Law and Social Economy: An examination of the relationship between law and the social economy, particularly emphasizing the influence of economic transformation on social order. The Role of Social Actors in Legal Development: Investigates how social actors such as activists, community groups, and non-profit organizations may drive legal change that promotes social development. With this focus and scope, the journal is expected to produce insightful and beneficial additions to our knowledge of the complicated interaction between law and social transformation.

Abstract

Singapore is one of the main destinations for criminal offenders from Indonesia, which causes losses for Indonesia. In the process, in 2007 Indonesia signed an extradition agreement with Singapore but failed to be ratified. During Joko Widodo's administration in 2022, Indonesia re-signed an extradition agreement with Singapore along with the Defense Cooperation Agreement (DCA) and Flight Information Region (FIR). The three agreements also took effect simultaneously in 2024. Since its signing, it has taken 17 years for the extradition treaty between the two countries to come into force. This case is understood by the Principle of Reciprocity in International Law. This paper uses a qualitative research method with descriptive analytical research. In this case, reciprocity is one of the basic principles governing extradition treaties. This principle is crucial in negotiating fair and equal terms. In drafting international agreements, reciprocity can make negotiations more complex as each party may have different priorities and needs. This is reflected in the case of the extradition treaty between Indonesia and Singapore, where Indonesia wants this treaty to be ratified to facilitate the pursuit of criminals who have fled to Singapore and the return of assets that have been illegally taken. Singapore responded by asking Indonesia to ratify the DCA and FIR Agreement, which cover aspects of Singapore's broader defense and security interests. Abstract

This study examines the legal considerations used by the Panel of Judges in imposing criminal sanctions on the defendant in Decision No. 116/Pid.B/LH/2023/PN Psb regarding the criminal act of misuse of government-subsidized fuel trading. Although Article 55 of Law Number 22 of 2001 on Oil and Gas stipulates a maximum penalty of six years in prison and a fine of up to Rp60,000,000,000.00, the defendant was only sentenced to six months in prison and fined Rp50,000,000.00. This study aims to analyze the judge's rationale for imposing the sanction and to examine the verdict from the perspective of Islamic criminal law. This research employs a qualitative approach using a case study method. Primary data was obtained through direct interviews with judges at the West Pasaman District Court, while secondary data was collected from books, journals, legislation, and Islamic legal sources such as the Qur’an and Hadith. The findings indicate that the judge's considerations in sentencing were based on the elements of the criminal act under Article 55 of Law No. 22 of 2001 jo. Article 55, paragraph (1) of the Criminal Code, available evidence, and aggravating and mitigating factors. Additionally, the judge considered consistency with previous decisions that have permanent legal force to prevent sentencing disparities in similar cases. From the perspective of Islamic criminal law, the defendant’s actions fall under jarimah ta'zir as they constitute an unlawful act that does not fall within hudud or qisas. While the act could be linked to the concept of al-baghyu (rebellion), the absence of violence or weapon use classifies the punishment under ta'zir, allowing the judge discretion in determining the appropriate sanction.

Abstract

Konflik bersenjata di Suriah yang berlangsung sejak 2011 telah menimbulkan krisis kemanusiaan yang kompleks. Sebagai organisasi kemanusiaan internasional, International Committee of the Red Cross (ICRC) memiliki peran penting dalam merespons kebutuhan mendesak yang timbul akibat konflik ini. Pendekatan teori Norm Entrepreneur dari Norm Life Cycle yang diperkenalkan oleh Finnemore dan Sikkink digunakan untuk menganalisis bagaimana ICRC mempromosikan norma-norma kemanusiaan, termasuk penerapan prinsip-prinsip hukum humaniter internasional di Suriah. ICRC tidak hanya bertindak sebagai penyedia bantuan kemanusiaan, tetapi juga sebagai aktor normatif yang memperkuat norma perlindungan terhadap korban konflik. Perspektif ini menunjukkan pentingnya peran organisasi internasional dalam mendukung tata kelola global yang berbasis norma.

