT solutions. The normative legal research method with the library search technique is to search for journal or article materials related to the title and theme that the author is studying. Therefore, this study has a strategic goal to investigate the extent to which applicable regulations can be effectively implemented in the IoT ecosystem, with a special focus on security and privacy aspects that are the main pillars of personal data protection regulations. Based on these findings, this study provides policy recommendations to improve personal data protection in the IoT era, such as the need for a revision of the ITE Law, strengthening supervision by related institutions, or increasing public awareness.

Abstract

Traffic congestion in Bandar Lampung City has led to the emergence of volunteer traffic controllers, commonly known as Pak Ogah. Their presence has sparked mixed reactions from the public. Some view them as helpful in maintaining traffic flow in the absence of traffic police, while others consider their actions to cause disturbances, traffic jams, and illegal levies. One of the most controversial actions is the forced opening of road barriers without proper authorization and outside the scheduled times, which violates Law Number 22 of 2009 on Road Traffic and Transportation. This study addresses two main issues: the functionalization of criminal law against Supeltas (volunteer traffic controllers) who unlawfully open road barriers, and the policies of the traffic police (Polantas) regarding their presence. This research uses normative and empirical juridical methods, with data collected through literature studies and field interviews with four key informants. The findings reveal that such actions constitute legal violations that can jeopardize road safety and public order. Firm legal enforcement is essential, yet specific regulations concerning Supeltas are still lacking. This study recommends guidance and supervision by law enforcement, particularly traffic police, and the application of criminal sanctions in accordance with existing legal provisions.

Abstract

This study aims to analyze the legal protection for investors in the capital market through the harmonization of existing regulations. In the context of Indonesia's capital market, legal protection is a crucial aspect for maintaining investor confidence and creating a healthy investment climate. Although various regulations, such as Law No. 8 of 1995 on Capital Markets, have been established, the implementation of legal protection still faces several challenges, including a lack of alignment between existing regulations. This research employs a normative approach with legal analysis and literature review as data collection methods. The findings indicate that regulatory harmonization is essential to enhance the effectiveness of legal protection for investors, both preventively and repressively. With harmonization in place, it is expected that regulations can operate more effectively and provide better protection for investors in the capital market.
