Abstract

The phenomenon of contempt of court has garnered increasing attention in Indonesia’s legal practice, especially when such actions are committed by legal professionals such as advocates. This research is prompted by the case of Razman Arif Nasution, an advocate who allegedly committed contempt of court by making public statements that discredited judges and judicial proceedings. The purpose of this study is to analyze the form of contempt of court committed and examine the existing legal framework regulating and addressing such conduct in Indonesia. This research uses a normative juridical method with a case study approach. The findings indicate that Razman Arif Nasution’s actions violated the Indonesian Advocate Code of Ethics, particularly Article 6 point (c), and may also constitute criminal offenses under Articles 217 and 310 of the Indonesian Penal Code (KUHP). Although the new Criminal Code (Law No. 1 of 2023) begins to regulate contempt of court in a more structured manner, there remains a need for a dedicated and comprehensive law. This study underscores the importance of establishing specific legislation and strengthening the enforcement of professional ethics for advocates.

Abstract

Bankruptcy is a legal issue that has a broad impact on companies, creditors, and workers. In the context of civil law, bankruptcy occurs when a debtor is unable to fulfill his debt obligations that have matured and can be collected by creditors. This study focuses on a legal analysis of the Gresik District Court Decision Number 1/Pdt.Sus-PHI/2022/PN Gsk, which stated that PT New Era Rubberindo was bankrupt due to failure to pay workers' wages and holiday allowances (THR) within a certain period. This study uses a normative method with a case approach to evaluate the legal implications of the decision on workers' rights and the effectiveness of bankruptcy regulations in Indonesia. The results of the analysis show that bankruptcy not only has an impact on the sustainability of a company's business but also has significant consequences for the workforce. Based on Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations, workers' rights to salaries and allowances must be a top priority in the bankruptcy resolution process. In practice, the main obstacles that often arise are the slow process of resolving bankruptcy and the lack of clarity in the implementation of regulations that protect workers' rights. Therefore, more effective legal reform is needed to ensure a balance between the interests of creditors and the protection of workers' rights in the bankruptcy system in Indonesia.

Abstract

The India-Pakistan conflict over Kashmir, which has peaked again in 2025, is a reflection of historical tensions that have been ongoing since 1947, with issues of self-determination and territorial sovereignty at its core. This research analyzes recent conflict dynamics, including unilateral Indian actions such as the revocation of Jammu and Kashmir's autonomous status, the suspension of the Indus Waters Treaty, and the escalation of military operations into civilian areas, which significantly increase the risk of humanitarian law and human rights violations. In addition, the involvement of non-state armed groups allegedly supported by Pakistan raises serious questions about state responsibility under international law, particularly the doctrine of effective control. This study also highlights the role of third parties such as the United States, China, the United Kingdom and Saudi Arabia that emphasize the global geopolitical dimension of the conflict, and assesses the effectiveness of dispute resolution mechanisms that have been more tactical than substantive. Using a normative juridical and descriptive qualitative approach, this study emphasizes the need to reform international dispute resolution mechanisms and strengthen state accountability within the framework of international law in order to create a comprehensive and sustainable solution to the Kashmir conflict.

Abstract

Juvenile delinquency is one of the social problems that impacts the development of the younger generation, especially in the Saombo Village, Gunungsitoli City. This study aims to examine the role of the family in preventing juvenile delinquency in the area. The method used is a qualitative approach with data collection techniques through observation, interviews, and documentation of several families and local community leaders. The results of the study indicate that the family has a central role in the formation of adolescent character, through consistent parenting, open communication, and active supervision. Families who apply democratic parenting tend to be more successful in preventing their children from falling into deviant behavior. Conversely, lack of attention and emotional closeness from parents is one of the triggers for delinquency. Thus, efforts to prevent juvenile delinquency in Saombo Village need to start from strengthening the function of the family as the first and main educational environment for children.

Abstract

Military comes from the word miles, meaning people who are ready or assigned to go to war. The military is a tool of the state that is assigned to go to war and defend the country. Legal politics in the current era or after the reform era states that those who commit general crimes must be subject to general justice. Therefore, in Indonesia itself, regulations are regulated regarding the formation of military justice in Indonesia. Referring to the country of Indonesia which is an agricultural country with a geographical area flanked by two continents and two oceans, Indonesia's position is very strategic because its territory is very potential. Although Indonesia has a potential area, Indonesia is very disadvantaged because it has a territory located in the ring of fire area. Thus, Indonesia becomes an area prone to natural disasters due to this. Therefore, the military also has a role to help overcome natural disasters because the military has the capacity in the form of the ability to carry out tasks which are in fact in emergency conditions with its command network down to the regional level. This is based on the fact that natural disaster management is not only the task of BNPB and BPBD according to the military, but this proves that the military can also help with problems related to natural disaster management

Abstract

In the context of industrial relations in Indonesia, employee branding plays an important role in shaping the company's image through employee behavior and attitudes. Employees have a responsibility to maintain the company's reputation in accordance with applicable laws and internal regulations. This article analyzes the legal framework governing employee branding obligations and the legal implications that may arise if employees violate these obligations. Based on normative analysis, it was found that violations of employee branding obligations can result in legal sanctions, both internal such as termination of employment (PHK) and administrative sanctions, and external such as claims for compensation. Thus, it is important for companies and employees to understand the obligations and consequences related to employee branding in employment relations.