Abstract

Penelitian ini menganalisis peran ASEAN sebagai norm entrepreneur dalam mengembangkan dan mempromosikan norma perlindungan HAM di kawasan Asia Tenggara. Menggunakan kerangka teoretis Norm Life Cycle dari Finnemore dan Sikkink, penelitian ini mengkaji bagaimana ASEAN membangun, memperkuat, dan menginternalisasi norma HAM melalui berbagai mekanisme regional. Dengan pendekatan kualitatif dan metode studi kasus, penelitian ini menggunakan teknik process tracing untuk menganalisis dokumen resmi ASEAN dan literatur akademis. Hasil penelitian menunjukkan bahwa ASEAN telah berperan signifikan dalam memperkenalkan dan mempromosikan norma HAM melalui pembentukan ASEAN Intergovernmental Commission on Human Rights (AICHR) dan ASEAN Human Rights Declaration. Namun, efektivitas ASEAN masih terbatas karena prinsip non-intervensi dan perbedaan komitmen politik antar negara anggota. Meskipun beberapa negara seperti Indonesia dan Filipina menunjukkan kemajuan dalam internalisasi norma HAM, negara-negara dengan sistem politik lebih otoritarian masih menunjukkan resistensi. Penelitian ini menyimpulkan perlunya penguatan mekanisme HAM ASEAN untuk mencapai implementasi yang lebih efektif di kawasan.

Abstract

Abstrak Perubahan iklim merupakan suatu masalah yang akan terusdihadapi oleh masyarakat global. Bumi sendiri sudah mengalamipeningkatan rata-rata suhu yang signifikan hingga sekarang ini. Hal ini menimbulkan kekhawatiran terhadap keberlanjutankehidupan manusia karena dampak yang ditimbulkan di bidangpangan, kesehatan, dan masih banyak lagi. Perubahan iklim juga menjadi suatu permasalahan politik yang sudah banyak dibahas. Pembentukan UNFCCC dan kerangka kerjanya seperti Kyoto Protocol dan Paris Agreement menjadi bukti bahwa masyarakatinternasional harus mulai peka terhadap masalah perubahaniklim. Dalam pelaksanaannya juga, terdapat satu norma yang dibentuk yaitu Climate Justice, yang dimana menjadi bahasanyang ingin dibahas oleh penulis tentang bagaianaperkembangannya dan proses nya menjadi norm entrepereneuryang diterima oleh masyarakat internasional. Climate justice disini juga ingin dibahas tentang apa yang menjadi pokokpembentukan norma ini dan bagaimana proses nya diterimamenjadi norm entrepreneur. Penulis juga ingin membahasmengenai tentang proses norm life cycle yang dialami oleh norma ini sehingga bisa diterima dan diterapkan pada kebijakan-kebijakan negara negara di dunia yang membahas tentangperubahan iklim. The Earth itself has experienced a significant increase in average temperature to date. This raises concerns about the sustainability of human life because of the impacts on food, health, and more. Climate change is also a political issue that has been widely discussed. The establishment of the UNFCCC and its frameworks such as the Kyoto Protocol and the Paris Agreement are proof that the international community must begin to be sensitive to the problem of climate change. In its implementation, there is also one norm formed, namely Climate Justice, which is the topic that the author wants to discuss about how it develops and its process of becoming an entrepreneurial norm accepted by the international community. Climate justice here also wants to be discussed about what is the main formation of this norm and how the process is accepted as an entrepreneur norm. The author also wants to discuss the norm life cycle process experienced by this norm so that it can be accepted and applied to the policies of countries in the world that discuss climate change. Abstract

Abstrak Sudan Selatan telah menghadapi perang saudara dari tahun 2013 yang melibatkan dua kelompok etnis. Perang saudara ini mengakibatkan korban sebanyak 400.000 jiwa dan memaksa sepertiga dari populasi negara tersebut untuk mengungsi. Konflik ini juga mengakibatkan pendidikan di Sudan Selatan menjadi terganggu. Artikel ini bertujuan untuk menganalisis peran organisasi internasional UNICEF sebagai norm entrepreneur dalam bidang pendidikan di Sudan Selatan. Penelitian ini menggunakan metode penelitian kualititif dengan melakukan studi literatur. Hasil penelitian menemukan bahwa UNICEF dengan Back to Learning Initiative dapat mengubah pandangan masyarakat Sudan Selatan mengenai pendidikan, memberikan akses pendidikan kepada anak-anak yang putus sekolah, serta meningkatkan lingkungan pendidikan di Sudan Selatan. This civil war resulted in the loss of 400,000 lives and forced a third of the country’s population to flee. The conflict has also disrupted education in South Sudan. This article aims to analyze the role of the international organization UNICEF as a norm entrepreneur in the field of education in South Sudan. This research uses a qualitative research method by conducting a literature study. The results found that UNICEF with the Back to Learning Initiative can change the views of the people of South Sudan about education, provide access to education to children who drop out of school, and improve the educational environment in South Sudan. Abstract