Abstract

Perkembangan teknologi informasi dan komunikasi telah membawa dampak besar terhadap transformasi global, termasuk dalam aspek keamanan siber. Negara berkembang seperti Indonesia menghadapi tantangan serius dalam membangun kapasitas pertahanan siber yang andal, akibat keterbatasan sumber daya, infrastruktur, serta regulasi yang belum harmonis. Dalam konteks ini, peran organisasi internasional menjadi sangat penting untuk membantu negara-negara berkembang dalam meningkatkan kesiapan dan ketahanan terhadap ancaman siber. Artikel ini membahas kontribusi organisasi internasional, khususnya International Telecommunication Union (ITU), dalam membangun kapasitas siber negara berkembang melalui kerja sama teknis, pelatihan sumber daya manusia, dan advokasi kebijakan keamanan siber. Melalui metode yuridis normatif dan studi pustaka, artikel ini menelusuri bagaimana ITU menjalankan perannya melalui berbagai inisiatif, seperti pengembangan broadband, pelatihan mitigasi kejahatan siber, serta kolaborasi dengan organisasi lain seperti IMPACT dan INTERPOL. Di sisi lain, Indonesia juga telah membentuk Badan Siber dan Sandi Negara (BSSN) sebagai langkah strategis untuk mengoordinasikan keamanan siber nasional. BSSN menerapkan strategi berdasarkan lima pilar Global Cybersecurity Index (GCI), yakni aspek hukum, teknis, organisasi, pengembangan kapasitas, dan kerja sama. Penelitian ini menyimpulkan bahwa kolaborasi internasional menjadi kunci dalam menciptakan ekosistem keamanan siber yang tangguh dan adaptif. Oleh karena itu, diperlukan sinergi berkelanjutan antara pemerintah, organisasi internasional, sektor swasta, akademisi, dan masyarakat guna meningkatkan daya saing digital negara berkembang di tengah tantangan dunia maya yang semakin kompleks.

Abstract

Sukuk is an Islamic financial instrument that serves as an alternative to conventional bonds. Unlike bonds, which are based on debt and interest (riba), sukuk is based on asset ownership and profit-sharing in accordance with Sharia principles. This study aims to analyze the concept of sukuk, compare it with conventional bonds, and evaluate its implementation in Indonesia and globally. The research method used is qualitative with a descriptive-analytical approach based on secondary data from journals, regulations, and Islamic capital market reports. The findings indicate that sukuk has significant potential in supporting the development of the Islamic economy, particularly with the growing demand for halal investments. However, challenges such as low public literacy, the need for stronger regulations, and competition with conventional bonds remain obstacles to sukuk’s growth. With government support and innovation in the Islamic finance sector, sukuk can become a more competitive and attractive investment instrument for investors.

Abstract

Collaboration between banking and fintech lending or online loans is a development that continues to emerge in the Indonesian financial system. On the one hand, this collaboration offers inclusive and efficient financial service innovations, but on the other hand it raises potential legal, operational, and consumer protection risks that have not been fully anticipated by the existing supervisory framework. This article examines the urgency of strengthening legal supervision of this collaboration, with an emphasis on regulatory gaps, overlapping supervisory authorities, and challenges in ensuring compliance with the principles of prudence and transparency. This study uses a normative legal approach with an analysis of laws and regulations, financial institution decisions, and case studies of bank-fintech collaboration. The results of the study indicate that strengthening supervision is needed through regulatory harmonization between the OJK and Bank Indonesia, affirmation of integrated supervisory mechanisms, and updates to digital risk-based policies. With this strengthening, the Indonesian banking legal system is expected to be able to accommodate the development of financial technology adaptively while protecting the stability of the financial system and consumer interests.

Abstract

The Constitutional Court of the Republic of Indonesia was established as an institution tasked with upholding the supremacy of the Constitution and protecting the constitutional rights of citizens. One of its primary authorities is the judicial review of legislation against the 1945 Constitution of the Republic of Indonesia. This article examines the procedural mechanisms of the Constitutional Court in safeguarding the constitutional rights of petitioners, and to what extent these procedures ensure the fulfillment of the right to justice. Utilizing a normative legal method, this study reveals that although the procedural law of the Court is designed to uphold the principles of fairness and accessibility, significant challenges remain in ensuring optimal protection for petitioners. While the Court’s decisions are final and binding, granting them strong legal force, their implementation and impact on legislative reform still require robust institutional support.