Organisasi Internasional memiliki peran strategis dalam membentuk norma global yang memengaruhi dinamika hubungan internasional. Sebagai Neofunctionalism, organisasi internasional tidak hanya berfungsi sebagai wadah kerja sama antarnegara, tetapi juga sebagai aktor yang mendorong adopsi nilai dan standar tertentu oleh komunitas global. Artikel ini bertujuan menganalisis peran organisasi internasional dalam pembentukan norma global, dengan menggunakan kerangka  Neofunctionalism oleh Ernst B. Haas, serta mengeksplorasi alasan beberapa negara bergabung dalam organisasi internasional berdasarkan teori institusionalis rasional dan legitimasi. Penelitian ini menggunakan metode kajian pustaka dengan menganalisis literatur akademik, laporan kebijakan, dan studi kasus relevan. Hasil kajian menunjukkan bahwa peran organisasi internasional memainkan peran penting dalam menginisiasi dan menginternalisasi norma global melalui mekanisme advokasi, sosialisasi, dan pengawasan. Sementara itu adanya motivasi negara bergabung dipengaruhi oleh keinginan untuk memperkuat legitimasi internasional akan mendapatkan manfaat ekonomi serta meningkatkan kapasitas nasional. Sehingga dengan memahami peran dan alasan ini artikel ini memberikan wawasan tentang pentingnya organisasi internasional dalam mengatur tata kelola global yang berkeadilan dan inklusif.

Abstract

Penelitian ini menganalisis alasan di balik keputusan negara-negara untuk bergabung dalam organisasi internasional menggunakan kerangka teori institusional rasional. Dengan mengkaji literatur akademik terkini dan menerapkan pendekatan analisis kualitatif, studi ini mengidentifikasi motivasi utama seperti peningkatan legitimasi internasional, akses terhadap sumber daya, serta peningkatan keamanan dan stabilitas. Hasil penelitian menunjukkan bahwa faktor-faktor tersebut secara signifikan mempengaruhi keputusan negara untuk terlibat dalam organisasi internasional. Implikasi dari temuan ini memberikan wawasan mendalam tentang dinamika hubungan internasional dan strategi politik luar negeri negara-negara.

Abstract

This study analyzes the role of UN Women as a norm entrepreneur in addressing gender-based violence (GBV) in Indonesia during the COVID-19 pandemic. Using a qualitative approach and literature review, the research explores UN Women's efforts in promoting norms of gender equality, women's empowerment, and the eradication of GBV. The COVID-19 pandemic exacerbated GBV in Indonesia due to mobility restrictions, socio-economic pressures, and patriarchal culture. In response, UN Women launched initiatives such as the DELILA reporting system, online counseling services in collaboration with Yayasan Pulih, and educational campaigns. This study concludes that UN Women's efforts significantly contribute to social change and accelerate the achievement of Sustainable Development Goal (SDG) 5. However, challenges such as the digital divide and patriarchal norms require further efforts to ensure the sustainability of these programs.

Abstract

Saat ini, kehadiran teknologi pada era globalisasi nyatanya dapat memberikan sebuah ancaman baru terutama dalam keamanan siber sehingga perlu adanya sebuah strategi yang perlu dibentuk sebagai sebuah tindakan oleh aktor hubungan internasional dalam menyelesaikan permasalahan kompleks dalam keamanan siber. Oleh karena itu, artikel ini hadir untuk memahami bagaimana tata kelola global dapat memberikan manfaat besar dalam menyelesaikan permasalahan yang kompleks di tengah era globalisasi terutama dalam arus keamanan siber regional. Penelitian ini menggunakan metode penelitian kualitatif-deskriptif melalui pengumpulan data sekunder berupa dokumen resmi EU, laporan lembaga terkait, dan artikel website. Sebagai pisau analisis pada penelitian ini penulis menggunakan teori neoliberal institusionalisme dan konsep regionalisme. Melalui penelitian ini penulis menemukan bahwa tata kelola global memiliki peranan penting dalam menangani permasalahan kompleks di ruang siber terutama di kawasan regional melalui lanskap kerja sama institusional, seperti yang dilakukan Uni Eropa dengan Cybersecurity Act yang dirilis oleh ENISA.
